which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 10, United States Code, to provide for concurrent receipt of veterans’ disability compensation and retired pay for disability retirees with fewer than 20 years of service and a combat-related disability, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HD3D086E6204E4863B93633D331226E9B"><section section-type="section-one" id="idC8DCAFD4ED794A2083490046CACDF713"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Major Richard Star Act</short-title></quote>.</text></section><section id="id062314987C1F454EAD9E085F49023BFA"><enum>2.</enum><header>Eligibility of disability retirees with fewer than 20 years of service and a combat-related disability for concurrent receipt of veterans' disability compensation and retired pay</header><subsection id="HEA83BCEB1A1E41D8B8F1ABFD3D8A5C03"><enum>(a)</enum><header>Concurrent receipt in connection with CSRC</header><text display-inline="yes-display-inline">Section 1413a(b)(3)(B) of title 10, United States Code, is amended by striking <quote>creditable service,</quote> and all that follows and inserting the following: “creditable service—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id14E4521B60C045DA832179A6FC18D3D6"><clause id="id221610CA7B9E448C9FED546D4BC82BF2"><enum>(i)</enum><text display-inline="yes-display-inline">the retired pay of the retiree is not subject to reduction under sections 5304 and 5305 of title 38; and</text></clause><clause id="id5DB33C717C1F40CBB3DD32E37E9C73F9"><enum>(ii)</enum><text>no monthly amount shall be paid the retiree under subsection (a).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idA7575BBCC24F415A9BCF1CC197F03B6D"><enum>(b)</enum><header>Concurrent receipt generally</header><text>Section 1414(b)(2) of title 10, United States Code, is amended by striking <quote>Subsection (a)</quote> and all that follows and inserting the following: “Subsection (a)—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id27B6FE2A2BCD4918B5301B9A896F1AAC"><subparagraph id="id1109085B198D4FA6B8BE5B4D5DEF6CB8"><enum>(A)</enum><text>applies to a member described in paragraph (1) of that subsection who is retired under chapter 61 of this title with less than 20 years of service otherwise creditable under chapter 1405 of this title, or with less than 20 years of service computed under section 12732 of this title, at the time of the member's retirement if the member has a combat-related disability (as that term is defined in section 1413a(e) of this title), except that in the application of subsection (a) to such a member, any reference in that subsection to a qualifying service-connected disability shall be deemed to be a reference to that combat-related disability; but</text></subparagraph><subparagraph id="idA360245DEFE94C87A0D081DD0727153F"><enum>(B)</enum><text>does not apply to any member so retired if the member does not have a combat-related disability.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id49A033C307AA4059B0C376B8247DD824"><enum>(c)</enum><header>Technical and conforming amendments</header><paragraph id="id77339235AC114E029418E50D89958F69"><enum>(1)</enum><header>Amendments reflecting end of concurrent receipt phase-in period</header><text display-inline="yes-display-inline">Section 1414 of title 10, United States Code, is further amended—</text><subparagraph id="id270784952ED643B3BFE80AE6CCA30344"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a)(1)—</text><clause id="id9FC37608BE1349D784A965F7BDB39FD8"><enum>(i)</enum><text>by striking the second sentence; and</text></clause><clause id="id6301CBDA967D4862A92422BC15B9DED3"><enum>(ii)</enum><text>by striking subparagraphs (A) and (B);</text></clause></subparagraph><subparagraph id="id493555FB85A143F8B515E93466580CFE"><enum>(B)</enum><text>by striking subsection (c) and redesignating subsections (d) and (e) as subsections (c) and (d), respectively; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id469B80E9CD054189895604AFF25E5127"><enum>(C)</enum><text>in subsection (d), as redesignated, by striking paragraphs (3) and (4).</text></subparagraph></paragraph><paragraph commented="no" id="H62128DBFCD68401D8D4375CDD75B12A2"><enum>(2)</enum><header>Section heading</header><text display-inline="yes-display-inline">The heading of such section 1414 is amended to read as follows:</text><quoted-block style="USC" id="H6A4913CEBE0D4F6A93C31C03A9B35C1B"><section commented="no" id="H968EE82ED73F4E95B484CA5F128F15C4"><enum>1414.</enum><header>Members eligible for retired pay who are also eligible for veterans’ disability compensation: concurrent receipt</header></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="H2DD2D56663674E9B845C27FE4422909B"><enum>(3)</enum><header>Table of sections</header><text display-inline="yes-display-inline">The table of sections at the beginning of chapter 71 of such title is amended by striking the item relating to section 1414 and inserting the following new item:</text><quoted-block style="OLC" id="HB27F7B8E73A1460B8FC28CC1BF38572B"><toc regeneration="no-regeneration"><toc-entry level="section">1414. Members eligible for retired pay who are also eligible for veterans’ disability compensation: concurrent receipt.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="idEF6F718663F64300AC9D360B3F541423"><enum>(4)</enum><header>Conforming amendment</header><text>Section 1413a(f) of such title is amended by striking <quote>Subsection (d)</quote> and inserting <quote>Subsection (c)</quote>.</text></paragraph></subsection><subsection id="H04834422C2AC43B58DFC872BB4968B8F"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the first day of the first month beginning after the date of the enactment of this Act and shall apply to payments for months beginning on or after that date.</text></subsection></section></legis-body></bill>
