<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 3567</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240110">January 10, 2024</action-date><action-desc><sponsor name-id="S307">Mr. Brown</sponsor> (for himself and <cosponsor name-id="S421">Mr. Vance</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish within the Department of Veterans Affairs a Veterans Affairs History Office, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Affairs Centennial and Heritage Act of 2024</short-title></quote>.</text></section><section id="ida6d5508ce66e4cc1b799538f2f5d040f"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text><paragraph id="idd8786f8cc2fb415e8cd7b5f05358cb81"><enum>(1)</enum><text>On January 19, 2017, Secretary of Veterans Affairs Robert A. McDonald signed a Memorandum of Agreement that established goals for the Department of Veterans Affairs and regional leaders of Dayton, Ohio, to advance a history office as a community partnership.</text></paragraph><paragraph id="idabd0cba4fec841bf9604e1f3739155e2"><enum>(2)</enum><text>A report commissioned by the Department determined that, <quote>a central History Office, properly staffed and resourced, can become an essential ally for the Department’s senior staff at Headquarters and in the field.</quote>.</text></paragraph><paragraph id="id54214de6020b45669acbca2584aedc8a"><enum>(3)</enum><text>The establishment of a History Office in the Department pursuant to an executive memorandum of the Department, dated April 10, 2020, is a vital contribution to honoring veterans and improving the understanding of how they served the United States.</text></paragraph><paragraph id="idc89ae79bb8c04bdab0fd708090ff3f89"><enum>(4)</enum><text>Department of Veterans Affairs Directive 7777, titled <quote>Implementation of the VA History Program</quote>, was issued on February 9, 2021, and established the policies, responsibilities, and management directions for the Department of Veterans Affairs History Program.</text></paragraph><paragraph id="id8e14cdf92803450e8d8768b2b7387e3d"><enum>(5)</enum><text>The centennial year of the Department is 2030 and such year is a goal for establishing a robust program of ongoing history outreach activities and permanent public exhibits telling the story of the Department.</text></paragraph></section><section id="id45d1078a30bd437bba1e014c504fef32"><enum>3.</enum><header>Department of Veterans Affairs History Office</header><subsection commented="no" display-inline="no-display-inline" id="id28bdcbf6e4fa46dbba80b21714fda208"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/3">Chapter 3</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="idD6DB6437AC4B4DF98C7B3E6B51F90488"><section commented="no" display-inline="no-display-inline" id="idabc7936b7d724267bdce2574163889be"><enum>325.</enum><header>History Office</header><subsection id="id6e1f53ec18f64dbb8bd44ac40d2b6a65"><enum>(a)</enum><header>Establishment</header><paragraph commented="no" display-inline="no-display-inline" id="id6ea165562f58451db3613e02307b5280"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There is established within the Department an office comprising a history program and a national history center.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide49fb6e79050438697472a61a4bf8e60"><enum>(2)</enum><header>Designation</header><text>The office established by paragraph (1) shall be known as the <quote>Department of Veterans Affairs History Office</quote> (in this section the <quote>Office</quote>).</text></paragraph></subsection><subsection id="id34bb81175a204566bd42e24263cf49f5"><enum>(b)</enum><header>Purposes</header><text>The purposes of the Office are—</text><paragraph commented="no" display-inline="no-display-inline" id="idc74f475d68414983a54c82dbfadaee09"><enum>(1)</enum><text display-inline="yes-display-inline">to collect, preserve, and provide access to relevant historical records, artifacts, and cultural resources of the Department (including those of its predecessor organizations); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idec11c68f845f43fd9dc56b1ca5b4a3c6"><enum>(2)</enum><text display-inline="yes-display-inline">to tell a comprehensive story of the Department and its predecessor organizations to veterans, government agencies, and the public.