<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 3333</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20231115">November 15, 2023</action-date><action-desc><sponsor name-id="S311">Ms. Klobuchar</sponsor> (for herself and <cosponsor name-id="S398">Mr. Cramer</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To enhance pre- and post-adoption support services, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Supporting Adopted Children and Families Act</short-title></quote>.</text></section><section id="id94632CC42CAD4430AFB79B8416336A02"><enum>2.</enum><header>Adoption support services</header><subsection id="id34551C894CA34A10897D3FC50D7EA8D4"><enum>(a)</enum><header>Ensuring the well-Being of adopted children and their adoptive families</header><text>Section 421 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/621">42 U.S.C. 621</external-xref>) is amended—</text><paragraph id="id457B6B312A88417B9B7ECB89262CF473"><enum>(1)</enum><text>in paragraph (4), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="id78F44C55FDB04CFEA78A15D2CDEDF54E"><enum>(2)</enum><text>by redesignating paragraph (5) as paragraph (6); and</text></paragraph><paragraph id="id02B602992CA84F63A12C87A59910A2AF"><enum>(3)</enum><text>by inserting after paragraph (4) the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEB9A336CF2EE42B7AF7E4303BB2FC7B3"><paragraph id="idB828C9C05EF34C1C8AA8AA0ABFA60D3A"><enum>(5)</enum><text>ensuring the well-being of adopted children and their adoptive families and promoting efforts to prevent such children from entering the foster care system through the provision of pre- and post-adoption support services; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id0651DC197F834718BB265ADC198D568A"><enum>(b)</enum><header>Pre- and post-Adoption support services</header><text>Paragraph (8) of section 431(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/629a">42 U.S.C. 629a(a)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1465929FF3F34BE4A44DF298DDF6A297"><paragraph id="idAA2E0B6D87C1444DBD82CB391A42B338"><enum>(8)</enum><header>Adoption promotion and support services</header><subparagraph id="idC216BFF4059D421D9927229097BABBBA"><enum>(A)</enum><header>In general</header><text>The term <term>adoption promotion and support services</term> means services and activities designed to encourage more adoptions out of the foster care system and support domestic adoptions and adoptions from other countries, consistent with promoting the best interests of adopted children and their adoptive families. Such services and activities may include pre- and post-adoption support services, as described in subparagraph (B), that are designed to support adopted children and their adoptive families.</text></subparagraph><subparagraph id="id77F1AE245D2B424CAF0BC051259C25E1"><enum>(B)</enum><header>Pre- and post-adoption support services</header><text>The term <term>pre- and post-adoption support services</term> means the following:</text><clause id="id48F7B2CE3D01415FBBC45490399EEBE7"><enum>(i)</enum><text>Pre-adoption support services, which may include—</text><subclause id="id3C115E9B4BDE44058A574A47A73B1B61"><enum>(I)</enum><text>direct services, including training, educational support, counseling, and other services for adoptive parents and families that address caregiver interests and concerns regarding common behavioral issues, such as—</text><item id="id0344256AFFF1462EA69D0C99109F542F"><enum>(aa)</enum><text>issues relating to emotional, behavioral, or developmental health needs;</text></item><item id="id2DF81C527E76475BB582A0B7F3189858"><enum>(bb)</enum><text>issues relating to attachment, identity, abandonment, cultural differences, grief, loss, and trauma; and</text></item><item id="id71BE3FEFFF294BE5A7905BF7A7432CBF"><enum>(cc)</enum><text>issues resulting from birth defects due to fetal alcohol syndrome or any other substance abuse-related developmental disorder;</text></item></subclause><subclause id="id56C67020B4F44E679AC34B9171CCF765"><enum>(II)</enum><text>the provision of educational resources for adoptive parents regarding the geographic, ethnic, and cultural background of the adopted child;</text></subclause><subclause id="id6D115576CA6A457EA11473E25492B5E3"><enum>(III)</enum><text>peer-to-peer