which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To reform the Centers for Disease Control and Prevention, limit the scope of public health authorities, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>End COVID Tyranny Act</short-title></quote>.</text></section><section id="id3e2ff0342503459c85fd2484c6d04ef0"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph commented="no" display-inline="no-display-inline" id="idf633eb10a2744b45b86c88efcd491b1b"><enum>(1)</enum><text>the vaccine mandate in response to COVID–19 that applied to military personnel and the resulting discharge of servicemen and servicewomen threatened our military readiness;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida43359e8ff864b0b8f4d6dc24ddfe06c"><enum>(2)</enum><text display-inline="yes-display-inline">prolonged school closures in response to COVID–19 directly impacted students’ schooling and contributed to learning loss;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1d29abe47408428db69d9bc1c7cd8e90"><enum>(3)</enum><text display-inline="yes-display-inline">steps to distribute vaccines based on race do not reflect the values of the United States;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida214cdb7b6e14b7ca79253378d251cc8"><enum>(4)</enum><text display-inline="yes-display-inline">during the COVID–19 public health emergency, Federal agencies colluded with private corporations to stifle legitimate political speech and infringe on the first amendment rights of Americans;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6318853adb4d49b087eef5ab9cd7f055"><enum>(5)</enum><text display-inline="yes-display-inline">economic lockdowns threatened the livelihoods of American families, and directly led to record closures of small businesses;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc951955641bc429097c1e183a10bbf47"><enum>(6)</enum><text display-inline="yes-display-inline">on account of the Centers for Disease Control and Prevention’s inconsistent and confusing messaging, which was not based on science, the United States relinquished its ability to effectively control the pandemic; </text></paragraph><paragraph id="id2a37b1fa12f0468fa41f5d085bff753a"><enum>(7)</enum><text>forced lockdowns worsened an already pressing mental health crisis, leading to an increase in suicides rates and drug abuse; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddd8ff9e6050341638ef0742962969d44"><enum>(8)</enum><text>the roles of the Centers for Disease Control and Prevention and other agencies and offices of the Department of Health and Human Services are strictly advisory, and such agencies and offices have not been empowered by Congress to establish laws or mandates.</text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id24736ada85994bddb4a8d33719aff7ec"><enum>3.</enum><header display-inline="yes-display-inline">Prohibitions on imposing a mask mandate in education settings</header><subsection commented="no" display-inline="no-display-inline" id="idefe61bb95a654f93a2b39fb19907c13f"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id98406cf7190c4e1481af76f4e399015e"><enum>(1)</enum><header>Applicable period</header><text>The term <term>applicable period</term> means the period that begins on the date of enactment of this Act and ends on December 31, 2024.</text></paragraph><paragraph id="idad3b493fcc444b43aa8402ef23bdf81d"><enum>(2)</enum><header>Head Start program</header><text>The term <term>Head Start program</term> means such a program, including an Early Head Start program, carried out under the Head Start Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9831">42 U.S.C. 9831 et seq.</external-xref>).</text></paragraph><paragraph id="id7b7873f7114748859e85655b8f730ae2"><enum>(3)</enum><header>Mask</header><text>The term <term>mask</term> means a material covering the nose and mouth of the wearer, excluding face shields.</text></paragraph><paragraph id="id977442ea8a2a43839aeed445a3a7ce64"><enum>(4)</enum><header>Mask mandate</header><text>The term <term>mask mandate</term> means an order, directive, or ordinance, in response to a public health emergency, that requires an individual to wear a mask to enter, or remain in, a facility.</text></paragraph></subsection><subsection id="id8f16b730ec334149abc38020a1781faa"><enum>(b)</enum><header>Restriction on the use of Federal funds</header><text>During the applicable period, notwithstanding any other provision of law, no Federal funds may be obligated or expended to propose, establish, implement, or enforce, directly or indirectly through the imposition of a condition on receipt of Federal funds, any requirement that an individual wear a mask or comply with a mask mandate while in a facility of a Head Start program.