which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To improve purchasing of food by the Department of Agriculture, and for other purposes.</official-title></form><legis-body><section id="id4d34274290fe436397949021cc9a78bb" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Enabling Farmer, Food worker, Environmental, and Climate Targets through Innovative, Values-aligned, and Equitable Food Procurement Act</short-title></quote> or the <quote><short-title>EFFECTIVE Food Procurement Act</short-title></quote>.</text></section><section section-type="subsequent-section" commented="no" display-inline="no-display-inline" id="id8180d3ff5103455ab7ce31679097df29"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds that the Department of Agriculture, as one of the largest food purchasers in the world, has the responsibility and opportunity to help spur a more just, healthy, and sustainable food system by purchasing more foods that support—</text><paragraph commented="no" display-inline="no-display-inline" id="id92703c5d1f744e09ade0eee5c3db6777"><enum>(1)</enum><text display-inline="yes-display-inline">regional and resilient food economies;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcd1e8f4063bc4b459e2e7289fb2a2a29"><enum>(2)</enum><text display-inline="yes-display-inline">worker well-being;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6fce9204cba34609b391b86b46d47d23"><enum>(3)</enum><text display-inline="yes-display-inline">a safe and healthy environment;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id758d1528280b4e0b8df0aa20118b2426"><enum>(4)</enum><text display-inline="yes-display-inline">equity and inclusion; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9542a36b45ba4c0f9086f008e7824632"><enum>(5)</enum><text display-inline="yes-display-inline">fairness for family farms, fishing businesses, and ranches.</text></paragraph></section><section id="id8738c1c6214f4baca944ade250abc6d3"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="HB749AA4FFB094B858D1E05F4772E396A"><enum>(1)</enum><header display-inline="yes-display-inline">Beginning farmer, fisherman, or rancher</header><text display-inline="yes-display-inline">The term <term>beginning farmer, fisherman, or rancher</term> means a person that—</text><subparagraph commented="no" display-inline="no-display-inline" id="H899B38691E664A7A800951C3AFA6B5D7"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="HA3AE2F9E666F45EAA57FF9853C1D80BF"><enum>(i)</enum><text>has not operated a farm, fishing business, or ranch; or</text></clause><clause id="HA8E7A63899134F5AB90BB8F41EC727A8" indent="up1"><enum>(ii)</enum><text>has operated a farm, fishing business, or ranch for not more than 10 years; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H99ABACE8A7EF4B5FA045CD7828C83970"><enum>(B)</enum><text>meets such other criteria as the Secretary may establish.</text></subparagraph></paragraph><paragraph id="id2a845bfd572349849572007a57fde380"><enum>(2)</enum><header>Covered authority</header><text>The term <term>covered authority</term> means—</text><subparagraph id="id7a122a8aafb8410e9ad4977dea757bd0"><enum>(A)</enum><text>section 32 of the Act of August 24, 1935 (<external-xref legal-doc="usc" parsable-cite="usc/7/612c">7 U.S.C. 612c</external-xref>);</text></subparagraph><subparagraph id="id4aa005f729584ddfaf20e496be84bfd2" commented="no"><enum>(B)</enum><text>the matter under the heading <quote><header-in-text style="appropriations" level="appropriations-small">REMOVAL OF SURPLUS AGRICULTURAL COMMODITIES</header-in-text></quote> under the heading <quote><header-in-text style="OLC" level="appropriations-intermediate">Agricultural Marketing Service</header-in-text></quote> in title I of <external-xref legal-doc="public-law" parsable-cite="pl/88/250">Public Law 88–250</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/7/612c-1">7 U.S.C. 612c–1</external-xref>);</text></subparagraph><subparagraph id="id6cbb6edaaf2340cea21fef9eaa41cfa3"><enum>(C)</enum><text>section 10603 of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/612c-4">7 U.S.C. 612c–4</external-xref>);</text></subparagraph><subparagraph id="id68ca36decfad40f0a0d32bdee5fc1f37"><enum>(D)</enum><text>section 4404 of the Food, Conservation, and Energy Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/612c-5">7 U.S.C. 612c–5</external-xref>);</text></subparagraph><subparagraph id="idd2f130cc08ad4da8a937fe8a97ced7aa"><enum>(E)</enum><text>section 14222 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/7/612c-6">7 U.S.C. 612c–6</external-xref>); and</text></subparagraph><subparagraph id="idbc73f15ee1a14019a6ed45f9b5ca20e0"><enum>(F)</enum><text>any other purchasing authority of the Department of Agriculture.