which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend titles XIX and XXI of the Social Security Act to provide mental health and substance use services to incarcerated individuals, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H7DB57381BB854E6A9B845F36496985B0"><section section-type="section-one" id="HA7468158AFBD41F59812C5CD52AA04F3"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rehabilitation and Recovery During Incarceration Act</short-title></quote>.</text></section><section id="H2A3896C73FC24FC6B1976DA748F322D4"><enum>2.</enum><header>Modifying Medicaid and CHIP exclusions relating to incarcerated individuals to allow for provision of mental health and substance use services</header><subsection id="H7067E6D28D1C40298DE6B8E786ED14CA"><enum>(a)</enum><header>Medicaid option</header><paragraph commented="no" display-inline="no-display-inline" id="id21bd1197abaf495c86986f84b72d39c0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1905(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(a)</external-xref>) is amended, in the subdivision (A) following paragraph (31), by inserting <quote>, or, at the option of the State, in the case of an eligible inmate (as defined in paragraph (4) of section 1902(nn)), with respect to mental health and substance use services described in paragraph (5) of such section</quote> before <quote>); or</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf01f3b9932c54e88a665d92ffc38445d"><enum>(2)</enum><header>Eligible inmate and mental health and substance use services defined</header><text>Section 1902(nn) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(nn)</external-xref>) is amended— </text><subparagraph commented="no" display-inline="no-display-inline" id="idce732fade55541caaf32cbeddc5f4825"><enum>(A)</enum><text display-inline="yes-display-inline">in the subsection header, by inserting <quote><header-in-text style="OLC" level="subsection">; Eligible Inmate; Mental Health and Substance Use Services</header-in-text></quote> after <quote><header-in-text style="OLC" level="subsection">Public Institution</header-in-text></quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddf35e41752ea459db0300111e503ad9c"><enum>(B)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1), by striking <quote>and this subsection</quote> and inserting <quote>, this subsection, and the subdivision (A) following the last numbered paragraph of section 1905(a)</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3b8e067e5fcb4afc80da023acd520b3f"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following new paragraphs: </text><quoted-block id="idFBA2B86EC0FC45308188046E9ED252E8" style="OLC" act-name=""><paragraph id="idE8D07B81F5F4483CABB072B4D42F97A6"><enum>(4)</enum><header>Eligible inmate</header><text>The term <term>eligible inmate</term> means an individual of any age who is an inmate of a public institution and who— </text><subparagraph id="H22B5336E992047239AFE9E643BEC701E"><enum>(A)</enum><text>was determined eligible for medical assistance under the State plan immediately before becoming an inmate of such a public institution; or</text></subparagraph><subparagraph id="HE20A9BB28F42468695F7436AFC6EE699"><enum>(B)</enum><text>is determined eligible for such medical assistance while an inmate of a public institution.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida26bf6fe94134fd8875f8c1b2f1f326f"><enum>(5)</enum><header>Mental health and substance use services</header><text display-inline="yes-display-inline">The term <term>mental health and substance use services</term> means such services for the treatment of a mental health condition or substance use disorder as the Secretary shall specify by regulation.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7f30952af46f42d9883a15a03114f507"><enum>(b)</enum><header>CHIP option</header><paragraph commented="no" display-inline="no-display-inline" id="ida0194943994847b2842044182ca2dfdb"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2110(b)(7) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397jj">42 U.S.C. 1397jj(b)(7)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida99ab3800b2e4914ac69e7b0403028e7"><enum>(A)</enum><text>in the paragraph header, by striking <quote><header-in-text style="OLC" level="paragraph">Exception</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="paragraph">Exceptions</header-in-text></quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida4599355be934439bd4b8631742bb624"><enum>(B)</enum><text>by striking <quote>In the case of</quote> and inserting the following:</text><quoted-block id="id8AB7A6995699456DBA675E97C60C495F" style="OLC" act-name=""><subparagraph id="id244A3E96312E426F9CE9870C024B9B8C"><enum>(A)</enum><header>Provision of screening, diagnostic, referral, and case management services pre-release</header><text>In the case of</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id32beb9da69954d24be4fc3eb74bf0eed"><enum>(C)</enum><text>by adding at the end the following new subparagraph: </text><quoted-block id="id6FFF7BDE883941E889EA7616C6FC78A4" style="OLC" act-name=""><subparagraph id="idA689AABF23C44346911074FCE6B20E5F"><enum>(B)</enum><header>Provision of mental health and substance use disorder services while an inmate</header><clause