which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the Commercial Space Activity Advisory Committee, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="idd1986e9629a14c2085473f99595b12a9"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Space Commerce Advisory Committee Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="S1"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id242a145f121047218bdb6f1dc5744a7b"><enum>(1)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce, acting through the Office of Space Commerce.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcfe210c64668494aa8304bbe4bd138bd"><enum>(2)</enum><header>Space object</header><text>The term <term>space object</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6dd83c73e3744a86a98971edc69cc7c2"><enum>(A)</enum><text>means—</text><clause id="id9f221505088b4eb6b07b997afc2c94a4"><enum>(i)</enum><text>a human-made object located in outer space, including on the Moon or other celestial bodies, with or without human occupants, that was launched from Earth, such as a satellite or a spacecraft, including component parts of the object; and</text></clause><clause id="id1b00890cdd9a450e8005a1ec19beafe8"><enum>(ii)</enum><text>all items carried on such object that are intended for use in outer space outside of, and independent of, the operation of such object;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id756836c0ba674fafa228e2d6b831ca89"><enum>(B)</enum><text>includes any human-made object that is—</text><clause id="idbbed5ce2a20a4777be5079b63a9cfaee"><enum>(i)</enum><text>manufactured or assembled in outer space; and</text></clause><clause id="id6aaf7924473f438dbfd63372e0c1d244"><enum>(ii)</enum><text>intended for operations in outer space other than, and independent of, the operations of such object in which the manufacturing or assembly occurred; and </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5e2b2369ea8342b49829bb7c6877ce10"><enum>(C)</enum><text>does not include—</text><clause id="id6327022ec2a542f794d7faaa733631a4"><enum>(i)</enum><text>an article aboard a space object that is only intended for use inside the space object;</text></clause><clause id="idc1e2d1dffd1247ca81d2437285657a24"><enum>(ii)</enum><text>an article manufactured or processed in outer space that is a material; or</text></clause><clause id="id6045c54efa274984891e8582188a5bfa"><enum>(iii)</enum><text>an article intended for use outside a space object as part of the authorized operations of the space object. </text></clause></subparagraph></paragraph><paragraph id="id66e9193eaa464669a6c07a771c78717e"><enum>(3)</enum><header>State</header><text>The term <term>State</term> means each of the several States of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, and any other commonwealth, territory, or possession of the United States. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id55dcfb37e40f482aadb61d0a18957288"><enum>(4)</enum><header>United States entity</header><text>The term <term>United States entity</term> means—</text><subparagraph id="ida411908634da4093a0874dcdf734b59a"><enum>(A)</enum><text>an individual who is a national of the United States (as defined in section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>)); and</text></subparagraph><subparagraph id="id06cf8c24dcaf46d4bf8e6aed3b3865f2"><enum>(B)</enum><text>a nongovernmental entity organized or existing under, and subject to, the laws of the United States or a State. </text></subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="id4c2bf6a676ea481db1d4870fc0b50b1a"><enum>3.</enum><header display-inline="yes-display-inline">Commercial Space Activity Advisory Committee</header><subsection commented="no" display-inline="no-display-inline" id="idf427c60c87b74360960ea5df70f2ec46"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary shall establish a Commercial Space Activity Advisory Committee (in this section referred to as the <quote>Committee</quote>).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id42b2b22175e94bab9f56053cd1ba7676"><enum>(b)</enum><header>Membership</header><paragraph commented="no" display-inline="no-display-inline" id="id29bd6d42ac59470a88883a3b2a131d75"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Committee shall be composed of 15 members appointed by the Secretary.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id673791b4b0cf4e489f793ec4d75b3444"><enum>(2)</enum><header>Qualifications</header><subparagraph commented="no" display-inline="no-display-inline" id="idc64b936ee93f44f2b8c8c77326b5cbb2"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>The Committee shall be composed of representatives from a variety of space policy, engineering, technical, science, legal, and finance fields who have significant experience in the commercial space industry.