</text></subparagraph></paragraph><paragraph id="ided1f0f8dc20c4c38b5bcb44eb7edbc70"><enum>(3)</enum><header>Fishing business</header><text>The term <term>fishing business</term> means a business engaged in commercial fishing (as defined in section 3 of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1802">16 U.S.C. 1802</external-xref>)). </text></paragraph><paragraph id="id75f7943ebe8a43abb94194e24c835d2b"><enum>(4)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> means an Indian tribe included on the list published by the Secretary of the Interior under section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>).</text></paragraph><paragraph id="idf3ef5e2415c94ac4bee058ca78005ffb"><enum>(5)</enum><header>Native Alaskan</header><text>The term <term>Native Alaskan</term> has the meaning given the term <term>Native</term> in section 3 of the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1602">43 U.S.C. 1602</external-xref>).</text></paragraph><paragraph id="idea981857ea1b414aa116c383428a3581"><enum>(6)</enum><header>Native Hawaiian</header><text>The term <term>Native Hawaiian</term> has the meaning given the term in section 801 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4221">25 U.S.C. 4221</external-xref>).</text></paragraph><paragraph id="idd31c67ab9d5b488286aa1eb60a4a1658"><enum>(7)</enum><header>Policy to limit deforestation</header><text>The term <term>policy to limit deforestation</term> means a policy that includes, at a minimum, the following:</text><subparagraph id="id08a38354eda646628523a95260d5faea"><enum>(A)</enum><text>Measures to identify the point of origin of forest-risk commodities and ensure compliance with the policy when supply chain risks are present.</text></subparagraph><subparagraph id="idca5d825c6413423dbc748d5911f8d0cf"><enum>(B)</enum><text>Data detailing the complete list of direct and indirect suppliers and supply chain traceability information for each forest-risk commodity found in products that may be furnished to the Federal Government, including—</text><clause commented="no" display-inline="no-display-inline" id="id38ac92b47a86404499a2227302353075"><enum>(i)</enum><text display-inline="yes-display-inline">refineries, processing plants, farms, and plantations;</text></clause><clause commented="no" display-inline="no-display-inline" id="iddd7174e7f182490897d4c53c33e0e6d3"><enum>(ii)</enum><text display-inline="yes-display-inline">the respective owners, parent entities, and farmers of the entities described in clause (i);</text></clause><clause commented="no" display-inline="no-display-inline" id="id9f32ebd2c13a443fb8751bd2408ba0d4"><enum>(iii)</enum><text display-inline="yes-display-inline">maps; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id09751ca8649b42db80c5ee5362431d2d"><enum>(iv)</enum><text display-inline="yes-display-inline">geolocations.</text></clause></subparagraph><subparagraph id="id8cdc0231fb3347aca8dfd8d70454c304"><enum>(C)</enum><text>Measures taken to ensure that each commodity described in subparagraph (B) does not contribute to deforestation.</text></subparagraph><subparagraph id="iddc1d207d8cae44c0b0c57178a5efc8ec"><enum>(D)</enum><text>Measures taken to ensure the process of obtaining the free, prior, and informed consent of indigenous peoples and local communities directly affected by the production of commodities described in subparagraph (B).</text></subparagraph><subparagraph id="id9a24f0b6902e4917aefa3ff247f6329d"><enum>(E)</enum><text>Measures taken to protect biodiversity and prevent the poaching of wildlife and trade in bushmeat in all operations and areas adjacent to the production of commodities described in subparagraph (B).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id80d72efefb19430aaaf4c26e1ca002dc"><enum>(F)</enum><text display-inline="yes-display-inline">Measures taken to ensure compliance with the laws of countries where forest-risk commodities in the supply chain of the contractor are produced.