which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To address Federal employees and contractors who commit sexual misconduct.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Compulsory Requirement to Eliminate Employees who are Perpetrators of Sexual misconduct Act of 2023</short-title></quote> or the <quote><short-title>CREEPS Act</short-title></quote>.</text></section><section id="idB76DD2BC0FE84A34A49AE62B5AE3380F"><enum>2.</enum><header>Sexual misconduct by Federal employees and contractors</header><subsection id="id65EB72289B274BD2BAACBEC8A1C6B0F8"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="idF6F0C12ED7CF495B9847810B4949B72F"><enum>(1)</enum><text>the term <term>becomes final</term> means—</text><subparagraph id="idC7F3CBBBC56D49AF94858476B4E0A479"><enum>(A)</enum><text>that—</text><clause id="idB318C489A6DA405E845010909BE4B666"><enum>(i)</enum><text>there is a final agency action; and</text></clause><clause id="id8EE87826F2CA4B04B7F7ABDB6740CA50"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id7503FC21950B4242862799288B2D3E63"><enum>(I)</enum><text>the time for seeking judicial review of the final agency action has lapsed and judicial review has not been sought; or</text></subclause><subclause id="id63D62F8648504DB49E7F375362AB1CDD" indent="up1"><enum>(II)</enum><text>judicial review of the final agency action was sought and final judgment has been entered upholding the agency action; or</text></subclause></clause></subparagraph><subparagraph id="idF0DCE99F5B164D1BAF88D3E7D82B0F6D"><enum>(B)</enum><text>that final judgment has been entered in a civil action;</text></subparagraph></paragraph><paragraph id="id7fcf52f7514a46fabc7c7bf35f322b53"><enum>(2)</enum><text>the term <term>bonus</term>—</text><subparagraph id="id0F903769D582430CBC4367A1D79D5484"><enum>(A)</enum><text>means any bonus or cash award; and</text></subparagraph><subparagraph id="idDC9B94044BAF4484854B48E031B3324F"><enum>(B)</enum><text>with respect to a Federal employee, includes—</text><clause id="id6fe30cbdceee47a7b730373d0baaaef3"><enum>(i)</enum><text>an award under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/45">chapter 45</external-xref> of title 5, United States Code;</text></clause><clause id="id7f59e6fdf15c4dd29087e41bf9438f04"><enum>(ii)</enum><text>an award under section 5384 of title 5, United States Code; and</text></clause><clause id="id7cef505edf9848e2ad7126354715875e"><enum>(iii)</enum><text>a retention bonus under section 5754 of title 5, United States Code;</text></clause></subparagraph></paragraph><paragraph id="idDEC31F48D3684F9F870B100540507535"><enum>(3)</enum><text>the term <term>civil service</term> has the meaning given that term in section 2101 of title 5, United States Code;</text></paragraph><paragraph id="id89FF9562EE1842779AEF8D52419551AA"><enum>(4)</enum><text>the term <term>contractor</term> includes a subcontractor, at any tier, of an individual or entity entering into a contract with the Federal Government;</text></paragraph><paragraph id="idABE9E6F457C946D0A918F817DF792688"><enum>(5)</enum><text>the term <term>Federal employee</term> has the meaning given the term <term>employee</term> in section 2105 of title 5, United States Code, without regard to whether the employee is exempted from the application of some or all of such title 5;</text></paragraph><paragraph id="id3024D7EA09154C288AD75A795021D627"><enum>(6)</enum><text>the term <term>sexual assault offense</term> means a criminal offense under Federal law or the law of a State that includes as an element of the offense that the defendant engaged in a nonconsensual sexual act upon another person;</text></paragraph><paragraph id="id8D31E47B7C0D41C3AA52EBBBE536D064"><enum>(7)</enum><text>the term <term>sustained complaint involving sexual assault</term> means an administrative or judicial determination that an employer engaged in an unlawful employment practice under title VII of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e et seq.</external-xref>) which included, as part of the course of conduct constituting the unlawful employment practice, that an employee of the employer engaged in a nonconsensual sexual act upon another person; and</text></paragraph><paragraph id="id5F44B058E34E46CC92596228AFE6AA59"><enum>(8)</enum><text>the term <term>sustained complaint involving sexual misconduct</term>, with respect to an employee, means an administrative or judicial determination that the employee engaged in conduct that involved unwelcome sexual advances, requests for sexual favors, and deliberate or repeated offensive comments or gestures of a sexual nature, if—</text><subparagraph id="id68e98cd67fad478fa5812aa84380cce3"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id1afc9f5d331d4731be82748effa019c2"><enum>(i)</enum><text>submission to the conduct by a person was explicitly a term or condition of the person’s job, pay, or career advancement prospects;</text></clause><clause id="id2336b26d85e640e28442f3a115192b0a" indent="up1"><enum>(ii)</enum><text>submission to or rejection of the conduct by a person was represented to have an impact on the person’s job, pay, or career advancement prospects; or</text></clause><clause id="idd1bbcf8962a5455781a29260d85415f0" indent="up1"><enum>(iii)</enum><text>the conduct had the purpose or effect of creating an intimidating, hostile, or offensive working environment; and</text></clause></subparagraph><subparagraph id="idc2bcb627bd0648f49c7d1aa64ce09624"><enum>(B)</enum><text>the conduct was so severe or pervasive that a reasonable person would perceive the conduct as hostile, offensive, and of a sexual nature.