<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 366</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230209">February 9, 2023</action-date><action-desc><sponsor name-id="S390">Mr. Van Hollen</sponsor> (for himself and <cosponsor name-id="S409">Mr. Luján</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Administrator of General Services to ensure that the design of public buildings in the United States adheres to the guiding principles for Federal architecture, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H22B4190D21FE457E9EB2CB9609F0D492"><section section-type="section-one" id="H1558795C9B5841AF866AE086DCA60646"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Democracy in Design Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="H28562D4844D446ABA7EC01E181742CFE"><enum>2.</enum><header>Continuing investigation and survey of public buildings</header><subsection id="H460ED6039E0A44DABFEF48EF68CB4CD1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3303 of title 40, United States Code, is amended—</text><paragraph id="H2F1E80128A3A4126A0F616A9600CF69A"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), in the matter preceding paragraph (1), by inserting <quote>(referred to in this section as the <term>Administrator</term>)</quote> after <quote>Services</quote>; and</text></paragraph><paragraph id="H2DE0D57CF5CF4E0C9783F28A3B8E1628"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HCE429E3FE17F4ED58F93354DECD5B435"><subsection id="H6E96608BFC9D4F3DB264E804D306AAB8"><enum>(e)</enum><header>Guiding principles for Federal architecture</header><text display-inline="yes-display-inline">The Administrator shall ensure that the design of public buildings in the United States adheres to the principles described in the report published by the Ad Hoc Committee on Federal Office Space entitled <quote>Guiding Principles for Federal Architecture</quote> and dated June 1, 1962.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HC8F86BDDF5EB461E82C2114487338D0E"><enum>(b)</enum><header>Rulemaking</header><paragraph id="H0BAA0B9827D547B3B9D6E0A2B92FE206"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator of General Services shall promulgate such regulations as are necessary—</text><subparagraph id="H1CC4ECBCA56149D188EB22AD41CB5F4E"><enum>(A)</enum><text>to implement the amendment made by subsection (a)(2); and </text></subparagraph><subparagraph id="H1728906399C24CCC9EB3A51530A9308E"><enum>(B)</enum><text>to establish minimum standards by which the Administrator of General Services shall design public buildings in the United States.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1C2C4FDA05984E7B81701C417B340FE7"><enum>(2)</enum><header>Notice and comment</header><text display-inline="yes-display-inline">The regulations required under paragraph (1) shall be issued after notice and an opportunity for public comment in accordance with the procedure applicable to substantive rules under section 553 of title 5, United States Code.</text></paragraph></subsection></section></legis-body></bill>
