which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 40, United States Code, to modify certain requirements for regional commissions, to reauthorize the Southwest Border Regional Commission, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H15974EA8FA634A42BFAE33A61C72BAFD"><section section-type="section-one" id="H7EB44C1C92C8475DBCA2B65EAD14745C"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Southwest Border Regional Commission Reauthorization Act of 2023</short-title></quote>.</text></section><section id="HD153483CB14D4FF591117F4E20A0EC4A"><enum>2.</enum><header>Modifications to regional commissions</header><subsection id="H6F411D56D57B436CB07187E2BC66CB76"><enum>(a)</enum><header>Membership</header><text>Section 15301 of title 40, United States Code, is amended—</text><paragraph id="H018B08AA19C64D00AD1F85563A41F314"><enum>(1)</enum><text>in subsection (b)(2)(C)—</text><subparagraph id="H161EA3288DB84ED1AE0218A6A13D4335"><enum>(A)</enum><text>by striking <quote>An alternate member</quote> and inserting the following:</text><quoted-block style="OLC" id="HF223D31E97774F97967EAFC778EF3E90"><clause id="HA726A633A227425D9FDB5E94E582B729"><enum>(i)</enum><header>In general</header><text>An alternate member</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HBD0415AD7237486CAFE8755891A580D6"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H983DFD4B3E1941278E1E022436E53D2C"><clause id="H9764F8ADA2B44F07AC2D9F90C598816F"><enum>(ii)</enum><header>State alternates</header><text>If the alternate State member is unable to vote in accordance with clause (i), the alternate State member may delegate voting authority to a designee, subject to the condition that the executive director shall be notified, in writing, of the designation not less than 1 week before the applicable vote.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HBA6A4A542A1644F38E4898EF3D69337B"><enum>(2)</enum><text>in subsection (f), by striking <quote>a Federal employee</quote> and inserting <quote>an employee</quote>.</text></paragraph></subsection><subsection id="H87447AB26A4549AD86451E53B6EF9FAE"><enum>(b)</enum><header>Decisions</header><text>Section 15302 of title 40, United States Code, is amended—</text><paragraph id="H6A532BD5408A402985B0924686561D03"><enum>(1)</enum><text>in subsection (a), by inserting <quote>or State alternate members, including designees</quote> after <quote>State members</quote>; and</text></paragraph><paragraph id="H26D1CDC3156748EB90849BC7EBDBDD67"><enum>(2)</enum><text>by striking subsection (c) and inserting the following:</text><quoted-block style="OLC" id="H0F866CBA371F4EA1BBF5A9F83EBF8552"><subsection id="H18EF80247A20490A843B1FAB0E93CDD2"><enum>(c)</enum><header>Quorums</header><paragraph id="H75048A8625F747E8B20DFC9FE38A84AD"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), a Commission shall determine what constitutes a quorum for meetings of the Commission.</text></paragraph><paragraph id="HADE8001F0A8B46118C083416E0385824"><enum>(2)</enum><header>Requirements</header><text>Any quorum for meetings of a Commission shall include—</text><subparagraph id="HAD6F316AC83D41D398857AB6EE2E7129"><enum>(A)</enum><text>the Federal Cochairperson or the alternate Federal Cochairperson; and</text></subparagraph><subparagraph id="HB62FBC654C744B3CB7FB5B4FCA148C7E"><enum>(B)</enum><text>a majority of State members or alternate State members, including designees (exclusive of members representing States delinquent under section 15304(c)(3)(C)).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H6B82DF038D174D5AA30BDDDCC03D66E3"><enum>(c)</enum><header>Meetings</header><text>Section 15305(b) of title 40, United States Code, is amended by striking <quote>with the Federal Cochairperson</quote> and all that follows through the period at the end and inserting the following: </text><quoted-block style="OLC" display-inline="yes-display-inline" id="HF791E45181904452BD893DBB71C327DC"><text>with—</text><paragraph id="H5A8456B0A0954908A9EE81FC6F5EDA93"><enum>(1)</enum><text display-inline="yes-display-inline">the Federal Cochairperson; and</text></paragraph><paragraph id="H63779D9D578E4014B016A654B7078BF8"><enum>(2)</enum><text display-inline="yes-display-inline">at least a majority of the State members or alternate State members, including designees, present in-person or via electronic means.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H8A733D566D7B4E648C4C6E4953218EF1"><enum>3.</enum><header>Transfer of funds from other Federal agencies</header><subsection id="H35068F85CE33467B97F5D19537134798"><enum>(a)</enum><header>In general</header><text>Chapter 153 of subtitle V of title 40, United States Code, is amended—</text><paragraph id="H35CDD71B77BA40C1A40C2B9C7C67E85C"><enum>(1)</enum><text>by redesignating section 15308 as section 15309; and</text></paragraph><paragraph id="H0FAE445EE0DD403EBC3963EA8B4D64FC"><enum>(2)</enum><text>by inserting after section 15307 the following:</text><quoted-block style="USC" id="HFEF1B3D049B344C593A6B4BE67434C26"><section id="H199DAA7E209D4B65A3238C2F882FF4B3"><enum>15308.</enum><header>Transfer of funds from other Federal agencies</header><subsection id="H9D2C2506231541CA8C328EEF0D3D4B1E"><enum>(a)</enum><header>In general</header><text>Subject to subsection (c), for purposes of this subtitle, each Commission may accept transfers of funds from other Federal agencies.</text></subsection><subsection id="H800BA019A2F34715A8D435163442869D"><enum>(b)</enum><header>Transfers</header><text>Any Federal agency authorized to carry out an activity that is within the authority of a Commission may transfer to the Commission any appropriated funds for the activity.