which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Omnibus Crime Control and Safe Streets Act of 1968 to establish a grant program to recruit, retain, certify, and train bilingual law enforcement officers, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Bilingual Public Safety Act</short-title></quote>.</text></section><section id="id7a0a943464ae41e1bd019917cdab9c5b"><enum>2.</enum><header>Bilingual law enforcement officer grants</header><text display-inline="no-display-inline">Section 1701 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10381">34 U.S.C. 10381</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDF2DEDB140F1480BA2000BF985D150ED"><subsection id="id41427333288446c48ecbe0207cd4909f"><enum>(o)</enum><header>Bilingual law enforcement officer grants</header><paragraph commented="no" display-inline="no-display-inline" id="idee671c15fc974c02893d45b4ae11e5c8"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph commented="no" display-inline="no-display-inline" id="id843ba7195f384dc3a6b5a3119dd46f89"><enum>(A)</enum><header>Covered training program</header><text>The term <term>covered training program</term> means—</text><clause commented="no" display-inline="no-display-inline" id="id2978aa829caa480d9660f27f696419ae"><enum>(i)</enum><text display-inline="yes-display-inline">training curricula for law enforcement officers to enable effective communication with members of communities with limited English proficiency; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idd1e8e112565a4c74b2a2ec4893e827a3"><enum>(ii)</enum><text display-inline="yes-display-inline">an education program relating to the matter described in clause (i), including a partnership between a law enforcement agency and a community college or university under which law enforcement officers of the law enforcement agency take language classes or participate in a series of trainings conducted by the law enforcement agency.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id70ca0e30fae9433095ffe707a8667f22"><enum>(B)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means—</text><clause commented="no" display-inline="no-display-inline" id="id475f14405812438c8bb904495c2832aa"><enum>(i)</enum><text display-inline="yes-display-inline">a State, Tribal, or local law enforcement agency; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ida915d6fc3f7a4f52af76c0eaf99b7099"><enum>(ii)</enum><text display-inline="yes-display-inline">a group of Tribal law enforcement agencies.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5d46505b95034e21affe909600b84241"><enum>(C)</enum><header>Grant recipient</header><text>The term <term>grant recipient</term> means a recipient of a grant under the Program.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0557856106ec4002b7b9bad1dfb7b95f"><enum>(D)</enum><header>Law enforcement agency</header><text>The term <term>law enforcement agency</term> means a public agency charged with policing functions, including any component bureau of the agency (such as a governmental victim services program or village public safety officer program), including an agency composed of officers or persons referred to in subparagraph (B) or (C) of section 2(10) of the Indian Law Enforcement Reform Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2801">25 U.S.C. 2801(10)</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb161087dd066404c928920d913bff4b7"><enum>(E)</enum><header>Program</header><text display-inline="yes-display-inline">The term <term>Program</term> means the grant program established under subsection paragraph (2).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idefb6b06d7897482e8387dbbe1149d2ff"><enum>(2)</enum><header>Grant program</header><text>Not later than 180 days after the date of enactment of the <short-title>Bilingual Public Safety Act</short-title>, the Attorney General shall establish a grant program within the Office of Community Oriented Policing Services under which the Attorney General awards grants to eligible entities to aid in recruiting, retaining, or training law enforcement officers for the purpose of serving communities with limited English proficiency.</text></paragraph><paragraph id="idbf3f03421b214a238ac5ec25222298ce"><enum>(3)</enum><header>Applications</header><text>An eligible entity seeking a grant under the Program shall submit to the Attorney General an application at such time, in such manner, and containing or accompanied by—</text><subparagraph id="idfacc395cb3894cac9988ca2c8b27e8bd"><enum>(A)</enum><text>such information as the Attorney General may reasonably require;</text></subparagraph><subparagraph id="id7da4656369dd4d459f0a71d909ed1b03"><enum>(B)</enum><text>a description of each eligible project under paragraph (5) that the grant will fund; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2869ef3ec54c44499a95644397d9f114"><enum>(C)</enum><text>a plan for evaluating the effectiveness of the eligible entity in implementing each project described in subparagraph (B).