which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the use of facial recognition technology in airports, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Traveler Privacy Protection Act of 2023</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id656f358918c94637a525e5258b95ecc7"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idac3725efaced4006b9780e522c714466"><enum>(1)</enum><header>Administration</header><text>The term <term>Administration</term> means the Transportation Security Administration.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc4dcf9a19dab4e6ab1c9cb315a9d1503"><enum>(2)</enum><header display-inline="yes-display-inline">Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Transportation Security Administration.</text></paragraph><paragraph id="id8307abf4ed7f441dbfa5ba0f56af8474"><enum>(3)</enum><header>Airport</header><text>The term <term>airport</term> has the meaning given such term in section 47102 of title 49, United States Code. </text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id289472d8a7c641218c46f649c6339297"><enum>3.</enum><header display-inline="yes-display-inline">Prohibition on use of facial recognition technology</header><subsection commented="no" display-inline="no-display-inline" id="id9000ca5ebd634eca992177e4adbab150"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator may not, for any purpose, use facial recognition technology or facial matching software in any airport unless such use is expressly authorized by an Act of Congress enacted after the date of the enactment of this Act.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id9608b8779b1841e688f493f99657c1fa"><enum>(b)</enum><header>Disposal of facial biometrics</header><text>Not later than 90 days after the date of the enactment of this Act, the Administrator shall dispose of any facial biometric information, including images and videos, obtained through facial recognition technology or facial matching software of the Administration. </text></subsection></section><section commented="no" display-inline="no-display-inline" id="ide2cd3ac0144d422db715e16f7b29e441"><enum>4.</enum><header>Amendments to Aviation and Transportation Security Act</header><text display-inline="no-display-inline">The Aviation and Transportation Security Act (<external-xref legal-doc="public-law" parsable-cite="pl/107/71">Public Law 107–71</external-xref>; 115 Stat. 597) is amended—</text><paragraph id="id4110170168c1462a88becd04356341ef"><enum>(1)</enum><text>in section 109 (<external-xref legal-doc="usc" parsable-cite="usc/49/114">49 U.S.C. 114</external-xref> note)— </text><subparagraph id="id381bb9db00e447f8b964415d5225f4f7"><enum>(A)</enum><text>in paragraph 6, by inserting <quote>, excluding facial recognition technology or facial matching software</quote> after <quote>imprints</quote>; and</text></subparagraph><subparagraph id="id284a650d328f4de991a98b08dc23caab"><enum>(B)</enum><text>in paragraph 7, by inserting <quote>, excluding facial recognition technology or facial matching software,</quote> after <quote>technologies</quote>; and</text></subparagraph></paragraph><paragraph id="idd0c506a649f44d53a83cd821a9f624e5"><enum>(2)</enum><text>in section 137(d)(3) (<external-xref legal-doc="usc" parsable-cite="usc/49/44912">49 U.S.C. 44912</external-xref> note), by inserting <quote>, excluding facial recognition technology or facial matching software,</quote> after <quote>biometrics</quote>.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id4ae9b96c94084fadbd5b3e0c93b0b5c9"><enum>5.</enum><header>Additional modifications with respect to air transportation security</header><text display-inline="no-display-inline">Section 44903 of title 49, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id610e2761703f4bf7a62841272e79c5ca"><enum>(1)</enum><text>in subsection (c)(3), by inserting <quote>, excluding facial recognition technology or facial matching software,</quote> after <quote>other technology</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbdfde0272d184600b9717006d2418c9d"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (g)(2)(G), by inserting <quote>, excluding facial recognition technology or facial matching software,</quote> after <quote>technologies</quote>; and</text></paragraph><paragraph id="idb46ff9777d0c4cbe90c94744d714a023" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (h)(4)(E), by inserting <quote>, excluding facial recognition technology or facial matching software,</quote> after <quote>technology</quote>. </text></paragraph></section></legis-body></bill>