commented="no" display-inline="no-display-inline" id="idf19a6fb4b6be42c5851e405fb386dc1a"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of a child who is an eligible inmate, the child shall not be considered to be described in paragraph (2)(A) with respect to mental health services and substance use disorder services otherwise covered under the State child health plan (or waiver of such plan). </text></clause><clause commented="no" display-inline="no-display-inline" id="idf7ae05809b6d4321a24fe6d4e6cab35d"><enum>(ii)</enum><header>Eligible inmate defined</header><text display-inline="yes-display-inline">For purposes of this subparagraph, the term <term>eligible inmate</term> has the meaning given that term in section 1902(nn)(4), except that such section shall be applied by—</text><subclause commented="no" display-inline="no-display-inline" id="idcec6b48e0ad94692a8ef4af97cb6d1ac"><enum>(I)</enum><text display-inline="yes-display-inline">substituting <quote>child health assistance</quote> for <quote>medical assistance</quote> each place it appears; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idfe2a2e1b131d436395d04b94e8d37be3"><enum>(II)</enum><text display-inline="yes-display-inline">by substituting <quote>State child health plan under title XXI</quote> for <quote>State plan</quote>.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id69ba446ff68d4be1a147d06d0682629e"><enum>(2)</enum><header>Technical amendment</header><subparagraph commented="no" display-inline="no-display-inline" id="id435c46d18a9a4e359f7d6502f1b2fe56"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Section 5122(b) of division FF of the Consolidated Appropriations Act, 2023 (<external-xref legal-doc="public-law" parsable-cite="pl/117/328">Public Law 117–328</external-xref>) is amended by striking paragraph (1).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb74d8cbf946f4944b959da59e3856a51"><enum>(B)</enum><header>Effective date</header><text>The amendment made by this paragraph shall take effect as if included in the enactment of the Consolidated Appropriations Act, 2023 (<external-xref legal-doc="public-law" parsable-cite="pl/117/328">Public Law 117–328</external-xref>).</text></subparagraph></paragraph></subsection><subsection commented="no" id="H6CC8F007421340F4B152ECCC75D02FDF"><enum>(c)</enum><header>Increased Federal match for mental health and substance use disorder services furnished to incarcerated individuals</header><paragraph commented="no" display-inline="no-display-inline" id="ida49e5e5222734c768260c25593cf2d9b"><enum>(1)</enum><header display-inline="yes-display-inline">Medicaid</header><text>Section 1905 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="idDF00D2C9E9114FBAAD982645E5D0ABA9"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (b), by striking <quote>and (ii)</quote> and inserting <quote>(ii), and (jj)</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA26FE583D69E4AAB9535BC686B2937E0"><enum>(B)</enum><text>by adding at the end the following new subsection:</text><quoted-block id="id1671EB95AFE244F7895E2527E9DD64BC" display-inline="no-display-inline" style="OLC" act-name=""><subsection id="id0AED6D6AB4D1421993BC635833DC0AC8"><enum>(jj)</enum><header>Increased FMAP for mental health and substance use services furnished to inmates</header><paragraph commented="no" display-inline="no-display-inline" id="idBE0561C2C5544A5B8EFC3F2A07288CF4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this title except for paragraph (3), the Federal medical assistance percentage for a State, with respect to amounts expended by the State for medical assistance for mental health and substance use disorder services furnished to an eligible inmate (as such terms are defined in section 1902(nn)) shall be equal to 100 percent.</text></paragraph><paragraph id="id64D8A28460BA4B59947AAB710ECA2D76" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Exclusion of expenditures from territorial caps</header><text display-inline="yes-display-inline">Any payment made to a territory for expenditures for medical assistance that are subject to the Federal medical assistance percentage specified under paragraph (1) shall not be taken into account for purposes of applying payment limits under subsections (f) and (g) of section 1108.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf8bf574abb6b4e53a1600f9cc0e47745"><enum>(3)</enum><header>Requirement to reinvest additional funds</header><text display-inline="yes-display-inline">As a condition for the receipt of the increase under paragraph (1) to the Federal medical assistance percentage of a State, the State shall demonstrate to the satisfaction of the Secretary that the State will use the Federal funds attributable to such increase only for the following purposes:</text><subparagraph commented="no" display-inline="no-display-inline" id="idbfe1fcbcf19f4c0b94291688eb6cc752"><enum>(A)</enum><text display-inline="yes-display-inline">To improve health information technology and data sharing between State Medicaid programs, jails and prisons, and community-based providers and support organizations.