which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title II of the Social Security Act to make available parental leave benefits to parents following the birth or adoption of a child, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H803271225774449086695DDC9BAC713C"><section section-type="section-one" id="H84EB4E72C28C458EB60F4A93B88F3406"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>New Parents Act of 2023</short-title></quote>.</text></section><section id="H064AD49F55D64C96B42DDE4FB2B44939"><enum>2.</enum><header>Parental leave benefits</header><subsection id="id365B0C1FB91A44DB9ED54758E4F66062"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title II of the Social Security Act is amended by inserting after section 218 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H330BAF0E52924ACBB72026528481DF49"><section id="HC632FB0F7AB3470DB539AB2426FFFAF5"><enum>219.</enum><header>Parental leave benefits</header><subsection id="HAFDDF24044964FC0B641A2E026EA9988"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Every individual—</text><paragraph id="HC88CD1E8B5E644B8A426BEF396F54168"><enum>(1)</enum><text>who has—</text><subparagraph id="HF53AF720C45740A5BB56A8A5C223FFAB"><enum>(A)</enum><text display-inline="yes-display-inline">not less than 8 quarters of coverage, 4 of which are credited to calendar quarters during the calendar year preceding the calendar year in which the 1st month of the benefit period described in subsection (c) occurs; or</text></subparagraph><subparagraph id="H30648379DEDE42A398CE46D00DD29BBA"><enum>(B)</enum><text>not less than 12 quarters of coverage; and</text></subparagraph></paragraph><paragraph id="H04EE740DA4104CB5BECDE9A3DC1AB290"><enum>(2)</enum><text display-inline="yes-display-inline">who has filed an application for a parental leave benefit with respect to a qualified child of the individual,</text></paragraph><continuation-text continuation-text-level="subsection">shall be entitled to a parental leave benefit with respect to such qualified child.</continuation-text></subsection><subsection id="HE4DFFCEC5A8743498CAC6793C37CF163"><enum>(b)</enum><header>Benefit amount</header><text display-inline="yes-display-inline">Such individual’s parental leave benefit shall be an amount equal to the product of—</text><paragraph id="HAAFD975A99FA4E0DBFE4423C6843E904"><enum>(1)</enum><text display-inline="yes-display-inline">the number of benefit months (not to exceed 3) selected by the individual in the individual’s application for a parental leave benefit, multiplied by</text></paragraph><paragraph id="H399FF058192C4B6F8B60E32092F98222"><enum>(2)</enum><text display-inline="yes-display-inline">an amount equal to the primary insurance amount for the individual that would be determined under section 215 if—</text><subparagraph id="H7C7DAB93A826420F80E3A88DE058A957"><enum>(A)</enum><text>the individual had attained age 62 in the first month of the individual’s benefit period; and</text></subparagraph><subparagraph id="HB34C9F27F2C844B9AB6FD3B3C1C7E71A"><enum>(B)</enum><text>the individual had become entitled to an old-age insurance benefit under section 202 beginning with such month.</text></subparagraph></paragraph><continuation-text continuation-text-level="subsection">For the purposes of the preceding sentence, the elapsed years referred to in section 215(b)(2)(B)(iii) shall not include the year in which the individual's benefit period begins, or any year thereafter.</continuation-text></subsection><subsection id="H660B0BC3A93A4839B76C05418B94AB1F"><enum>(c)</enum><header>Payment of benefit</header><paragraph id="H16EA046DFD8D4C588EBCF27FC777332E"><enum>(1)</enum><header>Selection of number of benefit months</header><text>In filing an application for a parental leave benefit under this section, an individual shall select the number of months (not to exceed 3) for which the individual will receive a monthly payment under such parental leave benefit (in this section referred to as <term>benefit months</term>).</text></paragraph><paragraph id="HD6FD07913B094460BA9E439D9E6634BA"><enum>(2)</enum><header>Election of benefit months</header><text display-inline="yes-display-inline">Not later than 14 days before the start of any month in the benefit period of an individual entitled to a parental leave benefit, the individual may elect to treat such month as a benefit month. The number of months in such benefit period treated as benefit months shall equal the number selected in the individual’s benefit application, and the Commissioner may designate any month as a benefit month in any case in which an individual does not elect to treat a sufficient number of months as benefit months before the end of the benefit period.