which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Energy to establish a program to provide loans to manufacturers of energy grid products and components.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Facilitating the Reshoring of Energy Grid Component Manufacturing Act of 2023</short-title></quote>.</text></section><section id="idEDC0D86DC0F54F6EB6AD81AC488E3530"><enum>2.</enum><header>Energy grid product and component manufacturing in the United States</header><subsection id="id1BD48C15A6864AC78BFC7093246283BE"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id49912F2A154F46B0A80CF8D20293C6FB"><enum>(1)</enum><header>Component</header><text>The term <term>component</term> means any part or element of an energy grid product.</text></paragraph><paragraph id="id87944D8928174169B6DB39FD1CA57C66"><enum>(2)</enum><header>Eligible project</header><text>The term <term>eligible project</term> means a project to reequip, expand, or establish (including through new construction) a manufacturing facility in the United States to produce energy grid products or components.</text></paragraph><paragraph id="id786C3F612E784F769E7C3F615EA5B578"><enum>(3)</enum><header>Energy grid product</header><text>The term <term>energy grid product</term> means—</text><subparagraph id="id94164DA125CB40EAA1F84FE76525C2DE"><enum>(A)</enum><text>a bulk-power system (as defined in section 215(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C. 824o(a)</external-xref>));</text></subparagraph><subparagraph id="idE6462C8C363D4E35AE79788DC7D61EE7"><enum>(B)</enum><text>a large power transformer;</text></subparagraph><subparagraph id="id08A21469500E4C859EF18C46AEC52DBD"><enum>(C)</enum><text>a switchgear or breaker;</text></subparagraph><subparagraph id="id7DE281672773426A9BAF4438629B0F94"><enum>(D)</enum><text>a converter;</text></subparagraph><subparagraph id="id065E6887531F4B219275ADF1F1B69A6B"><enum>(E)</enum><text>a direct current filter;</text></subparagraph><subparagraph id="id1E53C66EED714C339A6223D304BBE895"><enum>(F)</enum><text>an alternating current switch or switchyard;</text></subparagraph><subparagraph id="id1D4B2270BDC7447FA5B340B8FD1B0E06"><enum>(G)</enum><text>an insulated-gate bipolar transistor;</text></subparagraph><subparagraph id="idF86554A16B7F47F887B41BBFED2380C3"><enum>(H)</enum><text>a capacitor;</text></subparagraph><subparagraph id="id6A047602DA0149CAB8AE052EAB7BB108"><enum>(I)</enum><text>an inductor;</text></subparagraph><subparagraph id="id15355A24A363486DA8228713679D33C6"><enum>(J)</enum><text>an arrestor;</text></subparagraph><subparagraph id="idF7E749E96F9D4B838B3CC125BE7E938A"><enum>(K)</enum><text>a resistor;</text></subparagraph><subparagraph id="idA99A9A4B646F4EB194CA9E88FCAB40C2"><enum>(L)</enum><text>a distribution transformer;</text></subparagraph><subparagraph id="idED3F1712EA704912908AA6B282AB990C"><enum>(M)</enum><text>grain-oriented electrical steel;</text></subparagraph><subparagraph id="idB05D2164F1704A39A1AC449CE323CDBE"><enum>(N)</enum><text>continuously transposed conduction (CTC) copper wire;</text></subparagraph><subparagraph id="id61F8344C1DC54818924F398B3B3C43C9"><enum>(O)</enum><text>silicon steel;</text></subparagraph><subparagraph id="id4E3166ECCF084A5FB9104007BD1CC4DC"><enum>(P)</enum><text>any insulating material; and</text></subparagraph><subparagraph id="id4A2E2FC4A2EB47498D18ED6723E6CB01"><enum>(Q)</enum><text>any other electrical equipment commonly used for the transmission or distribution of electric energy by public electric utilities.</text></subparagraph></paragraph><paragraph id="idCA11A821D3CF4B348907587099FC19CF"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph></subsection><subsection id="id7A608D8E34F541BD8F8CD8348DE570E0"><enum>(b)</enum><header>Loan program</header><paragraph id="id6F6C6F3E2132416A8C1FE8936BB375D0"><enum>(1)</enum><header>Establishment</header><subparagraph id="idF3C6BAAF5C564EEEA97FFA39481EDF79"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, and subject to the availability of appropriated funds, the Secretary shall establish and carry out a program to provide a total of not more than $8,000,000,000 in loans to eligible individuals and entities (as determined by the Secretary) for the costs of activities relating to eligible projects.