</text></subparagraph></paragraph><paragraph id="id13f05f5ef2a34d3daac5cb95df76a5bf"><enum>(4)</enum><header>Selection of grant recipients</header><text>In selecting a recipient of a grant under the Program, the Attorney General shall consider—</text><subparagraph commented="no" display-inline="no-display-inline" id="id70dc134711154bb79b894e9f9e32f0f5"><enum>(A)</enum><text display-inline="yes-display-inline">the specific plan and activities proposed by the applicant to improve the ability of the applicant to serve communities with limited English proficiency;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd7afdf227f9540309047f6f12f90fca7"><enum>(B)</enum><text>the size of each community with limited English proficiency that will be directly served by recipient;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbcec6da404c145a28f7897830f1422a2"><enum>(C)</enum><text display-inline="yes-display-inline">the number of law enforcement officers the grant would support;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5c03924b02c34d17a8911f1420cd8882"><enum>(D)</enum><text display-inline="yes-display-inline">the plan of the recipient described in paragraph (3)(C); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6f624a28e7a045d9a396b68bcbef76e4"><enum>(E)</enum><text display-inline="yes-display-inline">the amount of funding from the grant the recipient will dedicate to direct program activities, as opposed to program administration.</text></subparagraph></paragraph><paragraph id="id2b67c501c1d642968a31cf13f81895e1"><enum>(5)</enum><header>Eligible projects</header><subparagraph commented="no" display-inline="no-display-inline" id="id57efb1838fd540379afd55ce289104eb"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>A grant recipient shall use the grant for activities with the specific objective of improving the ability of the grant recipient to serve communities with limited English proficiency, including by—</text><clause commented="no" display-inline="no-display-inline" id="id41db378f3dc24eec97e326cbf0db2d0a"><enum>(i)</enum><text display-inline="yes-display-inline">hiring or retaining bilingual or multilingual officers who, in the course of their official duties, use their foreign language skills to communicate with members of those communities; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id1880344d159c4c1094bb4fb7c82cfadc"><enum>(ii)</enum><text display-inline="yes-display-inline">providing language education or training developed, identified, or approved by the Attorney General under paragraph (6) to monolingual, bilingual, or multilingual law enforcement officers to enable those law enforcement officers to communicate with members of those communities and in the course of their official duties.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id088d9e04777248b0b1488372c4f9c6bd"><enum>(B)</enum><header>Limitations</header><clause id="idFB092410330640B3ADD90BE60CC85D90" commented="no"><enum>(i)</enum><header>Compensation and bonuses</header><subclause commented="no" display-inline="no-display-inline" id="idd8fc059b3de2459c9fcd5e46ad1d4462"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to a grant recipient that uses amounts from a grant under this subsection to provide compensation or recruitment or retention bonuses to law enforcement officers, the grant recipient shall require the law enforcement officer to commit to employment by the grant recipient during the 3-year period beginning on the date of the provision of the compensation or recruitment or retention bonus.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id153d829f9e02479a8828870c5539f610"><enum>(II)</enum><header>Return of funds</header><text display-inline="yes-display-inline">A law enforcement officer who does not remain employed by a grant recipient during the 3-year period described in subclause (I) after receiving compensation or a recruitment or retention bonus pursuant to subclause (I) shall return a prorated amount of the compensation or recruitment or retention bonus based on the period during which the law enforcement officer does not remain employed.</text></subclause></clause><clause id="id5325512033114DD994CA4F71ED4C43FC" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header>Prohibition on remote services</header><text>A grant recipient may not use funds from the grant for remote, on-demand translation services, such as entering into a contract with a translation service that English-speaking law enforcement officers call during the course of an encounter to provide translation by phone. </text></clause></subparagraph></paragraph><paragraph id="iddf1198f6e1044cbba99d117ecba29c50"><enum>(6)</enum><header>Language education or training</header><subparagraph commented="no" display-inline="no-display-inline" id="idd9924396f1ec4794a82b2a19fbc4e3a8"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of the <short-title>Bilingual Public Safety Act</short-title>, the Attorney General shall develop or identify effective covered training programs for law enforcement officers.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id11a218019cc64406a965aba9de509d5e"><enum>(B)</enum><header>Approval of proposed programs</header><text display-inline="yes-display-inline">The Attorney General may approve a covered training program identified by an eligible entity in an application submitted under paragraph (3).