<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 3382</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20231130">November 30, 2023</action-date><action-desc><sponsor name-id="S399">Mr. Hawley</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Food, Conservation, and Energy Act of 2008 to protect ranchers from out-of-state regulation that interferes with interstate livestock production, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Interstate Commerce for Livestock Producers Act</short-title></quote>.</text></section><section id="ida83457ff20ac4a968ed9a51a7df2479a"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to preempt States from enforcing State laws incongruent with, disproportionate to, or otherwise in conflict with livestock laws and regulations in other States, such as the laws and regulations described in National Pork Producers Council v. Ross, 598 U.S. 356 (2022).</text></section><section id="id10c91a1ce0fa4f92bb0b370be4c7d31a"><enum>3.</enum><header>State interference with interstate livestock production prohibited</header><text display-inline="no-display-inline">The Food, Conservation, and Energy Act of 2008 is amended by inserting after section 11008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/246">Public Law 110–246</external-xref>; 122 Stat. 2120) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE17421AD19374256A10725F379E5609E"><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idfd9864a24d8344eead295a7110558599"><enum>11009.</enum><header>Preemption of State and local interference with interstate animal production</header><subsection commented="no" display-inline="no-display-inline" id="ida5d2b886aa564207acc89530f42b62db"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id239a4c8cc1044b6baed85fceb3ba119a"><enum>(1)</enum><header>Disease</header><text display-inline="yes-display-inline">The term <term>disease</term> has the meaning given the term—</text><subparagraph commented="no" display-inline="no-display-inline" id="id44E2ADCF14AE465EB13C7893F561770A"><enum>(A)</enum><text display-inline="yes-display-inline"><term>agricultural disease</term> in section 14102; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id37f059d67ad841a7a4bab379ef431aca"><enum>(B)</enum><text display-inline="yes-display-inline">in section 10403 of the Animal Health Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/7/8302">7 U.S.C. 8302</external-xref>).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id324130da66534332948eeb247365f118"><enum>(2)</enum><header>Livestock</header><text display-inline="yes-display-inline">The term <term>livestock</term> has the meaning given the term in—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida919527b7c264f5e9a6fa64de3f93271"><enum>(A)</enum><text display-inline="yes-display-inline">section 10403 of the Animal Health Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/7/8302">7 U.S.C. 8302</external-xref>); </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide51f18a849f74be4a08faff58add96fc"><enum>(B)</enum><text display-inline="yes-display-inline">section 2103 of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/6502">7 U.S.C. 6502</external-xref>); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id574292cf80a4439d80a4f6efea4094b0"><enum>(C)</enum><text display-inline="yes-display-inline">section 602 of the Agricultural Act of 1949 (7 U.S.C 1471).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf1537596b48a441f981be32b712b86d9"><enum>(3)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means</text><subparagraph commented="no" display-inline="no-display-inline" id="id1707c5e670134ad5b87be434f9f9c80d"><enum>(A)</enum><text display-inline="yes-display-inline">a State;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb48582f75c264bbc9b7b7478c828c3e7"><enum>(B)</enum><text display-inline="yes-display-inline">the District of Columbia;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbb6f3e48aaca4daa95968685aca0e279"><enum>(C)</enum><text display-inline="yes-display-inline">the Commonwealth of Puerto Rico;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id961edcbea494410db340d642843b0220"><enum>(D)</enum><text display-inline="yes-display-inline">Guam; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbc65c8b2007546c78aa49c976fdc56d7"><enum>(E)</enum><text display-inline="yes-display-inline">the Commonwealth of the Northern Mariana Islands; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4e6f5ce405a043bf814c34d169f99e8a"><enum>(F)</enum><text display-inline="yes-display-inline">the Virgin Islands of the United States; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0be4505bce754eba8d4b09c750f27fb7"><enum>(G)</enum><text display-inline="yes-display-inline">any territory or possession of the United States.