</text></subparagraph><subparagraph id="id158EE5FC5B6044E9B2EE88CCD6D732FD"><enum>(B)</enum><header>Financing method</header><clause id="id946864D7C1424596B06AE68855400E99"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), a loan under this subsection shall be provided through the Federal Financing Bank, with the full faith and credit of the United States Government on the principal and interest.</text></clause><clause id="id89358EFEBEE446CC879AC54AE49F4702"><enum>(ii)</enum><header>Cooperation with other institutions</header><text>A loan under this subsection may be provided in cooperation with 1 or more banks or other financial institutions through agreements to participate on an immediate or deferred (guaranteed) basis.</text></clause></subparagraph><subparagraph id="id0977CE2565214B4B8F76B1BD8D43C38C"><enum>(C)</enum><header>Credit subsidy</header><text>The full credit subsidy for each loan provided under this subsection shall be paid by the Secretary using appropriated funds.</text></subparagraph></paragraph><paragraph id="idFD2217B77B0146EAB7456637E73E4B1B"><enum>(2)</enum><header>Application</header><text>An individual or entity desiring a loan under this subsection shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including a written assurance that—</text><subparagraph id="id282450c96d8441f99ba6dd5d57540871"><enum>(A)</enum><text>all laborers and mechanics employed by contractors or subcontractors during any construction, alteration, or repair that is financed, in whole or in part, by a loan provided under this subsection shall be paid wages at rates not less than those prevailing on projects of a character similar in the locality, as determined by the Secretary of Labor in accordance with sections 3141 through 3144, 3146, and 3147 of title 40, United States Code; and</text></subparagraph><subparagraph id="id1f383f8989504ac3bfcb9d1761a1b83a"><enum>(B)</enum><text>the Secretary of Labor shall, with respect to the labor standards described in this paragraph, have the authority and functions set forth in Reorganization Plan Numbered 14 of 1950 (5 U.S.C. App.) and section 3145 of title 40, United States Code.</text></subparagraph></paragraph><paragraph id="id327C7AFAD759414FB019FCC111EA33B6"><enum>(3)</enum><header>Selection of loan recipients and eligible projects</header><subparagraph id="id2B28EF0B16D8422EA3E263BC0C8A3DC5"><enum>(A)</enum><header>In general</header><text>The Secretary may provide a loan under this subsection if the Secretary determines that—</text><clause id="id826d80990eda43c588268d7c6face1cb"><enum>(i)</enum><text>the loan recipient—</text><subclause id="id823b307c4997466a921941a8a4be56ae"><enum>(I)</enum><text>has a reasonable prospect of repaying the principal and interest on the loan;</text></subclause><subclause id="id472322679aa840019f065c80247e9abb"><enum>(II)</enum><text>will provide sufficient information to the Secretary for the Secretary to ensure that the loan proceeds are expended efficiently and effectively; and</text></subclause><subclause id="id559ffca5da5b4d1297f304b42de949ce"><enum>(III)</enum><text>has met such other criteria as may be established and published by the Secretary; and</text></subclause></clause><clause id="id4b030dfe01cb417fafba58339f8913e1"><enum>(ii)</enum><text>the amount of the loan (when combined with amounts available to the loan recipient from other sources) will be sufficient to carry out the eligible project for which the loan is provided.