</text></subparagraph></paragraph></subsection><subsection id="id0F775FBC35F6430DAF5BAA2814954869"><enum>(b)</enum><header>Federal employees</header><paragraph id="id33374445919641E591873A9CDC5ED04E"><enum>(1)</enum><header>Criminal convictions</header><text>The head of the agency, office, or other entity employing a Federal employee who is convicted of a sexual assault offense committed while a Federal employee shall, after notice and an opportunity for a hearing, remove the Federal employee from the civil service.</text></paragraph><paragraph commented="no" id="id19404C2C117E408D8636238087E1A47A"><enum>(2)</enum><header>Unlawful employment practices</header><subparagraph commented="no" display-inline="no-display-inline" id="id00bf7f7e8b2e407f9246c2e4510f42a7"><enum>(A)</enum><header display-inline="yes-display-inline">Sexual assault</header><text>During the 5-year period beginning on the date on which a sustained complaint involving sexual assault with respect to an agency, office, or other entity employing Federal employees becomes final, the head of the agency, office, or other entity may not increase the rate of basic pay (including any increase in grade and any within-grade step increase) of a Federal employee who engaged in a nonconsensual sexual act upon another person that was part of the course of conduct constituting the applicable unlawful employment practice, award such a Federal employee a bonus, or promote such a Federal employee.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc9cd0be33b624ac399af5a4eec67cecc"><enum>(B)</enum><header>Sexual misconduct</header><text>During the 5-year period beginning on the date on which a sustained complaint involving sexual misconduct with respect to a Federal employee becomes final, the head of the agency, office, or other entity employing the Federal employee may not increase the rate of basic pay (including any increase in grade and any within-grade step increase) of the Federal employee, award the Federal employee a bonus, or promote the Federal employee.</text></subparagraph></paragraph><paragraph id="id032040D377E34E5A97E44C96EBC73DAB"><enum>(3)</enum><header>Interaction with other laws</header><text>The authority under this subsection is in addition to any authority provided to the head of an agency, office, or other entity employing Federal employees.</text></paragraph></subsection><subsection id="id1E417B22F46941A6AA321283B33B49C3"><enum>(c)</enum><header>Contractors</header><text>Any contract to procure property or services entered into or modified by the Federal Government on or after the date of enactment of this Act shall require that the contractor have in effect policies that provide that—</text><paragraph id="idDBBD6D5045B94205B9CF1CD00C6679AC"><enum>(1)</enum><text>the contractor shall, after notice and an opportunity for a hearing, terminate an employee of the contractor who is convicted of a sexual assault offense committed while an employee of the contractor; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id056BC80FC0F44E55A33711FC1605D20F"><enum>(2)</enum><text display-inline="yes-display-inline">during the 5-year period beginning on the date on which—</text><subparagraph commented="no" display-inline="no-display-inline" id="id19b052530de84c8cafba50fe7ed2d6d6"><enum>(A)</enum><text display-inline="yes-display-inline">a sustained complaint involving sexual assault with respect to the contractor becomes final, the contractor may not increase the rate of basic pay of an employee of the contractor who engaged in a nonconsensual sexual act upon another person that was part of the course of conduct constituting the applicable unlawful employment practice, award such an employee a bonus, or promote such an employee; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id62D5999AAF7E4ED28D5DFB97C2412740"><enum>(B)</enum><text display-inline="yes-display-inline">a sustained complaint involving sexual misconduct with respect to an employee of the contractor becomes final, the contractor may not increase the rate of basic pay of the employee, award the employee a bonus, or promote the employee.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
