which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit institutions of higher education, elementary schools, and secondary schools from receiving Federal funds if those schools or institutions have covered relationships with covered persons, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Education from Malign Foreign Influence Act of 2023</short-title></quote>.</text></section><section id="id47AE74DC06434183B7AC06BB4872370C"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="idF4734945E18F41638790A16FE4C00EE1"><enum>(1)</enum><header>Adversarial foreign government</header><text>The term <term>adversarial foreign government</term> means the government of any of the following: </text><subparagraph commented="no" display-inline="no-display-inline" id="id1A35164D5CC14A9192223F991E9D50E7"><enum>(A)</enum><text>The People's Republic of China.</text></subparagraph><subparagraph id="idD92CB715AA884FA3B6DD0EE014450AE9" commented="no"><enum>(B)</enum><text>The Russian Federation.</text></subparagraph><subparagraph id="idE4EC7B065724467D882C08F9615E8445" commented="no"><enum>(C)</enum><text>The Islamic Republic of Iran.</text></subparagraph><subparagraph id="id8DB6310F9D20493FA3B571AC514FB036" commented="no"><enum>(D)</enum><text>The Democratic People's Republic of Korea.</text></subparagraph><subparagraph id="id0BEBCDCB1F6746E2B9BD728D741761A3" commented="no"><enum>(E)</enum><text>The Republic of Cuba. </text></subparagraph><subparagraph id="id707515DF7648459793D5DA85D307479B" commented="no"><enum>(F)</enum><text>The regime of Nicolás Maduro in Venezuela.</text></subparagraph><subparagraph id="id78B6CBDA219F472DA4911196F8F55993" commented="no"><enum>(G)</enum><text>The Syrian Arab Republic.</text></subparagraph><subparagraph id="id0E71EF8CB06A4D03B4AEFDC6A4B374E2" commented="no" display-inline="no-display-inline"><enum>(H)</enum><text>Any other country designated as an adversarial foreign government for purposes of this section by the Secretary of State.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide4da12ae05e84bc6ba7cf5e9a51e09bc"><enum>(2)</enum><header>Confucius Classroom</header><text>The term <term>Confucius classroom</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id01b31ad3bcb14104a27e0e7e5d6c02d1"><enum>(A)</enum><text display-inline="yes-display-inline">an entity that has a relationship with a Confucius Institute and seeks to influence early childhood, elementary, or secondary education in the United States; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id320ca08999484d09af882bc679855824"><enum>(B)</enum><text>any successor or replacement entity, or any other similar entity, intended to influence education in the United States.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id08082043fe424713abcc55852567a5e9"><enum>(3)</enum><header display-inline="yes-display-inline">Confucius Institute</header><text>The term <term>Confucius Institute</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide005bcafc28546d69c88c3209005a4ec"><enum>(A)</enum><text display-inline="yes-display-inline">a cultural institution that is directly or indirectly funded by the Government of the People’s Republic of China and seeks to influence education in the United States; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4d08bed7b4594f6aa3b303d5ce7510cf"><enum>(B)</enum><text display-inline="yes-display-inline">any successor or replacement institution, or any other similar institution, intended to influence education in the United States. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE4BCC2A0D8A54B7298DD9CCCD67C776D"><enum>(4)</enum><header display-inline="yes-display-inline">Covered person</header><text>The term <term>covered person</term> means a foreign person that is any of the following:</text><subparagraph id="id48D4E15DD760471F973CA512560FB49D"><enum>(A)</enum><text>An adversarial foreign government, including any agency of an adversarial foreign government, or an official or agent of an adversarial foreign government.</text></subparagraph><subparagraph id="id7a99f759f41c4e6187ac1a06abae6a53"><enum>(B)</enum><text>A political party of an adversarial foreign government, including the Chinese Communist Party, or an official or member of such a political party, including any members of the Chinese Communist Party.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id135c412380764318bb52923e5677ac3f"><enum>(C)</enum><text display-inline="yes-display-inline">The People’s Liberation Army, the People’s Armed Police, or any other armed entity affiliated with the Chinese Communist Party or the People’s Republic of China.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id411D230613F74F038D7A250BA9A2DA32"><enum>(D)</enum><text>An entity identified by the Secretary of Defense under section 1260H(a) of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/113">10 U.S.C. 113</external-xref> note) as a Chinese military company.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id08F2929FF51E446AB9AC0F53D0599464"><enum>(E)</enum><text display-inline="yes-display-inline">Any Chinese military company identified by the Secretary of Defense pursuant to section 1237(b) of the Strom Thurmond National Defense Authorization Act for Fiscal Year 1999 (<external-xref legal-doc="public-law" parsable-cite="pl/105/261">Public Law 105–261</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA319A92C2F76494F9C1DB779A332018A"><enum>(F)</enum><text display-inline="yes-display-inline">Any entity on the Non-SDN Chinese Military-Industrial Complex Companies List maintained by the Office of Foreign Assets Control of the Department of the Treasury.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id05a7edc47eaf450186df8fdd4f2a46a9"><enum>(G)</enum><text display-inline="yes-display-inline">The government of any country determined by the Secretary of State to have repeatedly provided support for acts of international terrorism, for purposes of—</text><clause id="ide3b08637f0514570adc742f2d0490985"><enum>(i)</enum><text>section 1754(c)(1)(A)(i) of the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4813">50 U.S.C. 4813(c)(1)(A)(i)</external-xref>);</text></clause><clause id="id312f0bd0d11e43ddab92205b06e2446a"><enum>(ii)</enum><text>section 620A of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2371">22 U.S.C. 2371</external-xref>); or</text></clause><clause id="id3244374b4d174fe5b446fd3d0492d7ee"><enum>(iii)</enum><text>section 40(d) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2780">22 U.S.C. 2780(d)</external-xref>).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id552436E16F4A4813B2FA1784E4E9795C"><enum>(H)</enum><text>The Government of the Russian Federation, any entity owned or controlled by that Government, or any entity with respect to which the Secretary of the Treasury has imposed sanctions under Executive Order 13662 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note; relating to blocking property of additional persons contributing to the situation in Ukraine). </text></subparagraph><subparagraph id="idEA61CA4991744934BD61F3C03951ECE0"><enum>(I)</enum><text>Any entity included on any of the following lists maintained by the Department of Commerce:</text><clause id="idA6D42E861A7A40D78CB849A5368F2B92"><enum>(i)</enum><text>The Entity List set forth in Supplement No. 4 to part 744 of the Export Administration Regulations under subchapter C of chapter VII of title 15, Code of Federal Regulations.</text></clause><clause id="idB626D9FC81774A809D7F56C0552C6918"><enum>(ii)</enum><text>The Denied Persons List maintained pursuant to section 764.3(a)(2) of the Export Administration Regulations.</text></clause><clause id="id4EF35828E72C477BBC81960030A3EBB7"><enum>(iii)</enum><text>The Unverified List set forth in Supplement No. 6 to part 744 of the Export Administration Regulations.