and</text></paragraph><paragraph id="id1f4558a0fc4b4124b9c0ae4918590bfd"><enum>(2)</enum><text>by inserting after subparagraph (B) the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id1bdfc3c74ca44045a6cace6d446eea45" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><subparagraph id="id9c65a933d20941acb24a7e8ae94039cb"><enum>(C)</enum><header>Royalties received by Government employees</header><text>Notwithstanding section 12(c) of the Stevenson-Wydler Technology Innovation Act of 1980 (15 U.S.C. 3710a (c)) and section 209 of title 35, if the reporting individual is an officer or employee in the executive branch (including a special Government employee, as defined in section 202 of title 18), the source and amount or value of any royalties received by the reporting individual, the spouse of the reporting individual, or a dependent child of the reporting individual during the reporting period described in subsection (d) or (e) of section 13103, as applicable, that were received as a result of an invention developed by the reporting individual in the course of employment of the reporting individual with the United States Government, including any royalty interest payment made under the Federal Technology Transfer Act of 1986 (<external-xref legal-doc="public-law" parsable-cite="pl/99/502">Public Law 99–502</external-xref>; 100 Stat. 1785), an amendment made by such Act, or any other applicable authority.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idec11473a79404c7a91e671fc380667b2"><enum>(b)</enum><header>Review of reports</header><text>Section 13107(b) of title 5, United States Code, is amended—</text><paragraph id="ideb63f7d3e11e4b27b8962eedaea68251"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="id812ae72b64ce458985a5db63a66aef7c"><enum>(A)</enum><text>in the first sentence, by inserting <quote>and shall, notwithstanding section 12 of the Stevenson-Wydler Technology Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3710a">15 U.S.C. 3710a</external-xref>) and section 209 of title 35, publish such report on the internet website of the agency, office, Clerk, or Secretary of the Senate, as the case may be</quote> after <quote>to any person requesting such inspection or copy</quote>; and</text></subparagraph><subparagraph id="ide667ef148a3b4c7bb1e7fbfce9bccc9b"><enum>(B)</enum><text>in the second sentence—</text><clause id="id1c733f50682f4c72a8efc38c293ef576"><enum>(i)</enum><text>by inserting <quote>, notwithstanding section 12 of the Stevenson-Wydler Technology Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3710a">15 U.S.C. 3710a</external-xref>) and section 209 of title 35,</quote> after <quote>such report shall</quote>; and</text></clause><clause id="idf40cef168dfa457cba98229e0547e6b9"><enum>(ii)</enum><text>by inserting <quote>and published on the internet website of the agency, office, Clerk, or Secretary of the Senate, as the case may be,</quote> after <quote>made available for public inspection</quote>; </text></clause></subparagraph></paragraph><paragraph id="idd85b5d6c8cde46eeb704578a7961e023"><enum>(2)</enum><text>by striking paragraph (2) and the matter following paragraph (2); </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0dd8236e03b946fb8ab7dbb954c7f743"><enum>(3)</enum><text>by redesignating paragraph (3) as paragraph (2); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfa2bb70b74e0448db25b43599753d61e"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idAA069EFFF144454D90E2B68F3992362A" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><paragraph commented="no" display-inline="no-display-inline" id="idc84c2d7b0a2a4222b6a66b040efca7b8"><enum>(3)</enum><header>Procedure for releasing reports to Members of Congress</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, not later than 30 days after receiving a request from a Member of Congress, any agency or supervising ethics office in the executive branch shall furnish to the Member of Congress an unredacted copy of any report received under this subchapter.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id5d7042c34846443a83823b92c1cb4640"><enum>(c)</enum><header>Confidential reports and other additional requirements</header><text>Section 13109(a)(2) of title 5, United States Code, is amended—</text><paragraph id="idbcf36af8cbc846359f95f765e26b890d"><enum>(1)</enum><text>by striking <quote>Any information</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0b9cc745121849b8a0a3faf477f5eeb1" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><subparagraph id="idcd1da9ac52e44d3eb8920ab216a165e5"><enum>(A)</enum><header>In general</header><text>Any information</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id840ed81b7f4c4455bc666eb66ec2fef3"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id58909c35c0644ff4b44ed117dbe7c4dd" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><subparagraph id="ide0ccc12c088347dcab26b4cb1957892e"><enum>(B)</enum><header>Special government employees</header><clause id="idf600f48b7cf846f598fd05a7af562eb3"><enum>(i)</enum><header>Definition</header><text>For the purposes of this subparagraph, the term <term>sensitive personal information</term> does not include the source or amount or value of any royalties received by a reporting individual.