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida588f5e908834557a68f40ebd86a1a02"><enum>(b)</enum><header>State law preemption</header><text display-inline="yes-display-inline">No State or local government, nor any subdivision thereof, shall enforce any State or local law, rule, or ordinance that regulates the raising, production, use, transportation, importation, sale, or distribution of any livestock or goods deriving from livestock if—</text><paragraph commented="no" display-inline="no-display-inline" id="idb3f0414d6a5044ba8c792622e03a6628"><enum>(1)</enum><text display-inline="yes-display-inline">the livestock or livestock-derived goods—</text><subparagraph commented="no" display-inline="no-display-inline" id="id932e69a69ea846f4b2bc0070e3def9a9"><enum>(A)</enum><text display-inline="yes-display-inline">are used, transported, distributed, sold, or offered for sale in or through, or by using any means, channel, facility, or instrumentality of, interstate or foreign commerce; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id498d6833914f4b64966ea6df3eb4c707"><enum>(B)</enum><text display-inline="yes-display-inline">are raised or produced in another State; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1a089a4d13e44cb6a99a2e9ca8d44f1e"><enum>(2)</enum><text display-inline="yes-display-inline">that law, rule, or ordinance—</text><subparagraph commented="no" display-inline="no-display-inline" id="id00d53978c98a481795349367a5949741"><enum>(A)</enum><text display-inline="yes-display-inline">is incongruent with, disproportionate to, or otherwise in conflict with any applicable regulation under the laws, rules, or ordinances of the State or local subdivision in which the applicable livestock or livestock-derived goods are raised or produced; or</text></subparagraph><subparagraph id="id54dd548d12634b648c3cfb63b9d6e780"><enum>(B)</enum><text>imposes any requirement not present in the laws, rules, or ordinances of the State or local subdivision in which the applicable livestock or livestock-derived goods are raised or produced. </text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id514bc4de1e8840d6931de57b15f02449"><enum>(c)</enum><header>Limitations</header><text display-inline="yes-display-inline">Subsection (b) shall not apply to any State or local law, rule, or ordinance that regulates—</text><paragraph commented="no" display-inline="no-display-inline" id="id48d84fb4c1334aec989b00b84a98e7c2"><enum>(1)</enum><text display-inline="yes-display-inline">the import of animals suffering from or likely to suffer from a recognized animal disease, including the animal diseases described in section 71.3 of title 9, Code of Federal Regulations (or successor regulations);</text></paragraph><paragraph id="idf8149ac7f24d464e9545f7e1bbc4b40c"><enum>(2)</enum><text>the raising of livestock if the law, rule, or ordinance relates only to conduct occurring entirely within the applicable State or locality and does not relate to the production, use, transportation, importation, sale, or distribution of livestock or livestock-derived goods occurring in another State; or</text></paragraph><paragraph id="idb5c24670500b428388b4319119669c66"><enum>(3)</enum><text>the production of livestock if the law, rule, or ordinance relates only to conduct occurring entirely within the applicable State or locality and does not relate to the raising, use, transportation, importation, sale, or distribution of livestock or livestock-derived goods occurring in another State.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id96f85fe323b348de8155eb233f7c07c0"><enum>(d)</enum><header>Enforcement</header><paragraph id="id23fad8a9c0784f8592e9adf930b8a754"><enum>(1)</enum><header>Federal</header><text>The Attorney General of the United States may enforce this section by suit for injunctive relief.</text></paragraph><paragraph id="id840850caa0ec43ca84ba9c42d0e9cd9c"><enum>(2)</enum><header>State</header><text>The Attorney General of a State may enforce this section by suit for injunctive relief.</text></paragraph><paragraph id="idecbc3b56a09b41ee87659da093aae378"><enum>(3)</enum><header>Private right of action</header><text>Any individual or entity harmed by a State or local law, rule, or ordinance in violation of this section shall have a private right of action against a State for injunctive relief. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idde744a6a6981476cac63da93acb694e8"><enum>(e)</enum><header>Complete defense</header><text display-inline="yes-display-inline">With respect to any civil action, criminal prosecution, or other enforcement action brought in any Federal, State, or local judicial or administrative tribunal relating to a State or local law, rule, or ordinance preempted by this section, this section shall serve as a complete defense to that action. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="ide979771d75af43dc93918a5e8c04e192"><enum>(f)</enum><header>Rule of construction</header><text>Nothing in this section shall abrogate State sovereign immunity or authorize any suit against a State for monetary damages.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
