<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 3339</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20231115">November 15, 2023</action-date><action-desc><sponsor name-id="S324">Mrs. Shaheen</sponsor> (for herself, <cosponsor name-id="S374">Mr. Cotton</cosponsor>, and <cosponsor name-id="S406">Mr. Kelly</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit former members of the Armed Forces from accepting employment in positions involving training, consulting, advising, or instructing any government-associated individual or entity from the People’s Republic of China, the Russian Federation, the Islamic Republic of Iran, the Democratic People’s Republic of Korea, the Republic of Cuba, or the Syrian Arab Republic.</official-title></form><legis-body><section id="id5c96e4b464b7463da251fd4d548ef1db" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Defending Against Adversary Recruitment Efforts Act</short-title></quote> or the <quote><short-title>DAARE Act</short-title></quote>.</text></section><section section-type="subsequent-section" commented="no" display-inline="no-display-inline" id="id4ff0b31fba644f3388ced4a892e2bed2"><enum>2.</enum><header display-inline="yes-display-inline">Prohibition on former members of the Armed Forces accepting post-service employment with certain foreign governments</header><subsection id="iddfcd758ee0de4677abc04dde20a5883c"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/49">Chapter 49</external-xref> of title 10, United States Code, is amended by adding at the end the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="idBE7DDED1993A48EBA0023D0C997DBB7A"><section id="id9bfdea72442649fe96bbb93a14bf6402"><enum>989.</enum><header>Prohibition on former members of the armed forces accepting post-service employment with certain foreign governments</header><subsection id="id56e33697ca5a4a4abef4c757044285c4"><enum>(a)</enum><header>In general</header><text>Except as provided by subsection (b), a covered individual may not occupy a covered post-service position.</text></subsection><subsection id="id4d55315250c64a9d82a290563299fb82"><enum>(b)</enum><header>Temporary waiver</header><paragraph id="idae395e1a4b0644e689393a39ad913bda"><enum>(1)</enum><header>In general</header><text>The Secretary of Defense shall establish a process under which a covered individual may be granted a temporary waiver of the prohibition under subsection (a) if—</text><subparagraph id="id3793b2b8c66047c6b7a32f2c52c36728"><enum>(A)</enum><text>the individual, or a Federal agency on behalf of, and with the consent of, the individual, submits to the Secretary a written application for a waiver in such form and manner as the Secretary determines appropriate; and</text></subparagraph><subparagraph id="ida7fee5bcff2c4c85904b86f6d8653674"><enum>(B)</enum><text>the Secretary determines that the waiver is necessary to advance the national security interests of the United States.</text></subparagraph></paragraph><paragraph id="id03d79d6ddde9427cb0a95569569424ff"><enum>(2)</enum><header>Period of waiver</header><text>A waiver issued under paragraph (1) shall apply for a period not exceeding 5 years. The Secretary may renew such a waiver.</text></paragraph><paragraph id="id048fc350e49c434b8bfdacf3e9ccc812"><enum>(3)</enum><header>Revocation</header><text>The Secretary may revoke a waiver issued under paragraph (1) to a covered individual with respect to a covered-post service position if the Secretary determines that the employment of the individual in the covered-post service position poses a threat to national security.</text></paragraph><paragraph id="id2a4e730188d541dda77c2e89a754f1b5"><enum>(4)</enum><header>Notification</header><subparagraph commented="no" display-inline="no-display-inline" id="idcfc2c08d3d4540c0bea8ab8d05b4eef8"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 30 days after the date on which the Secretary issues a waiver under paragraph (1) or revokes a waiver under paragraph (3), the Secretary shall submit to the Committees on Armed Services of the Senate and the House of Representatives written notification of the waiver or revocation, as the case may be. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf01bd7f4162a4a00a5803b90439cf4fd"><enum>(B)</enum><header>Elements</header><text display-inline="yes-display-inline">A notification required by subparagraph (A) shall include the following:</text><clause id="id523ffec8621e495ab9a4d96439a4f90a"><enum>(i)</enum><text>With respect to a waiver issued to a covered individual—</text><subclause id="id08ce8695bcb7455c8caede85756e8fe2"><enum>(I)</enum><text>the details of the application, including the position held by the individual in the armed forces;</text></subclause><subclause id="id0b0f673264444cc5aa60a7c3598c3e14"><enum>(II)</enum><text>the nature of the post-service position of the individual;</text></subclause><subclause id="idf8da794ffa324fa099765e536c73cf87"><enum>(III)</enum><text>a description of the national security interests that will be advanced by reason of issuing such a waiver; and</text></subclause><subclause id="idca17a5040c484a61883eaf71c7702b9b"><enum>(IV)</enum><text>the specific reasons why the Secretary determines that issuing the waiver will advance such interests.