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id85c748e2263547f99ed35c00a4f54608"><enum>(c)</enum><header display-inline="yes-display-inline">No mask requirements in schools or institutions of higher education</header><text>Notwithstanding any other provision of law, during the applicable period, neither the President nor any other Federal officer, employee, agency, or office, shall issue or enforce a mask mandate requiring individuals to wear a mask in any facility of a Head Start program.</text></subsection><subsection id="ide878ed973b1843a2859680e6395e0bd9"><enum>(d)</enum><header>No authority To refuse access to education</header><text>During the applicable period, a Head Start program shall not refuse entry to, or participation in, any educational service or activity to a child, teacher, parent, or other individual on the basis that the child, teacher, parent, or other individual refuses to wear a mask or comply with a mask mandate during the educational service or activity.</text></subsection><subsection id="id6b41e39468ac43d3a69ddc3358e8f07a"><enum>(e)</enum><header>No authority To issue or enforce mask mandates in educational settings in response to a public health emergency</header><text>Section 361 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/264">42 U.S.C. 264</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0dc480424ca14057a442bcc75faf6cd0"><subsection id="idf10eb0ef1df04e4b950ccd64dd2eb8e2"><enum>(f)</enum><text>Nothing in this section authorizes the Secretary to require individuals to comply with a mask mandate (as defined in section 2(a) of the <short-title>End COVID Tyranny Act</short-title>) in any facility of a Head Start program (as defined in such section 2(a)) in response to a public health emergency declared under section 319 during the applicable period (as defined in such section 2(a)).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id8107dd6343d94425bb20c2eedca8e69a"><enum>4.</enum><header>Appointment and authority of the Director of the Centers for Disease Control and Prevention; terms of CDC and NIH directors</header><subsection commented="no" display-inline="no-display-inline" id="idf665f30c5a7c427c8765fce904fcf68f"><enum>(a)</enum><header display-inline="yes-display-inline">Appointment authority</header><text display-inline="yes-display-inline">Section 2101(b) of the Prepare for and Respond to Existing Viruses, Emerging New Threats, and Pandemics Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/328">Public Law 117–328</external-xref>) is amended by striking <quote>January 20, 2025</quote> and inserting <quote>the date of enactment of the <short-title>End COVID Tyranny Act</short-title></quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id4f4083257cae4d428fcfefee72b59c2e"><enum>(b)</enum><header>Term of CDC director</header><text>Section 305(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/242c">42 U.S.C. 242c(a)</external-xref>) is amended by adding at the end the following: <quote>No individual may serve as Director for a total period of more than 12 years.</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idff5db010f2d54fd48b2cb19346af4410"><enum>(c)</enum><header>Term of NIH director</header><text>Section 402(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/282">42 U.S.C. 282(a)</external-xref>) is amended by adding at the end the following: <quote>No individual may serve as Director of NIH for a total period of more than 12 years.</quote>.</text></subsection></section><section id="id69c9a7319d8f4b8db9fdcc61e33c8ed2" commented="no"><enum>5.</enum><header>Limiting the CDC strategic plan</header><text display-inline="no-display-inline">Section 305(c)(2)(A) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/242c-1">42 U.S.C. 242c–1(c)(2)(A)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id335ba59191024604b9549c24aaa35cc9"><enum>(1)</enum><text display-inline="yes-display-inline">in clause (i), by striking <quote>and noncommunicable diseases or conditions, and addressing injuries, and occupational and environmental hazards</quote> and inserting <quote>diseases</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id83855091415c4c9f9d0ce2be62568274"><enum>(2)</enum><text display-inline="yes-display-inline">in clause (ii), by striking <quote>or conditions</quote>; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id77ff5b86afc04ae5914e589d431cfe46"><enum>(3)</enum><text display-inline="yes-display-inline">in clause (iii), by adding <quote>and</quote> at the end;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ideaff04d52fa14990a10fa010c1cdaf3d"><enum>(4)</enum><text>in clause (iv), by striking <quote>; and</quote> and inserting a period; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4f2df2597424426b928fe58aa81a7783"><enum>(5)</enum><text>by striking clause (v).