</text></paragraph></subsection><subsection id="ide591cf903854425ab424f9aa64ff5a4e"><enum>(c)</enum><header>Chief Historian and staff</header><text>The Office shall be led by the Chief Historian of the Department of Veterans Affairs (in this section referred to as the <quote>Chief Historian</quote>) who may be assisted by such professional and administrative staff as the Secretary considers necessary to carry out the purposes of the Office under subsection (b) and the requirements set forth under subsection (d).</text></subsection><subsection id="id802533ead99e4bc08ef78a069e414547"><enum>(d)</enum><header>Requirements</header><text>The Office shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id4ee6bdb3459e425a8767fc7dadb60740"><enum>(1)</enum><text display-inline="yes-display-inline">carry out the activities set forth in Department Directive 7777 (relating to implementation of a Department history program), or successor directive;</text></paragraph><paragraph id="id90539c194fb14dfea0b4e57e40c10d83"><enum>(2)</enum><text>assist with planning appropriate history-related events leading up to the centennial of the Department in 2030 (in this section referred to as the <quote>Centennial</quote>) and in events after the Centennial as the Chief Historian considers appropriate in the context of the purposes of the Office set forth under subsection (b);</text></paragraph><paragraph id="id63ec56d5c65c41d99077b30bbf0f4745"><enum>(3)</enum><text>carry out public activities and educational opportunities, including print and web-based publications and exhibits, that increase awareness of the contributions of the Department in supporting veterans;</text></paragraph><paragraph id="id1b42efbef40c436381a8523d019e8603"><enum>(4)</enum><text>construct, renovate, repair, operate, and maintain new or existing Department facilities used for—</text><subparagraph commented="no" display-inline="no-display-inline" id="id00eace841e394c3abd9f7f153275888f"><enum>(A)</enum><text display-inline="yes-display-inline">preservation, restoration, and public access to Department historic materials, archives, and artifacts;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida995b376adc347b5abe28c066fb0772b"><enum>(B)</enum><text display-inline="yes-display-inline">training on the preservation of historic materials, archives, and artifacts; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3083f070b68f4defa24cfc5fc4a4ba02"><enum>(C)</enum><text display-inline="yes-display-inline">education relating to the history of the Department and its predecessor organizations;</text></subparagraph></paragraph><paragraph id="id91eda67b1f1e473da60235d0b57c0884"><enum>(5)</enum><text>maintain facilities for access to, and storage of, historic materials, artifacts, and archives, compliant with recognized specifications for such facilities, which may include storage, conference, and public exhibit space; and</text></paragraph><paragraph id="id1f1e8ee8f0624191a0c7c7b418edb926"><enum>(6)</enum><text>conduct education and training on the preservation of historical materials, archival management, digitization, restoration, historical research, and related subjects to assist the Department.</text></paragraph></subsection><subsection id="id7cc7ba2a24634bc1a537c179a71f6e1d"><enum>(e)</enum><header>Gifts and bequests</header><paragraph commented="no" display-inline="no-display-inline" id="id3034365316c440eaad9c2236616a6e8f"><enum>(1)</enum><header>Authority to accept</header><text display-inline="yes-display-inline">The Secretary may accept, hold, administer, and spend any gift, devise, or bequest of real property, personal property, or money made on the condition that the gift, devise, or bequest be used for the benefit, or in connection with, the purposes and activities of the Office, including a gift, devise, or bequest of an improvement made pursuant to subsection (f)(3).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id936ffb0444874964a1cdcc5c59d98cb8"><enum>(2)</enum><header>Disposition of property</header><text>The Secretary may authorize the sale of donated property received under paragraph (1). A sale under this paragraph need not be conducted in accordance with disposal requirements that would otherwise apply, so long as the sale is conducted at arms-length and includes an auditable transaction record.