</text></subsection><subsection id="H308CB2FE02AD42BD862090C9FDFF9583"><enum>(c)</enum><header>Treatment</header><text>Any funds transferred to a Commission under this section—</text><paragraph id="HA5A8D2CD5FCB47ACA215FA4E7319B1C1"><enum>(1)</enum><text>shall remain available until expended; and</text></paragraph><paragraph id="H960470E01541421393CB41C954C019F2"><enum>(2)</enum><text>may, to the extent necessary to carry out this subtitle, be transferred to, and merged with, the amounts made available by appropriations Acts for the Commission by the Federal Cochairperson.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="H279A4F031C3E4B88B38983EB3A5B7AE7"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for chapter 153 of subtitle V of title 40, United States Code, is amended by striking the item relating to section 15308 and inserting the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H6DA80E8BBB64441796E8DEFC19C5665A"><toc regeneration="no-regeneration"><toc-entry level="section">15308. Transfer of funds from other Federal agencies. </toc-entry><toc-entry level="section">15309. Annual reports.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HF4160F932B6E45B7B48500E508DB2B71"><enum>4.</enum><header>Economic and infrastructure development grants</header><text display-inline="no-display-inline">Section 15501 of title 40, United States Code, is amended—</text><paragraph id="H66E7BBE9550B47BEA51EA5936E2F65EB"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="HFB85721D652B4B548ADABD189045C8A0"><enum>(A)</enum><text>by redesignating paragraphs (4) through (9) as paragraphs (6) through (11), respectively; and</text></subparagraph><subparagraph id="H21EBD6C0A68B4997BD1FD9825053E225"><enum>(B)</enum><text>by inserting after paragraph (3) the following:</text><quoted-block style="OLC" id="HA2B37EEED7674C6983F4CF3AE3E502FF"><paragraph id="H773D4F4A834A42BFAA0B8F4C7C2A0A3C"><enum>(4)</enum><text>to design, build, implement, or upgrade transportation or basic public infrastructure or workforce capacity to support the adaption to and mitigation of climate challenges;</text></paragraph><paragraph id="HD6728CA418C34D2BB09AF10BC62D3612"><enum>(5)</enum><text>to promote the production of housing to meet economic development and workforce needs;</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H739E759109B9464BA74B6A2E0869963C"><enum>(2)</enum><text>in subsection (b), by striking <quote>paragraph (1), (2), (3), or (7)</quote> and inserting <quote>paragraph (1), (2), (3), (4), (5), (7), or (9)</quote>.</text></paragraph></section><section id="H5829FA36632640F3B62904B5DC14BE24"><enum>5.</enum><header>Financial assistance</header><subsection id="HB8153C2D6A9A47C0A4FA2C34C4D4F1E7"><enum>(a)</enum><header>In general</header><text>Chapter 155 of subtitle V of title 40, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="HB3BE1EC704644F7497EE10885E1338B6"><section id="H8F0639F465D641279F5A5CA09E3B7DDF"><enum>15507.</enum><header>Discretionary grants</header><subsection id="HD66D0EAD5C5F4873AA7B1BF93BA715FC"><enum>(a)</enum><header>Grants to which percentage limitation does not apply</header><text>A discretionary grant made by a Commission to implement significant regional initiatives, to take advantage of special development opportunities, or to respond to emergency economic distress in the region of the Commission may be made without regard to the percentage limitations described in section 15501(d).</text></subsection><subsection id="HC8328525343A409A9096803D5283DDB5"><enum>(b)</enum><header>Limitation on aggregate amount</header><text>For each fiscal year, the aggregate amount of discretionary grants provided in accordance with subsection (a) shall not be more than 20 percent of the amount made available to carry out this subtitle for the Commission for the fiscal year. </text></subsection></section><section id="H84F7DD053A8B4112BCDBD98D4217096B"><enum>15508.</enum><header>Payment of non-Federal share for certain Federal grant programs</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, amounts made available to carry out this subtitle shall be available for the payment of a non-Federal share for a project carried out under a Federal grant program if—</text><paragraph commented="no" display-inline="no-display-inline" id="ida1061dc1c9934f0f9403ac574037dc74"><enum>(1)</enum><text display-inline="yes-display-inline">a Commission is not the sole or primary funding source for the project; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc5d835174b364fb79455cb0ea98cb504"><enum>(2)</enum><text display-inline="yes-display-inline">the project is consistent with the purposes of the applicable Commission.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="HF3938A139D6944D8B194E73B51FDAA8D"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for chapter 155 of subtitle V of title 40, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" display-inline="no-display-inline" id="H1273BDE593054B6ABF4EA773B2396F1D"><toc regeneration="no-regeneration"><toc-entry level="section">15507. Discretionary grants.</toc-entry><toc-entry level="section">15508. Definition.</toc-entry><toc-entry level="section" bold="off">15902. State capacity building grant program.</toc-entry><toc-entry level="section" bold="off">15903. Demonstration health projects.</toc-entry><toc-entry level="section" bold="off">15904. Water and wastewater infrastructure projects.