</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="ida8c12ae8df984f64b6f3580a6bc053be"><enum>6.</enum><header>Advisory committee to the CDC Director</header><text display-inline="no-display-inline">Section 305A(c) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/242c-1">42 U.S.C. 242c–1(c)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="ida826f1fec17343d0a7cb42de8f76a235"><enum>(1)</enum><text>in paragraph (1), by striking <quote>by the Secretary under</quote> and inserting <quote>as described in</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idea9a5abdab604a2a9d98bb41a89d2ca3"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking subparagraphs (A) and (B) and inserting the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id16D37D75AB2D4E6BAC82E9A89258913F"><subparagraph id="id5526f8af3bdc40e79b054d83e6087387" commented="no"><enum>(A)</enum><text>Three members shall be appointed by the Secretary of Health and Human Services—</text><clause id="idfa50291d501d45e5b0f6ed669f963f5b" commented="no"><enum>(i)</enum><text>1 of whom shall be appointed to represent the Department of Health and Human Services; and</text></clause><clause id="id298b326621fb4b22bd48f365066c6678" commented="no"><enum>(ii)</enum><text>1 of whom shall be a public health official.</text></clause></subparagraph><subparagraph id="id7d26424810344abaaf0907185f739358" commented="no"><enum>(B)</enum><text>Two members shall be appointed by the majority leader of the Senate.</text></subparagraph><subparagraph id="id5c6c9987a0d048c189866a51d876f086" commented="no"><enum>(C)</enum><text>Two members shall be appointed by the minority leader of the Senate.</text></subparagraph><subparagraph id="idc1a66f68b7824281bc60d977247debfe" commented="no"><enum>(D)</enum><text>Two members shall be appointed by the Speaker of the House of Representatives.</text></subparagraph><subparagraph id="id2fe17ef651ec4e229e0fbe5176ef20fc" commented="no"><enum>(E)</enum><text>Two members shall be appointed by the minority leader of the House of Representatives.</text></subparagraph><subparagraph id="id368612322d82491494f0186868106169" commented="no"><enum>(F)</enum><text>Four members shall be appointed by the Comptroller General of the United States.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id530b2f0d858246e48445b36a46ed7f5f"><enum>7.</enum><header>Limiting the scope of regulations of the Department of Health and Human Services to control communicable diseases</header><text display-inline="no-display-inline">Section 361(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/264">42 U.S.C. 264(a)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idbc3c38c395e84f569638d2475d2d39b8"><subsection commented="no" display-inline="no-display-inline" id="iddf6b6bd2f30e42e39b73ebc1df514aaa"><enum>(a)</enum><text display-inline="yes-display-inline">To prevent the introduction, transmission, or spread of communicable diseases from foreign countries into the States or possessions, or from one State or possession into any other State or possession, the Secretary may make and enforce regulations for the inspection, fumigation, disinfection, sanitation, pest extermination, or destruction of animals or articles found to be so infected or contaminated as to be sources of dangerous infection to human beings.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id434706f8b600461c8da33c088fc2f594"><enum>8.</enum><header>Eligibility for organ transplantation</header><subsection id="id9f80e95160d844e7b3b0eaaaa044e206"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law—</text><paragraph id="id37132fed43e1430facb3bb8cdd8c0db5"><enum>(1)</enum><text>no individual may be determined to be ineligible for organ donation or receipt of an organ transplant on the basis of the COVID–19 vaccination status of the individual;</text></paragraph><paragraph id="id13fa0d678dc44391a0d0c5a49fb378f6"><enum>(2)</enum><text>no individual may be given a higher or lower priority for such a donation or receipt on such basis; and</text></paragraph><paragraph id="id5cc7f1ac465446668f1d9fb96d841125"><enum>(3)</enum><text>the incidence of COVID–19 positive rates in a geographic area or region, as determined by public health officials, may not be a factor in determining eligibility to donate organs or to receive organs.