</text></paragraph><paragraph id="H571B19CEF5A44F05854A4C1A054FDDB3"><enum>(3)</enum><header>Amount of monthly payment</header><text display-inline="yes-display-inline">The amount of a monthly payment made in any benefit month within a benefit period to an individual entitled to a parental leave benefit shall be an amount equal to—</text><subparagraph id="H664CA49EDE704EF59583C77E0AA06520"><enum>(A)</enum><text>the amount of the parental leave benefit determined for the individual under subsection (b); divided by</text></subparagraph><subparagraph id="HF5D8DF0CC6064A86B4522767EE0D9285"><enum>(B)</enum><text>the number of benefit months selected by the individual pursuant to paragraph (1) with respect to such benefit.</text></subparagraph></paragraph><paragraph id="HC6F8680C1F0447578626A4BADA67BB90"><enum>(4)</enum><header>Definition of benefit period</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>benefit period</term> means, with respect to an individual entitled to a parental leave benefit with respect to a qualified child, the 1-year period beginning with the month after the month in which the birth or adoption of the qualified child occurs.</text></paragraph></subsection><subsection id="H09813C763DC5430CABC65506C3E802A3"><enum>(d)</enum><header>Benefit application</header><paragraph id="HA85324CF02A3429885AD31BB8A5E1A5E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Commissioner shall ensure that the application for a parental leave benefit—</text><subparagraph id="HB09A2B2985CA4139AB5BC45B0EA04911"><enum>(A)</enum><text display-inline="yes-display-inline">includes a notice, clearly written in language that is easily understandable to the reader, explaining that—</text><clause id="HD49D0BC5CDD047F5A69FD3A735CBED1A"><enum>(i)</enum><text display-inline="yes-display-inline">failure to submit such proof or documentation as the Commissioner may require to demonstrate that the applicant is the parent of the qualified child shall be subject to criminal and civil penalties;</text></clause><clause id="H813267F7FEB54DE58D5F6F3F83C6FBC5"><enum>(ii)</enum><text>the full cost to the Trust Funds of any amount received by an individual as a parental leave benefit must be repaid through reductions to old-age insurance benefits payable to the individual in subsequent months, or by other means; and</text></clause><clause id="H3FC3C6FF7FFD47C1BAB217A32BB9067A"><enum>(iii)</enum><text>entitlement to a parental leave benefit has no effect on the determination of an individual’s entitlement to leave under the Family and Medical Leave Act of 1993; and</text></clause></subparagraph><subparagraph id="HB31124DC70F34571AD1DF0972FED84A2"><enum>(B)</enum><text>requires an attestation by the individual submitting the application that—</text><clause id="H87BC8731A3504B919AB0565361DDA5DE"><enum>(i)</enum><text>the individual expects to be the parent of a qualified child throughout the benefit period with respect to such application;</text></clause><clause id="H440C040CF50C4E2EA60B2246E60943B3"><enum>(ii)</enum><text display-inline="yes-display-inline">the individual intends to use the benefit to finance spending more time with the qualified child at home and away from employment during the benefit period; and</text></clause><clause id="HEF5B8ADA66A14CEF906C3B5EFB876560"><enum>(iii)</enum><text>the individual consents to the terms and conditions specified in the notice described in subparagraph (A).</text></clause></subparagraph></paragraph><paragraph id="HFA1EE64A7F5E48D694E2C3A33908BF32"><enum>(2)</enum><header>Option to file simultaneous applications</header><text>The Commissioner of Social Security may establish an option under which an individual may file an application for a parental leave benefit under this section with respect to a qualified child at the same time the individual submits an application for a social security account number for such qualified child.</text></paragraph><paragraph id="HB8CA39E353A1403AA7AC0D8C345D46B2"><enum>(3)</enum><header>Online availability</header><text display-inline="yes-display-inline">The Commissioner of Social Security shall, as soon as practicable after the date of enactment of this section, permit an individual to apply for a parental leave benefit through an internet website or other electronic media.