<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 3526</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20231214">December 14, 2023</action-date><action-desc><sponsor name-id="S402">Ms. Rosen</sponsor> (for herself and <cosponsor name-id="S288">Ms. Murkowski</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 38, United States Code, to require a lactation space in each medical center of the Department of Veterans Affairs.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H43C7F961079646EE9188A5279C5EE221"><section section-type="section-one" id="H71EEEFB0811E422CACA1639BD135947D"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Lactation Spaces for Veteran Moms Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="H3FDB9B3CFD6743ED88C61568771E76DC"><enum>2.</enum><header>Lactation spaces in medical centers of the Department of Veterans Affairs</header><subsection id="HAE4369839A08465C8B30BDCDC8BD629C"><enum>(a)</enum><header>In general</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">chapter 17</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text><quoted-block style="USC" id="HC26DD4D280234A3D93DD9100EACD7BAA"><section id="H3DC38C234885429B932A4FC16BC0B930"><enum>1720K.</enum><header>Lactation spaces in medical centers of the Department </header><subsection id="H6B88453CFC824E978D842C5AAEC12BC6"><enum>(a)</enum><header>Lactation space required</header><text display-inline="yes-display-inline">The Secretary shall ensure that each medical center of the Department contains a lactation space.</text></subsection><subsection id="H7F53C8E85EEF4464AB16C849DE1C5970"><enum>(b)</enum><header>No unauthorized entry</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to authorize an individual to enter a medical center of the Department or portion thereof that the individual is not otherwise authorized to enter.</text></subsection><subsection id="H52733A875CCC42158B2D2DC6B8F0F11B"><enum>(c)</enum><header>Lactation space defined</header><text>In this section, the term <term>lactation space</term> means a hygienic place, other than a bathroom, that—</text><paragraph id="H021D151C1B644A7BAA6E184C4E0C05B5"><enum>(1)</enum><text>is shielded from view;</text></paragraph><paragraph id="H2037C3B431ED4ADD846CEE56FFD8BA95"><enum>(2)</enum><text>is free from intrusion;</text></paragraph><paragraph id="H9E1885B1C90C402FB05C2B7290DFF642"><enum>(3)</enum><text>is accessible to disabled individuals (including such individuals who use wheelchairs);</text></paragraph><paragraph id="H9393C20B855748F6AA381FF337EA6685"><enum>(4)</enum><text>contains a chair and a working surface;</text></paragraph><paragraph id="H31216AA51FF54CADA1EE630184AF693E"><enum>(5)</enum><text>is easy to locate;</text></paragraph><paragraph id="HC54E290FF6FF4B9EB55378676FBEA82E"><enum>(6)</enum><text>is clearly identified with signage; and</text></paragraph><paragraph id="H4D3E590EE23B44E7897CE3E9D9007F56"><enum>(7)</enum><text display-inline="yes-display-inline">is available for use by women veterans and members of the public to express breast milk.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HE879A4DB1C1A46A29D4EB462955C133C"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item related to section 1720J the following new item:</text><quoted-block style="USC" id="HA43771BD69B1492B8F53707EC118CEAA"><toc regeneration="no-regeneration"><toc-entry level="section">1720K. Lactation spaces in medical centers of the Department.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H3B82A96E2F0040B280DA7BC889048FA7"><enum>(c)</enum><header>Effective date</header><text>The Secretary of Veterans Affairs shall carry out section 1720K of title 38, United States Code, as added by this section, not later than two years after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