mentoring and support groups that permit a newly adoptive parent to communicate and learn from more experienced adoptive parents, including programs that enhance communication between adoptive parents with children of similar geographic, ethnic, or cultural backgrounds; and</text></subclause><subclause id="id509A859DB1974385BFC15E4D9FBD388E"><enum>(IV)</enum><text>the provision of informational resources for adoptive parents, including—</text><item id="idEB6AF6BE1AA840B797E1B048B68E90CF"><enum>(aa)</enum><text>resources available through Federal and State agencies, including information regarding benefits for children with a medical condition or a physical, mental, or emotional disability;</text></item><item id="idB2A4206D7C2F4D969C1ACFB994A7D762"><enum>(bb)</enum><text>newsletters, websites, and other informational resources regarding adoption-related services;</text></item><item id="id10D1F2C25DD24C4B968AAD3E33E50C89"><enum>(cc)</enum><text>the establishment of lending libraries containing information and resources for adoptive parents; and</text></item><item id="id14FA543BFA31427C91805B46B06BC8B0"><enum>(dd)</enum><text>conferences, discussion groups, and seminars that are available to adoptive parents and other relevant stakeholders.</text></item></subclause></clause><clause id="idC8FDEE3BCF4C43EABFF549010ACED143"><enum>(ii)</enum><text>Post-adoption support services, which may include—</text><subclause id="idBD4DCC0687664B36923BF69EDA1BB8B0"><enum>(I)</enum><text>continued provision to adoptive parents of pre-adoption support services described in clause (i);</text></subclause><subclause id="id63220E5048A04EF88BF3AAB693C35683"><enum>(II)</enum><text>the provision of accessible and reliable respite services for adoptive parents;</text></subclause><subclause id="id0845098095744962AD8F4815086C35ED"><enum>(III)</enum><text>direct services and counseling for adopted children, including, as appropriate—</text><item id="id6C32FCBAEF5D4037942B1AFAF368D017"><enum>(aa)</enum><text>support services for an adopted child with emotional, behavioral, or developmental health needs;</text></item><item id="id654BCFC4CF694C17BEF1F2C252AA4AA9"><enum>(bb)</enum><text>support services that address issues relating to attachment, identity, abandonment, cultural differences, grief, and loss; and</text></item><item id="id6AE965288BFF44F2A4A29B6366A4B827"><enum>(cc)</enum><text>treatment services that are specialized for adopted children, including psychiatric residential services, outpatient mental health services, social skills training, intensive in-home supervision services, recreational therapy, suicide prevention, and substance abuse treatment;</text></item></subclause><subclause id="idEBD56FAF82474786B79180F09D8BBB7D"><enum>(IV)</enum><text>peer-to-peer mentoring and support groups that allow adopted children to communicate and socialize with other adopted children, including programs that provide for communication between adopted children from similar geographic, ethnic, or cultural backgrounds; and</text></subclause><subclause id="id723650D9534D4F3A9F49AC876E5E89B2"><enum>(V)</enum><text>crisis and family preservation services, including crisis counseling and a 24-hour emergency hotline for adoptive parents.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id9AC99F25A78B440A9B68C937CA14E108"><enum>3.</enum><header>Funding for adoption promotion and support services</header><text display-inline="no-display-inline">Paragraph (8) of section 473(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/673">42 U.S.C. 673(a)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7C71240A4E8A4A928E1FA399D42A502C"><paragraph id="idF575A63C9AA54119BF0CB6CB8833A705"><enum>(8)</enum><text>With respect to the amount of savings (if any) in State expenditures under this part resulting from the application of paragraph (2)(A)(ii) to all applicable children for a fiscal year, a State shall—</text><subparagraph id="idA2C9053132F74D8D8BA713D1CDA3937A"><enum>(A)</enum><text>spend a significant portion of such amount to provide pre- and post-adoption support services (as defined in section 431(a)(8)(B));</text></subparagraph><subparagraph id="id88E4B1A6FB6344CD94DB0F46CF53630E"><enum>(B)</enum><text>spend the remainder of such amount to provide to children or families any other services that may be provided under this part or part B; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id440C7A722F9E4D0C93FD2CF2CE1660F1"><enum>(C)</enum><text>on an annual basis, submit to the Secretary a report that provides a detailed account of any services that were funded pursuant to this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" id="id0A498FE7F9FF412FB82673AB2D093A60"><enum>4.