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8b221830b0ba43e1a7bab9507de32849"><enum>(B)</enum><text display-inline="yes-display-inline">To increase the treatment capacity of community-based providers who are particularly attuned to, and able to serve, the specific needs of individuals who are involved with the justice system or at risk of becoming involved in the justice system.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id80627e097ad94e2a97141337abd2d371"><enum>(C)</enum><text display-inline="yes-display-inline">To expand or enhance community-based reentry services and supports provided by the State to incarcerated and formerly incarcerated individuals, including services and supports designed to meet the health-related social needs of such individuals.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3ad3d27ac72c4d87896961bd3f90e5f0"><enum>(2)</enum><header>CHIP</header><subparagraph commented="no" display-inline="no-display-inline" id="id160035b38b6b4654839dcdc7ed900edf"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2105 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397ee">42 U.S.C. 1397ee</external-xref>) is amended—</text><clause commented="no" display-inline="no-display-inline" id="id76acf417f11c44d295fe9db5bdd664d0"><enum>(i)</enum><text display-inline="yes-display-inline">in subsection (b), by striking <quote>(11)</quote> and inserting <quote>(11), (12), and (13)</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idcfb55ed6bb2a4fb1810e261e1ff81d68"><enum>(ii)</enum><text display-inline="yes-display-inline">in subsection (c), by adding at the end the following new paragraph: </text><quoted-block id="idC97F26CC9E384A0FA6C98999931FB95D" style="OLC" act-name=""><paragraph id="id5E1236AD6F2A494BA43D91E3B63CF74B"><enum>(13)</enum><header>Enhanced payment for coverage of mental health and substance use disorder services</header><subparagraph commented="no" display-inline="no-display-inline" id="ida285f418507c41e292523832a6c22fa4"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding subsection (b) and subject to subparagraph (B), the enhanced FMAP for a State with respect to payments under subsection (a) for expenditures under the State child health plan (or a waiver of such plan) for mental health or substance use disorder services furnished to a targeted low-income child or a targeted low-income pregnant woman who is an eligible inmate (as such term is defined in section 2110(b)(7)(B)(ii)) shall be equal to 100 percent.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1144ab46fbbf4a8e9773ce5e489e6e40"><enum>(B)</enum><header>Requirement to reinvest additional funds</header><text display-inline="yes-display-inline">The requirement described in paragraph (3) of section 1905(jj) shall apply to Federal funds attributable to an increase in the enhanced Federal medical assistance percentage of a State under subparagraph (A) in the same manner as such requirement applies to Federal funds attributable to an increase to the Federal medical assistance percentage of a State under paragraph (1) of such section.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc015e2619bb043ac901fb65685f17fac"><enum>(B)</enum><header>Adjusting State CHIP allotments to account for increased payments for coverage of mental health and substance use services furnished to eligible inmates</header><text> Section 2104(m) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397dd">42 U.S.C. 1397dd(m)</external-xref>) is amended—</text><clause commented="no" display-inline="no-display-inline" id="ida6a285573bd24f1993da607bb8555e95"><enum>(i)</enum><text display-inline="yes-display-inline">in paragraph (2)(B), in the matter preceding clause (i), by striking <quote>and (12)</quote> and inserting <quote>(12), and (13)</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id63d032012b784073994943c03cc6db9a"><enum>(ii)</enum><text>by adding at the end the following new paragraph:</text><quoted-block id="id01A9D688E41D4B7EAD13A181B5B65F0D" style="OLC" act-name=""><paragraph commented="no" display-inline="no-display-inline" id="HF03A4436ABDF40A4B62EE37707D510A9"><enum>(13)</enum><header display-inline="yes-display-inline">Adjusting allotments to account for increased federal payments for coverage of mental health and substance use services for eligible inmates</header><text display-inline="yes-display-inline">If a State, commonwealth, or territory receives payment for a fiscal year under subsection (a) of section 2105 for expenditures that are subject to the enhanced FMAP specified under subsection (c)(13) of such section, the amount of the allotment determined for the State, commonwealth, or territory under this subsection—</text><subparagraph commented="no" display-inline="no-display-inline" id="HEEA7B005386042069375B024FA2DCB9A"><enum>(A)</enum><text>for such fiscal year shall be increased by the projected expenditures for such year by the State, commonwealth, or territory under the State child health plan (or a waiver of such plan) for mental health and substance use disorder services furnished to eligible inmates (as defined in section 2110(b)(7)(B)(ii)(B)); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA0276F9F196E4E21938F840E9E9CED78"><enum>(B)</enum><text>once actual expenditures are available in the subsequent fiscal year, the fiscal year allotment that was adjusted by the amount described in subparagraph (A) shall be adjusted on the basis of the difference between—</text><clause id="H9397481F05F94BFBBF0FBAE552466328" commented="no"><enum>(i)</enum><text>such projected amount of expenditures described in subparagraph (A) for such fiscal year described in such subparagraph by the State, commonwealth, or territory; and</text></clause><clause id="H7EADFFE9E801443F8E2F01C7AB0E2834" commented="no"><enum>(ii)</enum><text>the actual amount of expenditures for such fiscal year described in subparagraph (A) by the State, commonwealth, or territory under the State child health plan (or waiver of such plan) for mental health and substance use disorder services furnished to eligible inmates (as defined in section 2110(b)(7)(B)(ii)(B)).