<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 350</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230209">February 9, 2023</action-date><action-desc><sponsor name-id="S378">Mr. Lankford</sponsor> (for himself and <cosponsor name-id="S277">Mr. Carper</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 38, United States Code, to expand eligibility for the Marine Gunnery Sergeant John David Fry Scholarship to include spouses and children of individuals who die from a service-connected disability within 120 days of serving in the Armed Forces, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="idE8EA29EEC9154793B6B5713C49E2793E"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fry Scholarship Enhancement Act of 2023</short-title></quote>.</text></section><section section-type="subsequent-section" id="id7A41B26322ED47B0A89781E4B526EBE0"><enum>2.</enum><header>Expansion of eligibility for Marine Gunnery Sergeant John David Fry Scholarship</header><subsection id="id5160281143714205BA06F7A0D1B6F1DC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3311(b)(8) of title 38, United States Code, is amended—</text><paragraph id="id5D90F8AE3748428EAFFDD3AE336D96D9"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>dies in line of duty</quote> and inserting the following: “dies—</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF87678AF8A4041B9BF666E3CBBE67F1C"><subparagraph id="id34FA62DB8E9D4F6AA9E03D2D699C5B88"><enum>(A)</enum><text>in line of duty</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id6C486AE7098A412A960912515FF63448"><enum>(2)</enum><text>in subparagraph (A), as designated by paragraph (1), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="id82551C2231CF453A8DEB0250AA0D1492"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id76856CA20AD44F2FAC49264A0CE45582"><subparagraph id="idDFC2FDE383E24CB38879022EAC955492"><enum>(B)</enum><text>from a service-connected disability during the 120-day period beginning on the first day immediately following the last day on which the individual was discharged or released from active duty as a member of the Armed Forces or duty other than active duty as a member of the Armed Forces, but only if—</text><clause id="idE8265DA586D94BD5AC5553A91F542424"><enum>(i)</enum><text>the person was discharged with an honorable discharge; or</text></clause><clause id="id4E853CE5949B4DA78A18569558962E77"><enum>(ii)</enum><text>the person's service in the Armed Forces was characterized by the Secretary concerned as honorable.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idC5D1B7B561794978A9AE9DE0C7F98BA9"><enum>(b)</enum><header>Applicability</header><text>The amendments made by subsection (a) shall apply with respect to—</text><paragraph id="idAC11D2F5352A4B8BB52CBA49A91773A7"><enum>(1)</enum><text>deaths that occur before, on, or after the date of the enactment of this Act; and</text></paragraph><paragraph id="idF2726E11DBCC4BDB96985A4A70DA5818"><enum>(2)</enum><text>a quarter, semester, or term, as applicable, commencing on or after August 1, 2024.</text></paragraph></subsection></section></legis-body></bill>