</enum><header>Federal grant program for post-adoption and post-legal guardianship mental health services</header><subsection commented="no" display-inline="no-display-inline" id="id0ca67eb9f6a040c7810763a866d8e413"><enum>(a)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">Section 436 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/629f">42 U.S.C. 629f</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id98a68fd652024ff1b7a22c01d77e76cc"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking <quote>$345,000,000 for each of fiscal years 2017 through 2023</quote> and inserting <quote>$365,000,000 for each of fiscal years 2024 through 2028</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id614c75ced1d74e4ba535c36d80506b83"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b), by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3BE81D14F95240078E091B36346444BB"><paragraph commented="no" display-inline="no-display-inline" id="id12629b89e53a4c0ebc1721f663ff027c"><enum>(6)</enum><header>Post-adoption and post-legal guardianship mental health services</header><text>The Secretary shall reserve $20,000,000 for grants under section 437(h).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id099cb91e7af14070b01dd46c6ceb8a2c"><enum>(b)</enum><header>Grant program</header><text>Section 437 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/629g">42 U.S.C. 629g</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEED8A6DDFD8D464BBFE03E5ADC1F7436"><subsection commented="no" display-inline="no-display-inline" id="id1f3d1d9b03b1481ea730facb50506e61"><enum>(h)</enum><header>Post-Adoption and post-Legal guardianship mental health service programs</header><paragraph id="IDc12a552ce6aa4dcdaf0a7c10597a6327"><enum>(1)</enum><header>In general</header><text>From the amounts reserved for each of fiscal years 2024 through 2028 under section 436(b)(6), the Secretary shall award grants or cooperative agreements under this subsection to eligible entities to—</text><subparagraph id="idc7e89f182a3942478ee1c583326f10de"><enum>(A)</enum><text>develop and implement statewide or tribal post-adoption and post-legal guardianship mental health service programs for all children who are adopted or placed in legal guardianship and their families;</text></subparagraph><subparagraph id="idc7190acf39474d83bd37eda77d5166b2"><enum>(B)</enum><text>support public organizations and private nonprofit organizations actively involved in statewide or tribal post-adoption and post-legal guardianship mental health service programs;</text></subparagraph><subparagraph id="id87a4dcb49ba245aaa8a720d23bee9ded"><enum>(C)</enum><text>collect and analyze data on State-sponsored statewide or tribal post-adoption and post-legal guardianship mental health service programs that can be used to monitor the effectiveness of such services and for research, technical assistance, and policy development;</text></subparagraph><subparagraph id="id4c9482b237f34617b7b2d2dba221bea3"><enum>(D)</enum><text>develop and provide adoption and legal guardianship competent educational and training opportunities concerning the mental health needs of children who are adopted or placed in legal guardianship, and their families, for use by teachers, social workers, and other community mental health service providers;</text></subparagraph><subparagraph id="id1ad3575c41614e3c835141ee755ce95f"><enum>(E)</enum><text>develop and provide materials for potential adoptive parents and legal guardians, both for children who already reside in the United States at the time of adoption or placement in legal guardianship and for those who at such time reside in other countries, describing the possible need for post-adoption and post-legal guardianship mental health services and available