which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To apply user fees with respect to tobacco products deemed subject to the requirements of chapter IX of the Federal Food, Drug, and Cosmetic Act.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Resources To Prevent Youth Vaping Act</short-title></quote>.</text></section><section id="id866D0A53957F467B82DDCEAA7919871A"><enum>2.</enum><header>User fees</header><subsection id="id8f75a979309b4557a4c799aee6f9d4ae"><enum>(a)</enum><header>Increase in total amount</header><text>Section 919(b)(1) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/387s">21 U.S.C. 387s(b)(1)</external-xref>) is amended by striking subparagraph (K) and inserting the following subparagraphs:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide937769a18bb4c54974419b19440688b"><subparagraph id="idb0e9cd0bb7394eb6aab0c5297ace1480"><enum>(K)</enum><text>For each of fiscal years 2019 through 2024, $712,000,000.</text></subparagraph><subparagraph id="idde7fe83b969a4597b0121dd5da3a09b0"><enum>(L)</enum><text>For fiscal year 2025, $812,000,000.</text></subparagraph><subparagraph id="idaa64d3a696f6415bbffe2b1e20e094fe"><enum>(M)</enum><text>For fiscal year 2026 and each subsequent fiscal year, the amount that was applicable for the previous fiscal year, adjusted by the total percentage change that occurred in the Consumer Price Index for all urban consumers (all items; United States city average) for the 12-month period ending June 30 preceding the fiscal year.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="ide17f9fa2af3b462fb1cba49b29f2fa99"><enum>(b)</enum><header>Application of user fees to all classes of tobacco products</header><paragraph id="id649a586dbf8844d99740efa9c03e7db1"><enum>(1)</enum><header>In general</header><text>Subparagraph (A) of section 919(b)(2) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/387s">21 U.S.C. 387s(b)(2)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4a4030a88b24410b82ff87d74884fc5b"><subparagraph id="ide6f860826b924531930c2dacd90676b4"><enum>(A)</enum><header>In general</header><clause id="id15ed8cfbb71c4e1d8ada31b8e4d4d434"><enum>(i)</enum><header>Fiscal years 2025 and 2026</header><text>For fiscal years 2025 and 2026, user fees shall be assessed and collected under subsection (a) only with respect to the classes of tobacco products listed in subparagraph (B)(i), and the total such user fees with respect to each such class shall be an amount that is equal to the applicable percentage of each such class for the fiscal year multiplied by the amount specified in paragraph (1) for the fiscal year.</text></clause><clause id="id5d1ac6ad82fa49829dd5827fd492be89"><enum>(ii)</enum><header>Subsequent fiscal years</header><text>For fiscal year 2027 and each subsequent fiscal year, user fees shall be assessed and collected under subsection (a) with respect to each class of tobacco products to which this chapter applies (including tobacco products that the Secretary by regulation deems to be subject to this chapter), and the total user fees with respect to each such class shall be—</text><subclause id="id849a464c794147f6acf6b0e6d0f65734"><enum>(I)</enum><text>with respect to each class of tobacco products listed in subparagraph (B)(i), an amount that is calculated in the same way as the amounts calculated for fiscal years 2025 and 2026 under clause (i), except that for purposes of fiscal years 2027 and subsequent fiscal years, instead of multiplying the applicable percentage of each such class by <quote>the amount specified in paragraph (1) for the fiscal year</quote>, the applicable percentage shall be multiplied by—</text><item id="idca46b58a53b0465a9b05a27980aff2ae"><enum>(aa)</enum><text>the amount specified in paragraph (1) for the fiscal year, reduced by</text></item><item id="id981c12ceabea456e89f267ffc40bb4c0"><enum>(bb)</enum><text>the total user fees assessed and collected pursuant to subparagraph (C) for the fiscal year; and</text></item></subclause><subclause id="id0d0bc8384f8043a48cc08cbda32efbf3"><enum>(II)</enum><text>with respect to each class of tobacco products to which this chapter applies but which is not listed in subparagraph (B)(i), an amount determined pursuant to a formula under subparagraph (C).</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id708128f6f4ee460fb8f9113ae4139cd0"><enum>(2)</enum><header>Other tobacco products</header><text>Section 919(b)(2) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/387s">21 U.S.C. 387s(b)(2)</external-xref>), as amended by paragraph (1), is further amended by adding at the end the following new subparagraphs:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0ed55cc75a174a03b65b8100f049e98b"><subparagraph id="id3dcbec62252c44309ef05603c152b3f3"><enum>(C)</enum><header>Allocation for other tobacco products</header><clause id="idfb779c374193485d98555a9bbd996fc2"><enum>(i)</enum><header>In general</header><text>Beginning with fiscal year 2027, the total user fees assessed and collected under subsection (a) each fiscal year with respect to each class of tobacco products not listed in subparagraph (B)(i) shall be an amount that is determined pursuant to a formula developed by the Secretary by regulation using information required to be submitted under subparagraph (D).