which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To extend the authority to provide employees of the United States Secret Service with overtime pay beyond other statutory limitations, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Overtime Pay for Protective Services Act of 2023</short-title></quote>.</text></section><section id="idc365a2c82bec465fac8ed5ce829e8ba8"><enum>2.</enum><header>Extension of overtime pay exception through 2028 for protective services</header><subsection id="id68267ced424049bb94f3dc9c8bc25575"><enum>(a)</enum><header>Amendments</header><text>Section 2 of the Overtime Pay for Protective Services Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/5/5547">5 U.S.C. 5547</external-xref> note) is amended—</text><paragraph id="iddf860c600ceb4c7c9b01175794b34949"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text style="OLC" level="section">2023</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="section">2028</header-in-text></quote>;</text></paragraph><paragraph id="idb0dc554af6ff4791b902e98c86a4be05"><enum>(2)</enum><text>in subsection (a)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id37efc144910d4aa3bcdff25242ef71eb"><enum>(A)</enum><text display-inline="yes-display-inline">in the subsection heading, by striking <quote><header-in-text style="OLC" level="subsection">Definition</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="subsection">Definitions</header-in-text></quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcc6aca5e700748d89bc45036bf1265d8"><enum>(B)</enum><text>by striking <quote>In this section, the term</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="idFC58E85499864BA095402A490A4AC93B"><text>In this section—</text><paragraph commented="no" display-inline="no-display-inline" id="idd0010649c9a449cfae72207590ea5f32"><enum>(1)</enum><text display-inline="yes-display-inline">the term</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id679794828df448e1b042a659966cebf4"><enum>(C)</enum><text display-inline="yes-display-inline">by striking <quote>2023.</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="idB06260B32CCC4430960237BD31B777BD"><text>2028; and</text><paragraph commented="no" display-inline="no-display-inline" id="idbc33987ef14a42f4912ebee5423f74a0"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>protective services</term> does not include routine administrative or technical work that supports the daily operations of the United States Secret Service.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="ideb5fc8b9cacd49e38fde0ddbb712c9fb"><enum>(3)</enum><text>in subsection (b)(1), by striking <quote>during each of calendar years 2016 through 2023</quote> and inserting <quote>for protective services during each of calendar years 2016 through 2028</quote>.</text></paragraph></subsection><subsection id="idf58e23c5a03242aeb20d1e082c386495"><enum>(b)</enum><header>Retroactive effective date</header><text>If this Act is enacted after December 31, 2023, the amendments made by subsection (a) shall take effect as if enacted on December 31, 2023.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idda2beb6e564d46cc8bfacaca853d3516"><enum>(c)</enum><header display-inline="yes-display-inline">Reports</header><paragraph id="id6a73f7144d92434d86f0ad47678cd384"><enum>(1)</enum><header>Definitions</header><text>In this subsection: </text><subparagraph commented="no" display-inline="no-display-inline" id="idc67bcdfcd8784238adbe7fdc4c2260b0"><enum>(A)</enum><header>Appropriate committees of Congress</header><text display-inline="yes-display-inline">The term <term>appropriate committees of Congress</term> means—</text><clause commented="no" display-inline="no-display-inline" id="id6e0536b8db6f4df4a4dce13bba8c2831"><enum>(i)</enum><text display-inline="yes-display-inline">the Committee on Appropriations of the Senate; </text></clause><clause commented="no" display-inline="no-display-inline" id="id6877b6ff97fa4a749668583a5af5cb43"><enum>(ii)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security and Governmental Affairs of the Senate; </text></clause><clause commented="no" display-inline="no-display-inline" id="id7a2df5ffdf4545e0a7423dcd333c76cf"><enum>(iii)</enum><text display-inline="yes-display-inline">the Committee on the Judiciary of the Senate; </text></clause><clause commented="no" display-inline="no-display-inline" id="idd7c8ba8c61de4a529b1f6fd4c024eb28"><enum>(iv)</enum><text display-inline="yes-display-inline">the Committee on Appropriations of the House of Representatives; </text></clause><clause commented="no" display-inline="no-display-inline" id="id60f30e6ae6f544298dbba92e38985667"><enum>(v)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security of the House of Representatives;</text></clause><clause commented="no" display-inline="no-display-inline" id="idc06d3d6513994c74ae3fadfb003a996f"><enum>(vi)</enum><text display-inline="yes-display-inline">the Committee on Oversight and Accountability of the House of Representatives; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idbfa8d656117a4d2998c3fe49f5c20d9a"><enum>(vii)</enum><text display-inline="yes-display-inline">the Committee on the Judiciary of the House of Representatives.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7aa672d84f2c45bfb10970fb809fd148"><enum>(B)</enum><header display-inline="yes-display-inline">Director</header><text>The term <term>Director</term> means the Director of the United States Secret Service.</text></subparagraph></paragraph><paragraph id="ide97b04c06d6b4bc1963b20058f8250c4"><enum>(2)</enum><header>Report on plans to reduce overtime usage</header><subparagraph commented="no" display-inline="no-display-inline" id="id576e8b21b08643129c8714822229088b"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>Not later than 180 days after the date of enactment of this Act, the Director shall submit to the appropriate committees of Congress a report describing the steps that the United States Secret Service is taking to address the increased protective service demands placed upon United States Secret Service personnel.