which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Communications Act of 1934 to improve the accessibility of 9–8–8, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HB73A38A4247F4D66BB6A528F718D61BE"><section section-type="section-one" id="HB4AA0BAB90574EB2AFC7D384BF90272F"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Local 9–8–8 Response Act of 2023</short-title></quote>.</text></section><section id="H1A7D402A58AB48F99CBE2DC15D31DBCF"><enum>2.</enum><header>9–8–8 Improvement</header><subsection id="H6C5DE0173CA842E69DF55432B0E11FD0"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H6EDA2A48C284471DB4ADEED68D1947D1"><enum>(1)</enum><header><enum-in-header>9–8–8</enum-in-header></header><text display-inline="yes-display-inline">The term <term>9–8–8</term> means 9–8–8, as designated as the universal telephone number within the United States for the purpose of the national suicide prevention and mental health crisis hotline system under section 251(e)(4) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/251">47 U.S.C. 251(e)(4)</external-xref>).</text></paragraph><paragraph id="H0F09A1344A4441379C83DB925149B2CB"><enum>(2)</enum><header>Commercial mobile service</header><text display-inline="yes-display-inline">The term <term>commercial mobile service</term> has the meaning given the term in section 332(d) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/332">47 U.S.C. 332(d)</external-xref>).</text></paragraph><paragraph id="HAE531B0D969A41F6ACD3A4AB9ECA9D10"><enum>(3)</enum><header>Commission</header><text display-inline="yes-display-inline">The term <term>Commission</term> means the Federal Communications Commission.</text></paragraph><paragraph id="H1E09604F3D2342E38D0AB43B24247E1E" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>Non-service-initialized handset</header><text display-inline="yes-display-inline">The term <term>non-service-initialized handset</term> has the meaning given that term in section 9.10(o)(3)(i) of title 47, Code of Federal Regulations, or any successor regulation.</text></paragraph></subsection><subsection id="H27EB4F88A9D24E808636E6DC9613C8A9"><enum>(b)</enum><header>Proximity-Based routing</header><paragraph id="H489037D164234A0EB92770B0EE5B7C8B"><enum>(1)</enum><header>In general</header><text>The Commission shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9bf30cbf47e44dbbb1ab6b2d607f5477"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 1 year after the date of enactment of this Act, initiate the rulemaking process for regulations to ensure that each phone call and text message made or sent to 9–8–8 is routed to a participating crisis center that is near the geographic area from which the phone call or text message originated; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8843dc5de55b495ea3ec4d3b161c42ac"><enum>(B)</enum><text>not later than 180 days after initiating the rulemaking process under subparagraph (A), issue final regulations.</text></subparagraph></paragraph><paragraph id="H6B00065AB3A4408F8077A06A041C1673"><enum>(2)</enum><header>Privacy protections</header><text display-inline="yes-display-inline">In promulgating regulations under paragraph (1), the Commission shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id50ec2d9ff2da499fb47fe6ee20b5125d"><enum>(A)</enum><text display-inline="yes-display-inline">protect the privacy of individuals who contact 9–8–8 by ensuring that a phone call or text message made or sent to 9–8–8 does not reveal the precise location of the individual who made or sent the phone call, text message, or chat; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7aa320142ef7453d85c81dc79be027d5"><enum>(B)</enum><text>ensure that the geographic location used to route the 9-8-8 call or text message is accurate enough to determine the proper participating crisis center without revealing the precise location of the individual who made or sent the phone call or text message.</text></subparagraph></paragraph></subsection><subsection id="H48AE8EE694384CFBACE207012079887E"><enum>(c)</enum><header>Transmission of all calls and texts</header><paragraph commented="no" display-inline="no-display-inline" id="id5108b0aed7cd4cafa243ab74723db780"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 270 days after the date of enactment of this Act, the Commission shall promulgate regulations to ensure that each provider of commercial mobile service transmits all calls and text messages made or sent to 9–8–8, including a call or text message that originates from a non-service-initialized handset (if the call or text message originates on a phone using a compliant radio frequency protocol of the provider). </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id92490af56d9346d8b8acebad7c1d7e61"><enum>(2)</enum><header>Implementation</header><text>A provider of commercial mobile service shall comply with the regulations promulgated under paragraph (1) not later than 1 year after the date on which the regulations are promulgated.</text></paragraph></subsection><subsection id="HFEF03D524B9C4FE8B2D6F70E8E6C81EE"><enum>(d)</enum><header>Configuration of multi-Line telephone systems for direct dialing</header><paragraph id="HFC63BDE1CE5A48418FEE26B6BA4C3C5D"><enum>(1)</enum><header>In general</header><text>Section 721 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/623">47 U.S.C. 623</external-xref>) is amended—</text><subparagraph id="H589A23B207904C0B99CBE44C89C9D9F7"><enum>(A)</enum><text>in the section heading, by inserting <quote><header-in-text level="section" style="OLC">and 9–8–8</header-in-text></quote> after <quote><header-in-text level="section" style="OLC">9–1–1</header-in-text></quote>;</text></subparagraph><subparagraph id="H9ECD6F1FC6B84B669D7AF7D4E70920BC"><enum>(B)</enum><text>in subsection (a), by inserting <quote>or 9–8–8</quote> after <quote>9–1–1</quote>; and</text></subparagraph><subparagraph id="H6AC81CB086A84A4BB42BE78E26BD707B"><enum>(C)</enum><text display-inline="yes-display-inline">in subsection (b), by inserting <quote>or 9–8–8</quote> after <quote>9–1–1</quote>.</text></subparagraph></paragraph><paragraph id="H261F7CEE160C47FCA5D4B3E63D27DFAA"><enum>(2)</enum><header>Applicability</header><subparagraph id="HB2DCF2F9818D4995A02EA61B2A2400CF"><enum>(A)</enum><header>In general</header><text>The amendments made by paragraph (1) shall apply to actions occurring on and after the date that is 2 years after the date of enactment of this Act.</text></subparagraph><subparagraph id="HBFA51B42A4584069AED75377C574D6F3"><enum>(B)</enum><header>Exception</header><text display-inline="yes-display-inline">The amendment made by paragraph (1)(C) shall not apply to the management or operation of a multi-line telephone system installed before the date that is 2 years after the date of enactment of this Act, if the system is not able to be configured to satisfy the requirements of the amendment, without an improvement to the hardware or software of the system.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