</text></clause><clause id="id15effe9fbcbc4bf0bac04f910a9f4be2"><enum>(ii)</enum><header>Allocation for other tobacco products</header><text>For each class of tobacco products not listed in subparagraph (B)(i), the percentage of fees under the formula under clause (i) for the respective fiscal year shall be equal to the percentage of the gross domestic sales in the previous calendar year that is attributable to such class of tobacco products in such calendar year, as determined by the Secretary.</text></clause><clause id="id1cb04341eb3b45b69489c5faa3477e59"><enum>(iii)</enum><header>Allocation of assessment within each class of other tobacco products</header><text>The percentage of the total user fees to be paid by each manufacturer or importer of tobacco products in a class not listed in subparagraph (B)(i) shall be determined by the Secretary, based on the percentage of the gross domestics sales of all such classes of tobacco products by all manufacturers and importers in the previous calendar year that is attributable to such manufacturer or importer.</text></clause><clause id="id6b1927768f9a4b8f93fec5b5a94e56d4"><enum>(iv)</enum><header>Effect of failure to finalize formula on time</header><text>If the Secretary for any reason fails to finalize by fiscal year 2027 the formula required by this subparagraph for the assessment and collection of user fees for classes of tobacco products not listed in subparagraph (B)(i)—</text><subclause id="id348fb4b79102466390865e9e87afcc49"><enum>(I)</enum><text>the Secretary shall continue to assess and collect fees under subsection (a) with respect to each class of tobacco products listed in subparagraph (B)(i); and</text></subclause><subclause id="id685a7921e8d344f3ba839421ddf50aa0"><enum>(II)</enum><text>until the first fiscal year commencing after the finalization of such formula, the exception described in subparagraph (A)(ii)(I) shall not apply.</text></subclause></clause><clause id="idc3fed2055e064b43bc2b40c85a3ca9be"><enum>(v)</enum><header>Revisions by regulation</header><text>Any revisions to the formula promulgated pursuant to this subparagraph shall be by regulation.</text></clause><clause id="idcd9b599aecf74de1998ec01ba1020549"><enum>(vi)</enum><header>Definition</header><text>In this subparagraph, the term <term>gross domestic sales</term> means the total value in dollars of the sale or distribution by manufacturers and importers of tobacco products in the United States in classes not listed in subparagraph (B)(i), as determined based on the aggregation of sales data from every manufacturer and importer of tobacco products that submits sales data to the Secretary.</text></clause></subparagraph><subparagraph id="id3a73547be21a497e9c7ed19753aff0de"><enum>(D)</enum><header>Information required to be submitted</header><text>Each manufacturer or importer of any tobacco product shall submit to the Secretary the information required under this subparagraph by March 1, 2026, for calendar year 2025, by April 1, 2026, for the period of January 1, 2026, through March 30, 2026, and monthly thereafter. Such information shall include—</text><clause id="id35b0633c2dae44f2803f39f0bb68714d"><enum>(i)</enum><text>the identification of the manufacturer or importer;</text></clause><clause id="idd42b3839bbde41798a6209ce5e8f64ef"><enum>(ii)</enum><text>the class or classes of tobacco products sold by the manufacturer or importer;</text></clause><clause id="id549d3e17eb8046a382fd4a29fd7ca921"><enum>(iii)</enum><text>the full listing of the finished tobacco products in a class not listed in subparagraph (B)(i) sold or distributed by the manufacturer or importer in the United States; and</text></clause><clause id="id67dc81ea0a074d33afabd9ba71f8300d"><enum>(iv)</enum><text>the gross domestic sales data for each class of finished tobacco products sold or distributed by the manufacturer or importer in the United States.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id558e11b599344081bad45f242a08e56d"><enum>(3)</enum><header>Prohibited act</header><text>Section 301(q)(1)(B) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/331">21 U.S.C. 331(q)(1)(B)</external-xref>) is amended by inserting <quote>919(b)(2)(D),</quote> before <quote>or 920</quote>.</text></paragraph></subsection><subsection id="ide1d88018959248ca917b2aaa1462fddc"><enum>(c)</enum><header>Allocation of assessment within each class of tobacco product</header><text>Section 919(b)(4) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/387s">21 U.S.C. 387s(b)(4)</external-xref>) is amended by striking <quote>shall be the percentage determined for purposes of allocations under subsections (e) through (h) of section 625 of <external-xref legal-doc="public-law" parsable-cite="pl/108/357">Public Law 108–357</external-xref></quote> and inserting <quote>shall be the percentage determined by the Secretary</quote>.</text></subsection><subsection id="id5540e4708d19499eb5a7f748cb601f12"><enum>(d)</enum><header>Conforming amendments</header><text>Section 919(b) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/387s">21 U.S.C. 387s(b)</external-xref>) is amended—</text><paragraph id="idb84b6b3f3163404fbfa90e067b8ddc56"><enum>(1)</enum><text>by striking paragraph (5);</text></paragraph><paragraph id="idf0c973e01db64434a217d981cdcf3ff2"><enum>(2)</enum><text>by redesignating paragraphs (6) and (7) as paragraphs (5) and (6), respectively; and</text></paragraph><paragraph id="id3fd72a5b95564b238953c60b0a3a6c1f"><enum>(3)</enum><text>by amending paragraph (6), as redesignated, to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8fe02cedb1a043a5b983704913369e97"><paragraph id="id2ffb85ddde98439ca1b908f4de47bb26"><enum>(6)</enum><header>Memorandum of understanding</header><text>The Secretary shall request the appropriate Federal agency to enter into a memorandum of understanding that provides for the regular and timely transfer from the head of such agency to the Secretary of all necessary information regarding all tobacco product manufacturers and importers required to pay user fees. The Secretary shall maintain all disclosure restrictions established by the head of such agency regarding the information provided under the memorandum of understanding.