which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Energy Policy and Conservation Act to require that the Strategic Petroleum Reserve contain petroleum products produced or refined in the United States, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Replenishing Our American Reserves Act</short-title></quote> or the <quote>ROAR Act</quote>.</text></section><section id="id614F4327E3F44CBA858691E75AD7B5DB"><enum>2.</enum><header>Prioritizing domestic petroleum products for refill of the Strategic Petroleum Reserve</header><subsection id="idEA5656C2ACDF45C287465932DEE12B7C"><enum>(a)</enum><header>In general</header><text>Section 160(c) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6240">42 U.S.C. 6240(c)</external-xref>) is amended—</text><paragraph id="id5ECD4B0B541E4B22958E2871BDE45AAB"><enum>(1)</enum><text>in the first sentence of the matter preceding paragraph (1), by inserting <quote>products</quote> after <quote>petroleum</quote>;</text></paragraph><paragraph id="id77D4B690D3D74A5BA16F012D6B127AED"><enum>(2)</enum><text>in paragraph (5), by striking <quote>and</quote> after the semicolon;</text></paragraph><paragraph id="idD8EF52B6D3DE4502889C0EE1E314FF1B"><enum>(3)</enum><text>by redesignating paragraph (6) as paragraph (7); and</text></paragraph><paragraph id="idB1D25A89B03B463CB1CF16AF8E6B2C73"><enum>(4)</enum><text>by inserting after paragraph (5) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id634F0323698C4F45A8D83F4C5902BB71"><paragraph id="idE2CD79720863466C9DC974A2090B20F1"><enum>(6)</enum><text>effective on the date of enactment of the ROAR Act, ensure that only petroleum products that have been produced or refined in the United States are acquired and injected into the Reserve; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idAED3C56B21BB475C9F45F167459F9D40"><enum>(b)</enum><header>Regulation Updates</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Energy shall promulgate appropriate regulations to update procedures for the acquisition of petroleum products for the Strategic Petroleum Reserve in accordance with the amendments made by this section.</text></subsection></section><section id="idC3DA6F8041844DDB9CE9888CBF00E537"><enum>3.</enum><header>Limitation on the import of petroleum products from certain countries</header><subsection id="id721E952A3B2D462CA13672E368660B6C"><enum>(a)</enum><header>In general</header><text>Section 160 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6240">42 U.S.C. 6240</external-xref>) is amended—</text><paragraph id="idC709564ECD464DE1B43678349466983C"><enum>(1)</enum><text>by redesignating subsections (f) and (h) as subsections (d) and (e), respectively; and</text></paragraph><paragraph id="id26C8A43EEC634F668EE2852221397A53"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0906AB72113B46D4987BD2BB2EE39249"><subsection id="idDA868778518B406692A33E25F99949D9"><enum>(f)</enum><header>Limitation on filling the Strategic Petroleum Reserve</header><paragraph id="idEE159F7D6CA74DE8A4815E284F321A6E"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="id0E7C4B40759048188B7976A07CE71EC4"><enum>(A)</enum><header>Covered country</header><text display-inline="yes-display-inline">The term <quote>covered country</quote> means—</text><clause id="idC5BB707533124F19B1384C9145728907"><enum>(i)</enum><text display-inline="yes-display-inline">Algeria;</text></clause><clause id="id61ABC13DE87C4820ADA945CD82F1FC43"><enum>(ii)</enum><text display-inline="yes-display-inline">Angola;</text></clause><clause id="id4233CB1B62E14A6296B0E2EBEDD4DCBC"><enum>(iii)</enum><text display-inline="yes-display-inline">The Democratic Republic of the Congo;</text></clause><clause id="idCAA9C2832FB1406996EBBDD88A177F89"><enum>(iv)</enum><text display-inline="yes-display-inline">Equatorial Guinea;</text></clause><clause id="idC20CC3D4AEF544789D548A92577FC8A4"><enum>(v)</enum><text display-inline="yes-display-inline">Gabon;</text></clause><clause id="idD17D411F8F4B4F7CB019540131669A95"><enum>(vi)</enum><text display-inline="yes-display-inline">Iran;</text></clause><clause id="idC6AA1D2B91E84B79BA78A0D1FAE3224B"><enum>(vii)</enum><text display-inline="yes-display-inline">Iraq;</text></clause><clause id="id14AE7968C5394FD381452BDA3198E265"><enum>(viii)</enum><text display-inline="yes-display-inline">Kuwait;</text></clause><clause id="id663A4E61E2A84D298DF0868B8D1F8A11"><enum>(ix)</enum><text