resources;</text></subparagraph><subparagraph id="idc3169a205b5b4c13bfab7fd0f9cc8754"><enum>(F)</enum><text>develop and provide respite care services for adoptive and legal guardian families; and</text></subparagraph><subparagraph id="idb50403d3ce034e32b259943aa0c5fd6b"><enum>(G)</enum><text>support research on, and development of, promising practices (as defined in section 471(e)(4)(C)(iii)) for post-adoption and post-legal guardianship mental health services. </text></subparagraph></paragraph><paragraph id="ID830229708cc44bdaa46fa970869126e9"><enum>(2)</enum><header>Eligible entity defined</header><subparagraph id="IDe1dbf1f474b0426f9d7ed059c13a8ce6"><enum>(A)</enum><header>In general</header><text>In this subsection, the term <term>eligible entity</term> means—</text><clause id="ID613ab96d521844bab418e7afe174e430"><enum>(i)</enum><text>a State;</text></clause><clause id="ID2f279d4d9bd5468882600e69e98a9f22"><enum>(ii)</enum><text>a public organization or private nonprofit organization designated by a State to develop or direct the State-sponsored statewide post-adoption and post-legal guardianship mental health service program under a grant under this subsection; and </text></clause><clause id="IDaf3118530b5549c097d5f946a41f6d1a"><enum>(iii)</enum><text>a federally recognized Indian tribe or tribal organization (as defined in the Indian Self-Determination and Education Assistance Act) or an urban Indian organization (as defined in the Indian Health Care Improvement Act) that is actively involved in the development and continuation of a post-adoption and post-legal guardianship mental health service program.</text></clause></subparagraph><subparagraph id="ID61dda6420eca486688be98ed93fc8bef"><enum>(B)</enum><header>Limitation</header><text>In carrying out this subsection, the Secretary shall ensure that each State is awarded only 1 grant or cooperative agreement under this subsection. For purposes of the preceding sentence, a State shall be considered to have been awarded a grant or cooperative agreement if the eligible entity involved is the State or an entity designated by the State under subparagraph (A)(ii). Nothing in this subparagraph shall be construed to apply to entities described in subparagraph (A)(iii).</text></subparagraph></paragraph><paragraph id="IDa9d2478e12ea4d8fa8446a3ffdef61a7"><enum>(3)</enum><header>Preference</header><text>In providing assistance under a grant or cooperative agreement under this subsection, the Secretary shall give preference to—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6336537e23424a97814ff8fb2dd2a658"><enum>(A)</enum><text display-inline="yes-display-inline">eligible entities that have demonstrated success in increasing the level of adoption and legal guardianship competency among mental health providers, adoption and legal guardianship lawyers, social workers, case workers, adoptive parents, and legal guardians; and </text></subparagraph><subparagraph id="ided003fbede544fc2a30af84a42b0ecd7"><enum>(B)</enum><text>eligible entities that plan to partner with their State mental health agency in carrying out the activities for which the grant or cooperative agreement is made. </text></subparagraph></paragraph><paragraph id="ID650e5676f16c47d986c135276a41600b"><enum>(4)</enum><header>Requirement for direct services</header><text>Not less than 85 percent of funds received under a grant or cooperative agreement under this subsection shall be used to provide direct services, of which not less than 5 percent shall be used for activities authorized under paragraph (1)(C).</text></paragraph><paragraph id="ID72dfa956a6b648fb901a1bd674723695"><enum>(5)</enum><header>Coordination and collaboration</header><subparagraph id="ID20a821ebab32410aa9ae49d4df27051c"><enum>(A)</enum><header>In general</header><text>In carrying out this subsection, the Secretary shall collaborate with relevant Federal agencies and adoption and legal guardianship-related working groups to promote interaction between domestic foster care agencies and private adoption agencies in other countries.