</text></clause><clause id="id4AB877E816AF48D79EEAADAA42CC51CB"><enum>(iv)</enum><text>The Military End-User List set forth in Supplement No. 7 to part 744 of the Export Administration Regulations.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF46224357B464541899FB2227AA1A049"><enum>(J)</enum><text>Any entity or individual determined to pose a risk to the national security of the United States, the integrity of education in the United States, or students’ freedom of expression in the United States, by—</text><clause commented="no" display-inline="no-display-inline" id="idce3ee74662924728bd3535d7a299158a"><enum>(i)</enum><text display-inline="yes-display-inline">the Secretary of Education; </text></clause><clause commented="no" display-inline="no-display-inline" id="idbb400982d3c64e33a5530d2ce52e29e2"><enum>(ii)</enum><text display-inline="yes-display-inline">the Secretary of Defense; or</text></clause><clause commented="no" display-inline="no-display-inline" id="ide4cf92c160f64948af812dc6ae84fbe2"><enum>(iii)</enum><text>the Secretary of Transportation, the Secretary of the Interior, or the Secretary of Homeland Security, with respect to institutions under the jurisdiction of such Secretaries.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0D6F631C4AFF4545BE687270B8CC9184"><enum>(K)</enum><text>An entity substantively involved in the economic or industrial policies or military-civil fusion strategy of the People's Republic of China, including by—</text><clause commented="no" display-inline="no-display-inline" id="id7423ccadb828460099ca8d65d4d2260b"><enum>(i)</enum><text display-inline="yes-display-inline">accepting funding, performing services, or receiving subsidies, relating to such policies or strategy; or </text></clause><clause commented="no" display-inline="no-display-inline" id="idb7e3143794714e1d9b82aaeb440e60f3"><enum>(ii)</enum><text display-inline="yes-display-inline">having responsibilities for overseeing economic development projects, including the Made in China 2025 industrial strategy or the Belt and Road Initiative of the Government of the People's Republic of China.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id06e58719e94b46f7ba9b9f49c9ebff35"><enum>(L)</enum><text display-inline="yes-display-inline">Any college or university in the People's Republic of China that is determined by the Secretary of Defense to be substantively involved in the implementation of the military-civil fusion strategy, including any such college or university— </text><clause commented="no" display-inline="no-display-inline" id="idf34865442921454bba2d3564a32486b2"><enum>(i)</enum><text display-inline="yes-display-inline">known as the <quote>Seven Sons of National Defense</quote>; </text></clause><clause commented="no" display-inline="no-display-inline" id="idba0d9bff047a44e5a4f637c3a35bfe2f"><enum>(ii)</enum><text display-inline="yes-display-inline">that receives funding from— </text><subclause commented="no" display-inline="no-display-inline" id="id6b1d6f683a054bdf95a84550be163ed2"><enum>(I)</enum><text display-inline="yes-display-inline">the People's Liberation Army; or </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id126f201b987a4265bd22a42e87d1e3d8"><enum>(II)</enum><text display-inline="yes-display-inline">the Equipment Development Department, or the Science and Technology Commission, of the Central Military Commission; </text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id9a80b61310d84e12ac00db9e406f903e"><enum>(iii)</enum><text display-inline="yes-display-inline">involved in military training and education, including any such college or university in partnership with the People's Liberation Army; </text></clause><clause commented="no" display-inline="no-display-inline" id="id36fbccfca4664c47a4178316f7995756"><enum>(iv)</enum><text display-inline="yes-display-inline">that conducts military research or hosts dedicated military initiatives or laboratories, including such a college or university designated under the <quote>double first-class university plan</quote>; </text></clause><clause commented="no" display-inline="no-display-inline" id="id7014220aaa4c4777bacad7d2b9b3bd2b"><enum>(v)</enum><text display-inline="yes-display-inline">that is designated by the State Administration for Science, Technology, and Industry for the National Defense to host <quote>joint construction</quote> programs; </text></clause><clause commented="no" display-inline="no-display-inline" id="id11d6e38d12664079be54aaf0d00368bb"><enum>(vi)</enum><text display-inline="yes-display-inline">that has launched a platform for military-civil fusion or created national defense laboratories; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ide6d1fcf600a84ebcacf6112deeadbf02"><enum>(vii)</enum><text display-inline="yes-display-inline">that conducts research or hosts dedicated initiatives or laboratories for any other related security entity beyond the People’s Liberation Army, including the People’s Armed Police, the Ministry of Public Security, and the Ministry of State Security.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2EA2E51148114A81BCFFC1A4F8ACA35F"><enum>(M)</enum><text display-inline="yes-display-inline">Any privately owned entity in the People's Republic of China that—</text><clause commented="no" display-inline="no-display-inline" id="idc81047dd590544c28c4a25fa5d07a0a3"><enum>(i)</enum><text display-inline="yes-display-inline">has received a military production license from the Government of the People's Republic of China, such as the Weapons and Equipment Research and Production Certificate, the Equipment Manufacturing Unit Qualification, the Weapons and Equipment Quality Management System Certificate, or the Weapons and Equipment Research and Production Unit Classified Qualification Permit; </text></clause><clause commented="no" display-inline="no-display-inline" id="id1eded422911e47eaa2e70c61014c1bfd"><enum>(ii)</enum><text display-inline="yes-display-inline">is otherwise known to have set up mechanisms for engaging in activity in support of military initiatives; </text></clause><clause commented="no" display-inline="no-display-inline" id="id94769e8d9af0481784e62d91819d2a48"><enum>(iii)</enum><text display-inline="yes-display-inline">has a history of subcontracting for the People's Liberation Army or its affiliates; or </text></clause><clause commented="no" display-inline="no-display-inline" id="id81d0abfe9bb24a1e840996a68abf1d96"><enum>(iv)</enum><text display-inline="yes-display-inline">is participating in, or receiving benefits under, a military-civil fusion demonstration base.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id25120186F67F4184ADE892E975FBD826"><enum>(N)</enum><text>An entity owned, directed, operated, controlled, financed, or influenced, directly or indirectly, by an entity or individual described in this paragraph, including a Confucius Institute and a Confucius classroom. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFE60AD7B05284D079F49EB1DF8D32B2B"><enum>(O)</enum><text display-inline="yes-display-inline">An entity or individual that has the ability, through ownership of a majority or a dominant minority of the total outstanding voting interest in an entity, board representation, proxy voting, a special share, contractual arrangements, formal or informal arrangements to act in concert, or other means, to determine, direct, or decide, for an entity described in this paragraph, an important matter.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8BEA1D0CC43F458983861895BC687723"><enum>(P)</enum><text display-inline="yes-display-inline">An entity that owns or controls, or is under common ownership or control with, an entity described in this paragraph.