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc05b78151cf042729b9b56d4c9a0d260"><enum>(B)</enum><header display-inline="yes-display-inline">Limitation</header><clause commented="no" display-inline="no-display-inline" id="id8db84e8ab1694c7fa3bc5059c9a5b152"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in clause (i), the Secretary may not appoint as a member of the Committee any employee or official of the Federal Government.</text></clause><clause commented="no" display-inline="no-display-inline" id="idd0795c2e23734e8686dd9be39789d943"><enum>(ii)</enum><header>Exception</header><text display-inline="yes-display-inline">The Secretary may appoint as a member of the Committee a special government employee (as defined in section 202(a) of title 18, United States Code) who serves on 1 or more other Federal advisory committees.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd88c41a7ea6246d7914b4b9a939edd5a"><enum>(3)</enum><header>Term</header><text>Each individual appointed as a member of the Committee—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3c3e575b668d4deb8e5feafd0138b5bd"><enum>(A)</enum><text display-inline="yes-display-inline">shall be appointed for a term of 4 years; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida9cd7d371624478c92433830b8573eb1"><enum>(B)</enum><text display-inline="yes-display-inline">during the 2-year period beginning on the date on which such term ends, may not serve as a member of the Committee.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide8049f6ca74241068352fa53a8499362"><enum>(c)</enum><header>Duties</header><text display-inline="yes-display-inline">The duties of the Committee shall be—</text><paragraph commented="no" display-inline="no-display-inline" id="id94c9985e9be04365a1bb14ade0dafca3"><enum>(1)</enum><text display-inline="yes-display-inline">to advise on the status and recent developments of nongovernmental space activities;</text></paragraph><paragraph id="idc20d8c81cc7f4b5dae1c723da00db2ec"><enum>(2)</enum><text>to provide to the Secretary and Congress recommendations on the manner in which the United States may facilitate and promote a robust and innovative commercial sector that is investing in, developing, and operating space objects;</text></paragraph><paragraph id="idef4e141461034f6aac72ea29690b9671"><enum>(3)</enum><text>to identify any challenge faced by the United States commercial sector relating to—</text><subparagraph id="ide03134ce5810459ca90bea71909cdb72"><enum>(A)</enum><text>international obligations of the United States relevant to commercial space sector activities in outer space;</text></subparagraph><subparagraph id="id5fe08a118f674c8db7805f6ebcc72a93"><enum>(B)</enum><text>export controls that affect the commercial space sector;</text></subparagraph><subparagraph id="id0bf81ef6f0c94df99ec306012121d37b"><enum>(C)</enum><text>harmful interference with commercial space sector activities in outer space; and</text></subparagraph><subparagraph id="id4958e4dc1cb343b4a10703ff5aa5c002"><enum>(D)</enum><text>access to adequate, predictable, and reliable radio frequency spectrum;</text></subparagraph></paragraph><paragraph id="idf396317a7b7942a6ab05247c941548b1"><enum>(4)</enum><text>to review existing best practices for United States entities to avoid—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3a419ca3fb5f431ab15eb41b19a07900"><enum>(A)</enum><text display-inline="yes-display-inline">the harmful contamination of the Moon and other celestial bodies; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide6c5f5f0f7df42c2864f925ca447de1d"><enum>(B)</enum><text>adverse changes in the environment of the Earth resulting from the introduction of extraterrestrial matter; and</text></subparagraph></paragraph><paragraph id="id796fa22c4fe24aab96515e037bb206e5"><enum>(5)</enum><text>to provide information, advice, and recommendations on matters relating to—</text><subparagraph commented="no" display-inline="no-display-inline" id="id627d912bc39a40449589f5fd89291ec5"><enum>(A)</enum><text display-inline="yes-display-inline">United States commercial space sector activities in outer space; and</text></subparagraph><subparagraph id="id21ea86e08f854a46920b0ff7ab3a4d46"><enum>(B)</enum><text>other commercial space sector activities, as the Committee considers necessary.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="iddd54204b5b0b4e9c883bc8917645943b"><enum>(d)</enum><header>Termination</header><text display-inline="yes-display-inline">The Committee shall terminate on the date that is 10 years after the date on which the Committee is established.</text></subsection></section></legis-body></bill>
