<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 3592</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240116">January 16, 2024</action-date><action-desc><sponsor name-id="S365">Mr. Scott of South Carolina</sponsor> (for himself and <cosponsor name-id="S338">Mr. Manchin</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Consumer Financial Protection Act of 2010 to clarify the authority of the Bureau of Consumer Financial Protection with respect to persons regulated by a State insurance regulator, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HE197E76A953441ED8973D85387791D07"><section section-type="section-one" id="H456D2FA2BCD84D928E33232B796C68EA"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Business of Insurance Regulatory Reform Act of 2024</short-title></quote>.</text></section><section section-type="subsequent-section" id="H0C9CD05FF2634C8F967A8A90AA2855A3"><enum>2.</enum><header>Clarification to the authority of the Bureau with respect to persons regulated by a State insurance regulator</header><text display-inline="no-display-inline">Section 1027(f) of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5517">12 U.S.C. 5517(f)</external-xref>) is amended—</text><paragraph id="HFA547EEACF52458DBD320E8EE7AC7ABA"><enum>(1)</enum><text>in paragraph (2)—</text><subparagraph id="H3CBEE93AC0944E6D94DA296FFB08C34E"><enum>(A)</enum><text>in the paragraph heading, by striking <quote><header-in-text level="paragraph" style="OLC">Description of activities</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Exceptions</header-in-text></quote>;</text></subparagraph><subparagraph id="idCD9D179B4099472FA7B996A8EFEFD997"><enum>(B)</enum><text>by striking <quote>Paragraph (1)</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF22245FBFB104B7B845E595F911E2F88"><subparagraph id="idC4F5EC1437B44E6C9940E71C4EAA9F05"><enum>(A)</enum><header>Authority</header><text>Paragraph (1)</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H77A530C8FF9340D5A1E11B97B86E8DE9"><enum>(C)</enum><text>by inserting after subparagraph (A), as so designated, the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD7A80A99CF18472B800CB27DB859E681"><subparagraph id="H074C2FC1234E4CB1AFD74D6F64B61ADA"><enum>(B)</enum><header>Limitation</header><text display-inline="yes-display-inline">With respect to a person regulated by a State insurance regulator—</text><clause id="HDA6AC70FFD894FBCB69A4F8596E995B9"><enum>(i)</enum><text display-inline="yes-display-inline">if that person is offering or providing a consumer financial product or service, the Bureau may not enforce this title with respect to that person to the extent that the person is engaged in the business of insurance; or</text></clause><clause id="HD14DA897627D4948AE1FB5AFDA808699"><enum>(ii)</enum><text display-inline="yes-display-inline">if that person is subject to any enumerated consumer law or any law for which authorities are transferred under subtitle F or H, the authority of the Bureau to enforce that law with respect to that person shall be narrowly construed to the extent that the person is engaged in the business of insurance.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H1868C022C6374C9B82CE8882C1349050"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HAE63228EB3484430B31D8F6003FAFC4E"><paragraph id="H9965364451F845E1B377095A41F77669"><enum>(4)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">The enforcement of this title shall be broadly construed in favor of the authority of a State insurance regulator with respect to a person regulated by the State insurance regulator.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
