which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a grant program to facilitate peer-to-peer mental health support programs for secondary school students, and for other purposes. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Peer-to-Peer Mental Health Support Act</short-title></quote>.</text></section><section id="id21bca701d02642679ca5d987eb865949"><enum>2.</enum><header>Peer-to-peer mental health support grant program</header><subsection id="id9d47eb43a65e4f07a3bc5f5de8a8a45d"><enum>(a)</enum><header>Definitions</header><text>In this Act:</text><paragraph id="idb5aef1d7e63640d39bc0a409d69b3b07"><enum>(1)</enum><header>Assistant Secretary</header><text>The term <term>Assistant Secretary</term> means the Assistant Secretary for Mental Health and Substance Use.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id00e952d034df4282a26ed34b611a4c16"><enum>(2)</enum><header display-inline="yes-display-inline">ESEA terms</header><text>The terms <term>evidence-based</term>, <term>local educational agency</term>, and <term>secondary school</term> have the meanings given those terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph id="idd74697bade0a4cf7b0396fc1b920bf3d"><enum>(3)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="id3311695b6fbb4878a3ace2ddfe053617"><enum>(A)</enum><text>a local educational agency;</text></subparagraph><subparagraph id="idbcddbd6ba7e640a49c7c5ee586a35112"><enum>(B)</enum><text>an Indian Tribe or a Tribal organization (as such terms are defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)) or a Tribal educational agency; and</text></subparagraph><subparagraph id="id1c485fd89d7340ae84ec69078e7007a2"><enum>(C)</enum><text>the Bureau of Indian Education.</text></subparagraph></paragraph><paragraph id="id2f7bc0b8b83443629ac942fae310618c" commented="no"><enum>(4)</enum><header>Peer-to-peer mental health support program</header><text>The term <term>peer-to-peer mental health support program</term> means an evidence-based intervention that trains students to become peer support specialists and provide mental health support to other students.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7c2b651091ef4a2cb9e29c98d97434a0"><enum>(5)</enum><header>School-based mental health services provider</header><text>The term <term>school-based mental health services provider</term> has the meaning given the term in section 4102 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7112">20 U.S.C. 7112</external-xref>).</text></paragraph></subsection><subsection id="id454e94771b6543a1a508a06389db293d"><enum>(b)</enum><header>Grant program</header><paragraph commented="no" display-inline="no-display-inline" id="id4c962a1412994d10bd5ee1bd727f44f7"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Beginning not later than 1 year after the date of the enactment of this Act, the Assistant Secretary, in consultation with the Secretary of Education, as part of the Project AWARE (Advancing Wellness and Resiliency in Education) program of the Substance Abuse and Mental Health Services Administration, or a similar program, shall award grants, on a competitive basis, to eligible entities to carry out evidence-based peer-to-peer mental health support programs for students enrolled in secondary schools.</text></paragraph><paragraph id="id36f436623c9d4794a0225cc39d7569bb"><enum>(2)</enum><header>Sufficient size and scope</header><text>Grants awarded under this section shall be of sufficient size and scope to allow recipients to carry out the activities described in this section.</text></paragraph><paragraph id="idd309e693e85e45faab331d6db1fb504c"><enum>(3)</enum><header>Duration</header><text>A grant awarded under this section shall be for a period of not more than 5 years. </text></paragraph></subsection><subsection id="idfa91a1e4ca4a41a7aac74bfca685732a"><enum>(c)</enum><header>Applications</header><text>To be eligible to receive a grant under this section, an eligible entity shall submit an application to the Assistant Secretary at such time, in such manner, and containing such information as the Assistant Secretary may reasonably require.