which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XVIII of the Social Security Act to provide for coverage of peer support services under the Medicare program.</official-title></form><legis-body><section id="HF2C6CFAEAE204EDFA0E5992A6D88B5DA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Effective and Empowering Recovery Services in Medicare Act of 2023</short-title></quote> or the <quote>PEERS Act of 2023</quote>.</text></section><section id="H142815BD8855475FA922D007E7123DD1" display-inline="no-display-inline"><enum>2.</enum><header>Coverage of peer support services under the Medicare program</header><subsection id="H4484C1EADC9D4A38BF910247A838EA29"><enum>(a)</enum><header>Coverage</header><text display-inline="yes-display-inline">Section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>) is amended—</text><paragraph id="H1DEFFBB4E8934A94B1DD1D1C3E6FD21A"><enum>(1)</enum><text>in subsection (s)(2)—</text><subparagraph id="H1C0551DEEA424837A6CE26E3A9ED75A6"><enum>(A)</enum><text>in subparagraph (JJ), by inserting <quote>and</quote> after the semicolon at the end; and</text></subparagraph><subparagraph id="H2F7979C12BE1415E8E03EBB5E26B36F5"><enum>(B)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="H15B8BA0741F149A3A2B805F52BF50750" display-inline="no-display-inline"><subparagraph id="H671CC0AFBA3A42788B6ED7CD9D75395B" indent="up1"><enum>(KK)</enum><text display-inline="yes-display-inline">peer support services (as defined in subsection (nnn)) furnished on or after January 1, 2025;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HB2A95A1601654C719B2824D21B41724E"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9D1CBA6519734CFD90526723A5C3EACA"><subsection id="H8AFCFD44BFBF41E097657A72618712A6" commented="no"><enum>(nnn)</enum><header>Peer support services</header><paragraph commented="no" display-inline="no-display-inline" id="id40be488cb0004333984e4adb65588d7d"><enum>(1)</enum><header>Peer support services</header><text display-inline="yes-display-inline">The term <quote>peer support services</quote> means emotional, informational, instrumental, and affiliational support services—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0d478be20bd04c629f1f1c4212350e3b"><enum>(A)</enum><text display-inline="yes-display-inline">furnished—</text><clause commented="no" display-inline="no-display-inline" id="id18252bd3852f45f9a61ae3ed4bea983b"><enum>(i)</enum><text display-inline="yes-display-inline">by a Federally qualified health center, a rural health clinic, a community mental health center, or a certified community behavioral health clinic (as described in section 223 of the Protecting Access to Medicare Act of 2014), using a peer support specialist; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id44ab7cf256a9416da188e5917f57b5e8"><enum>(ii)</enum><text display-inline="yes-display-inline">to an individual who has been diagnosed with—</text><subclause commented="no" display-inline="no-display-inline" id="id4f9c2f1e934c4e24b21379f3ca72b7ff"><enum>(I)</enum><text display-inline="yes-display-inline">a mental disorder; or </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id91d14fb1c7bd4ac98be68e3fbef4ccbf"><enum>(II)</enum><text display-inline="yes-display-inline">a substance use disorder; and</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id53cee1a166284f10aa5d2f1bcf05a047"><enum>(B)</enum><text display-inline="yes-display-inline">that are designed to assist such individual in achieving recovery, integration in the community, self-empowerment, and self-determination (as specified by the Secretary).</text></subparagraph></paragraph><paragraph id="id9D8019AF53FA42E5AC601B0E30D70348"><enum>(2)</enum><header>Peer support specialist</header><text>The term <term>peer support specialist</term> means an individual who—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7cc24c4300c645e985a55bf35f7c1dd5"><enum>(A)</enum><text>is recovering from a mental health or substance use condition; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf65175a280274962ade456f942dc585e"><enum>(B)</enum><text display-inline="yes-display-inline">is certified as qualified to furnish peer support services under a certification process consistent with the National Practice Guidelines for Peer Supporters and inclusive of the Substance Abuse and Mental Health Services Administration Core Competencies for Peer Workers in Behavioral Health Settings (as established by the State in which such individual furnishes such services or under such certification process determined appropriate by the Secretary of Health and Human Services.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H85EE0731DE284183A04DEDC6D7DD75B8"><enum>(b)</enum><header>Payment</header><paragraph id="HEA97B08FE7354837B934A1E68E0A07E1"><enum>(1)</enum><header>Community mental health centers and certified community behavioral health clinics</header><text>Section 1833(a)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(a)(1)</external-xref>) is amended—</text><subparagraph id="H3DDBA1E85F064839A832D694C8358C5F"><enum>(A)</enum><text>by striking <quote>and</quote> before <quote>(HH)</quote>; and </text></subparagraph><subparagraph id="H086B3B9AFBF242B29C6D099113AB64FE"><enum>(B)</enum><text>by inserting before the semicolon: <quote>, and (II) with respect to peer support services (as defined in section 1861(nnn)) furnished by a community mental health center or a certified community behavioral health clinic, the amount paid shall be an amount equal to 80 percent of the lesser of the actual charge for the services or the amount determined by a fee schedule established by the Secretary for the purposes of this subparagraph</quote>. </text></subparagraph></paragraph><paragraph id="H6CA513740CE24794AC11F17654D2FBDC"><enum>(2)</enum><header>Inclusion as RHC and FQHC services</header><text>Section 1861(aa)(1)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(aa)(1)(B)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7393812241b843d7917194bcef28ebfc"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>or by a mental</quote> and inserting <quote>by a mental</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf9af32d8ca99407db1beecddfcaf843c"><enum>(B)</enum><text>by inserting <quote>or when using a peer support specialist,</quote> after <quote>subsection (ll)(4)),</quote>.</text></subparagraph></paragraph></subsection><subsection id="HDEA75BAAC6AD4D99A75B2F1DC054C6FA" commented="no"><enum>(c)</enum><header>Exclusion modification</header><text>Section 1862(a)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42 U.S.C. 1395y(a)(1)</external-xref>) is amended—</text><paragraph id="H4675355575744709871F722923AEA6DE" commented="no"><enum>(1)</enum><text>in subparagraph (O), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H790405E144614DBC860EAF00944E94C0" commented="no"><enum>(2)</enum><text>in subparagraph (P), by striking the semicolon at the end and inserting <quote>, and</quote>; and</text></paragraph><paragraph id="H8BC2CE2BE6F34AF89089183ED19BCC48" commented="no"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="HBB913CB1109A401889D224343D0A3277" display-inline="no-display-inline"><subparagraph id="HF086E07C37CD4FAA9C9F83B0789DAD0E" indent="up1" commented="no"><enum>(Q)</enum><text display-inline="yes-display-inline">in the case of peer support services (as defined in section 1861(nnn)), which are not furnished by a rural health clinic, a Federally qualified health center, a community mental health center, or a certified community behavioral health clinic;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
