Insurance Act to authorize the Federal Crop Insurance Corporation to carry out research and development on a single index insurance policy, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Withstanding Extreme Agricultural Threats by Harvesting Economic Resilience Act of 2023</short-title></quote> or the <quote><short-title>WEATHER Act of 2023</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="ide797af737138410e942fae356ebea0b5"><enum>2.</enum><header>Single index insurance policy</header><subsection commented="no" display-inline="no-display-inline" id="id5933b360054b427398fb3cdf4d6fb1e4"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 522(c) of the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1522">7 U.S.C. 1522(c)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id13D836C18F764468976388B3333946CF"><paragraph commented="no" display-inline="no-display-inline" id="idc4c37bc9f64043ce9d6ce24b044bf691"><enum>(20)</enum><header>Single index insurance policy</header><subparagraph commented="no" display-inline="no-display-inline" id="id21ecb51176ba4fda8f56a92dea0d542f"><enum>(A)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this paragraph:</text><clause commented="no" display-inline="no-display-inline" id="idf6a4ff58fe84499bb0195fcbcb458674"><enum>(i)</enum><header>Covered crop or commodity</header><text>The term <term>covered crop or commodity</term> means any crop or commodity (including a specialty crop) on a farm except timber, forest products, animals for sport or show, and pets.</text></clause><clause commented="no" display-inline="no-display-inline" id="id517016e81d404802bf83a789eadfef4e"><enum>(ii)</enum><header>Covered policy</header><text>The term <term>covered policy</term> means the single index insurance policy described in subparagraph (B)(i).</text></clause><clause commented="no" display-inline="no-display-inline" id="ide4cc8ac672d24ff6b9e612bd477846a2"><enum>(iii)</enum><header display-inline="yes-display-inline">Covered weather condition</header><subclause commented="no" display-inline="no-display-inline" id="id633d004394154e088f43d6de46587127"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>covered weather condition</term> means any of the following weather conditions that are found to be closely correlated with agricultural income losses: </text><item id="id2cabdd093c764c548172b75da075e553"><enum>(aa)</enum><text>High winds.</text></item><item commented="no" display-inline="no-display-inline" id="ida248bdcef9b84e62895001bff5693e85"><enum>(bb)</enum><text display-inline="yes-display-inline">Excessive moisture and flooding.</text></item><item commented="no" display-inline="no-display-inline" id="ide2e69e1faab042fcb65fe81fbbc5209a"><enum>(cc)</enum><text display-inline="yes-display-inline">Extreme heat.</text></item><item commented="no" display-inline="no-display-inline" id="idda6515d2a3774200aca7d73f0ad19198"><enum>(dd)</enum><text display-inline="yes-display-inline">Abnormal freeze conditions.</text></item><item commented="no" display-inline="no-display-inline" id="idbc2b75352a4846efb58ea90d76cd2fbb"><enum>(ee)</enum><text display-inline="yes-display-inline">Wildfire.</text></item><item commented="no" display-inline="no-display-inline" id="id521be55ac45348a792d602df579d2ece"><enum>(ff)</enum><text>Hail.</text></item><item commented="no" display-inline="no-display-inline" id="id8910a3aaf25c4d46961a19135c99bb25"><enum>(gg)</enum><text display-inline="yes-display-inline">Drought.</text></item><item commented="no" display-inline="no-display-inline" id="id3db19f7b45e44cc3b68addb197eafe6c"><enum>(hh)</enum><text display-inline="yes-display-inline">Any other severe weather or growing conditions applicable to small-scale farmers, as determined by the Secretary. </text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id6c5e417c9f7e413a981e1be8c9bd36f4"><enum>(II)</enum><header>Data</header><text display-inline="yes-display-inline">The existence of a weather condition described in subclause (I) shall be determined by indices that prioritize using data from the National Oceanic and Atmospheric Administration, as available, but may use other federally or State certified weather data sources, public and private satellite data, and weather and climate data and models, if necessary, as determined by the Secretary.</text></subclause></clause></subparagraph><subparagraph id="ida0e523fbc0754d7888f8e72b86b3c4b9"><enum>(B)</enum><header>Policy</header><clause commented="no" display-inline="no-display-inline" id="id2eb195aee1864c298b48faed7b9e0e0a"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Corporation shall carry out research and development, or offer to enter into 1 or more contracts with 1 or more qualified persons to carry out research and development, to develop a single index policy to insure against agricultural income losses due to 1 or more covered weather conditions. </text></clause><clause commented="no" display-inline="no-display-inline" id="H2F70A13B46E748CFAE0A25C3BE36CECF"><enum>(ii)</enum><header display-inline="yes-display-inline">Coverage</header><text display-inline="yes-display-inline">Research and development on the covered policy under clause (i) shall require that coverage is available in all 50 States (including Indian Tribes), the District of Columbia, American Samoa, Guam, the Commonwealth of the Northern Mariana Islands, the Commonwealth of Puerto Rico, and the Virgin Islands of the United States.