</toc-entry></toc><section commented="no" id="HE32A91AC7B2F474B9D071FA9792A469D"><enum>15901.</enum><header>Definition</header><text display-inline="no-display-inline">In this chapter, the term <term>SBRC</term> means the Southwest Border Regional Commission established by section 15301(a)(2).</text></section><section id="HC7E6ED0BC1DB4E7DB195657F599200C0"><enum>15902.</enum><header>State capacity building grant program</header><subsection commented="no" id="HAEB93F57391E49F0829847ACF5F512F3"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" id="H36D074B89BB6460E849ED1525C4BC4CF"><enum>(1)</enum><header>Commission State</header><text>The term <term>Commission State</term> means each of the States of Arizona, California, New Mexico, and Texas.</text></paragraph><paragraph commented="no" id="H9CF1BC72829A4246BEF727B1E5222C5B"><enum>(2)</enum><header>Eligible county</header><text>The term <term>eligible county</term> means a county described in section 15732.</text></paragraph><paragraph commented="no" id="H7AA0CBAF9BE2489B939AD8C9A55245D2"><enum>(3)</enum><header>Program</header><text>The term <term>program</term> means the State capacity building grant program established under subsection (b).</text></paragraph></subsection><subsection id="HB4D865519C5D4FF1A0821359F25111CE"><enum>(b)</enum><header>Establishment</header><text>The SBRC shall establish a State capacity building grant program to provide grants to Commission States for the purposes described in subsection (c).</text></subsection><subsection id="H766E87F483D1462597F0EDA11914EC67"><enum>(c)</enum><header>Purposes</header><text>The purposes of the program are to support the efforts of the SBRC—</text><paragraph id="H9316C4F960654C0F8DCAA6335B8461BD"><enum>(1)</enum><text>to better support business retention and expansion in eligible counties;</text></paragraph><paragraph id="H6E8188C63C2B4988AB528C7C3DFCD3DE"><enum>(2)</enum><text>to create programs to encourage job creation and workforce development in eligible counties;</text></paragraph><paragraph id="H16070E14CFCC4421AF7BE6662E2000F2"><enum>(3)</enum><text>to prepare economic and infrastructure plans for eligible counties;</text></paragraph><paragraph id="H7118C542A1994F249863125F1A842622"><enum>(4)</enum><text>to expand access to high-speed broadband in eligible counties;</text></paragraph><paragraph id="H258F3F1C40B148E29E1D075550F37079"><enum>(5)</enum><text>to provide technical assistance that results in SBRC investments in transportation, water, wastewater, and other critical infrastructure;</text></paragraph><paragraph id="H37AB9A035D0E49888075023163C2202C"><enum>(6)</enum><text>to create initiatives to increase the effectiveness of local development districts in eligible counties;</text></paragraph><paragraph id="HC91324BCA4624DF3A275E71CF1242D39"><enum>(7)</enum><text>to implement new or innovative economic development practices that will better position the eligible counties of Commission States to compete in the global economy; and</text></paragraph><paragraph id="H8BA1351D63CC40ECB8E2FD9CA6A40B26"><enum>(8)</enum><text>to create new capacity building centers within universities in distressed counties (as designated under section 15702(a)(1)) in order to strengthen the capacity to train underrepresented students in professional fields for which there is a shortage of workers and to increase local capacity for project management and execution, financial management, and to leverage funding sources.</text></paragraph></subsection><subsection id="H0E39CFB942B14FA7B15936DBD1DEB888"><enum>(d)</enum><header>Use of funds</header><paragraph commented="no" id="HAFA71246BDDB4A79917215B97C37C7FF"><enum>(1)</enum><header>In general</header><text>Funds from a grant under the program may be used to support a project, program, or related expense of the Commission State in an eligible county.</text></paragraph><paragraph id="H8867727DEDE14B5F91D2C874B3745F87"><enum>(2)</enum><header>Limitation</header><text>Funds from a grant under the program shall not be used for—</text><subparagraph id="H25F28BD44540425B981966F1D6D9361A"><enum>(A)</enum><text>the purchase of furniture, fixtures, or equipment;</text></subparagraph><subparagraph id="H78C5D7BBC3A7483192B73A998346DC5B"><enum>(B)</enum><text>the compensation of—</text><clause id="H031B6D43575240B2A3C098584166E60B"><enum>(i)</enum><text>any State member of the Commission (as described in section 15301(b)(1)(B)); or</text></clause><clause id="H83758182A06D4099863CBB8A9614934B"><enum>(ii)</enum><text>any State alternate member of the Commission (as described in section 15301(b)(2)(B)); or</text></clause></subparagraph><subparagraph id="HB97649532E70498B8BECD1FE2BF97D9D"><enum>(C)</enum><text>the cost of supplanting existing State programs.</text></subparagraph></paragraph></subsection><subsection id="HA8BA879FBAE4419685312DA58166B5BC"><enum>(e)</enum><header>Annual work plan</header><paragraph id="H1370E78378B643DCBF141E3931329E95"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For each fiscal year, before providing a grant under the program, each Commission State shall provide to the SBRC an annual work plan that includes the proposed use of the grant. </text></paragraph><paragraph id="H9EF890C928F1493CBD35FF49714F13F9"><enum>(2)</enum><header>Approval</header><text>No grant under the program shall be provided to a Commission State unless the SBRC has approved the annual work plan of the State.