</text></subparagraph></paragraph><paragraph id="id71B263FC388F472287385156847270B6"><enum>(5)</enum><header>Covered relationship</header><text display-inline="yes-display-inline">The term <term>covered relationship</term> means, at an institutional or school level, or with respect to a faculty or staff member employed at the institution or school—</text><subparagraph commented="no" display-inline="no-display-inline" id="idafe847011f6544caa2b187f843d70f37"><enum>(A)</enum><text>with respect to a covered person—</text><clause commented="no" display-inline="no-display-inline" id="id5F9380D24D4B48FCAAB9D79F41372ED3"><enum>(i)</enum><text>the distribution or receipt of a grant, gift, donation, present, award, contribution, scholarship, or loan;</text></clause><clause commented="no" display-inline="no-display-inline" id="idFEC5246D75A14BE0BB3DEEC5F791483B"><enum>(ii)</enum><text>having in place an agreement, including—</text><subclause commented="no" display-inline="no-display-inline" id="id4199e3e104d443e08ec63651041c46bd"><enum>(I)</enum><text display-inline="yes-display-inline">a written statement of mutual interest in an academic or research collaboration;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id2e22ff85a17c4896af078d25ac44cc9e"><enum>(II)</enum><text display-inline="yes-display-inline">a written statement in regard to the selection or admission of students; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idd2331120b4b34f31b848f01f7c165868"><enum>(III)</enum><text display-inline="yes-display-inline">a written statement in regard to the establishment of departments, centers, or research or lecture programs;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id786EA9744BCA4D5882343E54EC8D277A"><enum>(iii)</enum><text>a partnership;</text></clause><clause commented="no" display-inline="no-display-inline" id="id469D0962A2A14B6A90B9A8CF122003C3"><enum>(iv)</enum><text>a collaboration;</text></clause><clause commented="no" display-inline="no-display-inline" id="id167FBD9FFBAE4056A7EADF1DDBB7D4DB"><enum>(v)</enum><text>having in place a contract; or</text></clause><clause commented="no" display-inline="no-display-inline" id="idA41C488C3B56470794701498E31CFBAB"><enum>(vi)</enum><text>at the individual faculty or staff level, employing or being employed by a covered person; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd3eb4f202ca54ebe8850d30cca184369"><enum>(B)</enum><text>with respect to a foreign source that is not a covered person—</text><clause commented="no" display-inline="no-display-inline" id="id1b6313ecd6104ba491ecec054da8869b"><enum>(i)</enum><text display-inline="yes-display-inline">the distribution or receipt of a grant, gift, donation, present, award, or contribution that is equal to or greater than $50,000; </text></clause><clause commented="no" display-inline="no-display-inline" id="id078c9b0267654dbc9d1fdbf05cdf0636"><enum>(ii)</enum><text>a relationship described in clause (ii) through (v) of subparagraph (A); or</text></clause><clause commented="no" display-inline="no-display-inline" id="id38bc13e0056a47a4b98ac3b6c2259dfd"><enum>(iii)</enum><text>at the individual faculty or staff level, employing or being employed by a foreign source.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEF185459DD0049ADB2E42018FB468DA8"><enum>(6)</enum><header>Elementary school</header><text>The term <term>elementary school</term> has the meaning given that term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph id="idf518a0041acd490ebb198b705de9aed6"><enum>(7)</enum><header>Foreign person</header><text>The term <term>foreign person</term> means an individual or entity that is not a United States person. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id128942d171e1495582ee5d62e47b3a0e"><enum>(8)</enum><header>Foreign source</header><text>The term <term>foreign source</term> has the meaning given that term in section 117(h) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1011f">20 U.S.C. 1011f(h)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd82359e9f73b4cc6aaec551bcaa22a4e"><enum>(9)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given that term in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>), and includes a State maritime academy and a Tribal College or University (as such term is defined in section 316 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c</external-xref>)).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1d8aeeacdd504cf789f9e462acbfbe36"><enum>(10)</enum><header>Military-civil fusion strategy</header><text display-inline="yes-display-inline">The term <term>military-civil fusion strategy</term> means the strategy of the Chinese Communist Party aiming to mobilize non-military resources and expertise for military applications, including the development of technology, improvements in logistics, and other uses of such resources and expertise, by the People’s Liberation Army. </text></paragraph><paragraph id="id8FC6C4A625D64ACEB5FA1748170DA680" commented="no" display-inline="no-display-inline"><enum>(11)</enum><header display-inline="yes-display-inline">Secondary school</header><text>The term <term>secondary school</term> has the meaning given that term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>). </text></paragraph><paragraph id="id647e2ae8fade4e9e902ec0beaffc7ffb"><enum>(12)</enum><header>United States person</header><text>The term <term>United States person</term> means—</text><subparagraph id="id908b4e9984574bd18892de7e6039f017"><enum>(A)</enum><text>a United States citizen or an alien lawfully admitted for permanent residence to the United States; or</text></subparagraph><subparagraph id="ida6965d9ccf024af282ae50bc51d33042"><enum>(B)</enum><text>an entity organized under the laws of the United States or of any jurisdiction within the United States. </text></subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="id71475a5007594fc9a33d062af59153f6"><enum>3.</enum><header>Prohibitions relating to higher education</header><subsection commented="no" display-inline="no-display-inline" id="id9699a16bb60f4c309d9ed9068552c9d2"><enum>(a)</enum><header>Prohibition on covered relationships</header><paragraph commented="no" display-inline="no-display-inline" id="ide8f9bfa1b62c423eaf647671a4607489"><enum>(1)</enum><header>In General</header><text display-inline="yes-display-inline">An institution of higher education, including any member of the faculty or staff of an institution of higher education, that receives Federal funds—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2199e8b2dc3a4244a5c7bb8f7139a6ba"><enum>(A)</enum><text display-inline="yes-display-inline">shall not enter into or maintain a covered relationship with a covered person; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id719265574b8d4199a1efc673e804712d"><enum>(B)</enum><text>shall establish and maintain a policy to—</text><clause commented="no" display-inline="no-display-inline" id="id4edc8cff84bb4ee9813c6c425e0fac48"><enum>(i)</enum><text display-inline="yes-display-inline">prohibit faculty and staff of the institution from entering into or maintaining covered relationships with covered persons;</text></clause><clause commented="no" display-inline="no-display-inline" id="id7ba834deadde4ef692eeeca14f16d460"><enum>(ii)</enum><text display-inline="yes-display-inline">require faculty and staff to report to the institution covered relationships with foreign sources; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id120228af16bb41c39be69954ca7444a1"><enum>(iii)</enum><text display-inline="yes-display-inline">provide guidance to faculty and staff to help faculty and staff—</text><subclause commented="no" display-inline="no-display-inline" id="id404d558552ee4a659aad93a72a07c0fc"><enum>(I)</enum><text display-inline="yes-display-inline">take preventative actions regarding covered relationships with covered persons; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id1cae60a1053648e29225d4a8380ff37c"><enum>(II)</enum><text display-inline="yes-display-inline">identify existing covered relationships with covered persons.