</text></clause></subparagraph><subparagraph id="idc4758138040d433d9430dd40a47cab6f"><enum>(B)</enum><header>Reasonable prospect of repayment</header><text>The Secretary shall base a determination of whether there is a reasonable prospect of repayment of the principal and interest on a loan under subparagraph (A)(i)(I) on a comprehensive evaluation of whether the loan recipient has a reasonable prospect of repaying the principal and interest, including, as applicable, an evaluation of—</text><clause id="idc7aa44767c514740a98dccc45a4b9785"><enum>(i)</enum><text>the strength of the contractual terms of the applicable eligible project (if commercially reasonably available);</text></clause><clause id="id9568ffdb1fc24ffe897b738195b47542"><enum>(ii)</enum><text>the forecast of noncontractual cash flows supported by market projections from reputable sources, as determined by the Secretary;</text></clause><clause id="id1f4cefc3549145a689a3edf02df98068"><enum>(iii)</enum><text>cash sweeps and other structure enhancements;</text></clause><clause id="id70141c658f1348059d02c722b381f2bb"><enum>(iv)</enum><text>the projected financial strength of the loan recipient—</text><subclause id="id3b2d0e60800c4d5fa56d3923e275f485"><enum>(I)</enum><text>at the time of loan close; and</text></subclause><subclause id="id9aa16bbb503a49658b1cbf7bfce0b61e"><enum>(II)</enum><text>throughout the loan term after the applicable eligible project is completed;</text></subclause></clause><clause id="idb7ffa5c3186c4ebfa878b655c28ce3b5"><enum>(v)</enum><text>the financial strength of the investors and strategic partners of the loan recipient, if applicable; and</text></clause><clause id="id7b408358f7844592b18165c2faa91a1a"><enum>(vi)</enum><text>other financial metrics and analyses that are relied on by the private lending community and nationally recognized credit rating agencies, as determined to be appropriate by the Secretary.</text></clause></subparagraph></paragraph><paragraph id="idef8a96eaecf74929bd48f1f0387f47e7"><enum>(4)</enum><header>Rates, terms, and repayment of loans</header><text>A loan provided under this subsection—</text><subparagraph id="id22103baaeef84ee29d5f41f0c695bb01"><enum>(A)</enum><text>shall have an interest rate that, as of the date on which the loan is provided, is equal to the cost of funds to the Department of the Treasury for obligations of comparable maturity;</text></subparagraph><subparagraph id="id13fdab80858c4de9825a255c46c2b9b6"><enum>(B)</enum><text>shall have a term equal to the lesser of—</text><clause id="id9f2f6fa2cf37418ba1351e38fa3b7062"><enum>(i)</enum><text>the projected life, in years, of the eligible project to be carried out using proceeds from the loan, as determined by the Secretary; and</text></clause><clause id="id6d23159cab424ff7bb00945b73b3d0fa"><enum>(ii)</enum><text>20 years;</text></clause></subparagraph><subparagraph id="id7a9e8ee6821547f48b95ebf776af3518"><enum>(C)</enum><text>may be subject to a deferral in repayment for not more than 5 years after the date on which the eligible project carried out using proceeds from the loan first begins operations, as determined by the Secretary;</text></subparagraph><subparagraph id="id1e4c48e79fdf4e618a24858d223656ef"><enum>(D)</enum><text>shall be made by the Federal Financing Bank; and</text></subparagraph><subparagraph id="idc23a6dba55fc43c9a9e801a0570e001c"><enum>(E)</enum><text>shall be subject to the condition that the loan is not subordinate to other financing.</text></subparagraph></paragraph><paragraph id="idCBC26876A285478F908ABCC479626D13"><enum>(5)</enum><header>Conflicts of interest</header><text>For each loan provided under this subsection, the Secretary shall certify that political influence did not affect the provision of the loan, including—</text><subparagraph id="id1DE07604FD7D437E8BB027FDBACDFFAC"><enum>(A)</enum><text>selection of the eligible project for which the loan was provided; and</text></subparagraph><subparagraph commented="no" id="id1D7080A9DF9E49E9BC2085C03D74015E"><enum>(B)</enum><text>selection of the loan recipient.