</text></clause><clause id="id2b43be74c2d04676b341fa317dd8d3c7"><enum>(ii)</enum><header>Redaction and publication</header><text>Upon receipt of a confidential financial disclosure report under this section of submitted by a special Government employee, as defined in section 202 of title 18, the recipient supervising ethics office shall—</text><subclause id="id5b37b1b6e9e6482f99c3ffce92439cbe"><enum>(I)</enum><text>redact any sensitive personal information from the confidential financial disclosure report; and</text></subclause><subclause id="id066e6826a5464f029f55c42ad689ade2"><enum>(II)</enum><text>notwithstanding section 12 of the Stevenson-Wydler Technology Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3710a">15 U.S.C. 3710a(c)</external-xref>) and section 209 of title 35, publish the redacted confidential financial disclosure report on the internet website of the agency by which the special Government employee is employed not later than 120 days after the date on which the recipient supervising ethics office receives the confidential financial disclosure report.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id7af0c30401f74315acf46a39946344db" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>3.</enum><header>General disclosure of royalties</header><subsection id="ida9a2a5c4e0244f09b8b146497c22a3c0"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="ide37fbbac267741e483897100837c3fbe"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term> means an agency within the executive branch, as defined in section 13101 of title 5, United States Code.</text></paragraph><paragraph id="idc535ff645c3448949507c0e7bf4fca31"><enum>(2)</enum><header>Applicable person</header><text>The term <term>applicable person</term> means any individual or entity that applies to—</text><subparagraph id="idf62e449d430844a8914a2d8fe09fc724"><enum>(A)</enum><text>receive a grant from the Federal Government; or</text></subparagraph><subparagraph id="id4a6a6c0de85c4a5a8e85834d51db7298"><enum>(B)</enum><text>serve as a contractor.</text></subparagraph></paragraph><paragraph id="idc3d1a3d4c669467098ca598f94af45a1"><enum>(3)</enum><header>Contractor</header><text>The term <term>contractor</term> has the meaning given the term in section 7101 of title 41, United States Code.</text></paragraph><paragraph id="id25e51c3a1fd34c6591220ca4a22c95fd"><enum>(4)</enum><header>Covered royalty</header><text>The term <term>covered royalty</term> means any royalty received by an applicable person from any party other than the Federal Government.</text></paragraph></subsection><subsection id="iddb40a273a38945f088493aa0f7fc116a"><enum>(b)</enum><header>Agency requirement</header><text>Before receiving any Federal grant or contract, each applicable person shall submit to the agency from which the applicable person seeks the grant or for which the applicable person seeks to serve as a contractor, as applicable, a report disclosing the source and amount or value of all covered royalties received by the applicable person during the 10-year period preceding the date on which the applicable person receives such Federal grant or contract.</text></subsection><subsection id="id64B29F66F54D4496BD9E79A94F9B400F" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Procedure for releasing reports to Members of Congress</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, not later than 30 days after receiving a request from a Member of Congress, an agency shall furnish to the Member of Congress an unredacted copy of any report submitted under subsection (b). </text></subsection></section><section id="idd9a342c1b3194e13a383555a953013ea" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>4.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, an amendment made by this Act, or the application of such provision or amendment to any person or circumstance is held to be unconstitutional, the remainder of this Act and the amendments made by this Act, and the application of the provision or the amendment to any other person or circumstance, shall not be affected.</text></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="id8914f64d-57c8-4077-8632-6d966c6ebd6d" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Royalty Transparency Act</short-title></quote>. </text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idb61aa1c6-a11e-48b8-b124-da1aa0798be5" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>2.