</text></subparagraph><subparagraph id="IDe2a4a0d20a4842a18c7a3053ed2aac19"><enum>(B)</enum><header>Consultation</header><text>In carrying out this subsection, the Secretary shall consult with—</text><clause id="IDa2ddad5b95da4008865e370f6b34a969"><enum>(i)</enum><text>State and social service agencies engaged in the placement of children for adoption, domestically or from other countries;</text></clause><clause id="idf14b260b7c234f47b7927c04f6126bad"><enum>(ii)</enum><text>local and national organizations that serve foster and adopted youth and youth placed in legal guardianship;</text></clause><clause id="id3582dd281ec84e3bbaa6956a5ebb11d0"><enum>(iii)</enum><text>health and education specialists who focus on adoption, legal guardianship, and foster care medicine;</text></clause><clause id="id3dcc91cd73dd46d9bde536757685af6d"><enum>(iv)</enum><text>youth who have been in foster care, adopted, or in legal guardianship, domestically or from other countries, including youth who have experienced adoption or guardianship disruptions or dissolutions;</text></clause><clause id="id1084c84ffe1f4abdb16b38cf9e4d05c7"><enum>(v)</enum><text>families and friends of youth who have been in foster care, adopted, or in legal guardianship, domestically or from other countries, including foster and adoptive parents and legal guardians; and</text></clause><clause id="id27b54c614e554a028ca3ee874417d04d"><enum>(vi)</enum><text>qualified professionals who possess the specialized knowledge, skills, experience, and relevant attributes needed to serve children who are adopted or placed in legal guardianship and their families. </text></clause></subparagraph><subparagraph id="ID1d7a73a2a30346599ac808c6d93a5fb6"><enum>(C)</enum><header>Policy development</header><text>In carrying out this subsection, the Secretary shall—</text><clause id="IDfec13fa1c2a44fce87ed1643163755fa"><enum>(i)</enum><text>coordinate and collaborate on policy development with relevant Department of Health and Human Services agencies and adoption and legal guardianship-related working groups; and</text></clause><clause id="idbaa134a13e354cbbbc5b5306481e2b98"><enum>(ii)</enum><text>consult on policy development at the Federal level with those in the private sector engaged in the recruitment of foster and adoptive parents and legal guardians, the placement of children in foster care, for adoption, and in legal guardianship, and the provision of post-adoption and post-legal guardianship services.</text></clause></subparagraph></paragraph><paragraph id="ID86145e8676714e798556fef468c97c76"><enum>(6)</enum><header>Evaluation and report</header><subparagraph id="IDc7aecfd353b0405b83193c747e8267ee"><enum>(A)</enum><header>Evaluations by eligible entities</header><text>Not later than 18 months after receipt of a grant or cooperative agreement under this subsection, an eligible entity shall submit to the Secretary the results of an evaluation to be conducted by the entity concerning the effectiveness of the activities carried out under the grant or agreement.</text></subparagraph><subparagraph id="ID8281cd9c7e084434946fe543e4284d19"><enum>(B)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this subsection, the Secretary shall submit to the appropriate committees of Congress a report concerning the results of—</text><clause id="ID23414097cde64fd19471bf928ff027a3"><enum>(i)</enum><text>the evaluations conducted under subparagraph (A); and</text></clause><clause id="IDba48f114d267476bb0f595bdc849794b"><enum>(ii)</enum><text>an evaluation conducted by the Secretary to analyze the effectiveness and efficacy of the activities conducted with grants, collaborations, and consultations under this subsection.</text></clause></subparagraph></paragraph><paragraph id="IDd0f6b90a72f842c1bf88ac2252760a3e"><enum>(7)</enum><header>Additional definitions</header><text>In this subsection:</text><subparagraph id="id725412FE4BF14F37B48135493FCCA808"><enum>(A)</enum><header>Adopted child</header><text>The term <term>adopted child</term> means an individual who is under 21 years of age and was adopted from foster care or placed in legal guardianship through a private placement agency, or from another country.