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida391b68179494ec79690911cac95961c"><enum>(2)</enum><header>Enforcement</header><text display-inline="yes-display-inline">Upon determination, after reasonable notice and opportunity for a hearing, that an institution of higher education has knowingly violated subparagraph (A) of paragraph (1), including by failing to exercise reasonable oversight over its faculty and staff with respect to preventing a violation of subparagraph (A) of paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3004c9646c874f58ac7d06f24654cfc5"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary may suspend or terminate the eligibility status for any or all Federal funding (including funding under the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001 et seq.</external-xref>)) of any otherwise eligible institution, in accordance with procedures specified in such Act as applicable, until the Secretary finds that such practices have been corrected; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3834306931be44b5867120400e8ea13f"><enum>(B)</enum><text>the Secretary may impose a civil penalty upon such institution.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idce21a84caa6b4550ad26d0fcb09eaf69"><enum>(b)</enum><header display-inline="yes-display-inline">Prohibition of ownership, operation, or control</header><paragraph commented="no" display-inline="no-display-inline" id="id1358e9305aeb4b24bbd670ba21988654"><enum>(1)</enum><header>In General</header><text display-inline="yes-display-inline">Subject to paragraph (2), an institution of higher education shall not be eligible to receive Federal funds if that institution is owned, operated, or controlled by a covered person.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddc38a80af091469da81e9306c071b520"><enum>(2)</enum><header>Transition period</header><subparagraph commented="no" display-inline="no-display-inline" id="id36a8b8c9866b4b3391c6a62c9b114278"><enum>(A)</enum><header>Institutions that are noncompliant as of the date of enactment</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, and on a case-by-case basis, the Secretary may allow an institution that is owned, operated, or controlled by a covered person as of the date of enactment of this Act a transition period of not more than 4 years from the date of enactment of this Act, during which time the institution may continue to receive Federal funding.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id567aa25078fc4ba290b65c578e410d47"><enum>(B)</enum><header>Institutions that are noncompliant after the date of enactment</header><text>Notwithstanding any other provision of law, and on a case-by-case basis, the Secretary may allow an institution with respect to which the status of being owned, operated, or controlled by a covered person came into effect after the date of enactment of this Act a transition period of not more than 1 year from the date on which that institution is found to be owned, operated, or controlled by a covered person, during which time the institution may continue to receive Federal funding.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7c9edfdeec774b5992e69b107203ab84"><enum>(3)</enum><header>Identification of noncompliant institutions</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall identify institutions that are owned, operated, or controlled by a covered person and notify such institutions about the prohibition under this subsection.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id267721324c874f34bafb01ccd8506fc2"><enum>(c)</enum><header>Reports by IHEs</header><text>Each institution of higher education shall annually submit a report to each Federal agency from which that institution receives Federal funding, containing information about—</text><paragraph commented="no" display-inline="no-display-inline" id="idf0ee94188e444619863d09a772942997"><enum>(1)</enum><text display-inline="yes-display-inline">the extent to which the institution (including faculty and staff of the institution) has, or has had, covered relationships with covered persons; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5089500d31074270972109083457011c"><enum>(2)</enum><text display-inline="yes-display-inline">the extent to which covered entities have undermined or undermine academic integrity, influence academic and extra-curricular activities, and stifle free speech, at the institution of higher education;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb90dbeae1049424aa7881d80654a0c18"><enum>(3)</enum><text display-inline="yes-display-inline">preventative actions that the institution of higher education took or plans to take regarding covered relationships with covered persons;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbe3939c9a5ad4b9b8f3a6facd92ab8fc"><enum>(4)</enum><text display-inline="yes-display-inline">enforcement actions that the institution of higher education took or plans to take regarding covered relationships with covered persons; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfe7e8edb9d7547a89b55c0264531f5da"><enum>(5)</enum><text>any ways in which the Federal agency could help the institution of higher education—</text><subparagraph commented="no" display-inline="no-display-inline" id="id24b4ce78e1de4ed7bf992224df4a2353"><enum>(A)</enum><text display-inline="yes-display-inline">take preventative actions regarding covered relationships with covered persons; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id48603fbdc84848a1a1b5178c2b211d7e"><enum>(B)</enum><text display-inline="yes-display-inline">identify existing covered relationships with covered persons of which the institution of higher education is not aware.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id14b9cbdc1e244027b0da848c65d6d000"><enum>(d)</enum><header>Report to Congress</header><text>The Secretary of Education, in consultation with every other Federal agency that provides funding to institutions of higher education, shall provide an annual report to Congress that shall include, at minimum—</text><paragraph commented="no" display-inline="no-display-inline" id="ide3f60d381f614295a9e68855c3ad0684"><enum>(1)</enum><text display-inline="yes-display-inline">information about the extent to which institutions of higher education have had or have relationships with foreign sources, particularly covered persons; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4512c4e1572d4e15a76fcaa4bcae24fc"><enum>(2)</enum><text display-inline="yes-display-inline">the extent to which covered persons have undermined or undermine academic integrity, influence academic and extra-curricular activities, and stifle free speech, at institutions of higher education;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id868c314fcc0841bebb4797c54db3dd56"><enum>(3)</enum><text display-inline="yes-display-inline">preventative actions that the Federal agencies took or plan to take regarding covered relationships with covered persons;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb12936ccba6b448f99c0e34d44179f99"><enum>(4)</enum><text display-inline="yes-display-inline">enforcement actions that the Federal agencies took or plan to take regarding covered relationships with covered persons; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddfe431c7ef14430982b93a4bbe0fd87c"><enum>(5)</enum><text>any technical assistance that the Secretary or any other Federal agency has carried out to help institutions of higher education—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4CA33DBC06CF48E9843873CA21C4F838"><enum>(A)</enum><text display-inline="yes-display-inline">take preventative actions regarding covered relationships with covered persons; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5670C54A38FD45EDB25BD0290FCC8AD5"><enum>(B)</enum><text display-inline="yes-display-inline">identify existing covered relationships with covered persons of which the institution of higher education is not aware. </text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id097daf8d234f45829c6828da335c4e95"><enum>4.