</enum><header>Financial disclosure reports of executive branch employees</header><subsection id="id09a43381d02c47edbbc284c267063113"><enum>(a)</enum><header>Individuals required to file</header><paragraph commented="no" display-inline="no-display-inline" id="id0440927703ad433ab9cb8d0fc9bd7caa"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 13103 of title 5, United States Code, is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5d59cc8ab28045c2a251653fbd857edd"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (f)—</text><clause commented="no" display-inline="no-display-inline" id="id252e949ea441418ca8442e72ea500afa"><enum>(i)</enum><text display-inline="yes-display-inline">in paragraph (11), by striking <quote>; and</quote> and inserting a semicolon; </text></clause><clause commented="no" display-inline="no-display-inline" id="id4faa1f23a643435b9387fbcc75f8f976"><enum>(ii)</enum><text>in paragraph (12), by striking the period and inserting <quote>; and</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idd557f00b2bd9471aa9ca59d738e89a7b"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7B117C71E23944A48FA74C79490F8531" changed="added" reported-display-style="italic" committee-id="SSGA00"><paragraph id="id162d2b787cd8467abbe3cd93907f2c21"><enum>(13)</enum><text>any member of—</text><subparagraph commented="no" display-inline="no-display-inline" id="id82a3cd51486d4b739760e3a3d8f10c90"><enum>(A)</enum><text display-inline="yes-display-inline">the National Science Advisory Board for Biosecurity; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide27e0cae69804a4fa1b804a4bfd11e33"><enum>(B)</enum><text display-inline="yes-display-inline">the Advisory Committee on Immunization Practices; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida52581c84e5c49c98ca75fb6a0c708d7"><enum>(C)</enum><text display-inline="yes-display-inline">the Advisory Commission on Childhood Vaccines; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id753ed332f3284d058225d268474cd4af"><enum>(D)</enum><text display-inline="yes-display-inline">the National Vaccine Advisory Committee; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf82233e0ad3f405386c34c8151347c44"><enum>(E)</enum><text display-inline="yes-display-inline">the Vaccines and Related Biological Products Advisory Committee; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id97f0fbb3939d46508faa0a8700c685a7"><enum>(F)</enum><text display-inline="yes-display-inline">the Defense Science Board; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idad669acf08434f65b280ce4aab5c12ea"><enum>(G)</enum><text display-inline="yes-display-inline">the Board of Scientific Advisors of the National Cancer Institute;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id121de0b674164c6a82245603288c27d0"><enum>(H)</enum><text display-inline="yes-display-inline">the Homeland Security Science and Technology Advisory Committee;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8fa4a860c33c47cd97aca4011975128f"><enum>(I)</enum><text display-inline="yes-display-inline">the Medical Review Board Advisory Committee;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id14290bca9b7442d89aa97b6043a5c72a"><enum>(J)</enum><text display-inline="yes-display-inline">the President’s Council of Advisors on Science and Technology; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id58373a982d644d4394e84919b565f1cd"><enum>(K)</enum><text display-inline="yes-display-inline">any other advisory committee, as defined in section 1001, including a successor to a committee described in this paragraph, that the Government Accountability Office determines, in accordance with subsection (j)—</text><clause commented="no" display-inline="no-display-inline" id="id9a49043225564e8ea618c8d8d06d4b94"><enum>(i)</enum><text display-inline="yes-display-inline">makes recommendations relating to public health to an agency or the President; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id7fb873f9ccfd4ed8acd029b3e7a7f6fe"><enum>(ii)</enum><text display-inline="yes-display-inline">has had any recommendation fully or partially implemented during the 10 years preceding the determination.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfdf4a5968dbb4a2eb2fbaa248e894c67"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id6D90497A61E541109645DAFB657DBD2E" changed="added" reported-display-style="italic" committee-id="SSGA00"><subsection commented="no" display-inline="no-display-inline" id="id39fd34cb4b8b4922a685d5978814d0b8"><enum>(j)</enum><header>Determination regarding advisory committees</header><text>Not later than 180 days after the date of enactment of the <short-title>Royalty Transparency Act</short-title>, and annually thereafter, the Government Accountability Office shall publish a list of each advisory committee that the Government Accountability Office determines—</text><paragraph commented="no" display-inline="no-display-inline" id="idc0a78d840673479d877e8a074c80e58e"><enum>(1)</enum><text display-inline="yes-display-inline">makes recommendations relating to public health to an agency or the President; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id76a442a089cc49fdbc3144d536cf7784"><enum>(2)</enum><text display-inline="yes-display-inline">has had any recommendation fully or partially implemented during the 10 years preceding the determination.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id959264f3ec414548b9dd6d34ce6a5bd1"><enum>(2)</enum><header>Sunset</header><text>Effective on the date that is 5 years after the date of enactment of this Act, section 13103 of title 5, United States Code, as amended by this Act, is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5480dddb22ca46b4a62dd9c0a2b6c795"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (f)(13), by striking subparagraph (K) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD6EA9D5A11B94670A0E3F656D09FC9C0" changed="added" reported-display-style="italic" committee-id="SSGA00"><subparagraph commented="no" display-inline="no-display-inline" id="ide576d559617e46e79cbcb2bbd638b256"><enum>(K)</enum><text display-inline="yes-display-inline">a successor to a committee described in subparagraphs (A) through (J) of this paragraph.