which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To clarify task and delivery order solicitation and contract requirements.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Conforming Procedures for Federal Task and Delivery Order Contracts Act of 2024</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idd398807c2fa34eccb253eda70f17ae97"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph commented="no" display-inline="no-display-inline" id="id0cb637ca2cdb4c6a9c188fbbf9c0d86a"><enum>(1)</enum><text display-inline="yes-display-inline">certain procedures for solicitation and award of task and delivery order contracts have been streamlined for Defense agencies through amendments to Federal law made by—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbf09282dce8c4b3c8741fbccf3f5770a"><enum>(A)</enum><text>section 825 of the National Defense Authorization Act for Fiscal Year 2017 (<external-xref legal-doc="public-law" parsable-cite="pl/114/328">Public Law 114–328</external-xref>; 130 Stat. 2279); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4f370f9276334941b6b404ba2de038b0"><enum>(B)</enum><text>section 816 of the National Defense Authorization Act for Fiscal Year 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/92">Public Law 116–92</external-xref>; 133 Stat. 1487); and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd2d5306e7ae0406da2cd30bab7eb2188"><enum>(2)</enum><text>amending title 41, United States Code, to clarify that all Federal agencies and their contractors can benefit from the streamlined procedures for solicitation and award of task and delivery order contracts would align with the purpose of the Federal Acquisition Regulation to provide procurement procedures for use by all executive agencies that are standard, consistent, and conducted in a fair and impartial manner. </text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id1bcfc7b366e4497ca9448474253c840e"><enum>3.</enum><header>Multiple-award task and delivery order solicitation requirements</header><text display-inline="no-display-inline">Section 3306(c)(3) of title 41, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id37725b969dfd444ab54f8f3bed50b4fa"><enum>(1)</enum><text display-inline="yes-display-inline">in the paragraph heading, by striking <quote><header-in-text style="USC" level="paragraph">acquired on an hourly rate</header-in-text></quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idab78e1a961f942b7aa50bfba73dd08e4"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>for services to be acquired on an hourly rate basis</quote> and inserting <quote>for the same or similar services (including construction) to be acquired</quote>; and</text></paragraph><paragraph id="id14047c946d934a67962112ba6b7c4e50"><enum>(3)</enum><text>by striking <quote>based on hourly rates</quote>.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id9f499a0597454b21b7a194863338ef13"><enum>4.</enum><header>Single-award task and delivery order contract requirements</header><text display-inline="no-display-inline">Section 4103(d)(3) of title 41, United States Code, is amended—</text><paragraph id="idbce2b08aac9b4337bf1f46ee0279afeb"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>No task or delivery order contract</quote> and inserting <quote>Except as provided under subparagraph (B), no task or delivery order contract</quote>;</text></paragraph><paragraph id="id796944f70d494316b9f69c8c5402fa23"><enum>(2)</enum><text>by redesignating subparagraph (B) as subparagraph (C); and</text></paragraph><paragraph id="idE392FAB73B084AEDABD51E16A52A784D"><enum>(3)</enum><text>by inserting after subparagraph (A) the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id23a74ad17fb1483cbb12942119f6ae54"><subparagraph id="id8c19a037cb4b4690be5fa105433ce62c"><enum>(B)</enum><header>Exception</header><text>A task or delivery order contract in an amount estimated to exceed $100,000,000 (including all options) may be awarded to a single source without the written determination otherwise required under subparagraph (A) if the executive agency has made a written determination pursuant to section 3304 of this title that procedures other than competitive procedures may be used for the awarding of such contract.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