</text></subparagraph></paragraph><paragraph id="id7983268f6e7a45b3a81b6ecd54ec2ecb"><enum>(8)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph><paragraph id="id7a5dba92c2c047109f15094a00022aec"><enum>(9)</enum><header>Socially disadvantaged farmer, fisherman, or rancher</header><text>The term <term>socially disadvantaged farmer, fisherman, or rancher</term> means a farmer, operator of a fishing business, or rancher who is a member of a socially disadvantaged group (as defined in section 2501(a) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/2279">7 U.S.C. 2279(a)</external-xref>)).</text></paragraph><paragraph id="idbba8fde83a264cddaea647a62b811b1f"><enum>(10)</enum><header>Tradeoff process</header><text>The term <term>tradeoff process</term> means a tradeoff process described in part 15.101–1 of the Federal Acquisition Regulation (or a successor regulation).</text></paragraph><paragraph id="id889b0cf540414c99b33caa51ae6d49c1"><enum>(11)</enum><header>Veteran farmer, fisherman, or rancher</header><text>The term <term>veteran farmer, fisherman, or rancher</term> means a farmer, operator of a fishing business, or rancher who has served in the Armed Forces (as defined in section 101 of title 38, United States Code) and who—</text><subparagraph id="HCC930940329B41548BAE22F99A84193D"><enum>(A)</enum><text>has not operated a farm, fishing business, or ranch;</text></subparagraph><subparagraph id="H9F0289138AE7483C85B8B86312F83ADE"><enum>(B)</enum><text>has operated a farm, fishing business, or ranch for not more than 10 years; or</text></subparagraph><subparagraph id="H999855B36BDE4085BF6CAE4422C88115"><enum>(C)</enum><text>is a veteran (as defined in that section) who has first obtained status as a veteran (as so defined) during the most recent 10-year period.</text></subparagraph></paragraph></section><section id="id5914164d29c2480d87c4925b39ebec6f"><enum>4.</enum><header>Equitable food procurement</header><subsection id="id845300e8ae754d5b8e53dd4d6810d15f"><enum>(a)</enum><header>Purposes</header><text>The purposes of the requirements described in subsection (b) are—</text><paragraph commented="no" display-inline="no-display-inline" id="idce5a85fb5afd471bbc954aa72e6f35f7"><enum>(1)</enum><text display-inline="yes-display-inline">to strengthen the resilience of the domestic food system;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id037b8dddf0f743abb85ae19f59f0ad16"><enum>(2)</enum><text display-inline="yes-display-inline">to create more equitable opportunities for small and family farmers, fishermen, and ranchers;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id24c70694d60e43949802962824663d62"><enum>(3)</enum><text display-inline="yes-display-inline">to expand the choices available to school food authorities and food banks participating in the commodity procurement programs of the Department of Agriculture; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idecaa9796073b48e7b9634dd0a2a2a790"><enum>(4)</enum><text display-inline="yes-display-inline">to expand workplace protections in the food supply chains of the Federal Government.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id366925510ed94a9f8694927c4e17af93"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">In the procurement of foods under a covered authority, the Secretary shall make available and purchase a sufficient variety of—</text><paragraph id="id044ecd11edce4472a71a18ca05b17c5b"><enum>(1)</enum><text>foods that support equity and inclusion, including—</text><subparagraph id="id8e876ca4f13c4c99a47e1bc806b11df6"><enum>(A)</enum><text>foods that are produced by or sourced from—</text><clause commented="no" display-inline="no-display-inline" id="id1fd19a6581bd4ba0b1a82b56f755cb07"><enum>(i)</enum><text display-inline="yes-display-inline">beginning farmers, fishermen, or ranchers;</text></clause><clause commented="no" display-inline="no-display-inline" id="id8b70b6bd34264d9ca4864d0ff495757d"><enum>(ii)</enum><text display-inline="yes-display-inline">veteran farmers, fishermen, or ranchers; or </text></clause><clause commented="no" display-inline="no-display-inline" id="idf42efa97fc394c2589231f6310ff7da6"><enum>(iii)</enum><text