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd50ed12dcf9149d1bc36083834942ef0"><enum>(3)</enum><header>Use of money and proceeds</header><text>Any money received under paragraph (1) and any proceeds from the sale of property under paragraph (2) shall be deposited into a fund established in the Treasury to support the purposes and activities of the Office.</text></paragraph></subsection><subsection id="id4d7b79e9874d4a61ac78a2572720de3b"><enum>(f)</enum><header>Partnerships, cooperative agreements, and lease authority</header><paragraph commented="no" display-inline="no-display-inline" id="id03365d7e0bf14ac8a3e2ab5b3c675bdb"><enum>(1)</enum><header>Partnerships</header><text display-inline="yes-display-inline">The Secretary may enter into a partnership or cooperative agreement with an organization to support the purposes set forth in subsection (b).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id82541a190a5c49b7b9e0ac74f0ccf009"><enum>(2)</enum><header>Lease authority</header><subparagraph commented="no" display-inline="no-display-inline" id="id1b80ffa022204c22b5dace11a8162d68"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may lease portions of any real property or facility of the Office to a nonprofit organization for use in generating revenue for the support of activities of the Office and for such administrative purposes as may be necessary for support of the Office.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id19507901ef134ef08f9fbf1387d3b21f"><enum>(B)</enum><header>Rent</header><text>Any rent received by the Secretary under a lease under subparagraph (A), including rent-in-kind, shall be used solely to cover or defray the costs of carrying out subsection (b) or (d).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida08aae1f33d34d268638b862c2f7bb5d"><enum>(3)</enum><header>Improvements</header><text>The Secretary may permit a nonprofit organization to make improvements to real property or a facility of the Office for the construction of a multipurpose facility to be used for historical displays for public viewing, curation, and storage of artifacts, research facilities, classrooms, offices, and associated activities consistent with the mission of the Office. </text></paragraph></subsection><subsection id="id1fc792c8f37b4a48890b33726316b5bd"><enum>(g)</enum><header>Internal coordination group</header><paragraph commented="no" display-inline="no-display-inline" id="idd6447fa621fb438288ba4ebc42aa04e5"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><subparagraph commented="no" display-inline="no-display-inline" id="id741bd163445c4513a3031fbe1d572ed2"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of the <short-title>Veterans Affairs Centennial and Heritage Act of 2024</short-title>, the Secretary shall establish an internal coordinating group (in this subsection the <quote>Group</quote>) to assist the Office in carrying out the purposes under subsection (b) and the requirements of subsection (d) by advising the Office on matters relating to operations of the Office, which may include advising on matters relating to the provisions of continuity and resourcing for the Centennial or for development of the history program or the history center described in subsection (a).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idaf37b3992d1d4e0b87ed92ccbc9dc2be"><enum>(B)</enum><header>Procedures and charter</header><text display-inline="yes-display-inline">The Group shall operate in accordance with such procedures as the Secretary may establish and in accordance with a charter the Secretary shall establish for the Group.</text></subparagraph></paragraph><paragraph id="id6484e2c17c4a40e9a5a0914d1ac63df8"><enum>(2)</enum><header>Composition</header><text>The Group shall be composed of the following:</text><subparagraph id="id210b60920e8948519326eb6f8bbf8ce9"><enum>(A)</enum><text>The Deputy Secretary of Veterans Affairs.</text></subparagraph><subparagraph id="id4a9d2b50aca74a21a21926a10c64bdcb"><enum>(B)</enum><text>The Assistant Secretary for Management and Chief Financial Officer, or designee.</text></subparagraph><subparagraph id="id870d6d12bf4242a58625d83383768c3f"><enum>(C)</enum><text>The Chief Historian.</text></subparagraph><subparagraph id="id1f50e017345d4003b7066246f29e3e83"><enum>(D)</enum><text>A senior employee selected by the Secretary from each of the following:</text><clause id="id80bdbff245274b4781ead0d4be0455ef"><enum>(i)</enum><text>The Veterans Experience Office.