</enum><header>Prohibitions relating to elementary and secondary education</header><subsection commented="no" display-inline="no-display-inline" id="id3B0728698BC246AABA92101B5E7A3957"><enum>(a)</enum><header>Prohibitions relating to covered relationships with covered persons</header><text>Subpart 2 of part F of title VIII of the Elementary and Secondary Education Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/20/7901">20 U.S.C. 7901</external-xref>) is amended by inserting after section 8549C the following new section: </text><quoted-block id="id5EBDC852C8D1402D84BFAC9E94CF594B" display-inline="no-display-inline" style="OLC"><section commented="no" display-inline="no-display-inline" id="id63431494B36843A69BCF4CABD5A25601"><enum>8549D.</enum><header>Prohibition on covered relationships with covered persons</header><subsection commented="no" display-inline="no-display-inline" id="idCE5AB9FA97F94BC4BBCD98CAE9179166"><enum>(a)</enum><header display-inline="yes-display-inline">In General</header><text display-inline="yes-display-inline">Each State receiving funds under this Act shall, as a condition of receiving administrative funds under this Act—</text><paragraph commented="no" display-inline="no-display-inline" id="id23DC8679E6F44C6B8ABF010A3E1A7BB6"><enum>(1)</enum><text display-inline="yes-display-inline">establish and implement a statewide policy—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1B2A2ACF55DE4370B4CADF7FA7FB574A"><enum>(A)</enum><text display-inline="yes-display-inline">prohibiting elementary schools and secondary schools receiving funds under this Act, and their faculty, teachers, and staff from entering into or maintaining covered relationships with covered persons;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC8CCCEDD87B84EF699931BD671642BB8"><enum>(B)</enum><text display-inline="yes-display-inline">enforcing such prohibition; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFFAF1C56246743D1A42B0B263816C0B9"><enum>(C)</enum><text display-inline="yes-display-inline">helping elementary schools and secondary schools identify current violations of such prohibition, and avoid entering into covered relationships with covered persons;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAA31A091ED7A4A92A2C515F895ABE670"><enum>(2)</enum><text display-inline="yes-display-inline">develop reporting requirements for elementary and secondary schools receiving funds under this Act to enable the State to certify to the Secretary that the State is in compliance with this section, and make such certifications;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id10F1C71513E349BDAB34A7361E99D36C"><enum>(3)</enum><text display-inline="yes-display-inline">provide such data that the Secretary requires, which shall include, at minimum—</text><subparagraph commented="no" display-inline="no-display-inline" id="idE49FEC61A32547C9849DAE033446C921"><enum>(A)</enum><text display-inline="yes-display-inline">the extent to which elementary schools and secondary schools receiving funds under this Act have had or have covered relationships with covered persons; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF0EC6137A727457896AE48172D800370"><enum>(B)</enum><text display-inline="yes-display-inline">the extent to which covered entities have undermined or undermine academic integrity, influence academic and extra-curricular activities, and stifle free speech, at such schools; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB0DE414D0288410AA0B5268A901C598D"><enum>(C)</enum><text display-inline="yes-display-inline">preventative actions that the State took or plans to take regarding the requirements under this section; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD870472A9E424C2FB232530FE367653E"><enum>(D)</enum><text display-inline="yes-display-inline">enforcement actions that the State took or plans to take regarding the requirements under this section.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idDA12F5DA61CE4ED78EAAD67E1291B266"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">The Secretary shall prepare and submit an annual report to Congress on—</text><paragraph commented="no" display-inline="no-display-inline" id="idBA543857A9644BB09B74ADD22CA8E3E0"><enum>(1)</enum><text display-inline="yes-display-inline">the extent of the covered relationships between schools described in this section and covered persons; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id929E3459BD534F2A999E1CA04D8F7D3D"><enum>(2)</enum><text display-inline="yes-display-inline">the extent to which covered entities undermine academic integrity, influence academic and extra-curricular activities, and stifle free speech at such schools; and </text></paragraph><paragraph id="idBC6D107FAFED4F6E9AAFAEC438FD26D2" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">any preventative and enforcement actions the Secretary and the States took or plan to take regarding the requirements of this section.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="iddb71f324ffa645e4a31e7b55fcd39d1f"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section, the terms <term>covered person</term> and <term>covered relationship</term> shall have the meanings given such terms in section 2 of the <short-title>Protecting Education from Malign Foreign Influence Act of 2023</short-title>.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id4741a967e2a141ef841c83431f09284f"><enum>(b)</enum><header>Prohibitions relating to ownership, operation, or control by covered entities</header><paragraph commented="no" display-inline="no-display-inline" id="id51d950f4eedd4aebae92cb1cad2ab342"><enum>(1)</enum><header display-inline="yes-display-inline">In General</header><text>A private elementary school or secondary school shall not be eligible to receive Federal funds if that private elementary school or secondary school is owned, operated, or controlled by a covered person.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf6390eebdcc54826b47ba263f0ebfa85"><enum>(2)</enum><header>Funds under part A of title I</header><text>Section 1117 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6320">20 U.S.C. 6320</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3E3577BDEA0D49F8B903369D1D272D49"><subsection commented="no" display-inline="no-display-inline" id="idaba98795de3446faaad294dc04626f6a"><enum>(f)</enum><header>Ineligibility</header><paragraph commented="no" display-inline="no-display-inline" id="id04c1168899af494d8376f7cc5ae3b066"><enum>(1)</enum><header>In General</header><text display-inline="yes-display-inline">In accordance with section 4(b) of the <short-title>Protecting Education from Malign Foreign Influence Act of 2023</short-title> (including the transition provisions of such section), a private elementary school or secondary school shall not be eligible to receive funds under this section if that private elementary school or secondary school is owned, operated, or controlled by a covered person (as that term is defined in section 2 of the <short-title>Protecting Education from Malign Foreign Influence Act of 2023</short-title>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id45f846548cc84e16843dd83a0d235d86"><enum>(2)</enum><header>Parent notification</header><text display-inline="yes-display-inline">In the case of a school that is ineligible to receive funds, as described in paragraph (1), that school shall notify the parents of students attending the school about such ineligibility not later than 7 days after receiving notice from the Department of Education about such ineligibility.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfbc497a0b8864ee0a15c622299d61125"><enum>(3)</enum><header display-inline="yes-display-inline">Other ESEA Funds</header><text display-inline="yes-display-inline">Subpart 1 of part F of title VIII of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7881">20 U.S.C. 7881 et seq.