which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the importation of seafood and aquaculture products from the People's Republic of China.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ban China’s Forbidden Operations in the Oceanic Domain Act</short-title></quote> or the <quote><short-title>Ban C-FOOD Act</short-title></quote>.</text></section><section id="id34814119d0194a108c11727912e7d6db"><enum>2.</enum><header>Prohibition on importation of seafood and aquaculture products from the People's Republic of China</header><subsection commented="no" display-inline="no-display-inline" id="id70dedc27bad64de98c726aa29981211e"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>During the period described in subsection (b), the importation of seafood and aquaculture products that originate in the People's Republic of China is prohibited.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id41b5f2043e15420884d3d58268270d31"><enum>(b)</enum><header>Period described</header><text>The period described in this subsection is the period—</text><paragraph commented="no" display-inline="no-display-inline" id="idcce2943600524e6ca0e1150aa8d630be"><enum>(1)</enum><text display-inline="yes-display-inline">beginning on the date that is one year after the date of the enactment of this Act; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id92e118b202ad437daa067c4822676412"><enum>(2)</enum><text>ending on the date on which all of the certifications described in subsection (c) have been submitted to Congress.</text></paragraph></subsection><subsection id="idc6b0b01fb81f469aaa4133a45187bcf5"><enum>(c)</enum><header>Certifications described</header><text>The certifications described in this subsection are the following:</text><paragraph commented="no" display-inline="no-display-inline" id="id4aad37dc3d2e4908af9a72d8611fd672"><enum>(1)</enum><text>A certification by the Secretary of State that neither the fishing fleets nor the aquaculture industry of the People's Republic of China are meaningfully using forced labor.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id59f60d03776f44ebad8a491b6b319d4c"><enum>(2)</enum><text>A certification by the Secretary of Commerce that the Government of the People's Republic of China is not subsidizing those fleets or that industry beyond international norms.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf072a16d5dfc46ef8a8545dbe698fc02"><enum>(3)</enum><text>A certification by the Secretary of Defense that the fishing fleets of the People's Republic of China will not be used in an invasion of Taiwan.</text></paragraph></subsection></section><section id="id10accdf5310c4f1ab6a025f429c665c0"><enum>3.</enum><header>Imposition of sanctions with respect to entities facilitating transshipment</header><subsection commented="no" display-inline="no-display-inline" id="idabcecde329884e83ad8e94247249b8cf"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>The Secretary of the Treasury shall impose the sanctions described in subsection (b) with respect to each person that the Secretary determines knowingly participates in the transshipment, during the period described in section 2(b), of seafood or aquaculture products that originate in the People's Republic of China into the United States in violation of section 2(a).</text></subsection><subsection id="id410ab42aac504ece95d15f41daba89f7"><enum>(b)</enum><header>Sanctions described</header><text>The Secretary shall, pursuant to the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>), block and prohibit all transactions in property and interests in property of a foreign person described in subsection (a) if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></subsection><subsection id="id6c8456034ce4478f8b8ad5f648673572"><enum>(c)</enum><header>Implementation; penalties</header><paragraph id="idc82796b784834f52b9a6cb59a7882d6d"><enum>(1)</enum><header>Implementation</header><text>The Secretary may exercise the authorities provided to the President under sections 203 and 205 of the International Emergency Economic Powers Act (50 U.S.C. 1702 and 1704) to the extent necessary to carry out this section.</text></paragraph><paragraph id="ida2039c80e07044df935d50d69d3e064d"><enum>(2)</enum><header>Penalties</header><text>A person that violates, attempts to violate, conspires to violate, or causes a violation of this section or any regulation, license, or order issued to carry out this section shall be subject to the penalties set forth in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) to the same extent as a person that commits an unlawful act described in subsection (a) of that section.</text></paragraph></subsection><subsection id="id287d92393aca4795ac60849e41028ada"><enum>(d)</enum><header>United states person defined</header><text>In this section, the term <term>United States person</term> means—</text><paragraph id="id24a82a9d29704c6baa76e475bed99199"><enum>(1)</enum><text>a United States citizen or an alien lawfully admitted for permanent residence to the United States; </text></paragraph><paragraph id="id672761e257fb4d32830aed261eedb555"><enum>(2)</enum><text>an entity organized under the laws of the United States or of any jurisdiction within the United States, including a foreign branch of such an entity; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id647388b741274b7ba2711d3dcdfb8214"><enum>(3)</enum><text>any person in the United States.</text></paragraph></subsection></section><section id="id865064ac3df94d66930f1b728a7e0c54"><enum>4.</enum><header>Imposition of duties to prevent transshipment</header><text display-inline="no-display-inline">During the period described in section 2(b), the United States Trade Representative shall impose such duties with respect to seafood and aquaculture products as the Trade Representative determines necessary—</text><paragraph commented="no" display-inline="no-display-inline" id="id3b78ce1184e74cfbabae0c15c8f51166"><enum>(1)</enum><text display-inline="yes-display-inline">to prevent the transshipment into the United States of such products that originate in the People's Republic of China in violation of section 2(a); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id75708c7dae13425cbdd81f7622f7ed5f"><enum>(2)</enum><text>to penalize countries that facilitate such transshipment.</text></paragraph></section><section id="idd8f4638d50e94ab7a22d9d2b93a14c69"><enum>5.</enum><header>Report on combating abuses of fishing fleets and aquaculture industry of the People's Republic of China</header><text display-inline="no-display-inline">Not later than 90 days after the date of the enactment of this Act, the President shall submit to Congress a report that—</text><paragraph id="id156bc99a40494d45884d002aa1a9a7a3"><enum>(1)</enum><text>describes in detail—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7d5605ab299b4456b3c96e4df7a1c4d1"><enum>(A)</enum><text display-inline="yes-display-inline">all efforts of the executive branch to combat illegal fishing and the use of forced labor by the fishing fleets and aquaculture industry of the People's Republic of China; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3e89ee8f712d41a3a2f9e20db66a217f"><enum>(B)</enum><text>the funds and other resources allocated to such efforts; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4e7ac6bf8fbf4d2fac390ebe4b394e97"><enum>(2)</enum><text display-inline="yes-display-inline">includes requests for the additional funding, resources, and authorities necessary to combat illegal fishing and the use of forced labor by the fishing fleets and aquaculture industry of the People's Republic of China.</text></paragraph></section></legis-body></bill>