display-inline="yes-display-inline">socially disadvantaged farmers, fishermen, or ranchers; and</text></clause></subparagraph><subparagraph id="id96c51a77e694401f89c3d32fa32e9fd8"><enum>(B)</enum><text>foods that accommodate people with religious or restricted diets; </text></subparagraph></paragraph><paragraph id="id9d8898eedb864ee3be5626b966adb4e3"><enum>(2)</enum><text>foods that support diversified and resilient supply chains, including—</text><subparagraph id="id45d58e7cbeaa4861ac22945058df26db"><enum>(A)</enum><text>foods that are produced by or sourced from small or mid-sized family farms, fishing businesses, or ranches; </text></subparagraph><subparagraph id="id661d316306f144a9ab1ac19d94ee224b"><enum>(B)</enum><text>foods that are produced by or sourced from agricultural cooperatives, producer associations, or food hubs that principally work with the entities described in subparagraph (A);</text></subparagraph><subparagraph id="id252b1aac155147c88543ce11c0a1299d"><enum>(C)</enum><text>foods that are produced by a certified organic farm (as defined in section 2103 of the Organic Foods Production Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/6502">7 U.S.C. 6502</external-xref>)); and</text></subparagraph><subparagraph id="id528bcfaeb37d4c7a8b58e3ae9662d47c"><enum>(D)</enum><text>foods that are produced by a farm participating in an independent animal welfare certification program;</text></subparagraph></paragraph><paragraph id="id0df917d431d94c9f96ef20b9a7b47f75"><enum>(3)</enum><text>foods that support worker well-being, including—</text><subparagraph id="iddd39c09f2ed64e6f9291f3cadb919dfc"><enum>(A)</enum><text>foods that are sourced from vendors with employees who are represented by a collective bargaining agreement or memorandum of understanding;</text></subparagraph><subparagraph id="id81e4b448813b4201b536f45102302ad2"><enum>(B)</enum><text>foods that are sourced from vendors participating in a worker justice certification program; and</text></subparagraph><subparagraph id="id9972c301b2af4d688dfa65def84c6af8"><enum>(C)</enum><text>foods that are sourced from vendors that have signed a labor peace agreement with a bona fide labor union; and</text></subparagraph></paragraph><paragraph id="idde562c749d64443a900e350ac1b62c6e"><enum>(4)</enum><text>foods that mitigate the impacts on climate change of the food purchasing by the Department of Agriculture, including—</text><subparagraph id="id489883afb80244be9afcdf22a112c67f"><enum>(A)</enum><text>foods that are produced using agricultural practices that measurably reduce greenhouse gas emissions and increase on-farm diversification and resilience to climate impacts, including perennial-based systems, crop rotations, and pasture-based livestock;</text></subparagraph><subparagraph id="id5bf1c2ad38e349678988aa434c3cf34b"><enum>(B)</enum><text>foods that are sourced from suppliers with a policy to limit deforestation;</text></subparagraph><subparagraph id="idcc45f13b40dd420bb4cd1bd7ef037c23"><enum>(C)</enum><text>foods that emit less greenhouse gas emissions throughout the lifecycle of the product, relative to nutritionally similar foods; and</text></subparagraph><subparagraph id="id84d1cd9c24824bcdb5611877c73f7c55"><enum>(D)</enum><text>foods that provide environmental co-benefits that increase climate resilience, such as—</text><clause id="id56a4d3243831443aaa77d707a49c96d4"><enum>(i)</enum><text>improving soil health and water quality;</text></clause><clause id="idc65c73996b2f47a49a06c53c1356f1d1"><enum>(ii)</enum><text>increasing biodiversity and water conservation; and</text></clause><clause id="id164aa918a19c4d3e9c8919d5e1425d60"><enum>(iii)</enum><text>reducing the spread of invasive species.