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4cedd724e4f2487899558bef09339ff5"><enum>(B)</enum><text>by striking subsection (j).</text></subparagraph></paragraph></subsection><subsection id="id65e1aa61821a42efb3abe455220e828b"><enum>(b)</enum><header>Notification of waiver</header><paragraph commented="no" display-inline="no-display-inline" id="id83f4e9126ff944b59a3250bd137f8090"><enum>(1)</enum><header>Title 5</header><text display-inline="yes-display-inline">Section 13103(i) of title 5, United States Code, is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id8ac4764aadef4df0a88f72b7a90ce39c"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) through (4) as subparagraphs (A) through (D), respectively, and adjusting the margins accordingly;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id93eee1abc7a242e1b8b3d610a7860b1a"><enum>(B)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A), as so redesignated, by striking <quote>the supervising ethics office determines</quote> and inserting “the supervising ethics office—</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEBD9D1AFDBC54C2E83464FA91D662E41" changed="added" reported-display-style="italic" committee-id="SSGA00"><paragraph commented="no" display-inline="no-display-inline" id="idcf48d8a15dcf45198ae8d83bcf2daf2e"><enum>(1)</enum><text display-inline="yes-display-inline">determines</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfeabbc3831584303be914aa85bdbe118"><enum>(C)</enum><text>in subparagraph (D), as so redesignated, by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide98625297ebb40b58f0e36c8a3863ed5"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDAC844350C0C4A41980B6E50FB9CEEFA" changed="added" reported-display-style="italic" committee-id="SSGA00"><paragraph commented="no" display-inline="no-display-inline" id="idfd9fa18c3b0a413a8dc56940b7239c4b"><enum>(2)</enum><text display-inline="yes-display-inline">provides notification of such waiver to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Oversight and Accountability of the House of Representatives</committee-name>.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id58c67b8d4f1b4123a9e7da338e46ad03"><enum>(2)</enum><header>Title 18</header><text>Section 208 of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id5B89205E37384E168D8CF4461F0B6016" changed="added" reported-display-style="italic" committee-id="SSGA00"><subsection commented="no" display-inline="no-display-inline" id="id879557a41b734ae28929b06335a20d7e"><enum>(e)</enum><text>Any exemption—</text><paragraph commented="no" display-inline="no-display-inline" id="idb9b83885464043fdabcefe6c14a8da2d"><enum>(1)</enum><text display-inline="yes-display-inline">granted under paragraph (1) or (3) of subsection (b) shall be immediately reported to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Oversight and Accountability of the House of Representatives</committee-name>, including a detailed justification for granting the waiver; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id53f19d665966423aa4ae81a682842b79"><enum>(2)</enum><text display-inline="yes-display-inline">granted under subpart (C) of part 2640 of title 5 of the Code of Federal Regulations, or any successor regulation, shall be immediately reported to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Oversight and Accountability of the House of Representatives</committee-name>, including a detailed justification for granting the waiver.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id0f1dcdfe-0d27-4bce-8fd9-5436bdf93b3d"><enum>(c)</enum><header>Contents of reports</header><text>Section 13104(a)(1) of title 5, United States Code, is amended—</text><paragraph id="id8505352c-ed28-4c64-b18a-37822f073de3"><enum>(1)</enum><text>in subparagraph (A), by inserting <quote>, subject to subparagraph (C)</quote> after <quote>employment by the United States Government</quote>; and</text></paragraph><paragraph id="id0f7971b4-fb6c-4ed7-9374-1455a2ff6379"><enum>(2)</enum><text>by inserting after subparagraph (B) the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id5218044c-d0be-4100-9249-47f84df091ec" changed="added" reported-display-style="italic" committee-id="SSGA00"><subparagraph id="idf5e2aebe-d60d-4c0d-a897-effa6052443f"><enum>(C)</enum><header>Royalties received by Government employees and committee filers</header><text>Notwithstanding section 12(c) of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3710a">15 U.S.C. 3710a(c)</external-xref>) and section 209 of title 35, if the reporting individual is an officer or employee in the executive branch (including a special Government employee, as defined in section 202 of title 18), or an individual described in section 13103(f)(13), the original source and amount or value of any royalties received by the reporting individual, the spouse of the reporting individual, or a dependent child of the reporting individual during the reporting period described in subsection (d) or (e) of section 13103, as applicable, that were received as a result of an invention developed by the reporting individual in the course of employment of the reporting individual with the United States Government, including any royalty interest payment made under the Federal Technology Transfer Act of 1986 (<external-xref legal-doc="public-law" parsable-cite="pl/99/502">Public Law 99–502</external-xref>; 100 Stat. 1785), an amendment made by such Act, or any other applicable authority.