</text></subparagraph></paragraph><paragraph id="idD9B6479865E54F3FA1CE08BE1743E672"><enum>(6)</enum><header>Administrative fee</header><text>The Secretary may charge a fee for the administrative and closing costs of a loan provided under this subsection, subject to the condition that the fee does not exceed the lesser of—</text><subparagraph id="id48F57EC3E7A7416E9267706D363B236C"><enum>(A)</enum><text>$100,000; and</text></subparagraph><subparagraph id="idCDCE59A5950B43139447BC9F5631A456"><enum>(B)</enum><text>10 basis points of the principal amount of the loan.</text></subparagraph></paragraph></subsection><subsection id="id551BC266FF2145338F42FC8602D5A7D4"><enum>(c)</enum><header>Improvement</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary shall promulgate an interim final rule establishing regulations that the Secretary determines to be necessary to administer this section and any loans provided by the Secretary under subsection (b).</text></subsection><subsection id="id7F983A39173441BFB1E7A01308084B08"><enum>(d)</enum><header>Priority</header><paragraph id="id56A2024CA1214CFD9C7A7C396D867E5D"><enum>(1)</enum><header>In general</header><text>In providing loans under this section to manufacturers (including component suppliers) that have existing facilities, the Secretary shall give priority to manufacturers that are seeking to expand manufacturing output through—</text><subparagraph id="id91ACAE4C593546418F5F781E1BC274DD"><enum>(A)</enum><text>the establishment of 1 or more new facilities; or</text></subparagraph><subparagraph id="id232964F9EEDD4397B25164EE299F1165"><enum>(B)</enum><text>the reopening of 1 or more facilities.</text></subparagraph></paragraph><paragraph id="idD0BD5FD762DA43C197FE807F8A5D0B55"><enum>(2)</enum><header>Idle facilities</header><text>A facility described in subparagraph (A) or (B) of paragraph (1) may be sitting idle as of the date on which the applicable loan is provided under this section.</text></paragraph></subsection><subsection id="id890069cacdea4d7b8eaf1b15c56e36e8"><enum>(e)</enum><header>Set aside for small energy grid product manufacturers and component suppliers</header><paragraph id="id7d78e32637c948e098b62d034653c6da"><enum>(1)</enum><header>Definition of covered firm</header><text>In this subsection, the term <term>covered firm</term> means a firm that—</text><subparagraph id="id6c40b6779e464e4ea5b570e8965cbfbe"><enum>(A)</enum><text>employs fewer than 500 individuals; and</text></subparagraph><subparagraph id="id151697f39cae4f78adbe8d01e66f56df"><enum>(B)</enum><text>manufactures energy grid products or components.</text></subparagraph></paragraph><paragraph id="idcda81cfcf9c74a0cbdff31fece744695"><enum>(2)</enum><header>Set aside</header><text>Of the amounts used to provide loans each fiscal year under subsection (b), the Secretary shall use not less than 5 percent to provide loans to—</text><subparagraph id="id8D98AC4AFB074F50A41A39710AB68BC7"><enum>(A)</enum><text>covered firms; or </text></subparagraph><subparagraph id="id30AAA6E84C21491C8F3022670E3CE445"><enum>(B)</enum><text>consortia led by covered firms.</text></subparagraph></paragraph></subsection><subsection id="id4115ecabba394d6fb96389e75a1bfb14"><enum>(f)</enum><header>Appointment and pay of personnel</header><paragraph id="idad40f4b0e88e461494dae42eb42c779f"><enum>(1)</enum><header>In general</header><text>The Secretary may use direct hiring authority pursuant to section 3304(a)(3) of title 5, United States Code, to appoint such professional and administrative personnel as the Secretary determines to be necessary to carry out this section and any functions of the Secretary under this section.</text></paragraph><paragraph id="idD6CC8F7B6EE34660A7F116F4D6D65F58"><enum>(2)</enum><header>Rate of pay</header><text>The rate of pay for a person appointed pursuant to paragraph (1) shall not exceed the maximum rate payable for GS–15 of the General Schedule under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5, United States Code.</text></paragraph><paragraph id="idc7e321628c154b62be4340f30ca7e65c"><enum>(3)</enum><header>Consultants</header><text>The Secretary may retain, pursuant to section 1901 of title 41, United States Code, such consultants as the Secretary determines to be necessary to carry out this section and any functions of the Secretary under this section.