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0a2147d27e0f47a085bccbcb77543019"><enum>(C)</enum><header>Requirements</header><text>The covered training programs developed, identified, or approved under this paragraph shall include—</text><clause id="id5218d25d412e435bad155f735c8b9d1b"><enum>(i)</enum><text>pre-training and post-training tests to assess relevant knowledge and skills covered in the covered training program; and</text></clause><clause id="id4d152099a35e45ba9b20d50b12e95cbb"><enum>(ii)</enum><text>follow-up evaluative assessments to determine the degree to which participants in the covered training program apply the knowledge and skills gained in the covered training program in their jobs.</text></clause></subparagraph><subparagraph id="ide2ea44fcca83492b997fd288c4d1e1e5"><enum>(D)</enum><header>Consultation</header><text>The Attorney General shall develop, identify, and approve training curricula under this paragraph in consultation with—</text><clause commented="no" display-inline="no-display-inline" id="id47d9f2ed7bda48d2b86da7a68ffa7e61"><enum>(i)</enum><text display-inline="yes-display-inline">relevant law enforcement agencies of States and units of local government;</text></clause><clause commented="no" display-inline="no-display-inline" id="ide5bdf8d662e24b81a6323015de3b78f3"><enum>(ii)</enum><text display-inline="yes-display-inline">professional law enforcement agencies;</text></clause><clause commented="no" display-inline="no-display-inline" id="id0363cf74c5ab4d21bceb534b92d13db4"><enum>(iii)</enum><text display-inline="yes-display-inline">law enforcement labor or representative associations;</text></clause><clause commented="no" display-inline="no-display-inline" id="id426289a834b843a2841a2964e51725df"><enum>(iv)</enum><text display-inline="yes-display-inline">racial, ethnic, or cultural affinity groups; </text></clause><clause commented="no" display-inline="no-display-inline" id="ide8e861a6115243b5a65cd8e171e46ddb"><enum>(v)</enum><text display-inline="yes-display-inline">associations made up of or that represent individuals with limited English proficiency; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idef382db9158e45bc94e02039e666e065"><enum>(vi)</enum><text display-inline="yes-display-inline">civil rights and civil liberties groups.</text></clause></subparagraph><subparagraph id="id35eff43427b4406ea4d67f47017456f4"><enum>(E)</enum><header>Timing of grant</header><text>Before the date on which the Attorney General awards a grant to a grant recipient under this subsection, the Attorney General shall confirm that the curricula the grant recipient plans to use for language education or training is developed, identified, or approved under this paragraph.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id234b3c8d99fc4599bdf2676e097d7a31"><enum>(F)</enum><header>List</header><text>The Attorney General shall include as a part of grant application materials for the Program on the website of the Department of Justice a list of the covered training programs developed, identified, or approved under this paragraph.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbab1c1a83b7c46bdb67a10d563928fdb"><enum>(7)</enum><header>Background check requirement</header><text>An eligible entity that uses amounts from a grant under this subsection to hire a new law enforcement officer shall, before hiring the law enforcement officer, perform a background check on the law enforcement officer that includes—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5c502106c03244e5abd619c738a64658"><enum>(A)</enum><text display-inline="yes-display-inline">if permitted, a psychological evaluation; and</text></subparagraph><subparagraph id="ide8df46867ed144a29dfa7c5dd1343fc6"><enum>(B)</enum><text>a search against, if reasonably available—</text><clause commented="no" display-inline="no-display-inline" id="id144ee95648f8464babea1953de181f54"><enum>(i)</enum><text display-inline="yes-display-inline">the National Decertification Index established by the International Association of Directors of Law Enforcement Standards and Training;</text></clause><clause commented="no" display-inline="no-display-inline" id="id950c5ad00241491d925f9046382b294a"><enum>(ii)</enum><text display-inline="yes-display-inline">the National Law Enforcement Accountability Database established under Executive Order 14074 (87 Fed. Reg. 32945; relating to effective, accountable policing and criminal justice practices);</text></clause><clause commented="no" display-inline="no-display-inline" id="idaaa73746ef2b4a048a5853add2253de2"><enum>(iii)</enum><text display-inline="yes-display-inline">any system established by the State of the eligible entity to track the misconduct, disciplinary history, or decertification of law enforcement officers; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id012d2a9f63cd4b66a8ec819d55751cb1"><enum>(iv)</enum><text display-inline="yes-display-inline">any system established by the locality of the eligible entity to track the items described in clause (iii).