</text></paragraph></subsection><subsection id="HC8818E117D3F4B5D9691FB2A77D5F173"><enum>(f)</enum><header>Amount of grant</header><paragraph id="HAE61104D616F4F4CA2A352C6234FF391"><enum>(1)</enum><header>In general</header><text>The amount of a grant provided to a Commission State under the program for a fiscal year shall be based on the proportion that—</text><subparagraph id="HE851DA04FD8E4F9D9B1D4308B5AA8967"><enum>(A)</enum><text>the amount paid by the Commission State (including any amounts paid on behalf of the Commission State by a nonprofit organization) for administrative expenses for the applicable fiscal year (as determined under section 15304(c)); bears to</text></subparagraph><subparagraph id="H883A4EE2EFA243D8BF519A755395917C"><enum>(B)</enum><text>the amount paid by all Commission States (including any amounts paid on behalf of a Commission State by a nonprofit organization) for administrative expenses for that fiscal year (as determined under that section).</text></subparagraph></paragraph><paragraph id="H7FB512A8B88E424DBD7AFEFAE55BF52D"><enum>(2)</enum><header>Requirement</header><text>To be eligible to receive a grant under the program for a fiscal year, a Commission State (or a nonprofit organization on behalf of the Commission State) shall pay the amount of administrative expenses of the Commission State for the applicable fiscal year (as determined under section 15304(c)).</text></paragraph><paragraph id="HFA76A00FEC97490AB179D4A2E22BAD16"><enum>(3)</enum><header>Approval</header><text>For each fiscal year, a grant provided under the program shall be approved and made available as part of the approval of the annual budget of the SBRC.</text></paragraph></subsection><subsection id="H901F2E496D6A4611829319593C28299B"><enum>(g)</enum><header>Grant availability</header><text>Funds from a grant under the program shall be available only during the fiscal year for which the grant is provided.</text></subsection><subsection id="HFC93DDD0A53747A3BD13FA36BD5B1418"><enum>(h)</enum><header>Report</header><text>Each fiscal year, each Commission State shall submit to the SBRC and make publicly available a report that describes the use of the grant funds and the impact of the program in the Commission State.</text></subsection><subsection commented="no" id="H8C1F25110B0247B9B269FA3185E36319"><enum>(i)</enum><header>Funding</header><paragraph commented="no" id="HE559FECC1B6A4CF198B26843CFE3C237"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to carry out this section $10,000,000 for each of fiscal years 2024 through 2033. </text></paragraph><paragraph commented="no" id="H16E3655580B049BEB5000AB0BEF3C2E1"><enum>(2)</enum><header>Supplement, not supplant</header><text>Funds made available to carry out this section shall supplement and not supplant funds made available for the SBRC and other activities of the SBRC.</text></paragraph></subsection></section><section id="H62EF1AAAFEE9493D900361D7A731619A"><enum>15903.</enum><header>Demonstration health projects</header><subsection id="HCDC80CF771CD47FBB8C55A6F3C64C682"><enum>(a)</enum><header>Purpose</header><text>To demonstrate the value of adequate health facilities and services to the economic development of the region, the SBRC may make grants for the planning, construction, equipment, and operation of demonstration health, nutrition, and child care projects (referred to in this section as a <term>demonstration health project</term>), including hospitals, regional health diagnostic and treatment centers, and other facilities and services necessary for the purposes of this section.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idc0ac2317025b47069f5b97b46f7fbdfd"><enum>(b)</enum><header>Eligible entities</header><text>An entity eligible to receive a grant under this section is—</text><paragraph commented="no" display-inline="no-display-inline" id="id12594ade018c44e785533347632d6c2a"><enum>(1)</enum><text display-inline="yes-display-inline">an entity described in section 15501(a); </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id189a8c9c4cfc41da87c03848b305b170"><enum>(2)</enum><text>an institution of higher education (as defined in section 101(a) of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>));</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9e340bd0caaa46d8a6070b9078fe09ce"><enum>(3)</enum><text>a hospital (as defined in section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>)); and</text></paragraph><paragraph id="id4f8863b0e8e444de9ab39d01a748f139"><enum>(4)</enum><text>a critical access hospital (as defined in that section) that is located not more than 50 miles from an international land border.</text></paragraph></subsection><subsection id="H5E2C372C3C5F4567A72E3285BED21CC6"><enum>(c)</enum><header>Planning grants</header><paragraph id="H71732264B921425CA6DE0E7A722FD207"><enum>(1)</enum><header>In general</header><text>The SBRC may make grants for planning expenses necessary for the development and operation of demonstration health projects for the SBRC region.</text></paragraph><paragraph id="H2AEE4A62E7FF4278999889984FE07DE7"><enum>(2)</enum><header>Maximum SBRC contribution</header><text>The maximum SBRC contribution for a demonstration health project that receives a grant under paragraph (1) shall be made in accordance with section 15501(d).</text></paragraph><paragraph id="H9D727EC42E25448CA726D73B572EC98E"><enum>(3)</enum><header>Sources of assistance</header><text>A grant under paragraph (1) may be provided entirely from amounts made available to carry out this section or in combination with amounts provided under other Federal grant programs.