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id5937991e8c3f4f8d91af5bcc6b1382d7"><enum>(e)</enum><header>Applicability</header><text>The amendments made by subsections (b), (c), and (d) apply beginning with fiscal year 2027. Except for the amendment made by subsection (a), section 919 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/387s">21 U.S.C. 387s</external-xref>), as in effect on the day before the date of enactment of this Act, shall apply with respect to fiscal years preceding fiscal year 2027.</text></subsection></section><section id="id87d04472bc334d6c9a6ef2727fcdc7a2"><enum>3.</enum><header>Annual report</header><subsection id="idF14CADD7E40E47719CD9D5771800B1C6"><enum>(a)</enum><header>In general</header><text>For fiscal year 2025 and each subsequent fiscal year for which fees are collected under section 919 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/387s">21 U.S.C. 387s</external-xref>), the Secretary of Health and Human Services, acting through the Commissioner of Food and Drugs, shall, not later than 180 days after the end of the respective fiscal year for which the report is being prepared, submit to the Committee on Health, Education, Labor, and Pensions and the Committee on Appropriations of the Senate, and the Committee on Energy and Commerce and Committee on Appropriations of the House of Representatives, an annual report with respect to such fees that contains the information required under subsection (b).</text></subsection><subsection id="id4591A6D528BA486DAE63F7A053BCC631"><enum>(b)</enum><header>Required information</header><text>Each report submitted under subsection (a) shall contain the following information with respect to the fiscal year for which the report is being submitted:</text><paragraph id="id6a2adebb55d0475f8d3eced098554655"><enum>(1)</enum><text>A breakdown of the amount expended by the Food and Drug Administration on each of the following activities:</text><subparagraph id="id2D909346EF284F82B858CC2B10144805"><enum>(A)</enum><text>Compliance and enforcement.</text></subparagraph><subparagraph id="id5E740B89D9F84FA79B42A0C7871F5DC1"><enum>(B)</enum><text>Public education campaigns.</text></subparagraph><subparagraph id="id173C64784AB841058ED594973775BCD2"><enum>(C)</enum><text>Scientific research and research infrastructure.</text></subparagraph><subparagraph id="id0E5BF19DD0BC4802B0ED776210B2725C"><enum>(D)</enum><text>Communications.</text></subparagraph><subparagraph id="id7F01B7623AEF4C569854E9AD37A698AE"><enum>(E)</enum><text>Leadership, management, oversight, and administrative functions.</text></subparagraph><subparagraph id="idC56319A7FF4741B992AC1CC033915872"><enum>(F)</enum><text>Related overhead activities.</text></subparagraph><subparagraph id="idF74216C10FFB41C99E9EC15A8E739F1F"><enum>(G)</enum><text>Other activities.</text></subparagraph></paragraph><paragraph id="id8e9518c23d2341a9baa66d7cc4fbc03c"><enum>(2)</enum><text>Details on the amount expended, and the purpose of such expenditures, on each of the five largest expenditure amounts within each of the categories described in paragraph (1).</text></paragraph><paragraph id="id956e12317dd74d17bb70e1225c023440"><enum>(3)</enum><text>A breakdown of the amount expended on activities related to deemed tobacco products versus how much was expended on activities related to combustible tobacco products outlined in the pre-existing categories of tobacco products under section 919 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/387s">21 U.S.C. 387s</external-xref>).</text></paragraph><paragraph id="id931096899a9c4c09aedbcec2c958c0b6"><enum>(4)</enum><text>An explanation for how the Food and Drug Administration ensures that the amount of user fees allocated to public education campaigns on youth e-cigarette use and prevention is sufficient to meet the need for education of teens and minors on the dangers of e-cigarettes and other Electronic Nicotine Delivery Systems (commonly referred to as <quote>ENDS</quote>).</text></paragraph><paragraph id="ida037e03f6e404a44b8a4ea763b4a0c32"><enum>(5)</enum><text>A list of the status of submitted, pending, and approved tobacco product applications for each regulatory pathway and class of tobacco product as defined by the Family Smoking Prevention and Tobacco Control Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/31">Public Law 111–31</external-xref>), including subsequent regulations, for the 3-fiscal year period preceding the fiscal year for which the report is being prepared.</text></paragraph><paragraph id="idf9cd6a667d1443de82cc1a7fe8a7fa8b"><enum>(6)</enum><text>When applicable, a breakdown of the amount or user fees collected under the amendments made by this Act from manufacturers of deemed tobacco products and the amount collected from manufacturers of each of the original pre-existing categories of tobacco products under section 919 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/387s">21 U.S.C. 387s</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