</text></clause></subparagraph></paragraph></subsection><subsection id="id0bdfbb22491447dbb78cc8bd3708aa17"><enum>(c)</enum><header>Baseline report</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall submit to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report that includes—</text><paragraph id="id10a60569f2c543f7806436ebdb855e05"><enum>(1)</enum><text>the percentage of the total annual spending of the Department of Agriculture spent on purchasing foods in each category of foods listed in paragraphs (1) through (4) of subsection (b), including a record of each purchase the Department made under each category that lists—</text><subparagraph commented="no" display-inline="no-display-inline" id="id8f39f1f90752433e8fbc50f77e8137c8"><enum>(A)</enum><text display-inline="yes-display-inline">the name of each supplier, distributor, processor, and producer involved in the provision of the food product;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2124abca0cec4c28b212297cbf481284"><enum>(B)</enum><text display-inline="yes-display-inline">the total contract obligation; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idacb574c65080442e9ea2063b9f812f45"><enum>(C)</enum><text display-inline="yes-display-inline">a description of the food purchased;</text></subparagraph></paragraph><paragraph id="id5c2ff319e1184f2ebdb4ae807787d7fa"><enum>(2)</enum><text>an estimate, developed in consultation with the Environmental Protection Agency, of the greenhouse gas emissions associated with food purchasing by the Department of Agriculture;</text></paragraph><paragraph id="idc55981a8b4854ab89d452518c0de79f5"><enum>(3)</enum><text>targets to increase by calendar year 2032, to the maximum extent practicable, the percentage of the annual food spending by the Department of Agriculture in each category of food listed in paragraphs (1) through (4) of subsection (b);</text></paragraph><paragraph id="id49ba91c07315477ea691284e3415bd44"><enum>(4)</enum><text>a target to reduce by calendar year 2032, to the maximum extent practicable, the greenhouse gas emissions associated with the annual food purchasing by the Department of Agriculture relative to calendar year 2024, in accordance with the procurement-related targets established by Executive Order 14057 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> note; relating to catalyzing clean energy industries and jobs through Federal sustainability); and</text></paragraph><paragraph id="ide5dff3cb98784a9b83c64c4bc4cbcce9"><enum>(5)</enum><text>any recommendations—</text><subparagraph id="id193df564a51f4eeab60a89052043a91f"><enum>(A)</enum><text>to enhance supply chain transparency, particularly for school food authorities that participate in any Department of Agriculture foods program;</text></subparagraph><subparagraph id="idbfa4bd0dd3e14c5ba615a0a52024656d"><enum>(B)</enum><text>to restructure the commodity food procurement programs of the Department of Agriculture to support a regional model with increased local food purchasing, including recommendations for continuing and improving on the Local Food Purchase Assistance Cooperative Agreement Program; or</text></subparagraph><subparagraph id="ide730d9c450944298b1f19e6f098504b5"><enum>(C)</enum><text>to increase procurement of foods listed in paragraphs (1) through (4) of subsection (b), including any recommendations that would require new authority from Congress.</text></subparagraph></paragraph></subsection><subsection id="idaea5a697e11540b79c15e187abbf7208"><enum>(d)</enum><header>Annual reports</header><text>Not later than 2 years after the date of enactment of this Act, and each year thereafter, the Secretary shall submit to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report that includes—</text><paragraph id="idedd205b4a302465cbe54f86cb20d0f96"><enum>(1)</enum><text>the percentage of the total annual spending of the Department of Agriculture spent on purchasing foods in each category of foods listed in paragraphs (1) through (4) of subsection (b) during the previous fiscal year;</text></paragraph><paragraph id="id1828ca1d3064474fa739cbfef7b7776b"><enum>(2)</enum><text>the names of all suppliers, distributors, processors, and producers involved in the provision of all foods purchased under a covered authority during the previous fiscal year; and </text></paragraph><paragraph id="idc0fcb7f8a81f4e78850431f66344d664"><enum>(3)</enum><text>an estimate of the greenhouse gas emissions associated with food purchasing by the Department of Agriculture during the previous fiscal year.</text></paragraph></subsection></section><section id="id8f208f2283f54ccabd88c316076ca930"><enum>5.