</text></paragraph></subsection><subsection id="HFBD0AE1A162F44E08F88796F75DDEA66"><enum>(e)</enum><header>Fraud prevention</header><paragraph id="HC004D56A00324C95B6BDFE4D4C6618DB"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Commissioner of Social Security shall establish procedures to ensure the prevention of fraud with respect to applications for parental leave benefits under this section, including procedures for the submission of such proof or documentation as the Commissioner may require to verify the information contained in such an application.</text></paragraph><paragraph id="HC9ED42BED57D466CAAC92A4750E2FBD3"><enum>(2)</enum><header>Enforcement</header><text display-inline="yes-display-inline">In any case in which an individual willfully, knowingly, and with intent to deceive the Commissioner of Social Security fails to comply with the procedures established under paragraph (1), the Commissioner may impose on such individual, in addition to any other penalties that may be prescribed by law—</text><subparagraph id="H3D4F7D24BF3A45E2BB1CF3D794A818D4"><enum>(A)</enum><text display-inline="yes-display-inline">a civil monetary penalty of not more than $7,500 for each such failure; and</text></subparagraph><subparagraph id="HA6D023BFEA844C798B7364A307F4ED5E"><enum>(B)</enum><text display-inline="yes-display-inline">an assessment, in lieu of any damages sustained by the United States because of such failure, of not more than twice the amount of the cost to the Federal Old-Age and Survivors Insurance Trust Fund of any parental leave benefit paid to the individual.</text></subparagraph></paragraph></subsection><subsection id="H969106FC17E54229B0E85C3A1DA3EEED"><enum>(f)</enum><header>Benefit repayment</header><paragraph id="HEFDEB9D554AE49E38CB94243C57902D6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An individual who is paid a parental leave benefit under this section shall repay the full cost of such benefit to the Federal Old-Age and Survivors Insurance Trust Fund (as such amount is determined by the Commissioner) in accordance with this subsection.</text></paragraph><paragraph id="HA81B76BC134744D1BE211F90FC03DD7E"><enum>(2)</enum><header>Old-age insurance benefit offset</header><subparagraph id="H59F27FF7F86943C1A98AB32F83DD3E1C"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (3), in the case of any individual described in paragraph (1) who becomes entitled to an old-age insurance benefit, deductions shall be made from each monthly payment of such benefit (not to exceed the first 60 such monthly payments) in such amounts, subject to subparagraph (B), as the Commissioner of Social Security shall determine necessary to fully recover the cost to the Federal Old-Age and Survivors Insurance Trust Fund of any parental leave benefit paid to the individual as of the month in which the individual becomes entitled to an old-age insurance benefit.</text></subparagraph><subparagraph id="H45B2DCAD69F34924856C6DF0BBE2C6BF"><enum>(B)</enum><header>Notification</header><text display-inline="yes-display-inline">Not later than the beginning of each calendar year, the Commissioner of Social Security shall notify each individual whose old-age insurance benefits are subject to a deduction under subparagraph (A) during such calendar year of the amount of the deduction that will be applied to each monthly payment of such benefits during the calendar year.</text></subparagraph></paragraph><paragraph id="H1EAC541CBE624F90BB5E573D1A3E346F"><enum>(3)</enum><header>Alternative increase of retirement age</header><subparagraph id="H3F0874ADECDC4F1189A66803C87E055D"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of any individual described in paragraph (1) who becomes entitled to an old-age insurance benefit, such individual may elect, at the time of application for such benefit, to be subject to a retirement age increase in accordance with this paragraph. Such election shall be irrevocable, and an individual who makes such an election shall not be subject to a deduction under paragraph (2) for any month.</text></subparagraph><subparagraph id="HDE58C09875064EAB98D5BCA6676B6FF8"><enum>(B)</enum><header>Retirement age increase</header><text>Notwithstanding section 216(l)(1), with respect to an individual who makes an election under subparagraph (A), the retirement age of such individual shall be deemed to be—</text><clause id="HA22DBABA59E741D188F72F2B7DB0D449"><enum>(i)</enum><text>the retirement age determined with respect to the individual under such section; plus</text></clause><clause id="H57B7F0F52E5D449B9B07549326974593"><enum>(ii)</enum><text display-inline="yes-display-inline">the additional number of months the Commissioner of Social Security shall determine necessary to result in the full recovery of the cost to the Federal Old-Age and Survivors Insurance Trust Fund of any parental leave benefit paid to the individual as of the month in which the individual becomes entitled to an old-age insurance benefit.