<congress display="yes">118th CONGRESS</congress><session display="yes">2d Session</session><legis-num display="yes">S. 3502</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To amend the Fair Credit Reporting Act to prevent consumer reporting agencies from furnishing consumer reports under certain circumstances, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section id="id644d7b0cb20a49d4a42351eceada4758" section-type="section-one" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Homebuyers Privacy Protection Act</short-title></quote>.</text></section><section id="id5866b331f2494d8ebc5015a40b164c3d" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Treatment of prescreening report requests</header><text display-inline="no-display-inline">Section 604(c) of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681b">15 U.S.C. 1681b(c)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id809fcf9a2190403b9f2ca7c3efb00701"><paragraph id="idcdd961c983ec4eb2885c1fdb6facc137" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Treatment of prescreening report requests</header><subparagraph id="idc2931de07e554fd8ab0423882492a44e" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this paragraph:</text><clause id="id41779779717f44eb960a135c22af32dc" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">Credit union</header><text display-inline="yes-display-inline">The term <term>credit union</term> means a Federal credit union or a State credit union, as those terms are defined in section 101 of the Federal Credit Union Act (12 U.S.C 1752). </text></clause><clause id="id0e052696b1014b458d262e5d3ac77c06" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header display-inline="yes-display-inline">Insured depository institution</header><text display-inline="yes-display-inline">The term <term>insured depository institution</term> has the meaning given the term in section 3 of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813(c)</external-xref>). </text></clause><clause id="idac5955604a464845916ff1ab78af4eb6" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><header display-inline="yes-display-inline">Residential mortgage loan</header><text display-inline="yes-display-inline">The term <term>residential mortgage loan</term> has the meaning given the term in section 1503 of the S.A.F.E. Mortgage Licensing Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/12/5102">12 U.S.C. 5102</external-xref>).</text></clause><clause id="id2006103572cf4268bf4f8a0536bd4c71" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><header display-inline="yes-display-inline">Servicer</header><text display-inline="yes-display-inline">The term <term>servicer</term> has the meaning given the term in section 6(i) of the Real Estate Settlement Procedures Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/12/2605">12 U.S.C. 2605(i)</external-xref>).</text></clause></subparagraph><subparagraph id="idcc89f861959641509cc9487e44743a86" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">If a person requests a consumer report from a consumer reporting agency in connection with a credit transaction involving a residential mortgage loan, that agency may not, based in whole or in part on that request, furnish a consumer report to another person under this subsection unless that other person—</text><clause id="idcf2dc29ed57e49bf803f6820f3810031" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">has submitted documentation to that agency certifying that such other person has, pursuant to paragraph (1)(A), the authorization of the consumer to whom the consumer report relates; or</text></clause><clause id="idac6ec0bad9e14caeab070129d2c47fed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id0cab9acdcb084c3b9f27b0cdf55c4ca7"><enum>(I)</enum><text display-inline="yes-display-inline">has originated a current residential mortgage loan of the consumer to whom the consumer report relates;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id6e7bdc8975014c2dad084e98ebbda898" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">is the servicer of a current residential mortgage loan of the consumer to whom the consumer report relates; or</text></subclause><subclause commented="no" display-inline="no-display-inline" indent="up1" id="id48d4cf811b28453cafdbf5e6e39d4bcb"><enum>(III)</enum><item commented="no" display-inline="yes-display-inline" id="id6e5dacaf2afb410fb9a7cbf6bcf7cd6b"><enum>(aa)</enum><text display-inline="yes-display-inline">is an insured depository institution or credit union; and</text></item><item commented="no" display-inline="no-display-inline" indent="up1" id="ida0350a25f3954565bd2973b24fccee62"><enum>(bb)</enum><text display-inline="yes-display-inline">holds a current account for the consumer to whom the consumer report relates.</text></item></subclause></clause></subparagraph></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id620a5e99255d41f09358aea75fe554a1"><enum>3.</enum><header display-inline="yes-display-inline">Effective date</header><text display-inline="no-display-inline">This Act, and the amendments made by this Act, shall take effect on the date that is 90 days after the date of enactment of this Act.</text></section></legis-body><attestation><attestation-group><attestation-date date="20241217" legis-day="20241216" chamber="Senate">Passed the Senate December 17 (legislative day, December 16), 2024.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