</text></subclause></clause><clause id="id1852e50f2bca46bcb5b8a3166819ab9b"><enum>(ii)</enum><text>With respect to a revocation of a waiver issued to a covered individual—</text><subclause id="iddd02083e446a4d65920faf2298b0029e"><enum>(I)</enum><text>the details of the waiver, including any renewals of the waiver, and the dates of such waiver and renewals; and</text></subclause><subclause id="id1319f02b7d89485790e32e128e90d159"><enum>(II)</enum><text>the specific reasons why the Secretary determined that the revocation is warranted.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="idaf7f277538b94500b2f25da30bf97d5d"><enum>(c)</enum><header>Certification of prohibition</header><text>In implementing the prohibition under subsection (a), the Secretary shall establish a process under which each member of the armed forces is, before the member retires or is otherwise separated from the armed forces—</text><paragraph commented="no" display-inline="no-display-inline" id="idc6b8278ccf26450c82136a3a55460592"><enum>(1)</enum><text display-inline="yes-display-inline">informed in writing of the prohibition, and the penalties for violations of the prohibition; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3cc12bccba1f4e9b8f03d5f69e569a0c"><enum>(2)</enum><text display-inline="yes-display-inline">is required to certify that the member understands the prohibition and those penalties.</text></paragraph></subsection><subsection id="id9d22d36fdbcd49eb9bc411fa5b2a24fa"><enum>(d)</enum><header>Penalties</header><text>In the case of a covered individual who knowingly and willfully fails to comply with the prohibition under subsection (a), the Secretary shall, as applicable—</text><paragraph id="idc31daae69f8b405289fe949d7b121902"><enum>(1)</enum><text>withhold any pay, allowances, or benefits that would otherwise be provided to the individual by the Department of Defense; and</text></paragraph><paragraph id="id801832f3c4104c40a8712c52b67a569d"><enum>(2)</enum><text>revoke any security clearance of the individual.</text></paragraph></subsection><subsection id="ide38286f7cddf44b58d2e07b242ce8846"><enum>(e)</enum><header>Annual reports</header><paragraph id="iddecc7cd042704e9e9b2a42b3d2fbe18d"><enum>(1)</enum><header>Requirement</header><text>Not later than March 31, 2024, and annually thereafter, the Secretary shall submit to the congressional defense committees a report on covered post-service employment occurring during the year covered by the report.</text></paragraph><paragraph id="id72980e4d4e9d4798bcd8ab8d2632ef59"><enum>(2)</enum><header>Elements</header><text>Each report required by paragraph (1) shall include the following:</text><subparagraph id="idb9e439488886452a9616afaf10cf6102"><enum>(A)</enum><text>The number of former covered individuals who occupy a covered post-service position, broken down by—</text><clause id="id0080006ca09446f293ba44b41351e792"><enum>(i)</enum><text>the name of the employer;</text></clause><clause id="id537fd29bfa5f42a2b6b60a65ac9b4396"><enum>(ii)</enum><text>the foreign government, including by the specific foreign individual, agency, or entity, for whom the covered post-service employment is being performed; and</text></clause><clause id="idaf1643a78ddf48438ce883f26a9fbc21"><enum>(iii)</enum><text>the nature of the services provided as part of the covered post-service employment.</text></clause></subparagraph><subparagraph id="id9962af975f3d4b82b05f7f52c9fe8d1c"><enum>(B)</enum><text>An assessment by the Secretary of whether—</text><clause id="idef762e29ea3248c0b1b26c780dabc221" commented="no"><enum>(i)</enum><text>the Department of Defense maintains adequate systems and processes for ensuring that former members of the armed forces are submitting required reports relating to their employment by foreign governments;</text></clause><clause id="idf043ac9f35b84db68aff70bb45b4161f"><enum>(ii)</enum><text>all covered individuals who occupy a covered post-service position are in compliance with this section;</text></clause><clause id="id7a8348086f7b41ae9f708a68ae983e13"><enum>(iii)</enum><text>the services provided by the covered individuals who occupy a covered post-service position pose a current or future threat to the national security of the United States; and</text></clause><clause id="idff5f53500ad946dda84cf4821f863bee"><enum>(iv)</enum><text>there is any credible information or reporting that any covered individual who occupies a covered post-service position has engaged in activities that violate Federal law.</text></clause></subparagraph></paragraph><paragraph id="idf7d54ab1d7b041589af877f2708158df"><enum>(3)</enum><header>Form of report</header><text>Each report required by paragraph (1) shall be submitted in unclassified form, but may include a classified annex.