</text></clause></subparagraph><subparagraph id="idBD42C170F58240C88496E3A42D331EB9"><enum>(C)</enum><header>Increase to earliest entitlement age</header><text>In the case of an individual who makes an election under subparagraph (A), notwithstanding subsection (a) of section 202, no old-age insurance benefit shall be paid to such individual for any month before the first month throughout which the individual has attained age 62 plus the additional number of months determined for the individual under subparagraph (B)(ii).</text></subparagraph></paragraph><paragraph id="H0D34DC8515BB4B4190C2DF52DDC17AF0"><enum>(4)</enum><header>Other recovery methods</header><text display-inline="yes-display-inline">In any case in which the Commissioner of Social Security determines that the cost to the Federal Old-Age and Survivors Insurance Trust Fund of a parental leave benefit paid to an individual cannot be fully recovered pursuant to paragraph (2) or (3)—</text><subparagraph id="HABD58BA6DC224047BE527B12B583B32B"><enum>(A)</enum><text>such benefit shall be deemed, upon the making of such determination, to be a payment of more than the correct amount for purposes of section 204; and</text></subparagraph><subparagraph id="H977608C7933F4FDCA9EBBB7CB3DB61CA"><enum>(B)</enum><text>the Commissioner may recover such amounts by means of any method available to the Commissioner under such section.</text></subparagraph></paragraph><paragraph id="H72D526C8C5934A28B8957937073509F8"><enum>(5)</enum><header>Projection of repayment amount</header><text display-inline="yes-display-inline">As soon as practicable after the date of enactment of this section, the Commissioner shall establish a system to make available through an internet website or other electronic media to each individual who is paid a parental leave benefit under this section, beginning with the first month beginning after the individual’s benefit period the projected amount of the deduction to be made from each of the first 60 monthly payments of old-age insurance benefits under paragraph (2), or if the individual so elects, the additional number of months by which the individual’s retirement age would be increased under paragraph (3), in order to fully repay the cost to the Federal Old-Age and Survivors Insurance Trust Fund of any parental leave benefit paid to the individual, and a description of the assumptions used by the Commissioner in making such projection.</text></paragraph></subsection><subsection id="H253BD6937D54461AA80D3CDE8B7003AE"><enum>(g)</enum><header>Relationship with State law; employer benefits</header><paragraph id="H4CF60DB163B945F595BC642CC38F07D1"><enum>(1)</enum><header>In general</header><text>This section does not preempt or supersede any provision of State or local law that authorizes a State or political subdivision to provide paid parental or family medical leave benefits similar to the benefits provided under this section.</text></paragraph><paragraph id="HFB39F312DF694042993213A8D03C0A36"><enum>(2)</enum><header>Greater benefits allowed</header><text>Nothing in this Act shall be construed to diminish the obligation of an employer to comply with any contract, collective bargaining agreement, or employment benefit program or plan that provides greater benefits for leave or other leave rights to individuals than the benefits for leave or leave rights established under this Act.</text></paragraph></subsection><subsection id="HBBCA657AD043430E8AE2FDB0230ACF97"><enum>(h)</enum><header>Sunset</header><text display-inline="yes-display-inline">No application for parental leave benefits under this section may be filed in any calendar year if the OASDI trust fund ratio (as defined in section 215(i)) for such calendar year or for the year following such calendar year is projected, based on the intermediate projections in the most recent (as of January 1 of such calendar year) annual report issued under section 201(c)(2), to be less than 20 percent.</text></subsection><subsection id="H632480E707624FB9BA0D1F8FA25D47AB"><enum>(i)</enum><header>Definitions</header><text>For purposes of this section—</text><paragraph id="HED4FCCC147604FFEBD24FE31938D1C3B"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>qualified child</term> means, with respect to an individual for a benefit period, a biological child or legally adopted child of the individual (as determined by the Commissioner of Social Security) who—</text><subparagraph id="HFD5191308B7B4A88AC4C0A34D532C27D"><enum>(A)</enum><text>will not attain 18 years of age before the end of such benefit period; and</text></subparagraph><subparagraph id="H09FA729FE63A4CF7B5BBA496584E833F"><enum>(B)</enum><text display-inline="yes-display-inline">will be residing with, and under the care of, the individual during the benefit period as determined by the Commissioner.