Inhofe National Defense Authorization Act for Fiscal Year 2023 (<external-xref legal-doc="usc" parsable-cite="usc/6/665m">6 U.S.C. 665m(d)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id6516c77595ac4ffdbc82105d1659e695"><enum>(1)</enum><text>by striking paragraph (3); </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfe48c36e134e43eea4ed92c9b1337be6"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1), (2), and (4) as subparagraphs (A), (B), and (C), respectively, and adjusting the margin accordingly; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id14d13cade74a47b5ab8d410f5dbbf1af"><enum>(3)</enum><text display-inline="yes-display-inline">by striking <quote>Each competition</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBEB5FD3A2E914537AF95A8EA9F5A7F48" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><paragraph commented="no" display-inline="no-display-inline" id="idcad7deff7a5a457c877ac995f3c5e4be"><enum>(1)</enum><header>In general</header><text>Each competition</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd192fb5e098c4a86938307beedcb0756"><enum>(4)</enum><text>in subparagraph (C) of paragraph (1), as so redesignated, by striking <quote>paragraphs (1), (2), or (3)</quote> and inserting <quote>subparagraph (A) or (B)</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida41506a6ece64cfbabdb5e566f85c443"><enum>(5)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1C39162E8B4242A3BDC7DBEB671BB008" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><paragraph id="id117aaeafcd9b4eac89d37176042b7aa2"><enum>(2)</enum><header>Biennial requirements</header><text>Not less frequently than every second competition, the competition shall incorporate categories demonstrating offensive and defensive cyber operations involving—</text><subparagraph id="ide57eb5d88f6b45af854cec2a3a78c6c3"><enum>(A)</enum><text>information technology (as defined in section 11101 of title 40, United States Code), such as software reverse engineering and exploitation, network operations, forensics, big data analysis, cyber analysis, cyber defense, cyber exploitation, secure programming, and obfuscated coding;</text></subparagraph><subparagraph id="id68350e43fd664e91a578f97230a49e63"><enum>(B)</enum><text>operational technology (as defined in section 3 of the IoT Cybersecurity Improvement Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/15/278g-3a">15 U.S.C. 278g–3a</external-xref>)) or industrial control systems (as defined in section 2220C of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/665i">6 U.S.C. 665i</external-xref>)), such as knowledge of supervisory control and data acquisition systems and the protocols and communication methods used in these systems, detection of anomalies, and responding to and recovering after incidents involving such systems; or</text></subparagraph><subparagraph id="ideebf8b37bc934a92878e7e4781c13c95"><enum>(C)</enum><text>any other category of technological system requiring cybersecurity or information security, as determined appropriate by the Director.</text></subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="id6e4c66a1-8d1a-4d2d-a924-f5a4a6c0dfcc" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Industrial Control Systems Cybersecurity Competition Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="ida522145a-65f6-48b6-9157-6b05b76fd84c" section-type="subsequent-section" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>2.</enum><header display-inline="yes-display-inline">President's Cup Cybersecurity Competitions</header><subsection commented="no" display-inline="no-display-inline" id="id9e8946688d6b41f59522341a3aeb3fa1"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 7121 of the James M. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2faeab39-2828-4da8-b538-2614b386203e"><enum>(C)</enum><text display-inline="yes-display-inline">by striking <quote>Each competition</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6b952f85-37c2-4f42-b1aa-ecdead04b518" changed="added" reported-display-style="italic" committee-id="SSGA00"><paragraph commented="no" display-inline="no-display-inline" id="ide5ac9c0f-0985-4274-9720-85461271af2e"><enum>(1)</enum><header>In general</header><text>Each competition</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida9ad308c-337e-40ac-8736-f97bab697ea6"><enum>(D)</enum><text>in subparagraph (C) of paragraph (1), as so redesignated, by striking <quote>paragraphs (1), (2), or (3)</quote> and inserting <quote>subparagraph (A) or (B)</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id720ce33c-2002-4a1e-ae3b-3fb8395cdc5d"><enum>(E)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id55c9796b-acce-44eb-96fb-8eb1fd542c05" changed="added" reported-display-style="italic" committee-id="SSGA00"><paragraph id="id43c69026-0681-42fc-9adf-7e51989a3fe2"><enum>(2)</enum><header>Biennial requirements</header><text>Not less frequently than every second competition, the competition shall incorporate categories demonstrating offensive and defensive cyber operations involving—</text><subparagraph id="id821f2942-b996-44f8-ac1e-852b0170e6bd"><enum>(A)</enum><text>information technology (as defined in section 11101 of title 40, United States Code), such as software reverse engineering and exploitation, network operations, forensics, big data analysis, cyber analysis, cyber defense, cyber exploitation, secure programming, and obfuscated coding;</text></subparagraph><subparagraph id="id99E23E7BC0414FA5BFC633A493BAD98C"><enum>(B)</enum><text>operational technology (as defined in section 3 of the IoT Cybersecurity Improvement Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/15/278g-3a">15 U.S.C. 278g–3a</external-xref>)) or industrial control systems (as defined in section 2220C of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/665i">6 U.S.C. 665i</external-xref>)), such as knowledge of supervisory control and data acquisition systems and the protocols and communication methods used in such systems, detection of anomalies, exploitation of operational technology or industrial control systems, and responding to and recovering after incidents involving operational technology or industrial control systems; or </text></subparagraph><subparagraph id="ida4a1aa2b-0cbf-432b-88e6-efce4f68bc35"><enum>(C)</enum><text>any other category of technological system requiring cybersecurity or information security, as determined appropriate by the Director.</text></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id9b08f9cd562d4bf49478ff607dcc4782"><enum>(2)</enum><text>in subsection (e)(1)—</text><subparagraph id="idebc9995aec994852a86228d375936ec1"><enum>(A)</enum><text>in subparagraph (A), by inserting <quote>, which shall not exceed 20 percent of the amounts made available for the competition during any fiscal year</quote> after <quote>the competition</quote>;</text></subparagraph><subparagraph id="id4d6b5bd493e8401eb40ae314db38d04d"><enum>(B)</enum><text>in subparagraph (B), by inserting <quote>, which shall not exceed 20 percent of the amounts made available for the competition during any fiscal year</quote> after <quote>integrity of the competition</quote>; </text></subparagraph><subparagraph id="id3cbd6dce9bff4dfc999f2b80d78dc9a2"><enum>(C)</enum><text>in subparagraph (C), by inserting <quote>, which shall not exceed 20 percent of the amounts made available for the competition during any fiscal year</quote> after <quote>and apparel</quote>; and</text></subparagraph><subparagraph id="idDC827F1572784066B89FF9D2B90BDF38"><enum>(D)</enum><text>in subparagraph (D), by inserting <quote>, which shall not exceed 20 percent of the amounts made available for the competition during any fiscal year</quote> after <quote>the uniformed services</quote>; and</text></subparagraph></paragraph><paragraph id="id77d9081a9b52461c935e4e5cc13d612a"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4cc025a7ef1b4963a633aa3f1c7c803e" changed="added" reported-display-style="italic" committee-id="SSGA00"><subsection id="id12616b5319c54df184d6f5033067b35a"><enum>(h)</enum><header>Limitation</header><text>The Director may not hold an annual cybersecurity competition under this section for a year until after the Director submits the report required under subsection (g) with respect to the competition held under this section during the previous year.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="ide9f58d1805e848fe8be8de3c93a73447"><enum>(i)</enum><header display-inline="yes-display-inline">Sunset</header><text>The Director may not conduct a competition under the authority under this section on or after the first day of the first year that begins more than 5 years after the date of enactment of the <short-title>Industrial Control Systems Cybersecurity Competition Act</short-title>.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idb1d97eeacaeb4b4d82b05bde59b1e613" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>No new funding</header><text>No additional funds are authorized to be appropriated for the purpose of carrying out the amendments made by this Act.</text></subsection></section></legis-body><endorsement><action-date date="20241112">November 12, 2024</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