</text></paragraph><paragraph id="HF86CE03DD1544AA1A3E10B5A8C2DED31"><enum>(4)</enum><header>Federal share for grants under other Federal grant programs</header><text>Notwithstanding any provision of law limiting the Federal share in other Federal grant programs, amounts made available to carry out this subsection may be used to increase the Federal share of another Federal grant up to the maximum contribution described in paragraph (2).</text></paragraph></subsection><subsection id="H99D2B6B29FE241EA914F6FA5E6EEEB07"><enum>(d)</enum><header>Construction and equipment grants</header><paragraph id="H38AA813B1E0143B9863F51E5503294A0"><enum>(1)</enum><header>In general</header><text>A grant under this section for construction or equipment of a demonstration health project may be used for—</text><subparagraph id="H72C9DCC3109545C7A885779356C481F0" commented="no"><enum>(A)</enum><text>costs of construction;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ided948ff19c0a4c08b8f170065c277bee"><enum>(B)</enum><text>the acquisition of privately owned facilities—</text><clause id="H4635C8E175F94807A4982D60903F7C6D"><enum>(i)</enum><text>not operated for profit; or</text></clause><clause id="HE682F31975AD40E6A2EB8D90B88E32DA"><enum>(ii)</enum><text>previously operated for profit if the SBRC finds that health services would not otherwise be provided in the area served by the facility if the acquisition is not made; and</text></clause></subparagraph><subparagraph id="H6A50D014AF0E4C31B8D354910BD8F957"><enum>(C)</enum><text>the acquisition of initial equipment.</text></subparagraph></paragraph><paragraph id="HC2200431432E43D49682804A5EB5A7C4"><enum>(2)</enum><header>Standards for making grants</header><text>A grant under paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida96bface365b489e9b00c6241ad4a43c"><enum>(A)</enum><text display-inline="yes-display-inline">shall be approved in accordance with section 15503; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide9f4aa6e57db433fb9b914408a6cdf2f"><enum>(B)</enum><text display-inline="yes-display-inline">shall not be incompatible with the applicable provisions of title VI of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/291">42 U.S.C. 291 et seq.</external-xref>), the Developmental Disabilities Assistance and Bill of Rights Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/15001">42 U.S.C. 15001 et seq.</external-xref>), and other laws authorizing grants for the construction of health-related facilities, without regard to any provisions in those laws relating to appropriation authorization ceilings or to allotments among the States.</text></subparagraph></paragraph><paragraph id="H4321913BD1764B958EC734C4812ABAEB"><enum>(3)</enum><header>Maximum SBRC contribution</header><text>The maximum SBRC contribution for a demonstration health project that receives a grant under paragraph (1) shall be made in accordance with section 15501(d).</text></paragraph><paragraph id="H324C082854D2410E922BC3169F5FADE7"><enum>(4)</enum><header>Sources of assistance</header><text>A grant under paragraph (1) may be provided entirely from amounts made available to carry out this section or in combination with amounts provided under other Federal grant programs.</text></paragraph><paragraph id="HE7AFADE540BC4D819881EC10B947AA28"><enum>(5)</enum><header>Contribution to increased Federal share for other Federal grants</header><text>Notwithstanding any provision of law limiting the Federal share in another Federal grant program for the construction or equipment of a demonstration health project, amounts made available to carry out this subsection may be used to increase Federal grants for component facilities of a demonstration health project to a maximum of 90 percent of the cost of the facilities.</text></paragraph></subsection><subsection id="HAE845EF77B364326970F62B5C7ACD13D"><enum>(e)</enum><header>Operation grants</header><paragraph id="HEFFEA7CE81C147A2881E8796725EF31C"><enum>(1)</enum><header>In general</header><text>A grant under this section for the operation of a demonstration health project may be used for—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5892bf5a69374347a11a9e63b554e375"><enum>(A)</enum><text display-inline="yes-display-inline">the costs of operation of the facility; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcd9aee14a2da4e8eab0013e291d1bcde"><enum>(B)</enum><text>initial operating costs, including the costs of attracting, training, and retaining qualified personnel.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id18196babb1ee47cdb708792ee8309b4f"><enum>(2)</enum><header display-inline="yes-display-inline">Standards for making grants</header><text>A grant for the operation of a demonstration health project shall not be made unless the facility funded by the grant is—</text><subparagraph commented="no" display-inline="no-display-inline" id="id8e66be91980840af93353b62355ff82b"><enum>(A)</enum><text display-inline="yes-display-inline">publicly owned;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id841c82de804045008e210c70c2614bfc"><enum>(B)</enum><text display-inline="yes-display-inline">owned by a public or private nonprofit organization;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id83a66b53edc546b7819abca9745b1ce4"><enum>(C)</enum><text display-inline="yes-display-inline">a private hospital described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of that Code; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbcc801cbd23a4520b03467a966f34549"><enum>(D)</enum><text>a private hospital that provides a certain amount of uncompensated care, as determined by the SBRC, and applies for the grant in partnership with a State, local government, or Indian Tribe.