<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 3667</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240125">January 25, 2024</action-date><action-desc><sponsor name-id="S422">Mr. Welch</sponsor> (for himself, <cosponsor name-id="S341">Mr. Blumenthal</cosponsor>, <cosponsor name-id="S369">Mr. Markey</cosponsor>, <cosponsor name-id="S353">Mr. Schatz</cosponsor>, and <cosponsor name-id="S409">Mr. Luján</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Consumer Product Safety Act to strike provisions relating to the maximum civil penalties for violations of product safety standards.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Consumer Advocacy and Protection Act of 2024</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id3b835451935048fea13734919e7dd5a0"><enum>2.</enum><header>Amendments to the Consumer Product Safety Act</header><subsection id="idfe7fa3dee27d4631b69dae9172e68c96"><enum>(a)</enum><header>Civil penalty cap</header><text>Section 20(a)(1) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2069">15 U.S.C. 2069(a)(1)</external-xref>) is amended—</text><paragraph id="id1ea8d2253f14447b94529cf8ac2b2867"><enum>(1)</enum><text>in the first sentence, by striking <quote>$100,000</quote> and inserting <quote>$250,000</quote>;</text></paragraph><paragraph id="ide6f9d716bc1f474ea9aa1850233f255d"><enum>(2)</enum><text>in the second sentence—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbae8b5f05882498d903787f64cc964da"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>or (11)</quote> and inserting <quote>(11), (12), (15), or (16)</quote>; and</text></subparagraph><subparagraph id="id895edc480a264f4cb58ee282701a758b"><enum>(B)</enum><text>by striking <quote>, except that the maximum civil penalty shall not exceed $15,000,000 for any related series of violations</quote>; and</text></subparagraph></paragraph><paragraph id="idec4a465646594a549e00f619f16c147c"><enum>(3)</enum><text>in the third sentence by striking <quote>, except that the maximum civil penalty shall not exceed $15,000,000 for any related series of violations</quote>.</text></paragraph></subsection><subsection id="idf3018f5846ba472d98ed17e4f4e3e551"><enum>(b)</enum><header>Adjustment for inflation</header><text>Section 20(a)(3) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2069">15 U.S.C. 2069(a)(3)</external-xref>) is amended—</text><paragraph id="id2cd29abd10e945a0bd2f6f1dd7bc981f"><enum>(1)</enum><text>by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd6cf209774c040c09bad1d260e263470"><subsection id="id8e288a4829e14c2abf60afe9b44da4d5"><enum>(B)</enum><text>Not later than one year after the date of enactment of this subparagraph, and not later than January 15 of every year thereafter, the Commission shall—</text><paragraph id="id6dbe111a03934751b2b2491b633bddb6"><enum>(i)</enum><text>in accordance with subparagraph (C), determine the inflation adjusted maximum civil penalty for an individual violation; and</text></paragraph><paragraph id="idc7960a13b22d40bfb5144944b5dbbbf0"><enum>(ii)</enum><text>publish each such inflation adjusted maximum civil penalty for an individual violation in the Federal Register.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id226fb16e51144004b4b9d7ab37c0867d"><enum>(2)</enum><text>by striking subparagraph (C) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id253a330b5fd8464593bc6b98e7cfb646"><subsection id="id8f822632a04f4a02b4c0f0dfa26b27ac"><enum>(C)(i)</enum><text>The Commission shall adjust civil penalties in accordance with this subparagraph and shall make such adjustment notwithstanding section 553 of title 5, United States Code.</text></subsection><subsection id="id4d0ab82c69ad43c7821e16683d8ef11e"><enum>(ii)</enum><text>The inflation adjusted maximum civil penalty for the purposes of subparagraph (B) shall be determined by increasing the prior year maximum civil monetary penalty by the cost-of-living adjustment. Any increase determined under this subparagraph shall be rounded to the nearest multiple of $1.</text></subsection><subsection id="id720d309472964614a0b92c132128483f"><enum>(iii)</enum><text>For purposes of this subparagraph—</text><paragraph commented="no" display-inline="no-display-inline" id="idb2f1fb2120534901abe42c16ada6a6f2"><enum>(I)</enum><text display-inline="yes-display-inline">the term <term>cost-of-living adjustment</term> means the percentage (if any) by which—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide7cc5218ebe14a2fba8cd717813a87f0"><enum>(aa)</enum><text display-inline="yes-display-inline">the Consumer Price Index for the month of October preceding the date of the adjustment; exceeds</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idaacee801d1d045329c338533bfb77336"><enum>(bb)</enum><text display-inline="yes-display-inline">the Consumer Price Index for the month of October 1 one year before the month of October referred to in item (aa); and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd595d721db00418f9787778941e491ad"><enum>(II)</enum><text>the term <term>Consumer Price Index</term> means the Consumer Price Index for all-urban consumers published by the Department of Labor.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idd2da138a9c1444e7b622b09fc0411701"><enum>(iv)</enum><text>If the civil penalty subject to a cost-of-living adjustment is, during the 12 months preceding a required cost-of-living adjustment, increased by law by an amount greater than the amount of the adjustment required under subparagraph (B), the Commission is not required to make the cost-of-living adjustment otherwise required for that year.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idbd8e0986db7d4406b0071eff19d775a4"><enum>(3)</enum><text>by striking subparagraph (D).</text></paragraph></subsection><subsection id="id3e7d84130ef146808d01a4c4e9f65c8e"><enum>(c)</enum><header>Technical amendment</header><text>Section 20(c) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2069">15 U.S.C. 2069(c)</external-xref>) is amended, in the second sentence, by striking <quote>including, the</quote> and inserting <quote>including the</quote>.</text></subsection><subsection id="id4846c4daa3c34691969f7f0663b9e22a"><enum>(d)</enum><header>Technical amendment</header><text>Section 20(d) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2069">15 U.S.C. 2069(d)</external-xref>) is amended, in the first sentence, by striking <quote>man</quote> and inserting <quote>person</quote>.</text></subsection></section></legis-body></bill>