</text></clause><clause id="id99afa778832e4144a9c04831704dd573" commented="no"><enum>(iii)</enum><header>Option to buy-up or buy-down</header><subclause id="idb515b45a7a794aa28396201aa1647a17" commented="no"><enum>(I)</enum><header>In general</header><text>Research and development on the covered policy under clause (i) shall consider permitting a holder of the covered policy to elect to buy-up to 150 percent, subject to subclause (II), or buy-down to 5 percent, of the median county-level adjusted gross income for farms, in 5-percent increments, to reflect the income of the individual farm business of the holder insured under the covered policy.</text></subclause><subclause id="ida1ac4bbc645a466c8cd2ef4dd924ef3d" commented="no"><enum>(II)</enum><header>Limitation</header><text>A holder of a covered policy may buy-up under subclause (I) only if the farms of the holder insured under the covered policy have at least 3 covered crops or commodities.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id9642ba77407d40df8dc594cc2f850600"><enum>(iv)</enum><header>Priority features of policy</header><text>In carrying out research and development on the covered policy under clause (i), the following features may be given priority:</text><subclause commented="no" display-inline="no-display-inline" id="ide57d073a62c747a493572014b760a576"><enum>(I)</enum><text>Agricultural income losses under the covered policy include—</text><item commented="no" display-inline="no-display-inline" id="id72166b0c7d384e9bb7a7b9635db98c6b"><enum>(aa)</enum><text display-inline="yes-display-inline">losses for all covered crops or commodities; and</text></item><item id="id0d51026bff1041139cb01bae13c658a0"><enum>(bb)</enum><text>losses to the value of packing, packaging, or any other similar on-farm activity that the Corporation determines necessary to remove a covered crop or commodity from the field.</text></item></subclause><subclause id="id663d197ecef340deab936ac66549681c"><enum>(II)</enum><text>Payments are made under the covered policy not later than 30 days after the occurrence of a covered weather condition in the county in which the applicable farm of the farmer is located or an adjacent county.</text></subclause><subclause id="id1054b336d70645c4aaf98c5b63f6cf11"><enum>(III)</enum><text>Provision of seasonal coverage periods.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idfb2dca5bc66e47c382ddaa6cc1de075e"><enum>(IV)</enum><text>Provision of special consideration to concerns facing individual farm businesses—</text><item commented="no" display-inline="no-display-inline" id="id2c407ae4d7b64cda9da4adaff84dd85e"><enum>(aa)</enum><text display-inline="yes-display-inline">that have less than $350,000 in adjusted gross income; and</text></item><item commented="no" display-inline="no-display-inline" id="ida82e2ae83b064244be80a8e8bb1e04a2"><enum>(bb)</enum><text display-inline="yes-display-inline">with respect to which a farmer is an underserved producer (as defined in section 508(a)(7)(A)).</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id502b57da943840e183354dd19c2c1dd8"><enum>(V)</enum><text display-inline="yes-display-inline">Paperwork requirements are reduced for farmers seeking to obtain a covered policy.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id2d6b266bd9034593ae2b7d700a3dd56f"><enum>(v)</enum><header>Consultation</header><text display-inline="yes-display-inline">In carrying out research and development on the covered policy under clause (i), the Corporation—</text><subclause commented="no" display-inline="no-display-inline" id="id984ccfabf69a4a8e8ae7ab37a97d3976"><enum>(I)</enum><text display-inline="yes-display-inline">shall hold stakeholder meetings to solicit producer and agent feedback; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id6664994e94e642569c264e1149d85c13"><enum>(II)</enum><text display-inline="yes-display-inline">may consult with licensed actuaries with experience developing index policies insuring agricultural production. </text></subclause></clause></subparagraph><subparagraph id="idc7d74f1b0ded4498982f05399961cbd2"><enum>(C)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this paragraph, the Corporation shall make publicly available a report that describes—</text><clause id="idbe4a152587b346d4900b9a72b570f25a"><enum>(i)</enum><text>the results of the research and development carried out under this paragraph; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id0f000ded9cfa4758998aa43c6e2d1861"><enum>(ii)</enum><text display-inline="yes-display-inline">recommendations to Congress with respect to those results, including—</text><subclause commented="no" display-inline="no-display-inline" id="id92d6db96097940988f63420d0d2ab105"><enum>(I)</enum><text display-inline="yes-display-inline">any challenges to developing the covered policy; and</text></subclause><subclause id="idef85ff09dacc420c9b0f714026f8965f" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">options to address those challenges.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idbacc0e54aceb419fbd3e87a7fdfe42fc"><enum>(b)</enum><header>Technical amendment</header><text>Section 531(a)(18) of the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1531">7 U.S.C. 1531(a)(18)</external-xref>) is amended by striking <quote>section 2501(e) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/2279">7 U.S.C. 2279(e)</external-xref>)</quote> and inserting <quote>section 2501(a) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/2279">7 U.S.C. 2279(a)</external-xref>).</quote>.</text></subsection></section></legis-body></bill>
