<section section-type="section-one" id="id65243a83ee4b4413918839601609a00c"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prosecutorial Remedies and Other Tools to end the Exploitation of Children Today Act of 2023</short-title></quote> or the <quote><short-title>PROTECT Act of 2023</short-title></quote>.</text></section> <section section-type="subsequent-section" id="id8788BFFA237C45B486F2B49002C5F997"><enum>2.</enum><header>Sentencing for child pornography offenses</header> <subsection id="idE893D29703FD4AFF80015AC1A7D6CFD1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3553(b)(2) of title 18, United States Code, is amended by adding at the end the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="idD4C18E5EBBDF4BC79123EAA79C268BC3"> 
<subparagraph id="id110DC00F11704B68BB85ECB504B2D3C0"><enum>(B)</enum><header>Child pornography offenders</header> 
<clause id="idBE94B58507794BD29C762F09FD0DB7F5"><enum>(i)</enum><header>Definition</header><text>In this subparagraph, the term <term>child pornography offense</term> means a violation of, or an attempt or conspiracy to violate, section 2251, 2251A, 2252(a), 2252A(a), or 2260.</text></clause> <clause id="id4DB601202264484F895F7E6AF90B7777"><enum>(ii)</enum><header>Facts proven during trial or admitted by the defendant</header><text>Notwithstanding subparagraph (A), in sentencing a defendant convicted of a child pornography offense, a court shall impose a sentence of the kind, and that is not less than the minimum period in the sentencing range, referred to in subsection (a)(4), as determined based on facts proved beyond a reasonable doubt during a jury or bench trial and facts admitted by the defendant that are relevant to determining the kind and range of sentence, unless the court makes a finding described in clause (i), (ii), or (iii) of subparagraph (A).</text></clause> 
<clause id="idA597BC7DE7E747FDBF7D9BAA1B054B05"><enum>(iii)</enum><header>Facts found by courts</header> 
<subclause id="id90DE2AAA81B24B458729D3AD4819CB12"><enum>(I)</enum><header>In general</header><text>Notwithstanding subparagraph (A), in sentencing a defendant convicted of a child pornography offense, a court shall consider, and may impose, a sentence of the kind, and within the sentencing range, referred to in subsection (a)(4), as determined based on all facts found by the court that are relevant to determining the kind and range of sentence.</text></subclause> <subclause id="id58544225FC4E43AFBBA7203A99339687"><enum>(II)</enum><header>Minimum period</header><text>Nothing in subclause (I) shall authorize a court to impose a sentence that is less than— </text> 
<item id="id87D72695B6344CF4AE79CC2F8EC7F928"><enum>(aa)</enum><text>the minimum sentence determined in accordance with clause (ii); or</text></item> <item id="idE7BC3D023E234B21A81BAE6561631D5D"><enum>(bb)</enum><text>the minimum sentence otherwise required by statute.</text></item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="idA1A4D4BD73F046DC8DB84D363CB161B7"><enum>(b)</enum><header>Penalties for possession</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/110">Chapter 110</external-xref> of title 18, United States Code, is amended—</text> <paragraph id="idA3718B103CB441648D23C2ACFA4AABCB"><enum>(1)</enum><text>in section 2252(b)—</text> 
<subparagraph id="idA8E3A6B638A64014B952AF08B3D50100"><enum>(A)</enum><text>by striking <quote>(1) Whoever violates, or attempts or conspires to violate, paragraph (1), (2), or (3) of subsection (a)</quote> and inserting <quote>Whoever violates, or attempts or conspires to violate, subsection (a)</quote>; and</text></subparagraph> <subparagraph id="idA4B305F720484C849F18859097AD0E21"><enum>(B)</enum><text>by striking paragraph (2); and</text></subparagraph></paragraph> 
<paragraph id="id4426EB6747074926BD78A22C5AB651DD"><enum>(2)</enum><text>in section 2252A(b)—</text> <subparagraph id="id9581EFEBF21544D98E9E33EBCC5C1C1A"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>(5),</quote> after <quote>(4),</quote>; </text></subparagraph> 
<subparagraph id="idBF69E784AF314E23B49D68182CD0587F"><enum>(B)</enum><text>by striking paragraph (2); and</text></subparagraph> <subparagraph id="idF273BF377A6944E6BA26C4988D46358B"><enum>(C)</enum><text>by redesignating paragraph (3) as paragraph (2). </text></subparagraph></paragraph></subsection></section>