</text></paragraph></subsection><subsection id="idA0A5A622CB68487CB9786650997F5F43"><enum>(g)</enum><header>Outreach</header><text>In carrying out this section, the Secretary shall—</text><paragraph id="id7d7792d0bdd14c34bd8194e93599cafe"><enum>(1)</enum><text>provide assistance with the completion of applications for loans under this section; and</text></paragraph><paragraph id="id6613b4a23b3e4ed6ae1622033644cc36"><enum>(2)</enum><text>conduct outreach, including through conferences and online programs, to disseminate information about loans under this section to potential applicants.</text></paragraph></subsection><subsection id="id5865E1042E5944D4B515060C1EBE3268"><enum>(h)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this Act, and every 2 years thereafter, the Secretary shall submit to Congress a report on the status of projects supported by a loan under this section, including—</text><paragraph id="id50b33e3bf36a49888124d5e8e5891c05"><enum>(1)</enum><text>a list of projects for which a loan was provided under this section, including, with respect to each project—</text><subparagraph id="id48CED53155084CF3A945A5FBE9594CB0"><enum>(A)</enum><text>the loan amount; and</text></subparagraph><subparagraph id="id8B8640EE7E1349378136D5A97DBCADF8"><enum>(B)</enum><text>the construction status of the project;</text></subparagraph></paragraph><paragraph id="id7eb4fe9ab617464d8434317d1018e384"><enum>(2)</enum><text>the status of the loan repayment for each project, including future repayment projections;</text></paragraph><paragraph id="idc4ea99a0e4a34611b86b7ebde78a765b"><enum>(3)</enum><text>data regarding the number of direct and indirect jobs retained, restored, or created by financed projects;</text></paragraph><paragraph id="idfc3735ad8edd4de1aef510ee23667ef2"><enum>(4)</enum><text>a projection of the number of new projects for which the Secretary expects to provide a loan under this section during the 2-year period beginning on the date of the report, including the projected aggregate loan amount over that 2-year period;</text></paragraph><paragraph id="id1360f62144914d39aa1bba9dc21f1dc4"><enum>(5)</enum><text>an evaluation of ongoing compliance with the assurances and commitments (and the accuracy of any predictions) made by applicants pursuant to paragraphs (2) and (3) of subsection (b);</text></paragraph><paragraph id="id7aafa67bd45e44da96072088ce2e569e"><enum>(6)</enum><text>the total number of applications received by the Secretary each year; and</text></paragraph><paragraph id="id0adac6fbd87543cf84f266711a04d097"><enum>(7)</enum><text>any other metrics that the Secretary determines to be appropriate.</text></paragraph></subsection><subsection id="id142D684EC7A74A42B448B111BA75121F"><enum>(i)</enum><header>Funding</header><paragraph id="id56CAEBEC514C40E69C7CB25572AB2564"><enum>(1)</enum><header>Rescission</header><text>Of the unobligated balance of amounts made available by section 129 of division A of the Consolidated Security, Disaster Assistance, and Continuing Appropriations Act, 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/110/329">Public Law 110–329</external-xref>; 122 Stat. 3578), $2,400,000,000 are rescinded.</text></paragraph><paragraph id="idf339fe1a9fad4d24b94aeb66c410645f"><enum>(2)</enum><header>Direct appropriation</header><text>If sufficient unobligated amounts made available by section 129 of division A of the Consolidated Security, Disaster Assistance, and Continuing Appropriations Act, 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/110/329">Public Law 110–329</external-xref>; 122 Stat. 3578), are available on the date of enactment of this Act to execute the entire rescission described in paragraph (1), on the day after the execution of the entire rescission, there is appropriated to the Secretary, out of amounts in the Treasury not otherwise appropriated, $2,400,000,000 to carry out this section, to remain available until expended.</text></paragraph></subsection></section></legis-body></bill>