</enum><header>Best value procurement pilot program; technical assistance; grants</header><subsection commented="no" display-inline="no-display-inline" id="idf38885b766a4472c8a47e81e2936c304"><enum>(a)</enum><header display-inline="yes-display-inline">Best value procurement pilot program</header><paragraph commented="no" display-inline="no-display-inline" id="ided007d4f28864a74a8fb4b64e7b0391d"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish and carry out a pilot program that uses a tradeoff process to select bids for food procurement contracts that deliver the overall best value and target purchases under covered authorities of foods listed in paragraphs (1) through (4) of section 4(b), using evaluation criteria established under paragraph (2).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id87053b2cbe5247f08eec451bb7a05de5"><enum>(2)</enum><header>Establishment of evaluation criteria</header><text>The Secretary shall establish the evaluation criteria described in paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc6ce4eacb59f4deaadb06da62b1278d8"><enum>(A)</enum><text display-inline="yes-display-inline">after providing notice and an opportunity for public comment; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcd106c2e5f864a44ae19dc25676ff83e"><enum>(B)</enum><text>by providing opportunities for engagement with—</text><clause commented="no" display-inline="no-display-inline" id="idA115A48ECEAE4B2F995A6A61DAB14CB5"><enum>(i)</enum><text display-inline="yes-display-inline">beginning farmers, fishermen, and ranchers;</text></clause><clause commented="no" display-inline="no-display-inline" id="idA9F3CF3BD89945AC982EA02FB05852CB"><enum>(ii)</enum><text display-inline="yes-display-inline">veteran farmers, fishermen, and ranchers; </text></clause><clause id="id3F37D6B40A3B41359B0DE6C5CA8FC2A6" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">socially disadvantaged farmers, fishermen, and ranchers; </text></clause><clause id="id918378d432b148448e810187c17ed40a"><enum>(iv)</enum><text>small and mid-sized farms, fishing businesses, and ranches;</text></clause><clause id="id306bf2c655e0485e89d1ac66b86fd568"><enum>(v)</enum><text>individuals who follow religious or restricted diets;</text></clause><clause id="id74cddea8faba493883d9ab993de7ccd1"><enum>(vi)</enum><text>Indian Tribes;</text></clause><clause id="id2e1d79b524c74410bff470c0db6d207e"><enum>(vii)</enum><text>Native Hawaiians;</text></clause><clause id="idf1624f771d7d4bffa627feb483969ef1" commented="no" display-inline="no-display-inline"><enum>(viii)</enum><text>Native Alaskans;</text></clause><clause commented="no" display-inline="no-display-inline" id="id6742736ecdde4dc2ba4d3a08bfe9c0e9"><enum>(ix)</enum><text>workers in the food system, including workers employed on farms, in food processing facilities and warehouses, and in food transportation; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id34cb80622639495a87c71a1c88a6f9f4"><enum>(x)</enum><text>entities that use commodity programs of the Department of Agriculture, including child nutrition providers and food banks.</text></clause></subparagraph></paragraph><paragraph id="id164865880a3c4bfca2970625e22760bd"><enum>(3)</enum><header>Requirement</header><text>The Secretary shall annually select bids under the pilot program established under this subsection in an amount that is not less than 20 percent of the annual food spending of the Department of Agriculture under the covered authorities.</text></paragraph><paragraph id="idfeeda6ac08304990bbfee270cf39afff"><enum>(4)</enum><header>Report to Congress</header><text>Not later than January 1, 2025, and each year thereafter throughout the duration of the pilot program under this subsection, the Secretary shall submit to the Committee on Agriculture, Nutrition, and Forestry of the Senate and the Committee on Agriculture of the House of Representatives a report describing the progress of the Secretary in implementing the pilot program, including—</text><subparagraph id="idcd3ff445873a468ea5789b4c0030f4d8"><enum>(A)</enum><text>the number of bid solicitations selected under the pilot program;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9b1e56af4f9a4dbe9089b796882c47e5"><enum>(B)</enum><text display-inline="yes-display-inline">the total amount spent by the Department of Agriculture on purchases made through the pilot program;</text></subparagraph><subparagraph id="id6308443c4ce0408db9bd86e77c5a090a"><enum>(C)</enum><text>a description of the evaluation criteria established under paragraph (2); and</text></subparagraph><subparagraph id="idba3668d3685d4bdc891b831534c30ae1"><enum>(D)</enum><text>an evaluation of the solicitation process used for the pilot program that includes input from vendors.