</text></paragraph></subsection><subsection id="id535c7e854b884128b7239212cec41a3e"><enum>(b)</enum><header>Application of requirements</header><text>Paragraphs (1) through (3) of subsection (a) shall apply with respect to all organ donations and receipt of organ transplants in the United States, including under the laws administered by the Secretary of Veterans Affairs and the laws administered by the Secretary of Defense.</text></subsection><subsection id="id84335a9fcd8a43a5933b10cd662ccb42"><enum>(c)</enum><header>Organ procurement and transplantation network</header><text>Section 372(b) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/274">42 U.S.C. 274(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5f895b25e2614de6b86d73c2d7173890"><paragraph id="id23987de43b8444cdb5d065291adb4382"><enum>(4)</enum><header>Clarification regarding COVID–19 vaccination status</header><text>The criteria and standards established under paragraph (2) may not include any consideration of the COVID–19 vaccination status of organ donors or recipients, or of the incidence of COVID–19 positive rates in a geographic area or region, as determined by public health officials.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="idb6766c479cae4a32821d726444dea886" commented="no"><enum>9.</enum><header>Congressional approval for public health emergencies</header><text display-inline="no-display-inline">Section 319(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d(a)</external-xref>) is amended by striking the third and fourth sentences and inserting the following: <quote>Determinations that terminate under the preceding sentence may be renewed by a majority vote in both chambers of Congress, and such a renewal period terminates upon the Secretary declaring that the emergency no longer exists or the expiration of the 90-day period beginning on the date on which both chambers of Congress have voted in favor of such renewal, whichever occurs first. Not later than 48 hours after making a determination under this subsection of a public health emergency, the Secretary shall submit to the Congress written notification of the determination.</quote>.</text></section><section id="id0712c5171579465bb385405a1a6f90b9"><enum>10.</enum><header>Hospital visitation</header><subsection commented="no" display-inline="no-display-inline" id="id8b29e4c237e84f9f8a707f1361d6c236"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1861(e)(8) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(e)(8)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id1ae8066c0aa54c1ea69e0385cb457578"><enum>(1) </enum><text display-inline="yes-display-inline">in paragraph (8), by striking <quote>and</quote> at the end;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2c209d431568472082d21772487ff66e"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraph (9) as paragraph (10); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9af3e45d226c4a92a502451710ee8f4c"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after paragraph (8) the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6E6886BCFC604EE2BFE5B619BBF823E9"><paragraph id="ide31ecc165099427da54cd75bcd2ff94e"><enum>(9)</enum><text>has written policies and procedures regarding the visitation rights of individuals receiving items and services at the institution, which shall include—</text><subparagraph commented="no" display-inline="no-display-inline" id="id23e4711b8c904e62a10518b010c2a8e4"><enum>(A)</enum><text display-inline="yes-display-inline">a description of any clinically necessary or reasonable restriction or limitation that such institution may need to place on such rights and the reasons for the clinical restriction or limitation; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idebf90e1ca3684fcda8dc1d32dd9d125a"><enum>(B)</enum><text display-inline="yes-display-inline">a requirement that such institution inform each such individual of—</text><clause commented="no" display-inline="no-display-inline" id="id64d12a9cd6b9440d9ac726ce2cc53216"><enum>(i)</enum><text display-inline="yes-display-inline">the right, subject to the individual’s consent, to receive the visitors whom the individual designates, including a spouse, another family member, or a friend; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id35283a02cec14bdd8ee8495670af5df2"><enum>(ii)</enum><text display-inline="yes-display-inline">the individual’s right to withdraw or deny such consent at any time; and</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id17a0f1174c824eef98834f2c606c2c84"><enum>(b)</enum><header>Conforming