</text></subparagraph><subparagraph id="idDBDE0D54E4F34BE197ED7BF21C716399"><enum>(B)</enum><header>Adoption and legal guardianship competency</header><text>The term <term>adoption and legal guardianship competency</term> means an understanding of—</text><clause id="id337894433963416cb0e1d94a8ac9315e"><enum>(i)</enum><text>the nature of adoption and legal guardianship as a form of family formation and the different types of adoption and legal guardianship; </text></clause><clause id="idE95261FEC6404123BBEFD2DDF8A6907A"><enum>(ii)</enum><text>relevant emotional and physical issues involved in the adoption or legal guardianship process, including issues relating to separation, loss, attachment, abuse, trauma, and neglect;</text></clause><clause id="id026A8614ADDD4212838554A8E9CDCEC6"><enum>(iii)</enum><text>common developmental challenges associated with adoption and legal guardianship; </text></clause><clause id="id10A1A6EF71E044A09D792A5B3198BA44"><enum>(iv)</enum><text>the characteristics and skills that allow for successful adoptive and legal guardianship families;</text></clause><clause id="id02BC0158FB234ADF8A6401E24721F2D3"><enum>(v)</enum><text>proper sensitivity with respect to the different geographic, ethnic, or cultural backgrounds of children who are adopted or placed in legal guardianship and their families; and </text></clause><clause id="id3E575F239FC14561AEBEAA77A9BAA797"><enum>(vi)</enum><text>the necessary skills for effectively advocating on behalf of birth and adoptive and legal guardian families.</text></clause></subparagraph><subparagraph id="id3CBBA417DC0A428997D4CFCE253F732B"><enum>(C)</enum><header>Post-adoption and post-legal guardianship mental health services</header><text>The term <term>post-adoption and post-legal guardianship mental health services</term> includes—</text><clause id="id668e49a5ad9643e19972a5c2b36e9f98"><enum>(i)</enum><text>adoption and legal guardianship competent mental health direct services, including training, educational support, counseling, and other services for adoptive and legal guardian parents and families that address caregiver interests and concerns regarding child behavioral issues that are common among children who are adopted, placed in legal guardianship, or placed in foster care, including, as appropriate—</text><subclause id="id4cdd679044e649d3acdb8f1d1354392d"><enum>(I)</enum><text>caring for a child who is adopted or placed in legal guardianship and has emotional, behavioral, or developmental health needs; and</text></subclause><subclause id="id2976c1b278cf4e17a5bae357e6c5fd76"><enum>(II)</enum><text>providing for the emotional needs of a child who is adopted or placed in legal guardianship, including issues relating to attachment, identity, abandonment, cultural differences, grief, loss, and trauma;</text></subclause></clause><clause id="id84ca64fd4063466fa707a8dbec5ae407"><enum>(ii)</enum><text>peer-to-peer mentoring and support groups that permit a newly adoptive parent or legal guardian to communicate and learn from more experienced adoptive parents or legal guardians;</text></clause><clause id="idc66b8fa8f1584e96811fb786d35ceda0"><enum>(iii)</enum><text>the provision of informational resources and available services for adoptive parents or legal guardians; </text></clause><clause id="idfbe6dde8364d4a82adb2670657665497"><enum>(iv)</enum><text>direct services, including counseling, peer-to-peer mentoring and support groups, and other services for children who are adopted or placed in legal guardianship that address common behavioral and adjustment issues, including, as appropriate—</text><subclause id="id8e6701b49b254a78bcc97cb5b8376be5"><enum>(I)</enum><text>support services for a child who is adopted or placed in legal guardianship with emotional, behavioral, or developmental health needs;</text></subclause><subclause id="idbe72e5ec496d4aeda3275f1c59e89c7a"><enum>(II)</enum><text>support services that address the emotional needs of a child who is adopted or placed in legal guardianship, including issues relating to attachment, identity, abandonment, cultural differences, grief, loss, and trauma; and</text></subclause><subclause id="id64587a58e424472e81b42241d24f2264"><enum>(III)</enum><text>treatment services that are specialized for children who are adopted or placed in legal guardianship, including psychiatric residential services, outpatient mental health services, social skills training, intensive in-home supervision services, recreational therapy, suicide prevention, and substance abuse treatment; </text></subclause></clause><clause id="ID006797dc102a44dc8d7ad54513c71e91"><enum>(v)</enum><text>peer-to-peer mentoring and support groups that allow children who are adopted or placed in legal guardianship communicate and socialize with other such children; and</text></clause><clause id="IDd09d6ff3fe5d42f3a28fd0aa31d0846f"><enum>(vi)</enum><text>crisis intervention and family preservation services.