</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id8C028311173C4EE8BF4C795C59DB286C"><section commented="no" display-inline="no-display-inline" id="idec6d5dbb01ff4a518d59d5c1d14dc6a8"><enum>8507.</enum><header>Prohibition on funding for schools owned, operated, or controlled by a covered person</header><text display-inline="no-display-inline">In accordance with section 4(b) of the <short-title>Protecting Education from Malign Foreign Influence Act of 2023</short-title> (including the transition provisions of such section), a private elementary school or secondary school—</text><paragraph commented="no" display-inline="no-display-inline" id="ide837f0867328418b855e34b920d8ef50"><enum>(1)</enum><text display-inline="yes-display-inline">shall not be eligible to receive funds under this Act (including funds described in section 8501) if that private elementary school or secondary school is owned, operated, or controlled by a covered person (as that term is defined in section 2 of the <short-title>Protecting Education from Malign Foreign Influence Act of 2023</short-title>); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd9b072f2a9b44156a422e401abd792c1"><enum>(2)</enum><text display-inline="yes-display-inline">shall notify parents of students that attend the school about the ineligibility described in paragraph (1) not later than 7 days after receiving notice from the Department of Education about such ineligibility.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8EE5A4EB21674133BD830EC0432C15BA"><enum>(4)</enum><header>Transition period; identification</header><subparagraph commented="no" display-inline="no-display-inline" id="idD6AA6E9A3DEB46968DC4ACC8E0391979"><enum>(A)</enum><header>Schools that are noncompliant as of the date of enactment</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, and on a case-by-case basis, the Secretary may allow a private elementary school or secondary school that is owned, operated, or controlled by a covered person as of the date of enactment of this Act a transition period of not more than 4 years from the date of enactment of this Act, during which time the private elementary school or secondary school may continue to receive Federal funding.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9FC6D70DA31048CFB5CEF9341098F047"><enum>(B)</enum><header>Schools that are noncompliant after the date of enactment</header><text>Notwithstanding any other provision of law, and on a case-by-case basis, the Secretary may allow a private elementary school or secondary school with respect to which the status of being owned, operated, or controlled by a covered person came into effect after the date of enactment of this Act a transition period of not more than 1 year from the date on which that private elementary school or secondary school is found to be owned, operated, or controlled by a covered person, during which time such school may continue to receive Federal funding. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7A4C31CD67664CC4B42D7FDF15E2D036"><enum>(C)</enum><header>Identification of noncompliant institutions</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall identify private elementary schools or secondary schools that are owned, operated, or controlled by a covered person and notify such schools about the prohibition under this subsection.</text></subparagraph></paragraph></subsection></section><section id="ida6af1fa53652473b950c361e285bcc03"><enum>5.</enum><header>Prohibition on Reserve Officers' Training Corps programs at certain educational institutions</header><text display-inline="no-display-inline">The Secretary of a military department may not establish or maintain—</text><paragraph commented="no" display-inline="no-display-inline" id="id74af3ff4b77240fb8d47408cb3940f47"><enum>(1)</enum><text display-inline="yes-display-inline"> a unit of the Junior Reserve Officers' Training Corps under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/102">chapter 102</external-xref> of title 10, United States Code, at a secondary school owned, operated, or controlled by a covered person; or </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddda863c48eca49d284d4d5d2a53005d0"><enum>(2)</enum><text display-inline="yes-display-inline">a unit of the Senior Reserve Officers' Training Corps under chapter 103 of such title at an institution of higher education owned, operated, or controlled by a covered person. </text></paragraph></section><section id="idae817c240a0e44d2a528b0c89b60bb47"><enum>6.</enum><header>Prohibition on Department of Defense Education Activity schools, military service academies, and Bureau of Indian Education schools from entering into or maintaining covered relationships with covered entities</header><subsection commented="no" display-inline="no-display-inline" id="ida50f17c4dd7449d89df696efffe09b2f"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of Defense shall prohibit any school operated by the Department of Defense Education Activity and any military service academy from entering into or maintaining a covered relationship with a covered person.</text></subsection><subsection id="idcd523aea246d4d6398c53b18c31aeefb"><enum>(b)</enum><header>Military service academy defined</header><text>In this section, the term <term>military service academy</term> means the following:</text><paragraph id="ida42718d28cd04421a3774bfeaebe482e"><enum>(1)</enum><text>The United States Military Academy.</text></paragraph><paragraph id="id9c852a38319f4a99aa8f6b211550ef33"><enum>(2)</enum><text>The United States Naval Academy.</text></paragraph><paragraph id="id6f4e824ae0aa42ddab9a579f6d7b89c2"><enum>(3)</enum><text>The United States Air Force Academy. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3e368eb727134a84b8def9e325721c0a"><enum>(4)</enum><text>The United States Merchant Marine Academy.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc4b4602ecb8c489ba6621b3abfd19fd0"><enum>(5)</enum><text>The United States Coast Guard Academy.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idd80ff6d07210461c8b8a8b9dc5ec6f62"><enum>(c)</enum><header>BIE schools</header><text>Section 8549D of the Elementary and Secondary Education Act of 1965 (as added by section 4) shall apply to the Bureau of Indian Education with respect to elementary schools and secondary schools operated or funded by the Bureau of Indian Education in the same manner as that section applies to States.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id448daf79c880493a867b3e715fe52da8"><enum>7.</enum><header>Disclosure reports</header><subsection commented="no" display-inline="no-display-inline" id="id3f5921f8be024c3a9af2297950d81f8b"><enum>(a)</enum><header display-inline="yes-display-inline">HEA Amendment</header><text display-inline="yes-display-inline">Section 117 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1011f">20 U.S.C. 1011f</external-xref>) is amended to read as follows: </text><quoted-block style="OLC" display-inline="no-display-inline" id="idE793751A39724FD48902AF85A3ED8D86"><section id="idbe5d42f10fa444738b1d77d3f592c165"><enum>117.