which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for just compensation in the event that eminent domain is exercised, and for other purposes. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Just Compensation Act of 2023</short-title></quote>.</text></section><section id="idf946cf664afe49e287d9db28e99cccd1"><enum>2.</enum><header>Purpose</header><subsection commented="no" display-inline="no-display-inline" id="idc4b0ab87a9574d6f9643f0794efcd6d5"><enum>(a)</enum><header>Constitutional requirement</header><text display-inline="yes-display-inline">The Fifth Amendment to the Constitution of the United States guarantees that <quote>nor shall private property be taken for public use, without just compensation</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id5195de93fb114e77b89a37c9e924142b"><enum>(b)</enum><header>Act requirement</header><text display-inline="yes-display-inline">The purpose of this Act is to require that the Federal Government—</text><paragraph commented="no" display-inline="no-display-inline" id="idc7d8e51151324b2bba3056674f543c70"><enum>(1)</enum><text display-inline="yes-display-inline">demonstrate <quote>public use</quote> by exercising eminent domain itself and not delegate the power of the Federal Government to any private entity; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id59aeab4901fe40a28a37f2d5f32b9273"><enum>(2)</enum><text display-inline="yes-display-inline">provide just compensation in the form of 150 percent of fair market value for any property over which the Federal Government exercises eminent domain. </text></paragraph></subsection></section><section id="idf525e4f3d792466793bc943af557706d"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="idf99ab2e419cb4a2a8d85c97941b1b2b7"><enum>(1)</enum><header>Federal Government</header><text display-inline="yes-display-inline">The term <quote>Federal Government</quote> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="idea414f58cd6e41008a2e0a2c578c764b"><enum>(A)</enum><text display-inline="yes-display-inline">the President; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7da80b2492cc40aaa8215df87afa5271"><enum>(B)</enum><text display-inline="yes-display-inline">each Executive agency, as defined in section 105 of title 5, United States Code.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb9f3ee26cab249858b664ded113ef041"><enum>(2)</enum><header>Private entity</header><text display-inline="yes-display-inline">The term <quote>private entity</quote> means any non-governmental entity.</text></paragraph><paragraph id="idac348ba5b6284263b7fc79557da3a0c3"><enum>(3)</enum><header>Relevant congressional committees</header><text>The term <quote>relevant congress committees</quote> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id690bd32caed84ffba68d658c0463befa"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on the Judiciary of the Senate; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida843f3675b324ae697d6f3d62f499396"><enum>(B)</enum><text>the Committee on the Judiciary of the House of Representatives. </text></subparagraph></paragraph></section><section id="id55169c1a3d3147198a24488066770e60"><enum>4.</enum><header>Public use</header><text display-inline="no-display-inline">Notwithstanding any other law, the Federal Government may not delegate the power to exercise eminent domain to any private entity.</text></section><section id="idde1898ed99a24ef48a61975ea99261bd"><enum>5.</enum><header>Just compensation</header><text display-inline="no-display-inline">The Federal Government, in exercising eminent domain, shall provide just compensation of not less than 150 percent of fair market value.</text></section><section id="idb01d951db14f41999db9606db9524640"><enum>6.</enum><header>Reports</header><subsection commented="no" display-inline="no-display-inline" id="ida3f8a05ef11247e9882785f997d60c7c"><enum>(a)</enum><header display-inline="yes-display-inline">Initial report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Attorney General shall submit a report to the relevant congressional committees describing the implementation of this Act.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id65fb9501d5644376a4b5c5047751fc32"><enum>(b)</enum><header>Subsequent reports</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, and annually thereafter, the Attorney General shall submit a report to the relevant congressional committees describing the implementation of this Act, which shall include— </text><paragraph commented="no" display-inline="no-display-inline" id="id0e803b9ef55847579c184bf4b8f89457"><enum>(1)</enum><text display-inline="yes-display-inline">a description of the precise actions, locations, public uses, and compensations provided for every exercise of eminent domain by the Federal Government; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc231ba12a09f495a8e48be0a28600d77"><enum>(2)</enum><text display-inline="yes-display-inline">a summary of the use of eminent domain by States. </text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idb24cab2e9591484899b3f1ee12d2facf"><enum>7.</enum><header>No additional funds</header><text display-inline="no-display-inline">No additional funds are authorized to be appropriate to carry out this Act.</text></section></legis-body></bill>