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id8C8043D3FAAD4E53ADF2CA4BB9A133FE"><enum>5.</enum><header>Data collection on Adoption Disruption and Dissolution</header><subsection id="id218380C33CFD49A6B1FD9893804270C4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 479 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/679">42 U.S.C. 679</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8C0BE8CAF02A43D183EEF6731043A33C"><subsection id="idFD26712001F74BCDA7722970BCA68C45"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id4BCCD626D54C46B3ABDB36A1E4E29355"><enum>(1)</enum><text>Not later than 12 months after the date of enactment of the <short-title>Supporting Adopted Children and Families Act</short-title>, the Secretary shall, as part of the data collection system established under this section, promulgate final regulations providing for the collection and analysis of information regarding children who enter into State custody as a result of the disruption of a placement for adoption or the dissolution of an adoption, which shall require States to collect and report—</text><subparagraph id="id08B6A792CB3D4811B98202930793C01C" indent="up1"><enum>(A)</enum><text>information on children who are adopted within the United States or from other countries and who enter into State custody as a result of the disruption of a placement for adoption or the dissolution of an adoption, including—</text><clause id="id111B48B1B49F42F7BC92E23358FEE749"><enum>(i)</enum><text>the number of children who enter into State custody as a result of—</text><subclause id="idA34EC59345174879AB17E6D5CE5A37B9"><enum>(I)</enum><text>the disruption of placement for adoption; or</text></subclause><subclause id="idF5D81F36BF774B89B3244A6766A17B42"><enum>(II)</enum><text>the dissolution of an adoption; and</text></subclause></clause><clause id="id048C11DFDC5C42E5B295D1810DF3B878"><enum>(ii)</enum><text>for each child identified under clause (i)—</text><subclause id="id2CBC01D2BFD4479BAB6F98DFC25DD3FF"><enum>(I)</enum><text>as applicable, the country of birth for any child who was not born in the United States;</text></subclause><subclause id="id74DAF3C5921B47F9AFD96162FDB9D5B1"><enum>(II)</enum><text>the length of the adoption placement prior to disruption or dissolution;</text></subclause><subclause id="id2671501C90BA4CB0A59AC04EB3E4070B"><enum>(III)</enum><text>the age of the child at the time of the disruption or dissolution;</text></subclause><subclause id="id1893E2A2824E40EC9905B6155FC824B4"><enum>(IV)</enum><text>the reason for the disruption or dissolution; and</text></subclause><subclause id="id9D4CAFC513DA457D9C590B5C9FDEB442"><enum>(V)</enum><text>the agencies who handled the placement for adoption; and</text></subclause></clause></subparagraph><subparagraph id="idAE7BE972C4224BB8B7635849A232E149" indent="up1"><enum>(B)</enum><text>such other information as determined appropriate by the Secretary.</text></subparagraph></paragraph><paragraph id="id5892B15D3C2C41359270B92DD7975256" indent="up1"><enum>(2)</enum><text>The information described in paragraph (1) shall be used—</text><subparagraph id="id40012B1C54564C97A1038B2EA691547A"><enum>(A)</enum><text>to consolidate and expand the collection of information on adoption disruption and dissolution;</text></subparagraph><subparagraph id="id6C0CDCC09C4C47F681B22DC84CAB3526"><enum>(B)</enum><text>to improve research and data collection systems in order to more accurately determine and measure the rates, outcomes, and causes of adoption disruption and dissolution;</text></subparagraph><subparagraph id="id1FBD46552835469894AE0F4688A5F8E5"><enum>(C)</enum><text>to identify pre- and post-adoption support services (including services described in section 431(a)(8)(B)) that result in lower rates of disruption and dissolution of