</enum><header>Disclosures of foreign gifts</header><subsection id="id6480dc8c016848db9cc3d47487a44320"><enum>(a)</enum><header>Disclosure report</header><text>Whenever—</text><paragraph commented="no" display-inline="no-display-inline" id="ida6a1748a826d4f0fa29aae14d0ee63e6"><enum>(1)</enum><text display-inline="yes-display-inline">any institution is owned, directed, controlled, financed, or influenced directly or indirectly by a foreign source; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9a502a8413da44e3bd532dad01209d6a"><enum>(2)</enum><text display-inline="yes-display-inline">any institution, including a member of the faculty, professional staff, or other staff, of the institution enters into or maintains a covered relationship with a foreign source when—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd26713bd99874899b49e6c23eb8edae3"><enum>(A)</enum><text display-inline="yes-display-inline">the relationship is restricted or conditional; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id481512354d8944808f19000fc3e556cc"><enum>(B)</enum><text display-inline="yes-display-inline">the value of such relationship is $50,000 or more considered alone or in combination with all other relationships with that foreign source within a calendar year; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida3d40a8b7a72493380afbeba1b9c0e0a"><enum>(C)</enum><text display-inline="yes-display-inline">a foreign source involved in the relationship—</text><clause commented="no" display-inline="no-display-inline" id="id7ff720abdc68470fba0cce2becbbd55f"><enum>(i)</enum><text display-inline="yes-display-inline">resides in or is organized under the laws of, headquartered in, has its principal place of business in, or has more than 25 percent voting stock owned by affiliates that are citizens of a country that has an adversarial foreign government; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id8d83d8d87fc843cbaef3c05c30a64768"><enum>(ii)</enum><text display-inline="yes-display-inline">is owned, directed, controlled, financed, or influenced, directly or indirectly, by an individual who resides in a country that has an adversarial foreign government or an entity that is organized under the laws of, headquartered in, has its principal place of business in, or has more than 25 percent voting stock owned by affiliates that are citizens of, a country that has an adversarial foreign government;</text></clause></subparagraph><continuation-text continuation-text-level="paragraph" indent="subparagraph">the institution shall file a disclosure report with the Secretary on January 31 or July 31, whichever is sooner.</continuation-text></paragraph></subsection><subsection id="idacf4af331c6f48aba9d1133c84ef548c"><enum>(b)</enum><header>Contents of report</header><text>Each report to the Secretary required by this section shall contain the following:</text><paragraph id="idfb555dc3263c45e78510da8c6d9e679c"><enum>(1)</enum><text>For relationships entered into or maintained with a foreign source other than a foreign government, the aggregate dollar value amount of gifts, contracts, agreements, partnerships, collaborations, and employment attributable to a particular country, and for each relationship—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd00d282c86e4490382cb0116c5854c86"><enum>(A)</enum><text display-inline="yes-display-inline">the full legal name of the foreign source;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idece95c18499649969164aba95a2a9a28"><enum>(B)</enum><text>the content of the contract and any conditions or restrictions;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id98e4ab4066fb4dcfaf97d0258ec856a8"><enum>(C)</enum><text display-inline="yes-display-inline">in the case of a foreign source that is an individual, the country in which the individual resides and the individual's affiliations;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcec1c2f9ad8e4ac8a275f006928a7e01"><enum>(D)</enum><text>in the case of a foreign source that is an entity, the country where the foreign source is organized, headquartered, and has its principal place of business and the entity’s ownership;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id03e4445d609840bd973ded6474651a03"><enum>(E)</enum><text display-inline="yes-display-inline">the steps taken to ensure that the foreign source is not a covered person;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5aff171daf014304aa15a82513940cb3"><enum>(F)</enum><text display-inline="yes-display-inline">the goal of the relationship, the length of the relationship, whether the relationship is curriculum or research oriented, whether the institution or foreign source received financial compensation for entering or maintaining the relationship, along with the amount of the compensation, and any changes in program or structure resulting from the relationship.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6451e5302f7f460991fdfe8ace756cb2"><enum>(2)</enum><text display-inline="yes-display-inline">For relationships entered into or maintained with a foreign government—</text><subparagraph commented="no" display-inline="no-display-inline" id="id8f08a3806f2f4f75b1e43e90692a080c"><enum>(A)</enum><text display-inline="yes-display-inline">the name of the foreign government and the aggregate dollar value amount of gifts, contracts, agreements, partnerships, collaborations, and employment with that foreign government;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id298f5ee4254a431a825d7c4fadc381e7"><enum>(B)</enum><text display-inline="yes-display-inline">a description of the relationship, including the content of each such contract, and any conditions or restrictions; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id19a9f98f5e934ae190ef89c915bba41e"><enum>(C)</enum><text display-inline="yes-display-inline">the goal of the relationship, the length of the relationship, whether the relationship is curriculum or research oriented, whether the institution or foreign source received financial compensation for entering or maintaining the relationship, along with the amount of the compensation, and any changes in program or structure resulting from the relationship.</text></subparagraph></paragraph><paragraph id="id655ef4a9e7ca404fbcaa500466c6e841"><enum>(3)</enum><text>In the case of an institution that is owned, directed, controlled, financed, or influenced, directly or indirectly by a foreign source, the identity of the foreign source, the foreign source’s affiliations, the date on which the foreign source assumed such role, and any changes in program or structure resulting from such source’s role.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id14b6b3ae0c72444d887aa2af9ee29344"><enum>(c)</enum><header display-inline="yes-display-inline">Relation to PEMFIA</header><text>In accordance with the <short-title>Protecting Education from Malign Foreign Influence Act of 2023</short-title>, an institution shall not be eligible to receive funds under this Act if that institution is owned, operated, directed, or controlled by a covered person.</text></subsection><subsection id="idb9474f7af1aa4ec699203ec49b76b3b1" commented="no"><enum>(d)</enum><header>Public availability</header><text>Not later than 30 days after the deadline for submission of a disclosure report under subsection (a), the Secretary shall submit that report to Congress and other appropriate Federal agencies and make the contents of the disclosure report publicly available online. The Secretary may disclose a redacted version of such report to the public only if the Secretary grants a petition from an institution to redact and the Secretary has determined that the institution has established grounds for such redaction.</text></subsection><subsection id="id365f9571e338438cae4c059279c09660"><enum>(e)</enum><header>Enforcement</header><paragraph id="ide7b83216dfe94870a4f71b0e5edee49b"><enum>(1)</enum><header>Court orders</header><text>Whenever it appears that an institution has failed to comply with the requirements of this section, including any rule or regulation promulgated under this section, a civil action may be brought by the Attorney General, at the request of the Secretary, in an appropriate district court of the United States, or the appropriate United States court of any territory or other place subject to the jurisdiction of the United States, to request such court to compel compliance with the requirements of this section.