</text></subparagraph></paragraph><paragraph id="HDEDFA425ADDC4A69B1A167F5FA187597"><enum>(3)</enum><header>Maximum SBRC contribution</header><text>The maximum SBRC contribution for a demonstration health project that receives a grant under paragraph (1) shall be made in accordance with section 15501(d).</text></paragraph><paragraph id="H6C988EE8603145E394506654A62CAAEB"><enum>(4)</enum><header>Sources of assistance</header><text>A grant under paragraph (1) may be provided entirely from amounts made available to carry out this section or in combination with amounts provided under other Federal grant programs for the operation of health-related facilities or the provision of health and child development services, including parts A and B of title IV and title XX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>, 621 et seq., 1397 et seq.).</text></paragraph><paragraph id="H5470C49B6C154D34A72E83D537DDDF91"><enum>(5)</enum><header>Federal share</header><text>Notwithstanding any provision of law limiting the Federal share in the other Federal programs described in paragraph (4), amounts made available to carry out this subsection may be used to increase the Federal share of a grant under those programs up to the maximum contribution described in paragraph (3).</text></paragraph></subsection><subsection id="H0D0749BD42C74375B6EAB6332EAAD63A"><enum>(f)</enum><header>Emphasis on programs To address health professional shortages</header><text>To provide for the further development of the human resources of the SBRC region, grants under this section shall give special emphasis to projects and activities to address health professional shortages in the SBRC region, including projects and activities—</text><paragraph id="H2D405C02B93044618040E85C803E98EC"><enum>(1)</enum><text>to increase access to and disseminate information on the availability of treatment programs;</text></paragraph><paragraph id="HFFE77F88BE424BC29AB39524CBF7F6C9"><enum>(2)</enum><text>to strengthen the health professional workforce operating in the SBRC region, including programs to attract and retain relevant health care services, businesses, and staff;</text></paragraph><paragraph id="H28614B3F6D514924878880379E9CD197"><enum>(3)</enum><text>to facilitate the sharing of best practices among States, counties, and other experts in the SBRC region with respect to sustaining and incentivizing healthcare workforce;</text></paragraph><paragraph id="H399EA705FD2A452AB67AA08DFA2C7406"><enum>(4)</enum><text>to enhance health care access and quality of care for residents in the SBRC area, and develop and disseminate models of care that enhance health equity; and</text></paragraph><paragraph id="H0CC36511B85643ADAA7E93C7F41F4106"><enum>(5)</enum><text>to develop relevant infrastructure, including broadband infrastructure that supports the use of telemedicine.</text></paragraph></subsection></section><section id="id61926ba04a894666b9132b885bcb2ef3"><enum>15904.</enum><header>Water and wastewater infrastructure projects</header><subsection id="id310eff2d32c54c7688a08c2e8af38b32"><enum>(a)</enum><header>Purpose</header><text>The SBRC may make grants for—</text><paragraph id="idfd980788e15d4a0db71057bd5c0ac6bd"><enum>(1)</enum><text>the planning, design, construction, and equipment of public water systems (as defined in section 1401 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f</external-xref>)) and wastewater infrastructure (including treatment works (as defined in section 212 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1292">33 U.S.C. 1292</external-xref>))) that provides substantial water supply and other benefits for the SBRC region for—</text><subparagraph id="idc734fcfd36914caa94175512f462b461"><enum>(A)</enum><text>projects and activities described in section 1452(a)(2)(B) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12(a)(2)(B)</external-xref>); and</text></subparagraph><subparagraph id="id7d87d6e9a7fe4b0198dc6af71a4767e4"><enum>(B)</enum><text>projects and activities described in paragraphs (1) and (4) of section 603(c) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(c)</external-xref>), without regard to whether the treatment works is a publicly owned treatment works; and</text></subparagraph></paragraph><paragraph id="id05e4c3d5147f4bf3a18ec27298939db2"><enum>(2)</enum><text>activities described in section 4304(c)(1) of the America’s Water Infrastructure Act of 2018 (42 U.S.C. 300j–19e(c)(1)).</text></paragraph></subsection><subsection id="id3f085ab255f549fa8b3490f8095c85c9"><enum>(b)</enum><header>Eligible entities</header><text>An entity eligible to receive a grant under this section is an entity described in section 15501(a).</text></subsection><subsection id="idd6f37956a7f34bc69469b293ced827c1"><enum>(c)</enum><header>Planning grants</header><paragraph id="idb04f31fd64cb4bcdb19a9bda922170cd"><enum>(1)</enum><header>In general</header><text>The SBRC may make grants for planning expenses necessary for the development and operation of water and wastewater infrastructure projects for the SBRC region.</text></paragraph><paragraph id="id8efd21898dba41f884f27c211d452ef0"><enum>(2)</enum><header>Maximum SBRC contribution</header><text>The maximum SBRC contribution for a project that receives a grant under paragraph (1) shall be determined in accordance with section 15501(d).</text></paragraph><paragraph id="idd976940dd1d748cd8982b71c3740ceb7"><enum>(3)</enum><header>Sources of assistance</header><text>A grant under paragraph (1) may be combined with amounts provided under other Federal grant programs.