adoptions;</text></subparagraph><subparagraph id="id7D97C167E47044C78F07629C20FD21ED"><enum>(D)</enum><text>to develop an understanding of the relationship between the rate of incidence of adoption disruptions and dissolutions and the support services that are provided to adoptive families in order to identify and develop effective evidence-based strategies, programs, and support services that help to prevent adoption disruption and dissolution; and</text></subparagraph><subparagraph id="idB18CCF76708C4503A2DF7B0656CF5F32"><enum>(E)</enum><text>to develop and enhance training and educational services regarding strategies for prevention of adoption disruption and dissolution.</text></subparagraph></paragraph><paragraph id="id34E052BCC9CE4C049AFC2278F6C80F41" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id3345F577AC09416486751FB1B1DA4F68"><enum>(A)</enum><text>Not later than 6 months after the date of enactment of the <short-title>Supporting Adopted Children and Families Act</short-title>, the Secretary shall, subject to subparagraph (B), establish an advisory committee to study methods to effectively collect data regarding disruption and dissolution of adoptions that are not included in the data collection system established under this section, including—</text><clause id="id6F162EB0CD124461B7F6BAEE118BA551" indent="up1"><enum>(i)</enum><text>data on children whose adoptions are disrupted or dissolved but do not enter into State custody as a result of such disruption or dissolution;</text></clause><clause id="id961F2310ECBD46CDA387B80B2AAC85E1" indent="up1"><enum>(ii)</enum><text>data on adoption displacements, whereby an adopted child is temporarily placed out of the home of an adoptive parent in order to receive medical, mental health, behavioral, or other forms of treatment; and</text></clause><clause id="idBA3BA94F2C0F4D529D654C8B3B037731" indent="up1"><enum>(iii)</enum><text>such other data as determined appropriate by the Secretary.</text></clause></subparagraph><subparagraph id="id41C1452FA5964112A5D2DE0E2F2B966E" indent="up1"><enum>(B)</enum><text>The membership and organization of the advisory committee described in subparagraph (A) shall be determined by the Secretary and shall include—</text><clause id="id34F4AE0076424046A2EE83F874B6F0D3"><enum>(i)</enum><text>State and child welfare agencies that are engaged in the placement of children for adoption domestically or from other countries;</text></clause><clause id="idD3B23E905B314A4883B87250B80D001C"><enum>(ii)</enum><text>local and national organizations that serve adopted children and children in foster care; and</text></clause><clause id="id210360C16C9F49BF9F8FFDE0B388ED1A"><enum>(iii)</enum><text>members of State and local judiciary and court staff.</text></clause></subparagraph><subparagraph id="idFCF9402C07064F07A0092273F6C89632" indent="up1"><enum>(C)</enum><text>Not later than 12 months after establishment of the advisory committee described in subparagraph (A), the Secretary shall submit to the appropriate committees of Congress a report containing recommendations of the advisory committee for improvement of the data collection system established under this section.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id0B133C1AD6CE4F528F80B48C583C2EBF"><enum>(b)</enum><header>Annual report</header><text>Section 479A(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/679b">42 U.S.C. 679b(a)</external-xref>) is amended—</text><paragraph id="idB8B90144B2BB4BB08521B6633EA94F34"><enum>(1)</enum><text>in paragraph (6)(C), by striking <quote>and</quote> after the semicolon;</text></paragraph><paragraph id="idD9AAF78E162B453791F25A8C6E4C88FB"><enum>(2)</enum><text>in paragraph (7), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="id7E454B6643F84384A3B7CA2856DA2B97"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id71AE80B7824A43D7840E940CBC7ADA75"><paragraph id="idF849AD40783A4BAC8AFB4ACDBC9F010D"><enum>(8)</enum><text>include in the report submitted pursuant to paragraph (5) for fiscal year 2024 or any succeeding fiscal year, national and State-by-State data on the numbers and rates of disruptions and dissolutions of adoptions, as collected pursuant to section 479(e)(1).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