</text></clause><clause id="idbe28e7848e4e4046a4556eefafd54978"><enum>(ii)</enum><text>The Office of Congressional and Legislative Affairs.</text></clause><clause id="idafa0833f157d4a97b142c616952b38db"><enum>(iii)</enum><text>The Office of Acquisition Logistics and Construction.</text></clause><clause id="id6934ebbe6080461084ad7af69e77acf2"><enum>(iv)</enum><text>The Office of the General Counsel.</text></clause><clause id="idb27da78aec1f4f79a9fd62d167d975a5"><enum>(v)</enum><text>The Veterans Health Administration.</text></clause><clause id="idb17c283f775f47aa898cc37867830d48"><enum>(vi)</enum><text>The Veterans Benefits Administration.</text></clause><clause id="idde5b5a8d926b4bf0bac3e50260ca3600"><enum>(vii)</enum><text>The National Cemetery Administration.</text></clause></subparagraph><subparagraph id="ida07ba85775ec432e9a0b7a8841d890e2"><enum>(E)</enum><text>Such other officers and employees of the Department as the Secretary considers appropriate.</text></subparagraph></paragraph><paragraph id="id9e7838981acd4b65ba398cd13777fba4"><enum>(3)</enum><header>Chairperson</header><text>The chairperson of the Group shall be the Deputy Secretary of Veterans Affairs.</text></paragraph></subsection><subsection id="idd91c826df00e4c288bb550f65422ff3c"><enum>(h)</enum><header>Nonconflict</header><text>This section shall not be construed to affect the authority of the Archivist of the United States for management of permanent records of the Department.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idf4161cda11da4edc8530e99cc78aa475"><enum>(i)</enum><header>Definition of nonprofit organization</header><text>In this section, the term <term>nonprofit organization means</term> an organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of that Code.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id579f1e7951d04209baec1ba252a4b08f"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 3 of such title is amended by adding at the end the following new item:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idAF7538AD4251411B92AFD7D9BF045FE0"><toc><toc-entry level="section" bold="off">325. History Office.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="idc0f2d170592b43ecbd9c174ea2ba14d9"><enum>4.</enum><header>Reports</header><subsection id="id62cab87c46574954b403d6dd52bd9b78"><enum>(a)</enum><header>Long-Range planning</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report on proposed activities of the Department of Veterans Affairs History Office established pursuant to section 325(a) of title 38, United States Code, as added by section 3, leading up to the centennial described in subsection (d)(2) of such section 325.</text></subsection><subsection id="idd25f132597154d11944897bac51c43cc"><enum>(b)</enum><header>Contents</header><text>The report submitted pursuant to subsection (a) shall include plans for the following:</text><paragraph id="id9addab96819b49d4bef804e67aa7b86d"><enum>(1)</enum><text>Staffing and budget.</text></paragraph><paragraph id="id89a309a626b441768e55bcc358ab049a"><enum>(2)</enum><text>Organization charts pertaining to the current staff and location of the History Office within the Department.</text></paragraph><paragraph id="id54e0c47b5c004150833853033da441dc"><enum>(3)</enum><text>Construction and renovation of facilities supporting the History Office, including the National Department of Veterans Affairs History Center.</text></paragraph><paragraph id="id00fa39d2d28c495790b384578382dbce"><enum>(4)</enum><text>Public activities to mark the centennial described in subsection (a).</text></paragraph><paragraph id="id82f7b4775ef34c6da6d9f8d13fcea6a0"><enum>(5)</enum><text>Such recommendations for legislative or administrative action as the Secretary may have with respect to the History Office and the centennial described in subsection (a).</text></paragraph></subsection><subsection id="id4b5ef7cd37504d93aab914824db404ca"><enum>(c)</enum><header>Annual progress reports</header><text>Not later than one year after the date on which the Secretary submits the report required by subsection (a) pursuant to such subsection and not less frequently than once each year thereafter until December 31, 2030, the Chief Historian of the Department of Veterans Affairs shall submit to the committees described in such subsection a report on the progress of the History Office. </text></subsection></section></legis-body></bill>
