<congress display="yes">118th CONGRESS</congress><session display="yes">1st Session</session><legis-num display="yes">S. 349</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To amend title 5, United States Code, to authorize the appointment of spouses of members of the Armed Forces who are on active duty, disabled, or deceased to positions in which the spouses will work remotely.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section commented="no" display-inline="no-display-inline" section-type="section-one" id="id2aa9162c-94f9-423d-9a01-d4576ebd9156" changed="not-changed"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Military Spouse Employment Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idf3a9c390-e362-46f9-8c9b-263ee66bfcdf" changed="not-changed"><enum>2.</enum><header display-inline="yes-display-inline">Appointment of military spouses</header><text display-inline="no-display-inline">Section 3330d of title 5, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id30c695ad-1ece-40da-b358-01288da8f405"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id198ec974-e2b8-4de6-932b-6bc84a532701"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraph (3) as paragraph (4); </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id32f477a1-2077-4bd5-82bc-46d15dcbcc5d"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting after paragraph (2) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idfb726d3a-34ed-4a8a-b894-54c768834eb5" act-name="" changed="not-changed"><paragraph commented="no" display-inline="no-display-inline" id="id08506841-baa7-4b18-8e5d-1b88a8e8550f"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>remote work</term> refers to a particular type of telework under which an employee is not expected to report to an officially established agency location on a regular and recurring basis.</text></paragraph><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id476D0B3771C1496EBBFA30799763F42F"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCB4ECA76E93A4B1FAC1395B16FA6DDF5" act-name="" changed="not-changed"><paragraph commented="no" display-inline="no-display-inline" id="id3906B61ECB154BF19757CF5533A2E67F"><enum>(5)</enum><text display-inline="yes-display-inline">The term <term>telework</term> has the meaning given the term in section 6501.</text></paragraph><after-quoted-block display="yes">;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb1b64020-1bad-40a1-bd51-08341d651d0c"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9dc95b85-6e70-48c5-8a6b-afc98b7a5044"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id43fd532d-ebad-4451-a738-e77d7e030a7a"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id35ec48b1-6d07-477c-9eee-ffd884cd46ee"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4a795637-dd43-45e7-83db-57e69cbe5ab0" changed="not-changed"><paragraph commented="no" display-inline="no-display-inline" id="ide67d8514-1410-4845-a30b-3d895b31296f"><enum>(3)</enum><text display-inline="yes-display-inline">a spouse of a member of the Armed Forces on active duty, or a spouse of a disabled or deceased member of the Armed Forces, to a position in which the spouse will engage in remote work.</text></paragraph><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id45d9d2f3-172b-467c-80b7-6b33d1e73dcc"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (c)(1), by striking <quote>subsection (a)(3)</quote> and inserting <quote>subsection (a)(4)</quote>.</text></paragraph></section><section id="id9A800D3A3DC5445099BCA64207D8C4BE" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">GAO study and report</header><subsection commented="no" display-inline="no-display-inline" id="id9d83f8060d594acba53a8d5e969096af" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section— </text><paragraph commented="no" display-inline="no-display-inline" id="id04027b691e3c4a3a97f800d5734615c2" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">the terms <term>agency</term> means an agency described in paragraph (1) or (2) of section 901(b) of title 31, United States Code;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf77b428505d64c5da05e01d5ffd52b9b" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>employee</term> means an employee of an agency;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id988f3b5e7df94c469bf8ee5658abecf8" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>remote work</term> means a particular type of telework under which an employee is not expected to report to an officially established agency location on a regular and recurring basis; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idefbf770a7aad4182ac1c8985d4132c57" changed="not-changed"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>telework</term> means a work flexibility arrangement under which an employee performs the duties and responsibilities of such employee’s position, and other authorized activities, from an approved worksite other than the location from which the employee would otherwise work.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id915b9e0a47964ba199545dc1c91d1b3f" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Requirement</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, the Comptroller General of the United States shall conduct a study and publish a report regarding the use of remote work by agencies, which shall include a discussion of what is known regarding—</text><paragraph commented="no" display-inline="no-display-inline" id="id724b1770262e41079ad942c8dbcef6d5" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">the number of employees who are engaging in remote work;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc9194fb37e864470abefe9f4274d7a4c" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">the role of remote work in agency recruitment and retention efforts;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb721f6c8def34c078e56569c7b269db7" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">the geographic location of employees who engage in remote work;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idade6acf2befe491c81786d734d72ef08" changed="not-changed"><enum>(4)</enum><text display-inline="yes-display-inline">the effect that remote work has had on how often employees are reporting to officially established agency locations to perform the duties and responsibilities of the positions of those employees and other authorized activities; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0f1b2be843f94be2b2290f7db33a0bc1" changed="not-changed"><enum>(5)</enum><text display-inline="yes-display-inline">how the use of remote work has affected Federal office space utilization and spending. </text></paragraph></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20230622" chamber="Senate">Passed the Senate June 22, 2023.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