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id85d8a246-54eb-48dd-8fc0-0d6af7a61e27"><enum>(d)</enum><header>Review of reports</header><text>Section 13107(b) of title 5, United States Code, is amended—</text><paragraph id="id76ae1646-e906-4ae2-9234-6498e57096e2"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="id2c0f2d71-e1c8-42d0-9e27-f1b623f597d2"><enum>(A)</enum><text>in the first sentence, by inserting <quote>and shall, in the case of an agency or office and notwithstanding section 12 of the Stevenson-Wydler Technology Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3710a">15 U.S.C. 3710a</external-xref>) and section 209 of title 35, publish such report on the internet website of the agency or office, as the case may be</quote> after <quote>to any person requesting such inspection or copy</quote>; and</text></subparagraph><subparagraph id="id77c5ba45-4363-4113-8b8c-9d9bd444d202"><enum>(B)</enum><text>in the second sentence—</text><clause id="id4e475f23-7926-4975-a596-95bb36fe8805"><enum>(i)</enum><text>by inserting <quote>, notwithstanding section 12 of the Stevenson-Wydler Technology Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3710a">15 U.S.C. 3710a</external-xref>) and section 209 of title 35,</quote> after <quote>such report shall</quote>; and</text></clause><clause id="id4f3aa96e-bebd-40d7-b38a-3c6bc7b218c3"><enum>(ii)</enum><text>by inserting <quote>and, in the case of an agency or office, published on the internet website of the agency or office, as the case may be,</quote> after <quote>made available for public inspection</quote>; </text></clause></subparagraph></paragraph><paragraph id="idf0abaed5-d0f4-4482-a4a3-5e5f9827fe08"><enum>(2)</enum><text>by striking paragraph (2) and the matter following paragraph (2); </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9b250db2-011d-4003-8baa-dd665ebf73b1"><enum>(3)</enum><text>by redesignating paragraph (3) as paragraph (2); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4552008c-2ea3-44fb-8335-7a689d1f5b0a"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idd1ab8c46-4d52-4530-a54d-078325863534" changed="added" reported-display-style="italic" committee-id="SSGA00"><paragraph commented="no" display-inline="no-display-inline" id="idbfce6fb3-ea88-4939-b8cd-8117b79554df"><enum>(3)</enum><header>Procedure for releasing reports to Members of Congress</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, not later than 30 days after receiving a request from a Member of Congress, any agency or supervising ethics office in the executive branch shall furnish to the Member of Congress a copy of any report submitted under subsection (b), which shall be unredacted, except with respect to social security numbers.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id48431b95783c43b3a13e0eff5d97d393"><enum>(e)</enum><header>Confidential reports and other additional requirements</header><text>Section 13109 of title 5, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idbfff09444d094f2ab198d965b5ae7cf0"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (b) and (c) as subsections (f) and (g), respectively; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5e5f2a0684094662945abfdfc878d71b"><enum>(2)</enum><text>by inserting after subsection (a) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4b9d0b90ff68431597d99aed34c47ef1" changed="added" reported-display-style="italic" committee-id="SSGA00"><subsection id="iddec154234f5f41ad89817e7614020dfe"><enum>(b)</enum><header>Royalties received by confidential filers</header><text>Notwithstanding section 12(c) of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3710a">15 U.S.C. 3710a(c)</external-xref>) and section 209 of title 35, the information required to be reported under this section shall include the original source and amount or value of any royalties received by the reporting individual, or the spouse or any dependent child of the reporting individual, that were received as a result of an invention, including any royalty interest payment made under the Federal Technology Transfer Act of 1986 (<external-xref legal-doc="public-law" parsable-cite="pl/99/502">Public Law 99–502</external-xref>; 100 Stat. 1785), an amendment made by such Act, or any other applicable authority.</text></subsection><subsection id="id381a26a219e846ebb4ae0eb936fc2667"><enum>(c)</enum><header>Procedure for releasing reports to members of congress</header><text>Notwithstanding any other provision of law, not later than 30 days after receiving a request from a Member of Congress, any agency or supervising ethics office in the executive branch shall furnish to the Member of Congress a copy of any report submitted under subsection (a), which shall be unredacted, except with respect to social security numbers, home addresses, phone numbers, email addresses, and the personally identifiable information of dependents.