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7fe0d1f8455f490dbb81dbcafcf7ad4c"><enum>(5)</enum><header>Termination</header><text>The pilot program established under this subsection shall terminate on the date that is 5 years after the date of enactment of this Act. </text></paragraph></subsection><subsection id="id5b8a07b5ae304c04a066b1668864154c"><enum>(b)</enum><header>Technical assistance</header><paragraph id="id25d71caf842d4d65a8f3bac884070a51"><enum>(1)</enum><header>Participation in procurement programs</header><text>The Secretary shall provide technical assistance to support equitable participation in the procurement programs of the Department of Agriculture, including technical assistance in obtaining necessary food safety training or certification, to—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4124926E9F5347E4A142569AE09297E1"><enum>(A)</enum><text display-inline="yes-display-inline">beginning farmers, fishermen, and ranchers;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAF55357D5689410F8156B865605A4FEA"><enum>(B)</enum><text display-inline="yes-display-inline">veteran farmers, fishermen, and ranchers; </text></subparagraph><subparagraph id="idB85F0CCFE328491CBF677FCBB2E88B8C" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">socially disadvantaged farmers, fishermen, and ranchers; and</text></subparagraph><subparagraph id="idFEBE594DE3174212900D9173E07FF20F" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text>small and mid-sized farms, fishing businesses, and ranches.</text></subparagraph></paragraph><paragraph id="id672d8ac6e9864b3ab0ce2a210ad3a42c"><enum>(2)</enum><header>Small business certification</header><text>The Secretary shall coordinate with the Administrator of the Small Business Administration to provide technical assistance in becoming certified as eligible for the award of contracts pursuant to section 8(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637(a)</external-xref>) to—</text><subparagraph commented="no" display-inline="no-display-inline" id="idC114CB5401034E3786830BAA7BA36B36"><enum>(A)</enum><text display-inline="yes-display-inline">beginning farmers, fishermen, and ranchers;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE8C710533E9C455A8A47DE5E73846B01"><enum>(B)</enum><text display-inline="yes-display-inline">veteran farmers, fishermen, and ranchers; </text></subparagraph><subparagraph id="id83B47E48AEAF45A18B6EF6DBF08F7251" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">socially disadvantaged farmers, fishermen, and ranchers; and</text></subparagraph><subparagraph id="id6149AC007C32452CA85A01351FBF25EE" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text>small and mid-sized farms, ranches, and fishing businesses that are structured as family farms. </text></subparagraph></paragraph></subsection><subsection id="idca11bf6e777c4f008289972545282787"><enum>(c)</enum><header>Grants</header><paragraph id="id79444c490c7b40d4b3140c80e69c8545"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a competitive grant program to assist eligible applicants described in paragraph (5) in participating in the procurement programs of the Department of Agriculture.</text></paragraph><paragraph id="id850732b956014f2dba6f907a4841e184"><enum>(2)</enum><header>Term</header><text>The term of a grant awarded under this subsection shall be not more than 3 years.</text></paragraph><paragraph id="id3f846d65d3bf4525a49fcebce5b5230d"><enum>(3)</enum><header>Use of funds</header><text>A grant awarded under this subsection may be used for any of the following activities:</text><subparagraph id="ida61d3b22e8aa47f8992962bf7a1eabd1"><enum>(A)</enum><text>To make upgrades necessary to obtain food safety accreditations and audits required to become a vendor for the Department of Agriculture.</text></subparagraph><subparagraph id="id0234f375077c4dd68328451278e19155"><enum>(B)</enum><text>To pay for the cost of a food safety accreditation and audit.</text></subparagraph><subparagraph id="idfeed23de59c144c79556f56094ce62ea"><enum>(C)</enum><text>To purchase liability insurance.