display-inline="yes-display-inline">Libya;</text></clause><clause id="id9FFD9BDCC8FB495FB47743242D419B4C"><enum>(x)</enum><text display-inline="yes-display-inline">Nigeria;</text></clause><clause id="idF81CDB21B48C43CDBC30897E5D0B4801"><enum>(xi)</enum><text display-inline="yes-display-inline">The People's Republic of China;</text></clause><clause id="idC76DC957A17243ECBE2717A03AAB3AB6"><enum>(xii)</enum><text display-inline="yes-display-inline">The Russian Federation;</text></clause><clause id="id2C65825AD4D347298232C8F8AFEE00AD"><enum>(xiii)</enum><text display-inline="yes-display-inline">Saudi Arabia;</text></clause><clause id="idB578455FDA094669950217B0D3CD8A88"><enum>(xiv)</enum><text display-inline="yes-display-inline">United Arab Emirates; and</text></clause><clause id="id37C39F7737B84B1EBA04FF38E943967D"><enum>(xv)</enum><text display-inline="yes-display-inline">Venezuela.</text></clause></subparagraph><subparagraph id="id51E1577D4F7843F69CF7C5A855B972C0"><enum>(B)</enum><header>Production</header><text display-inline="yes-display-inline">The term <quote>production</quote>, with respect to a petroleum product, does not include the refining of that petroleum product.</text></subparagraph></paragraph><paragraph id="idC4DA28EF13914E4090E9C99D102D5D22"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">The Strategic Petroleum Reserve may not be filled with a petroleum product imported from—</text><subparagraph id="id407B5497EAE4438BB876DCE63AEC9010"><enum>(A)</enum><text display-inline="yes-display-inline">a covered country; or</text></subparagraph><subparagraph id="idEB8B65F96CA8401D8AA0F684A5136469"><enum>(B)</enum><text display-inline="yes-display-inline">a foreign country other than a covered country, unless the Secretary submits to Congress a certification that all means of increasing production of petroleum products in the United States has been exhausted, including—</text><clause id="idB5FE8AB1BB194157A9E90228421D0633"><enum>(i)</enum><text display-inline="yes-display-inline">increasing the availability of Federal land for leasing; and </text></clause><clause id="idECEBBC58637E4F0288389A9C0F204912"><enum>(ii)</enum><text display-inline="yes-display-inline">increasing the number of applications for permits to drill; and</text></clause></subparagraph></paragraph><paragraph id="id3785109D6981404EA73D5F34A6092672"><enum>(3)</enum><header>Consultation</header><text display-inline="yes-display-inline">In carrying out paragraph (2), the Secretary shall consult with—</text><subparagraph id="id65E41BFAB07A416B9D70AAD022C79638"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary of Agriculture;</text></subparagraph><subparagraph id="id566FD5E2738543B7861BDAF869761D77"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary of the Interior; and</text></subparagraph><subparagraph id="id9876B1DD6ABD4A6CACE18226AB76DD43"><enum>(C)</enum><text display-inline="yes-display-inline">the Secretary of Defense.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id04E41AD510A8411B86129E4782B84226"><enum>(b)</enum><header>Conforming amendments</header><text>Section 167 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6247">42 U.S.C. 6247</external-xref>) is amended—</text><paragraph id="id38AF9A8E005C4DDD8E119BEF9DD4F524"><enum>(1)</enum><text>in subsection (b)(3), by striking <quote>section 160(f)</quote> and inserting <quote>section 160(d)</quote>; and</text></paragraph><paragraph id="idA1FC85BE5D3449D6A1CBBE81C8CDF0F8"><enum>(2)</enum><text>in subsection (d), in the matter preceding paragraph (1), by striking <quote>section 160(f)</quote> and inserting <quote>section 160(d)</quote>.</text></paragraph></subsection></section><section id="id994B27FE74B542CCB8D0D1DCF68FAB7C"><enum>4.</enum><header>Prohibition on export and sale of Strategic Petroleum Reserve products</header><text display-inline="no-display-inline">Section 161(i) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6241">42 U.S.C. 6241(i)</external-xref>) is amended—</text><paragraph id="id4F506A25E4694E958637F8046F55AD84"><enum>(1)</enum><text>by striking <quote>(i) Notwithstanding any other law</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB48DBFE9FB7F4BD78BBE67FEB442D6EF"><subsection id="id0338C9021FF745BB8A81A033574EE128"><enum>(i) </enum><header>Refine or exchange outside the United States</header><paragraph id="id69BE8BBEB07E466794254F5469443D5E"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law