</text></subsection><subsection id="idbf2662ae98b04a2d9c61b20d3a1bf520"><enum>(d)</enum><header>Use of amounts</header><paragraph commented="no" display-inline="no-display-inline" id="id278e4bf955b943d7997e010c165c3fb8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible entity shall use grant amounts provided under this section only to—</text><subparagraph id="id4bf7cd6d8bf743dd953eb919a2fc17c5"><enum>(A)</enum><text>implement new or operate existing evidence-based peer-to-peer mental health support programs that meet the requirements of paragraph (2) in 1 or more secondary schools served by the eligible entity; or</text></subparagraph><subparagraph id="idfeabb8f61d92454389d128aada6fe5ad"><enum>(B)</enum><text>provide training to students, adult supervisors, and school-based mental health services providers in implementing the evidence-based peer-to-peer mental health support programs that meet the requirements of paragraph (2).</text></subparagraph></paragraph><paragraph id="id0103a4b1e04e49c5b2cc961ae3b1d7d0" commented="no"><enum>(2)</enum><header>Program requirements</header><text>Each peer-to-peer mental health support program funded by a grant under this section shall include, at a minimum, the following components:</text><subparagraph id="ida166461c3aa0496890cdcf12edeafd06" commented="no"><enum>(A)</enum><header>Training</header><text>Peer support specialists and participating school staff overseeing the peer-to-peer mental health support program shall receive training in—</text><clause id="id82e6b22a64d74e8c98ef7e6743894fcd" commented="no"><enum>(i)</enum><text>empathic listening;</text></clause><clause id="ide058fdeaca4b4793bc3bf93402f7767e" commented="no"><enum>(ii)</enum><text>enhancing protective mental health factors;</text></clause><clause id="id2a3a339534b342a681136c3441c064c1" commented="no"><enum>(iii)</enum><text>recognizing and appropriately responding to risk factors and warning signs of mental health challenges, including suicidal ideation and depression; </text></clause><clause id="id6d6e741ac9954620b74135fe657fc46e" commented="no"><enum>(iv)</enum><text>connecting students with professional mental health services and recovery supports, as necessary;</text></clause><clause commented="no" display-inline="no-display-inline" id="id2dbd1232ecf04990a12d7ef118ce0613"><enum>(v)</enum><text>recognizing and appropriately responding to risk factors and warning signs associated with mental health and substance use challenges, including co-occurring challenges; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id1186d972a88c4bbeb796d7fc2ab3489e"><enum>(vi)</enum><text display-inline="yes-display-inline">other areas included in the National Model Standards for Peer Support Certification of the Substance Abuse and Mental Health Services Administration.</text></clause></subparagraph><subparagraph id="id9d8feb7e16604ab2a30f59cf6803fe01" commented="no"><enum>(B)</enum><header>Program oversight</header><text>Each peer-to-peer mental health support program shall—</text><clause commented="no" display-inline="no-display-inline" id="iddc335b0973244ef49760baf0b071a165"><enum>(i)</enum><text display-inline="yes-display-inline">be overseen by a trained and certified youth peer support supervisor; and </text></clause><clause commented="no" display-inline="no-display-inline" id="idd734d93bf5f1433f95976ce6df326b1f"><enum>(ii)</enum><text display-inline="yes-display-inline">receive guidance from a school-based mental health services provider. </text></clause></subparagraph><subparagraph id="idcb654450bfa947598291e4038f5cc727"><enum>(C)</enum><header>FERPA</header><text>Any education record of a student collected or maintained under subsection (d) shall have the protections required for education records under section 444 of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232g">20 U.S.C. 1232g</external-xref>). </text></subparagraph></paragraph></subsection><subsection id="id063f5f8b73804c9e82e7e62493b1e671"><enum>(e)</enum><header>Relationship to other Federal programs</header><text>An eligible entity that receives a grant under this section may combine such grant funds with other Federal funds to support the activities carried out under this section.</text></subsection><subsection id="iddb6e527659f848d9bf4229b2752116de"><enum>(f)</enum><header>Priority; amounts</header><paragraph id="id06d804c054814dbba58e943685262aac"><enum>(1)</enum><header>Priority</header><text>In awarding grants under this section, the Assistant Secretary shall give priority to applications submitted by eligible entities that—</text><subparagraph id="id15bedb516591431db5be521bd95d2336"><enum>(A)</enum><text>propose to use grant amounts to establish new peer-to-peer mental health support programs in a majority of secondary schools served by such eligible entity;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd701c86a5f60490fb27eb7a45bd9275f"><enum>(B)</enum><text display-inline="yes-display-inline">propose to use grant amounts to establish a new peer-to-peer mental health support program in 1 or more secondary schools without such programs;</text></subparagraph><subparagraph id="id76a1bb80a2db4ca88eed0dd2f2b1dc5f"><enum>(C)</enum><text>propose to use grant amounts for peer-to-peer mental health support programs that have a suicide prevention component; or</text></subparagraph><subparagraph id="ide0b3d7f650b047408ceaa281e56ebc70"><enum>(D)</enum><text>are located in areas that have high rates of suicide or have experienced recent traumatic events.