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idae818c58c86e4a319278cdbccd7554c3"><enum>(d)</enum><header display-inline="yes-display-inline">Conforming amendments</header><paragraph commented="no" display-inline="no-display-inline" id="id7ea84529447149488442dec125f1c50f"><enum>(1)</enum><text display-inline="yes-display-inline">Section 1905(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(a)</external-xref>), as amended by subsection (a), is amended, in the matter following paragraph (31), by striking <quote>set forth in the subdivision (B) following paragraph (30) of the first sentence of this subsection</quote> and inserting <quote>set forth in the portion of the first sentence of this subsection that follows the last numbered paragraph of this subsection</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7680684124b34665ba522b61ae3b4ef2"><enum>(2)</enum><text display-inline="yes-display-inline">Section 5122(a)(1) of division FF of the Consolidated Appropriations Act, 2023 (<external-xref legal-doc="public-law" parsable-cite="pl/117/328">Public Law 117–328</external-xref>) is amended by striking <quote>case management</quote> and inserting <quote>targeted case management services</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HC429381643394E9999255D4ADC74F2E2"><enum>(e)</enum><header>Effective date</header><paragraph commented="no" display-inline="no-display-inline" id="id44c4cff3d3914df1a4d1bffe89da4c5d"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), the amendments made by this section shall apply with respect to medical assistance, child health assistance, and pregnancy-related assistance provided on or after January 1, 2023.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide4a6f2a38a2f48c1a0e5992d4b39dbbf"><enum>(2)</enum><header display-inline="yes-display-inline">Effective date of conforming amendment</header><text>The amendment made by paragraph (2) of subsection (d) shall take effect as if included in the enactment of the Consolidated Appropriations Act, 2023 (<external-xref legal-doc="public-law" parsable-cite="pl/117/328">Public Law 117–328</external-xref>).</text></paragraph></subsection></section><section id="H33590C27B2FF40A3826B11ADE26753AB"><enum>3.</enum><header>Report by Comptroller General</header><text display-inline="no-display-inline">Not later than the date that is 5 years after the date of enactment of this Act, the Comptroller General of the United States shall submit to Congress a report containing available information regarding incarcerated individuals that receive medical assistance or child health assistance under a State plan under title XIX or XXI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>, 1397aa et seq.) (as applicable) as a result of a State electing to provide coverage to eligible inmates pursuant to the amendments to such titles made by section 2. The information contained in the report may include information such as the following:</text><paragraph commented="no" display-inline="no-display-inline" id="ide84131c2dd464c9f868173f138368325"><enum>(1)</enum><text>The number of such incarcerated individuals.</text></paragraph><paragraph id="H0C6EAB485EA648D5B5257631255A063B"><enum>(2)</enum><text>The access of such incarcerated individuals to health care services, including specialty care, and health care providers.</text></paragraph><paragraph id="H63E91C4573724F6F8349E00578B3B71A"><enum>(3)</enum><text>The quality of health care services provided to incarcerated individuals.</text></paragraph><paragraph id="HDE3A0B0985DF484A8CC515D85EF03A66"><enum>(4)</enum><text>Any impact of coverage under such a State plan on recidivism.</text></paragraph><paragraph id="HF8134320E7654F2A8279B38BCB6AB478"><enum>(5)</enum><text>The percentage of such incarcerated individuals who, upon release, are—</text><subparagraph id="H9C9C3E7058884E58BD3331759E07AE51"><enum>(A)</enum><text>enrolled under such a State plan;</text></subparagraph><subparagraph id="H6A9D53E0130C487BB31DF8BF561A8FBB"><enum>(B)</enum><text>connected to a provider in their community of mental health, substance use disorder, or primary care services; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ideeacc95617bc46518ba516dc616cdb6d"><enum>(C)</enum><text>receiving medication-assisted treatment for the treatment of a substance use disorder.</text></subparagraph></paragraph><paragraph id="H04D8DF9676B749989A807A207114A2E1"><enum>(6)</enum><text>Any other information the Comptroller General determines necessary regarding the health of incarcerated individuals.</text></paragraph></section></legis-body></bill>