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ideacf4aebca50462a825c69f53a78bcf2"><enum>(B)</enum><header>Elements</header><text>The report required under subparagraph (A) shall include the following:</text><clause id="id74bbae4fd77d48ca841d67dec43de1a9"><enum>(i)</enum><text>An analysis of the current (as of the date on which the report is submitted) operational demands and staffing levels with respect to the United States Secret Service.</text></clause><clause commented="no" display-inline="no-display-inline" id="id6751fdfd2a5f47ae9699071d254edf08"><enum>(ii)</enum><text>Recommended strategies for reducing overtime requirements for United States Secret Service personnel, including—</text><subclause commented="no" display-inline="no-display-inline" id="idff96365604b24dd092a0e2f54f27f106"><enum>(I)</enum><text display-inline="yes-display-inline">the appointment of additional personnel;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id7c10eae07bbf4662bd0c7ad18577a6db"><enum>(II)</enum><text>solutions such that sufficient resources are available throughout each year without the need for exceptions to, or waivers of, premium pay limitations;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id87fe3809c04e4c3e88cfb67fa3d137e4"><enum>(III)</enum><text>the redistribution of workload among United States Secret Service personnel; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id7b7c290c3323440bb8c5d80d69dc0c96"><enum>(IV)</enum><text>other improvements in operational efficiency with respect to the United States Secret Service.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2fad57b13db8402c9bb998a073772e69"><enum>(3)</enum><header display-inline="yes-display-inline">Annual projections</header><subparagraph commented="no" display-inline="no-display-inline" id="idddb054b1f53f4a199f87b3db1d9e12f9"><enum>(A)</enum><header>In general</header><clause commented="no" display-inline="no-display-inline" id="id9e4b37a4a6314114b8b9a71c2b712379"><enum>(i)</enum><header display-inline="yes-display-inline">Requirement</header><text display-inline="yes-display-inline">In accordance with the schedule described in clause (ii), the Director shall submit to the appropriate committees of Congress a report that contains projections for the information described in paragraphs (1) through (7) of section 2(c) of the Secret Service Recruitment and Retention Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/160">Public Law 115–160</external-xref>; 132 Stat. 1246), which shall be divided by calendar quarter. </text></clause><clause commented="no" display-inline="no-display-inline" id="id8e35f27cb4ce457cb3f96cf9503b5435"><enum>(ii)</enum><header>Schedule described</header><text>The schedule described in this clause is as follows:</text><subclause commented="no" display-inline="no-display-inline" id="idfe0c741ee175482e85d2194e0d4040ea"><enum>(I)</enum><text>Not later than 30 days after the date of enactment of this Act, a report with respect to calendar year 2024.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idaeebde88890440e2b6fe3bf60719f394"><enum>(II)</enum><text>Not later than December 31 of each of calendar years 2024 through 2027, a report with respect to the calendar year following the calendar year in which the report is submitted.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4cd37d2e38be477b8cb33052d0b01737"><enum>(B)</enum><header>Quarterly updates</header><text>With respect to each annual report required under subparagraph (A), the Director shall, on the last day of each calendar quarter of the calendar year that is covered by the report, submit to the appropriate committees of Congress an updated version of that report that contains projections for the information described in that subparagraph for the remainder of that calendar year, which shall be divided by calendar quarter.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc6638b04285c4fdc89024ed9d21b3494"><enum>(C)</enum><header>Deeming of period</header><text>Solely for the purposes of a report required under this paragraph, a reference in any of paragraphs (1) through (7) of section 2(c) of the Secret Service Recruitment and Retention Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/160">Public Law 115–160</external-xref>; 132 Stat. 1246) to a numerical value for a previous calendar year shall be deemed to be a projection of that numerical value for an upcoming calendar year or for the remainder of a calendar year, as applicable. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id175737bfd88c409bb767946cf407a706"><enum>(4)</enum><header display-inline="yes-display-inline">Effect of amendments</header><text>Not later than January 30 of each of calendar years 2025 through 2029, the Director shall submit to the appropriate committees of Congress a report on the effects of the amendments made by subsection (a), which shall include, with respect to the calendar year preceding the calendar year in which the report is submitted, the following: </text><subparagraph commented="no" display-inline="no-display-inline" id="idf808bd56266c4518a9bb2e9c04698496"><enum>(A)</enum><text>The information described in paragraphs (1) through (7) of section 2(c) of the Secret Service Recruitment and Retention Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/160">Public Law 115–160</external-xref>; 132 Stat. 1246). </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8d9d025204084a83b8b6cf02e56bad05"><enum>(B)</enum><text display-inline="yes-display-inline">A comparison between the final data reported under subparagraph (A) and the annual projections reported for that calendar year under paragraph (3)(A), including an explanation for any substantial variance between that final data and those annual projections. </text></subparagraph></paragraph></subsection></section></legis-body></bill>