</text></paragraph><paragraph id="id381d60ab547e4b018847f5280a8eaa7e"><enum>(4)</enum><header>Federal share for grants under other Federal grant programs</header><text>Notwithstanding any provision of law limiting the Federal share in another Federal grant program, amounts made available to carry out this subsection may be used to increase the Federal share of another Federal grant up to the maximum contribution described in paragraph (2).</text></paragraph></subsection><subsection id="id95dabd8529c249248985c9ce63f2df0b"><enum>(d)</enum><header>Construction and equipment grants</header><paragraph id="id99d222f4e2724c878d06b7fb4a99721d"><enum>(1)</enum><header>In general</header><text>A grant under this section for construction or equipment of a water or wastewater infrastructure project may be used for—</text><subparagraph id="idf7f27b8c5d9e4a218abe2504abb1cc2c"><enum>(A)</enum><text>costs of construction;</text></subparagraph><subparagraph id="id2463e3477560454b8cd7c9f120228e4b"><enum>(B)</enum><text>the acquisition of privately owned facilities—</text><clause id="id93e379a40b71453a8728506dd6529a7d"><enum>(i)</enum><text>not operated for profit; or</text></clause><clause id="id24a695567e2443808cceb2e5425318d8"><enum>(ii)</enum><text>previously operated for profit if the SBRC finds that the acquisition would be necessary for the provision of drinking water or clean water in the area served by the facility; and</text></clause></subparagraph><subparagraph id="id1e5bdba3b7474c229daabdcca3a7ec2a"><enum>(C)</enum><text>the acquisition of initial equipment.</text></subparagraph></paragraph><paragraph id="id70a3c3b76c7c4b22b1818ac8c01be40f"><enum>(2)</enum><header>Standards for making grants</header><text>A grant under paragraph (1)—</text><subparagraph id="idac25b7d017a64d51bdb7507756955e71"><enum>(A)</enum><text>shall be approved in accordance with section 15503; and</text></subparagraph><subparagraph id="id54bf60cd43f94cc999d1b1355b7d25f0"><enum>(B)</enum><text>shall not be incompatible with other Federal laws (including regulations), without regard to any provisions in those laws relating to appropriation authorization ceilings or to allotments among the States.</text></subparagraph></paragraph><paragraph id="id7ae00c4544fc4cf7b38b3bc298bd7c59"><enum>(3)</enum><header>Maximum SBRC contribution</header><text>The maximum SBRC contribution for a project that receives a grant under paragraph (1) shall be determined in accordance with section 15501(d).</text></paragraph><paragraph id="id84515ea47515468894afdc6ddb3dd3c8"><enum>(4)</enum><header>Sources of assistance</header><text>A grant under paragraph (1) may be combined with amounts provided under other Federal grant programs.</text></paragraph><paragraph id="id57b8affe4276499a9e99180eddf1d7b5"><enum>(5)</enum><header>Contribution to increased Federal share for other Federal grants</header><text>Notwithstanding any provision of law limiting the Federal share in another Federal grant program for the construction or equipment of a water or wastewater infrastructure project, amounts made available to carry out this subsection may be used to increase the Federal share of another Federal grant for component facilities of a water or wastewater infrastructure project to a maximum of 90 percent of the cost of the facilities.</text></paragraph></subsection><subsection id="ida86c6f1ee0e54b48a0d2b2bf123dc0aa"><enum>(e)</enum><header>Emphasis on programs To address water sector workforce shortages</header><text>To provide for the further development of the human resources of the SBRC region, grants under this section shall give special emphasis to projects and activities to address water sector professional shortages in the SBRC region, including projects and activities—</text><paragraph id="idb863666af6f94c1ca171648193f59784"><enum>(1)</enum><text>to strengthen the water sector workforce operating in the SBRC region, including programs to attract and retain relevant staff; and</text></paragraph><paragraph id="idee208dbe6c2047d7a34c12ccf788426c"><enum>(2)</enum><text>to facilitate the sharing of best practices among States, counties, and other experts in the SBRC region with respect to sustaining and incentivizing the water sector workforce.</text></paragraph></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idE8550680A2984D869D3B8F9B8D105D2F"><enum>(b)</enum><header>Clerical amendment</header><text>The table of chapters for subtitle V of title 40, United States Code, is amended by inserting after the item relating to chapter 157 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE51089309A6C4682ACAE2121095040A9"><toc><multi-column-toc-entry bold="off" level="section"><toc-enum>159. </toc-enum><level-header level="section">Southwest Border Region Capacity Building Programs</level-header><target>15901</target></multi-column-toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H93DAF41B55B143B39B56B9B996402387"><enum>(c)</enum><header>Waiver of matching requirement</header><text display-inline="yes-display-inline">Chapter 155 of subtitle V of title 40, United States Code (as amended by section 5(a)) is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H91136062CFDE4223913A81E964F346DF"><section commented="no" id="H0B82290212DE4BFCA063AC328E9DEDB8"><enum>15509.