</text></subparagraph><subparagraph id="ide9a12577fd4440e79e82d7c6ce6db84b"><enum>(D)</enum><text>To develop and execute a food safety plan.</text></subparagraph></paragraph><paragraph id="id4523df9517454549861218819fb04f8d"><enum>(4)</enum><header>Distribution</header><text>The Secretary shall ensure geographic diversity in grants awarded under this subsection.</text></paragraph><paragraph id="id78f51edb7e3f442f9857795e62dc68c2"><enum>(5)</enum><header>Eligibility</header><text>Applicants eligible for grants under this subsection are—</text><subparagraph commented="no" display-inline="no-display-inline" id="id08D31F399E8649F6AD0D6B80BDF30579"><enum>(A)</enum><text display-inline="yes-display-inline">beginning farmers, fishermen, and ranchers;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBEAD096E93EA49F4A8FB7E82E1A69232"><enum>(B)</enum><text display-inline="yes-display-inline">veteran farmers, fishermen, and ranchers; </text></subparagraph><subparagraph id="id2D87DA34585542FBA1E4B39607AAE274" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">socially disadvantaged farmers, fishermen, and ranchers;</text></subparagraph><subparagraph id="id4A087A04D56D4F9BB32AF9296F65AEF8" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text>small and mid-sized farms, fishing businesses, and ranches;</text></subparagraph><subparagraph id="idba90b41f697e4f95b2d1f6f0869a5d67" commented="no"><enum>(E)</enum><text>agricultural cooperatives, fishing cooperatives, and producer associations composed of the individuals or entities described in any of subparagraphs (A) through (D); and</text></subparagraph><subparagraph id="id193763066e3042deb1b4c60ac7419862"><enum>(F)</enum><text>food hubs that work with the individuals or entities described in any of subparagraphs (A) through (D).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida086820ec32c44e492a09dd493fda73e"><enum>(6)</enum><header>Maximum grant amount</header><text>No eligible applicant described in paragraph (5) may receive more than $100,000 in grants under this subsection.</text></paragraph><paragraph id="id7d27a3e256c8439d80294086420c0c1f"><enum>(7)</enum><header>Reports</header><subparagraph commented="no" display-inline="no-display-inline" id="ida7045c0902b54f43ac690d6797c00238"><enum>(A)</enum><header>Recipients</header><text display-inline="yes-display-inline">Not later than 1 year after receiving a grant under this subsection, and annually thereafter for the period of the grant term, a recipient of a grant under this subsection shall submit to the Secretary a report describing—</text><clause commented="no" display-inline="no-display-inline" id="idfa73aa36e22e4fe99feb0347ebe3ff3f"><enum>(i)</enum><text display-inline="yes-display-inline">how the recipient used the funds; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id8fe7812a8e6d4ad4a33197bea30cd497"><enum>(ii)</enum><text display-inline="yes-display-inline">the progress of the recipient toward becoming a vendor, as described in paragraph (3)(A), if applicable.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8f822a9bcd634a419168a2a9f9ea2d1b"><enum>(B)</enum><header>Secretary</header><text>Not later than January 1, 2025, and each year thereafter in which the term of a grant under this subsection is ongoing, the Secretary shall submit to the Committee on Agriculture, Nutrition, and Forestry of the Senate and the Committee on Agriculture of the House of Representatives a report containing a list of the recipients of the grants, including a summary of—</text><clause commented="no" display-inline="no-display-inline" id="id4f099f694f9e41098f437b1e49bffefe"><enum>(i)</enum><text display-inline="yes-display-inline">how the recipients used the funds; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id83eabace262c4caa9c112b278d1d6023"><enum>(ii)</enum><text display-inline="yes-display-inline">the recipients that have become vendors, as described in paragraph (3)(A), if applicable.</text></clause></subparagraph></paragraph></subsection><subsection id="id517174adbd774d1da459424c85e94809"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $25,000,000 for fiscal year 2025, to remain available through fiscal year 2030.</text></subsection></section></legis-body></bill>