and subject to paragraphs (2) and (3)</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id3EE0395A182F4C2E9C730D109B1377A4"><enum>(2)</enum><text>by inserting after paragraph (1) (as so designated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id53E300561E154398B24F24CF0D36D5F3"><paragraph id="idD0DAD09DE4C747BC9E2353F08E4CD3D0"><enum>(2)</enum><header>Prohibition on export of strategic petroleum reserve petroleum products</header><text>Notwithstanding any other provision of law, with respect to the drawdown and sale at auction of petroleum products from the Strategic Petroleum Reserve under this section after the date of enactment of this paragraph, the Secretary shall require as a condition of the sale that the petroleum products shall not be exported to a country that is designated as a country of particular concern for religious freedom under section 402(b)(1)(A)(ii) of the International Religious Freedom Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/22/6442">22 U.S.C. 6442(b)(1)(A)(ii)</external-xref>).</text></paragraph><paragraph id="idF4EF97D7B4ED40F8B83BB8D20C33ABEF"><enum>(3)</enum><header>Requirements applicable to certain state-owned entities</header><text>Notwithstanding any other provision of law, with respect to the drawdown and sale at auction of petroleum products from the Strategic Petroleum Reserve under this section after the date of enactment of this paragraph, if the Secretary determines that there is in effect a United States ban on, or the imposition of sanctions by the United States with respect to, the purchase of crude oil from 1 or more countries, the Secretary shall not sell petroleum products to a State-owned entity participating in the auction unless that State-owned entity submits to the Secretary a certification that the State-owned entity has not purchased any petroleum products from a country subject to such a ban or sanctions after the date that is 15 days after the date on which the ban or sanctions took effect.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id4A2A480D6D1E4673AAC33A2BF2E3B6E9"><enum>5.</enum><header>Study on Remote Crude Oil and Natural Gas Reserve</header><subsection id="idC154B384AFD3412596142D2511160906"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Energy shall prepare and submit to Congress a report regarding the feasibility of establishing a reserve, to be known as the <quote>Remote Crude Oil and Natural Gas Reserve</quote>, subject to subsections (b) and (c), consisting of crude oil and natural gas to be acquired and stored by the United States, in place, pursuant to a contract or other agreement or arrangement between the United States and an individual or entity that discovered the oil or gas in a remote area described in subsection (c).</text></subsection><subsection id="idB58995038C6C468FBCDADCEDC7E765A1"><enum>(b)</enum><header>Purpose</header><text>The purpose of the Remote Crude Oil and Natural Gas Reserve shall be—</text><paragraph id="idED4D961D70E94E9B94DC97D8A0BF477D"><enum>(1)</enum><text>consistent with the purposes described in section 2 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6201">42 U.S.C. 6201</external-xref>); and</text></paragraph><paragraph id="idAC40C646799C4B27A46F37AA858CC3AE"><enum>(2)</enum><text>to ensure—</text><subparagraph id="idF7D69EBC0E344C8B9E1B19D05D69923B"><enum>(A)</enum><text>the long-term capability to increase the energy supply of the United States and allies of the United States; and</text></subparagraph><subparagraph id="id413582D2DDFA45A3B75F2B2CA7A49D6C"><enum>(B)</enum><text>to the maximum extent practicable, that energy costs remain affordable for United States consumers.</text></subparagraph></paragraph></subsection><subsection id="idC685960311674A76B9861AE9E6723AD6"><enum>(c)</enum><header>Locations</header><text>The Remote Crude Oil and Natural Gas Reserve shall include facilities located in, as applicable—</text><paragraph id="id94A6F1DAE81D4FA199C6DFB7898CCD41"><enum>(1)</enum><text> the State of Alaska; and</text></paragraph><paragraph id="id9608FC68A5C9434B8CB34FCA53B5C4D6"><enum>(2)</enum><text>any other area of the United States in close proximity to a qualified opportunity zone designated under <external-xref legal-doc="usc" parsable-cite="usc/26/1400Z">section 1400Z–1</external-xref> of the Internal Revenue Code of 1986.</text></paragraph></subsection></section></legis-body></bill>
