<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 3629</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240118">January 18, 2024</action-date><action-desc><sponsor name-id="S350">Mr. Rubio</sponsor> (for himself, <cosponsor name-id="S311">Ms. Klobuchar</cosponsor>, <cosponsor name-id="S331">Mrs. Gillibrand</cosponsor>, and <cosponsor name-id="S396">Mrs. Blackburn</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 18, United States Code, to revise recidivist penalty provisions for child sexual exploitation offenses to uniformly account for prior military convictions, thereby ensuring parity among Federal, State, and military convictions, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Parity for Child Exploitation Offenders Act</short-title></quote>.</text></section><section id="ida912ca0f953349b097a0c88e114b508a"><enum>2.</enum><header>Amendments</header><text display-inline="no-display-inline">Title 18 of the United States Code is amended—</text><paragraph id="idd266e487833349139b385799899e56ca"><enum>(1)</enum><text>in section 2241(c), in the second sentence, by inserting “or an offense under the Uniform Code of Military Justice” after <quote>State offense</quote>;</text></paragraph><paragraph id="idd6fc5a5284434fe4b2ae5032a4a54f7d"><enum>(2)</enum><text>in section 2251(e), by striking “section 920 of title 10 (article 120 of the Uniform Code of Military Justice), or under” each place it appears and inserting “the Uniform Code of Military Justice or”;</text></paragraph><paragraph id="id7f393a3b45224b41a8b9bb31c0dc40b4"><enum>(3)</enum><text>in section 2252(b)—</text><subparagraph id="id65d837926cd94ce2b10c472cb6cb4bd8"><enum>(A)</enum><text>in paragraph (1), by striking “section 920 of title 10 (article 120 of the Uniform Code of Military Justice), or under” and inserting “the Uniform Code of Military Justice or”; and</text></subparagraph><subparagraph id="id8a3d2240d5ed4cf7af64c28a384d0ef9"><enum>(B)</enum><text>in paragraph (2), by striking “section 920 of title 10 (article 120 of the Uniform Code of Military Justice), or under” and inserting “the Uniform Code of Military Justice or”;</text></subparagraph></paragraph><paragraph id="id2dd5dbb8fe914483a6d4decc718b0854"><enum>(4)</enum><text>in section 2252A(b)—</text><subparagraph id="idbb382864f5864450aafef2ee6db44586"><enum>(A)</enum><text>in paragraph (1), by striking “section 920 of title 10 (article 120 of the Uniform Code of Military Justice), or under” and inserting “the Uniform Code of Military Justice or”; and</text></subparagraph><subparagraph id="id68afa5ec8317450881ec9e7ced0455e5"><enum>(B)</enum><text>in paragraph (2), by striking “section 920 of title 10 (article 120 of the Uniform Code of Military Justice), or under” and inserting “the Uniform Code of Military Justice or”;</text></subparagraph></paragraph><paragraph id="id0d338f98ad984310810e6bd12224bab3"><enum>(5)</enum><text>in section 2426(b)(1)(B), by inserting <quote>or the Uniform Code of Military Justice</quote> after <quote>State law</quote>; and</text></paragraph><paragraph id="id3a2e458009ea4a508f3f2375e35e40c9"><enum>(6)</enum><text>in section 3559(e)(2)—</text><subparagraph id="id57644c969f9343fb99f7acc225f9e4a1"><enum>(A)</enum><text>in subparagraph (B)—</text><clause commented="no" display-inline="no-display-inline" id="id27648866845348c3b6d4e40278e40221"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>State sex offense</quote> and inserting <quote>State or Military sex offense</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id483543011f9f47b3ae3703a463c15b18"><enum>(ii)</enum><text>by inserting <quote>or the Uniform Code of Military Justice</quote> after <quote>State law</quote>; and</text></clause></subparagraph><subparagraph id="id39aa9731ba9047e39729605f45132503"><enum>(B)</enum><text>in subparagraph (C), by inserting <quote> or Military</quote> after <quote>State</quote>.</text></subparagraph></paragraph></section></legis-body></bill>