amendments</header><text>Section 1861(e)(8) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(e)(8)</external-xref>) is amended, in the flush matter following paragraph (1), as redesignated by subsection (a)(2)—</text><paragraph commented="no" display-inline="no-display-inline" id="ida74b7087cb7643eebe05ef6bf07d79cf"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>paragraph (9)</quote> and inserting <quote>paragraph (10)</quote>; and</text></paragraph><paragraph id="id964edb75625841078b2121df46f55f15"><enum>(2)</enum><text>in subparagraph (C), by striking <quote>paragraph (9)</quote> each place it appears and inserting <quote>paragraph (10)</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id287f0a34d5e34a4ca62b0c32fa3da815"><enum>(c)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall take effect on the date that is 1 year after the date of enactment of this section.</text></subsection></section><section id="idefea26f2e4184aa1824a9266adedecd6"><enum>11.</enum><header>Foreign laboratory inspections and certification</header><subsection id="idb58a9769f5804e4aa03f7c528445bca4"><enum>(a)</enum><header>In general</header><text>Section 495 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/289d">42 U.S.C. 289d</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id51845e99ed094b80b843cd113c579b5e"><subsection id="idca43400967ef4b7e9bfa646f10d8f205"><enum>(f)</enum><header>Inspection and certification of foreign laboratories</header><paragraph id="idd197160396eb410cae8113612e188d50"><enum>(1)</enum><header>In general</header><text>As a condition of eligibility to perform research involving animals under a grant, contract, or cooperative agreement administered by the National Institutes of Health or any national research institute, a laboratory located outside the United States that receives Federal funds shall be subject to quarterly inspections to evaluate compliance with the requirements under this title.</text></paragraph><paragraph id="id05db99118efa45ceafa49e2e36d7c2b2"><enum>(2)</enum><header>Inspection and certification requirements</header><subparagraph id="id176bd5d8cfb4419284fcc2598d0a3cc2"><enum>(A)</enum><header>Quarterly inspection process</header><text>The Secretary, in consultation with appropriate foreign regulatory authorities and international organizations, shall establish and implement a process for conducting quarterly inspections of foreign laboratories that have received an Animal Welfare Assurance (as defined in section 9.2 of title 42, Code of Federal Regulations) to ensure their continued compliance with the requirements under this title.</text></subparagraph><subparagraph id="ida9fe01addabb4236bf5bc2a61778c7b6"><enum>(B)</enum><header>Assurances</header><text>The inspection process established by the Secretary pursuant to subparagraph (A) shall evaluate the compliance of foreign laboratories with the requirements under subsection (c)(1), including—</text><clause id="id19fa2ec6f16a45698585195dc98bb500"><enum>(i)</enum><text>the establishment and operation of animal care committees;</text></clause><clause id="idde8a4e4deb7e4598b83ad72d9a113d30"><enum>(ii)</enum><text>the review and evaluation of animal care and treatment; and</text></clause><clause id="id9ad8dd63b9804d5db6d0bbae07cbe7f1"><enum>(iii)</enum><text>proper record-keeping and reporting procedures.</text></clause></subparagraph></paragraph><paragraph id="id65db13c5788b4313acc9b1e6bde504b5"><enum>(3)</enum><header>Certification of compliance and public access</header><subparagraph id="ide7fb6a8220cf4d7f91d49f48e5971c41"><enum>(A)</enum><header>Issuance</header><text>Following each quarterly inspection required under paragraph (2), the inspecting authority shall issue a certification of compliance to the laboratories determined to be in compliance with the requirements under paragraph (2)(B).</text></subparagraph><subparagraph id="id5530e57845714f9b8d0c4ff7f536d26c"><enum>(B)</enum><header>Public access</header><text>Copies of the certificates of compliance issued pursuant to subparagraph (A) shall be maintained by the Office of Laboratory Animal Welfare and shall remain publicly accessible with other information about currently issued Animal Welfare Assurances.</text></subparagraph><subparagraph id="id5e08b1d0f46c48608d64742e474b60d9"><enum>(C)</enum><header>Corrective action</header><text>Laboratories that fail to comply with the requirements under paragraph (2)(B) shall be given a reasonable opportunity to take corrective action.