</text></subparagraph></paragraph><paragraph id="id00db5f96cb1046f4a7c681d67499910e"><enum>(2)</enum><header>Grant amounts</header><text>A grant awarded to an eligible entity under the Program may not exceed $250,000.</text></paragraph></subsection><subsection id="id7457d472225d483396a19221c73118e3"><enum>(g)</enum><header>Evaluation; report</header><paragraph commented="no" display-inline="no-display-inline" id="id3b84b75304d84470b96ba3b5af01bef3"><enum>(1)</enum><header>Evaluation</header><text display-inline="yes-display-inline">The Assistant Secretary shall carry out an evaluation to measure the efficacy of the program under this section. The evaluation shall measure—</text><subparagraph id="id4b14fbf0c6764988ac779b1d3d84f117"><enum>(A)</enum><text>student participation in the peer-to-peer mental health support program and include a demographic analysis;</text></subparagraph><subparagraph id="id4172c99448344cf0bb487deacc17b7aa"><enum>(B)</enum><text>the efficacy of the training provided to peer support specialists and school staff in increasing their knowledge of protective factors, risk factors, and warning signs of mental health challenges; and</text></subparagraph><subparagraph id="ida90542717a5a485f88a9a8ade90feb01"><enum>(C)</enum><text>the percentage of students participating in the peer-to-peer mental health support program who report improved mental health outcomes or are connected to professional mental health services.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7e5078eb66c642358e6173261ca74374"><enum>(2)</enum><header>Report</header><text>The Assistant Secretary shall prepare and submit a report to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce and the Committee on Education and the Workforce of the House of Representatives containing the results of the evaluation conducted under paragraph (1).</text></paragraph></subsection><subsection id="id7b7932bf1694426caf2f20ebe88b11a3"><enum>(h)</enum><header>Technical assistance</header><text>The Assistant Secretary, in coordination with the Secretary of Education, shall provide technical assistance to eligible entities applying for and receiving grants under this section, which shall include the development and dissemination of best practices for evidence-based peer-to-peer mental health support programs.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id21413df9bc294ceeb1b3de72a0739994"><enum>(i)</enum><header>Rule of construction</header><text>Section 4001 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7101">20 U.S.C. 7101</external-xref>) (not including the exception under subsection (a)(2)(B)(i) of such section) shall apply to an entity receiving a grant under this section in the same manner as such section applies to an entity receiving funding under title IV of such Act.</text></subsection><subsection id="id9fb910c264f645e6b76c09e62d810441" commented="no"><enum>(j)</enum><header>Authorization of appropriations</header><paragraph commented="no" display-inline="no-display-inline" id="idc9c205d079c740d5953032fbd9eeec8f"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out this section $20,000,000 for each of fiscal years from 2024 through 2028. </text></paragraph><paragraph id="id137E9A7F29CF424DB5A1A245B5287BEF"><enum>(2)</enum><header>Reservations</header><text>From the total amount appropriated under paragraph (1) for a fiscal year, the Assistant Secretary shall reserve—</text><subparagraph id="id5854EFC8628A44C8A1D4BA05E5B32537"><enum>(A)</enum><text>not more than 2 percent for awards to eligible entities described in subsection (a)(3)(C);</text></subparagraph><subparagraph id="idB0EFD0E9A603415D8370BB2AE5D063DD"><enum>(B)</enum><text>not less than 2 percent for technical assistance and administration; and</text></subparagraph><subparagraph id="idA5A8EEBA8983492EBE481EA5A9819285" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>not more than 2 percent for evaluation, in accordance with subsection (g). </text></subparagraph></paragraph></subsection></section></legis-body></bill>