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H8AD912197B4144909AC9903AF58506C1"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="H8B4F9312F8C842CA983E5397AD1616E6"><enum>(1)</enum><header>Nonpayment provisions</header><text display-inline="yes-display-inline">Section 202 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402</external-xref>) is amended—</text><subparagraph id="H0A859E49153342C7A229B62A3E28CC72"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (n)(1)(A), by striking <quote>under this section or section 223</quote> and inserting <quote>under this section, section 219, or section 223</quote>;</text></subparagraph><subparagraph id="H45203DA7ACDA4E8CA381C22C270D7B45"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (t), in paragraphs (1) and (10), by striking <quote>under this section or under section 223</quote> each place it appears and inserting <quote>under this section, under section 219, or under section 223</quote>;</text></subparagraph><subparagraph id="HC382FE5C5E45490783A41920BCF5F028"><enum>(C)</enum><text display-inline="yes-display-inline">in subsection (u)(1), by striking <quote>under this section or section 223</quote> and inserting <quote>under this section, section 219, or section 223</quote>; and</text></subparagraph><subparagraph id="H59BA52E20CAA476CB42DA79C87212658"><enum>(D)</enum><text>in subsection (x)—</text><clause id="HA5070932DF80410084E868615282D516"><enum>(i)</enum><text>in paragraph (1)(A), by striking <quote>under this section or under section 223</quote> and inserting <quote>under this section, under section 219, or under section 223</quote>; and</text></clause><clause id="H4ABC9DC06811407BB8A017BFFA843920"><enum>(ii)</enum><text>in paragraph (2), by striking <quote>under this section or section 223</quote> and inserting <quote>under this section, section 219, or section 223</quote>.</text></clause></subparagraph></paragraph><paragraph id="id8AC769C0CB184D209257973164B14CE8"><enum>(2)</enum><header>Delayed retirement credits</header><text>Section 202(w) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(w)</external-xref>) is amended by inserting after <quote>age 70</quote> each place it appears the following: <quote>(or, in the case of an individual whose retirement age is increased under section 219(f)(3), age 70 plus the number of months by which the individual's retirement age is so increased)</quote>.</text></paragraph><paragraph id="HB7C0EF6E4CA34722A8FB7CBD67A2AA7C"><enum>(3)</enum><header>Voluntary suspension of benefits</header><text>Section 202(z)(1)(A)(ii) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(z)(1)(A)(ii)</external-xref>) is amended by striking <quote>the age of 70</quote> and inserting <quote>age 70 (or, in the case of an individual whose retirement age is increased under section 219(f)(3), age 70 plus the number of months by which the individual's retirement age is so increased)</quote>.</text></paragraph><paragraph id="idE83EB5D2367B4746B4DA0EC80CDAE3E2"><enum>(4)</enum><header>Number of benefit computation years</header><text>Section 215(b)(2)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/415">42 U.S.C. 415(b)(2)(A)</external-xref>) is amended—</text><subparagraph id="H0781652C2E904874B6EF02C937BA6B63"><enum>(A)</enum><text>in clause (i), by striking <quote>, and</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="H73FA559C7F3941A9A6A1399FDA41A9BC"><enum>(B)</enum><text>in clause (ii), by striking the period and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H2D63B2817E294DB78C5201A222453199"><enum>(C)</enum><text>by inserting after clause (ii) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H0C5AB64EBC6540019B6F44656BE7AED6"><clause id="HDA36659F3BE54EA5AA953D626EA8D52C" indent="up2"><enum>(iii)</enum><text display-inline="yes-display-inline">in the case of an individual who is entitled to a parental leave benefit under section 219, by the number of years equal to one-fifth of such individual's elapsed years (disregarding any resulting fractional part of a year), but not by more than 5 years.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id81DA92A0A31A48D38984DB930B764858"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to applications for parental leave benefits filed after 2023.</text></subsection></section></legis-body></bill>