</text></subparagraph></paragraph><paragraph id="id9e4abfd8585945adaafa9a1666929cb3"><enum>(4)</enum><header>Suspension or revocation of grant or contract for non-compliant foreign laboratories</header><text>If the Secretary determines that a foreign facility is not in compliance with the requirements under subsection (c)(1) and does not take appropriate corrective action after given a reasonable opportunity to do so, the Secretary shall suspend or revoke the applicable grant, contract, or cooperative agreement involving research on animals under such conditions as the Director of NIH determines appropriate, in accordance with subsection (d).</text></paragraph><paragraph id="id932b480de5f54421b89df545377e8572"><enum>(5)</enum><header>Designation of inspecting authority</header><text>The Secretary, in consultation with the Director of NIH, shall designate an appropriate authority to conduct the quarterly inspections required under paragraph (2) and issue certifications of compliance in accordance with paragraph (3).</text></paragraph><paragraph id="id7b876a4a9a7f4b098dd9904fdce9dce0"><enum>(6)</enum><header>Coordination with foreign authorities</header><text>The Secretary and the Director of NIH shall coordinate with appropriate foreign regulatory authorities and enter into agreements with foreign governments, as needed, to facilitate the implementation and enforcement of this subsection while respecting the sovereignty and laws of foreign nations.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id04c2c817792a487a8f425b1f6a2a5e28"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on the date that is 180 days after the date of enactment of this Act. </text></subsection></section><section id="idec221d1ed5014ea086a29f928cecaff1"><enum>12.</enum><header>Transfer of offices to NIH</header><subsection commented="no" display-inline="no-display-inline" id="id66ec6a566d4044028f313fae4861cfc5"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Effective on the date that is 2 years after the date of enactment of this Act, notwithstanding any other provision of law, the authorities, functions, personnel, and assets of the offices described in subsection (b) shall be transferred from the Centers for Disease Control and Prevention to the National Institutes of Health.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id4c484475996f4550b40ad2409d098846"><enum>(b)</enum><header>Offices described</header><text display-inline="yes-display-inline">The offices described in this subsection are the following:</text><paragraph commented="no" display-inline="no-display-inline" id="id0b626fa7441b4367a83a80e0819e048a"><enum>(1)</enum><text>The National Center on Birth Defects and Developmental Disabilities.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb3fc00fd059745d5b250a6d9a4cd9c7d"><enum>(2)</enum><text>The National Center for Chronic Disease Prevention and Health Promotion.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida68ecf014a744b32844778a03fd4e82f"><enum>(3)</enum><text>The National Center for Environmental Health.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb447fdd435a146379a9bb3fc3492bc7c"><enum>(4)</enum><text>The Agency for Toxic Substances and Disease Registry.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1438a9beda3c4f26a7b4ee921ec03441"><enum>(5)</enum><text>The National Center for Health Statistics.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3563fb13c43f40939e030c0432717989"><enum>(6)</enum><text>The National Center for HIV, Viral Hepatitis, STD, and TB Prevention.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idab7040257028420d95049f7e00c78c94"><enum>(8)</enum><text>The National Institute for Occupational Safety and Health.</text></paragraph></subsection></section><section id="idF7373EDC3F0B41089B110E175CEACC11"><enum>13.</enum><header>Regulations</header><text display-inline="no-display-inline">Not later than 90 days after the date of enactment of this Act, the Secretary of Health and Human Services shall issue such new or revised regulations as are necessary to carry out this Act (including the amendments made by this Act). </text></section><section id="id1BE578299DFD430299E613F6E32716D3" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>14.</enum><header>Preemption</header><text display-inline="no-display-inline">The provisions of this Act (including the amendments made by this Act) shall supersede any provision of Federal, State, Tribal, territorial, or local law, declaration, guidance, or directive to the extent that such law, declaration, guidance, or directive is inconsistent with this Act (including such amendments). </text></section></legis-body></bill>