</text></paragraph><paragraph id="ide17caa2b87de4affbd73d4bdb21a3f6e"><enum>(2)</enum><header>Costs</header><text>For knowing or willful failure to comply with the requirements of this section, including any rule or regulation promulgated thereunder, an institution shall, at a minimum, pay to the Treasury of the United States the full costs to the United States of obtaining compliance, including all associated costs of investigation and enforcement.</text></paragraph></subsection><subsection id="id20e1b1fe3aea4497be6b14e31978cff9"><enum>(f)</enum><header>Regulations</header><text>The Secretary may promulgate regulations to carry out this section.</text></subsection><subsection id="ida94312bd1f6049d18c8978687ce5bb32"><enum>(g)</enum><header>Agency coordination</header><text>The Secretary shall coordinate with other Federal agencies, as appropriate, including the Federal Bureau of Investigation and the Office of the Director of National Intelligence, to ensure that other Federal agencies have access to disclosure reports submitted under this section and any information or documentation relating to disclosure reports submitted under this section.</text></subsection><subsection id="idaa132f07cbb044f9818aa1fa33432f11"><enum>(h)</enum><header>Definitions</header><text>For the purpose of this section—</text><paragraph id="idcd49de6682e74d07b9e38a3e8d5dd7dc"><enum>(1)</enum><text>the term <term>contract</term> means any agreement for the acquisition by purchase, lease, or barter of property or services by the foreign source, for the direct benefit or use of either of the parties;</text></paragraph><paragraph id="id4aa0f55c31e94173bd7c4bedb9e19d65"><enum>(2)</enum><text>the term <term>covered person</term> has the meaning given that term in section 2 of the <short-title>Protecting Education from Malign Foreign Influence Act of 2023</short-title>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id19e160680bfe4e3c8a4d6e9e0fefafc3"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>covered relationship</term> has the meaning given that term in section 2 of the <short-title>Protecting Education from Malign Foreign Influence Act of 2023</short-title>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf654fdb090a34cb3ab61414836f8f754"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>foreign source</term> means—</text><subparagraph id="id33170fc09f754ae78305d71ca58bda13"><enum>(A)</enum><text>a foreign government, including an agency of a foreign government;</text></subparagraph><subparagraph id="id35cc47299f4242a2a77a8d24a1b852d1"><enum>(B)</enum><text>a legal entity, governmental or otherwise, organized under the laws of, headquartered in, or having its principal place of business in, a foreign state or states;</text></subparagraph><subparagraph id="id1902791eff5d4455aa288fcef60e5cb3"><enum>(C)</enum><text>an individual who is not a citizen or a national of the United States or a trust territory or protectorate thereof; and</text></subparagraph><subparagraph id="id7ec7f70cb30b428d8d12d105db68fb98"><enum>(D)</enum><text>an agent, including a subsidiary or affiliate of a foreign legal entity, acting on behalf of a foreign source;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide0567ccf5c5748c8881255aa901e69a4"><enum>(5)</enum><text>the term <term>gift</term> means any gift of money or property, the fair market value of an in-kind gift, or a grant, donation, present, award, contribution, or scholarship;</text></paragraph><paragraph id="idfad24f28add54bc681e77d580092667e"><enum>(6)</enum><text>the term <term>institution</term> means an institution of higher education as defined in section 2 of the <short-title>Protecting Education from Malign Foreign Influence Act of 2023</short-title>;</text></paragraph><paragraph id="id707fdcf1a1de430790ce8ec29f3511e0"><enum>(7)</enum><text>the term <term>restricted or conditional relationship</term> means any relationship of any kind which includes provisions regarding—</text><subparagraph id="id267f7acd378d4155af731993fe0a545c"><enum>(A)</enum><text>the employment, assignment, or termination of faculty;</text></subparagraph><subparagraph id="ide89db2371522489cb3114e0f1620f26f"><enum>(B)</enum><text>the establishment of departments, centers, research or lecture programs, or new faculty positions;</text></subparagraph><subparagraph id="idfefc1b128dde4f05b787e8d1dc5ca41c"><enum>(C)</enum><text>the selection or admission of students; or</text></subparagraph><subparagraph id="id2aa5c45572554e63a4c1b9951b9327b3"><enum>(D)</enum><text>the award of grants, loans, scholarships, fellowships, or other forms of financial aid restricted to students of a specified country, religion, sex, ethnic origin, or political opinion.<italic></italic></text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id864afc5b30d54ee6b8b05c30a617f000" commented="no"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply with respect to relationships entered into, or other activities carried out, on or after the date of the enactment of this Act, except that the prohibition described in subsection (c) of section 117 of the Higher Education Act of 1965 (as amended by subsection (a)) shall be subject to the transition provisions in section 3(b)(2) of the <short-title>Protecting Education from Malign Foreign Influence Act of 2023</short-title>.</text></subsection><subsection id="id190a59d604034df787bedc6f05af3183"><enum>(c)</enum><header>Ensuring compliance</header><text>Each Federal agency shall ensure that no Federal funds under the jurisdiction of that agency are distributed to an institution that is knowingly or willfully in violation of section 117 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1011f">20 U.S.C. 1011f</external-xref>), as determined by the head of the relevant agency. </text></subsection></section><section commented="no" display-inline="no-display-inline" id="idd83f34e994a54ff3bf6e9426189afd09"><enum>8.</enum><header>Technical assistance; other reports</header><subsection commented="no" display-inline="no-display-inline" id="idb62c37a188b74923ac148766d9b0800c"><enum>(a)</enum><header display-inline="yes-display-inline">Department of Education</header><text display-inline="yes-display-inline">The Secretary of Education shall provide technical assistance to elementary schools, secondary schools, and institutions of higher education under the Secretary's jurisdiction to assist those entities and the faculty and staff of those entities in avoiding covered relationships with covered persons. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="id0b1fba20b9a94ba18163da4ea3d6493a"><enum>(b)</enum><header>Other Federal agencies</header><text display-inline="yes-display-inline">The Secretary of Defense, the Secretary of Transportation, the Secretary of Homeland Security, and the Secretary of the Interior shall also provide such technical assistance to schools and institutions that are under their respective jurisdictions with respect to avoiding covered relationships with covered persons. </text></subsection></section><section id="idf6a91bddd38045f49ebec1a72a867d88"><enum>9.</enum><header>Limiting exemption from foreign agent registration requirement for persons engaging in activities in furtherance of certain pursuits to activities not promoting political agenda of foreign governments</header><subsection id="id04d929539779404cb5188d5a9903085c"><enum>(a)</enum><header>Limitation on exemption</header><text>Section 3(e) of the Foreign Agents Registration Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/22/613">22 U.S.C. 613(e)</external-xref>) is amended by striking the semicolon at the end and inserting the following: <quote>, but only if the activities do not promote the political agenda of a government of a foreign country;</quote>.</text></subsection><subsection id="id483a5b7fc1a5425a8b8dd59a6f1055da"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall apply with respect to activities carried out on or after the date of the enactment of this Act. </text></subsection></section></legis-body></bill>