</enum><header>Waiver of matching requirement for colonias and Indian tribes</header><subsection commented="no" display-inline="no-display-inline" id="id2b06db6aabd443619a4bd27f91e6fa24"><enum>(a)</enum><header>Definition of colonia</header><paragraph commented="no" display-inline="no-display-inline" id="idab9b3a698a5e47a889f3ea24e385f373"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In this section, the term <term>colonia</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="id633e8c19acc9438eb7e65d3e77652bde"><enum>(A)</enum><text display-inline="yes-display-inline">during the period beginning on the date of enactment of this section and ending on the date that is 2 years after the date of enactment of this section, means—</text><clause commented="no" display-inline="no-display-inline" id="idd6e9874f88f244e4bff7287b102e371b"><enum>(i)</enum><text display-inline="yes-display-inline">a colonia (as defined by the Secretary of Agriculture);</text></clause><clause commented="no" display-inline="no-display-inline" id="ida24a038e2c09462c8e5d8942a74faefd"><enum>(ii)</enum><text display-inline="yes-display-inline">a colonia (as defined by the Secretary of Housing and Urban Development); and</text></clause><clause commented="no" display-inline="no-display-inline" id="idfa6b8e1252f34bb9b7827ac6e8fcdd42"><enum>(iii)</enum><text display-inline="yes-display-inline">a colonia (as defined by the applicable State agency); and </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id072d5624904d464d86d53c7b286524f3"><enum>(B)</enum><text>during the period beginning 2 years after the date of enactment of this section, has the meaning given the term by the Southwest Border Regional Commission pursuant to paragraph (2). </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcb8b2a5a180547739e4c453a0b508192"><enum>(2)</enum><header>Unified definition</header><text>Not later than 2 years after the date of enactment of this section, the Southwest Border Regional Commission, in consultation with the Secretary of Agriculture, the Secretary of Housing and Urban Development, and applicable State agencies, shall develop a definition of the term <term>colonia</term>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idfdc8960183fe4049a1bbe547c15bc3ca"><enum>(b)</enum><header display-inline="yes-display-inline">Waiver</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, in the case of assistance provided to an entity described in subsection (c) under this subtitle by the Southwest Border Regional Commission—</text><paragraph commented="no" display-inline="no-display-inline" id="idb849089293a84fcfabe856b52cbe04a0"><enum>(1)</enum><text display-inline="yes-display-inline">the Federal share of the cost of the project carried out with that assistance shall be 100 percent; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0002bd7d66324e0f8089da341d6985db"><enum>(2)</enum><text>the entity shall not be required to provide matching funds for the project.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id45d40464268b4f28bde229a3ada4baed"><enum>(c)</enum><header>Entities described</header><text>An entity referred to in subsection (b) is any of the following:</text><paragraph commented="no" display-inline="no-display-inline" id="id5f968acbbd0e4a688f2725fe917347b9"><enum>(1)</enum><text display-inline="yes-display-inline">A colonia.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8727603da06c4953bb60e6fb928b2d95"><enum>(2)</enum><text display-inline="yes-display-inline">An Indian tribe.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H623C847117694B188FE0E9B984FEF409"><enum>(d)</enum><header>Clerical amendment</header><text>The analysis for chapter 155 of subtitle V of title 40, United States Code (as amended by section 5(b)), is amended by inserting after the item relating to section 15508 the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H14C197E1C0434DB3BAB243A7242EE57A"><toc regeneration="no-regeneration"><toc-entry level="section">15509. Waiver of matching requirement for colonias and Indian tribes.</toc-entry></toc><after-quoted-block>. </after-quoted-block></quoted-block></subsection></section><section id="HFEBB17D9119C46D38593A0FCDB6C95E1"><enum>8.</enum><header>Administrative powers and expenses</header><text display-inline="no-display-inline">Section 15304(a) of title 40, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id27226608b143497998ed0d1dd99d5257"><enum>(1)</enum><text>in paragraph (5), by inserting <quote>, without a requirement for the Commission to reimburse the agency or local government</quote> after <quote>status</quote>; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide236b1bfb0884fbdaac028e26112e769"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (8), by striking <quote>and</quote> at the end;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id765fdc0d9ea043868b21466b23bef41e"><enum>(3)</enum><text>by redesignating paragraph (9) as paragraph (10); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idde0262a672464fc0a66268b9c2f92c72"><enum>(4)</enum><text>by inserting after paragraph (8) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2CE8CD3BACC54D29BCAF1F0F6044F984"><paragraph commented="no" display-inline="no-display-inline" id="id57f4df39e2cc44ca82e215eb6c4edbb7"><enum>(9)</enum><text>in the case of the Southwest Border Regional Commission, enter into and perform such leases (including the lease of office space for any term) as are necessary to carry out Commission duties, including any leases with a department, agency, or instrumentality of the United States, a State (including a political subdivision, agency, or instrumentality of the State), or a person, firm, association, or corporation; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