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id4c5625d8687e46bab6f4f7e529c464a6"><enum>(d)</enum><header>Reports</header><text>Not later than 60 days after the date of enactment of the <short-title>Royalty Transparency Act</short-title>, and each year thereafter, the head of each agency shall submit to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Oversight and Accountability of the House of Representatives</committee-name> a report relating to confidential financial disclosures of officers and employees under the jurisdiction of such agency for the preceding fiscal year, which shall include—</text><paragraph id="id74848e18c8ea4ce58232b5a847c4813c"><enum>(1)</enum><text>the number of individuals who filed such disclosures with the agency under this section, including, if applicable, the subcomponent of the agency that has jurisdiction over the individual and the reason for filing confidentially;</text></paragraph><paragraph id="id9198afaf07e044e5a2e7c260b2cb5186"><enum>(2)</enum><text>the number of special Government employees, as defined in section 202 of title 18, that are required to file confidential financial disclosure reports with the agency under this section; and</text></paragraph><paragraph id="id53d6ef8fc35a4c259a0a350e31bbc4eb"><enum>(3)</enum><text>any additional information determined to be relevant by the Director of the Office of Government Ethics after consultation with the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Oversight and Accountability of the House of Representatives</committee-name>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida159628ff9f84aa3b09a139403d6b734"><enum>(e)</enum><header>Public Disclosure of Royalties Received by Certain Federal Employees</header><paragraph id="id2585b0706f5f48fc8f45f52bcf65f903"><enum>(1)</enum><header>Definition</header><text>For the purposes of this subsection, the term <term>covered individual</term> means an individual who—</text><subparagraph id="idc3c95dd67f184d5096b9c9f6f5168f13"><enum>(A)</enum><text>is required to file a confidential financial disclosure report under this section; and</text></subparagraph><subparagraph id="id0894f018aa5849958b666812a7c460f8"><enum>(B)</enum><text>reports receiving a royalty interest under subsection (b).</text></subparagraph></paragraph><paragraph id="idef6179591e4441e6a32a54550b5d7089"><enum>(2)</enum><header>Requirement</header><text>Not later than 180 days after the date of enactment of the <short-title>Royalty Transparency Act</short-title>, and annually thereafter, each agency shall publish a report on the internet website of the agency, listing—</text><subparagraph commented="no" display-inline="no-display-inline" id="idad04c7c2e41241bdba6f268178df346a"><enum>(A)</enum><text display-inline="yes-display-inline">the names of all covered individuals; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida5bf8abec12341deb6cc53166a56ca64"><enum>(B)</enum><text display-inline="yes-display-inline">the original source and amount or value of any royalties reported under this section by each covered individual.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="idd70e604b976d4412aab98f051817cff8" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>3.</enum><header>Preventing organizational conflicts of interest in Federal acquisition</header><subsection id="id8b955ea8b66b4ed8b885661eeeeca85e"><enum>(a)</enum><header>In General</header><text>The Federal Acquisition Regulatory Council and the Office of Management and Budget shall, as appropriate, enact or update any regulation necessary to ensure that conflict of interest reviews for prospective contractors or grantees include reviews of royalties paid to prospective contractors or grantees in the preceding calendar year.</text></subsection><subsection id="id1226f9d865c34c6f8e9f787c51545f22"><enum>(b)</enum><header>Ongoing reviews</header><text>Not later than 1 year after the date of enactment of this Act, and each year thereafter, each agency conducting any conflict of interest review described in subsection (a) shall report to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Oversight and Accountability of the House of Representatives</committee-name> on the number of identified cases of potential conflict of interest related to royalty payments and the steps taken to mitigate those cases.</text></subsection></section><section id="idc1b41806-e547-4abb-919c-2d2eae8b6ddd" commented="no" display-inline="no-display-inline" section-type="subsequent-section" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>4.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, an amendment made by this Act, or the application of such provision or amendment to any person or circumstance is held to be unconstitutional, the remainder of this Act and the amendments made by this Act, and the application of the provision or the amendment to any other person or circumstance, shall not be affected.</text></section></legis-body><endorsement><action-date date="20240909">September 9, 2024</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