</text></paragraph></subsection><subsection id="idb9ee8eb1319642b4aeda49fd25e8596e"><enum>(f)</enum><header>Notifications of determinations of certain threats</header><paragraph id="id012ae5a860624f4fb140867328cdcb59"><enum>(1)</enum><header>Requirement</header><text>In addition to the annual reports under subsection (d), if the Secretary determines that the services provided by a covered individual who occupies a covered post-service position pose a threat described in clause (iii) of paragraph (2)(B) of that subsection, or include activities described in clause (iv) of such paragraph, the Secretary shall notify the congressional defense committees of that determination by not later than 30 days after making the determination. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2230195f79ed4817b5a8be8a26ad9c07"><enum>(2)</enum><header>Elements</header><text display-inline="yes-display-inline">A notification required by paragraph (1) shall include the following:</text><subparagraph id="id181d1d56415c486686f8bc323dec3ee9"><enum>(A)</enum><text>The name of the covered individual.</text></subparagraph><subparagraph id="id61d92fcf77ee4c558cbc8b6ae89888ad"><enum>(B)</enum><text>The name of the employer.</text></subparagraph><subparagraph id="id1a98689e22184aa598226cf7fc6ca7ef"><enum>(C)</enum><text>The foreign government, including the specific foreign individual, agency, or entity, for whom the covered post-service employment is being performed.</text></subparagraph><subparagraph id="id18bd7ce068754d0e8d8567e3047a041b"><enum>(D)</enum><text>As applicable, a description of the risk to national security and the activities that may violate Federal law.</text></subparagraph></paragraph></subsection><subsection id="id15b3eea6ecc643a19a9a31ad2220a4c3"><enum>(g)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to indemnify or shield covered individuals from prosecution under any relevant provision of title 18.</text></subsection><subsection id="id4713e5d12bc84b399828281174084a3f"><enum>(h)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idba3911d78f774d5aaab928d38c528d31"><enum>(1)</enum><header>Covered individual</header><text>The term <term>covered individual</term> means an individual who has retired or otherwise separated from an active or reserve component of the armed forces.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0c01405062e34417ab624b8ec34da07f"><enum>(2)</enum><header display-inline="yes-display-inline">Covered post-service employment</header><text>The term <term>covered post-service employment</term> means direct or indirect employment by, representation of, or any provision of advice or services relating to national security, intelligence, the military, or internal security to—</text><subparagraph commented="no" display-inline="no-display-inline" id="iddcf6d36e103647428292874e5d29f1f6"><enum>(A)</enum><text display-inline="yes-display-inline">the government of—</text><clause commented="no" display-inline="no-display-inline" id="id02d213b5e71e418fac087e11e048e5f4"><enum>(i)</enum><text display-inline="yes-display-inline">a country of concern (as defined in section 1(m) of the State Department Basic Authorities Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/22/2651a">22 U.S.C. 2651a(m)</external-xref>)); or </text></clause><clause commented="no" display-inline="no-display-inline" id="idc98f74898e714e83b31a449be419ebde"><enum>(ii)</enum><text>a country the Secretary of Defense determines acts as a proxy or passthrough for services for a country of concern; or</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd61dc8666b724e799963cede1bbabf1d"><enum>(B)</enum><text display-inline="yes-display-inline">any company, entity, or other person the activities of which are directly or indirectly supervised, directed, controlled, financed, or subsidized, in whole or in major part, by a government described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="idcb3f2e3c83d848d29542dec467eda181"><enum>(3)</enum><header>Covered post-service position</header><text>The term <term>covered post-service position</term> means a position of employment described in paragraph (2).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id543b97f25552424989f35498b821f4b0"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 49 of such title is amended by adding at the end the following new item:</text><quoted-block style="USC" id="id8c355009-7d9c-4f16-9c43-117db6f1451e"><toc><toc-entry level="section" idref="id9bfdea72442649fe96bbb93a14bf6402">989. Prohibition on former members of the armed forces accepting post-service employment with certain foreign governments.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id8fff2e5e8733432e9ab9980c41e9c2a5"><enum>(c)</enum><header>Conforming amendment</header><text>Section 908 of title 37, United States Code, is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF176681F04F6408BB7244712B1BB6D39"><subsection id="ide0fe0ae2260c4c278b0f1ed8d3ba2da9"><enum>(f)</enum><header>Prohibition on former members of armed forces accepting employment with certain foreign governments</header><text>For a provision of law prohibiting former members of the armed forces from accepting post-service employment with certain foreign governments, see section 989 of title 10.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