</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9c0318aa52774eaa82206baff979db06"><enum>(8)</enum><header>Report</header><subparagraph commented="no" display-inline="no-display-inline" id="id82e249bdcc7948b995375df843b7c1e9"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which a grant recipient receives a grant under the Program, and annually thereafter until the date described in subparagraph (B), the grant recipient shall submit to the Attorney General a report on the activities carried out using the grant, including, if applicable—</text><clause id="idf67887abdf2346b58150a0368621f497"><enum>(i)</enum><text>the number of bilingual or multilingual law enforcement officers who received compensation or recruitment or retention bonuses awarded with amounts from a grant under this subsection and the amount of grant funds expended for such compensation or bonuses of law enforcement officers;</text></clause><clause id="id33c661606b4f40b493853a72768302e0"><enum>(ii)</enum><text>with respect to language education or training provided with a grant under the Program—</text><subclause commented="no" display-inline="no-display-inline" id="id9110a71820a543678a00355f691531b2"><enum>(I)</enum><text display-inline="yes-display-inline">the number of law enforcement officers who received the education or training;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id3ef46f3e4238403b8338333d1bb95527"><enum>(II)</enum><text display-inline="yes-display-inline">a description of the education or training; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id0727097ebd4544638e985c834593ff29"><enum>(III)</enum><text display-inline="yes-display-inline">data on the effectiveness of the education or training;</text></subclause></clause><clause id="idc9c1178725e944c195734abca93496da"><enum>(iii)</enum><text>with respect to encounters of law enforcement officers with members of communities with limited English proficiency during the preceding year, data on—</text><subclause commented="no" display-inline="no-display-inline" id="id87cd6bc40c574cf8910bc66866878ae7"><enum>(I)</enum><text display-inline="yes-display-inline">the number of those encounters; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id6f8aa7150c6e4c48ac8d005d24dc58f5"><enum>(II)</enum><text display-inline="yes-display-inline">the portion of those encounters that involved personnel who received, using funds from a grant—</text><item commented="no" display-inline="no-display-inline" id="id861e3dfd05234a35bd308fb48ec39e22"><enum>(aa)</enum><text display-inline="yes-display-inline">compensation or recruitment or retention bonuses; or</text></item><item commented="no" display-inline="no-display-inline" id="iddbf2b74edff24acca64505919b50f891"><enum>(bb)</enum><text display-inline="yes-display-inline">language education or training; and</text></item></subclause></clause><clause id="ide031fe46f4cb4a9683455bd14204f2b3"><enum>(iv)</enum><text>any other data the Attorney General determines appropriate.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1373dea5413943c18a480abbbf5c7f57"><enum>(B)</enum><header>Date described</header><text>The date described in this subparagraph, with respect to a grant recipient, is—</text><clause commented="no" display-inline="no-display-inline" id="idca5f22ffbc9b4cafb662d5cbef63ac9f"><enum>(i)</enum><text display-inline="yes-display-inline">the date on which the grant recipient expends all amounts from the grant and completes each activity conducted with those amounts; or</text></clause><clause commented="no" display-inline="no-display-inline" id="idbec706d2772f4bdeadba9e91b4c83db5"><enum>(ii)</enum><text>an appropriate date determined by the Attorney General that is not later than the third September 30 occurring after the date described in clause (i).</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idee4113d12f694b4b8980dd7baef6b058"><enum>(9)</enum><header>Evaluation and report</header><subparagraph commented="no" display-inline="no-display-inline" id="iddfe9604eac464d5bb1c30dee4a56027c"><enum>(A)</enum><header>Evaluation</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of the <short-title>Bilingual Public Safety Act</short-title>, and every 2 years thereafter, the Director of the National Institute of Justice shall conduct an evaluation of—</text><clause commented="no" display-inline="no-display-inline" id="id5becae441cb544eb9b863eaa8fc6b07a"><enum>(i)</enum><text display-inline="yes-display-inline">the practices deployed by grant recipients to serve communities with limited English proficiency; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id1bde5a9c23d644d7879c222e633fad6f"><enum>(ii)</enum><text display-inline="yes-display-inline">the efficacy of the Program in improving law enforcement communication with communities with limited English proficiency.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id58956b5bc6064adf8ccd123e18b5a93d"><enum>(B)</enum><header>Publication</header><text>Not later than 2 years after the date of enactment of this Act, the Director of the National Institute of Justice shall submit to Congress and make publicly available a report summarizing the evaluation conducted under subparagraph (A).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd32bbb876d6d4ef888836627c406ba7a"><enum>(10)</enum><header>Appropriations</header><text>There are authorized to be appropriated to the Attorney General $50,000,000 to carry out this subsection for each of fiscal years 2024 through 2033. </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
