<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 3327</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20231115">November 15, 2023</action-date><action-desc><sponsor name-id="S397">Mr. Braun</sponsor> (for himself and <cosponsor name-id="S417">Mr. Budd</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Health and Human Services to publish a list of hospitals found to be in noncompliance with the hospital price transparency rule.</official-title></form><legis-body><section id="id7ded9b0bc3054b549e3881a956a1d040" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expose Hospitals Violating Price Transparency Act</short-title></quote>.</text></section><section id="id5990F9B333174CDE9111D5BE9D30DDF5"><enum>2.</enum><header>Publication of list of hospitals</header><subsection id="id6BC81EA1218142AD9702734C88E546D2"><enum>(a)</enum><header>List of hospitals</header><text display-inline="yes-display-inline">Beginning not later than 90 days after the date of enactment of this Act, the Secretary of Health and Human Services (referred to in this section as the <quote>Secretary</quote>) shall establish and maintain a publicly available list, on the website of the Centers for Medicare &amp; Medicaid Services, of each hospital that—</text><paragraph id="idD27D71EF966B485C8E538396F1A92C72"><enum>(1)</enum><text display-inline="yes-display-inline">is not in compliance with the hospital price transparency rule implementing section 2718(e) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-18">42 U.S.C. 300gg–18(e)</external-xref>), and that, with respect to such noncompliance—</text><subparagraph id="id084A07CD54CE4685B9E6320052E166D8"><enum>(A)</enum><text>has been issued a civil monetary penalty;</text></subparagraph><subparagraph id="id6c585af76b7d433cb337ded36869ed03"><enum>(B)</enum><text>has received a warning notice; or</text></subparagraph><subparagraph id="id00be91196f8740a586b9cbfef6e0fc23"><enum>(C)</enum><text>has received a request for a corrective action plan; or</text></subparagraph></paragraph><paragraph id="id20C58A7E7A244FB89886506982BC4C4B"><enum>(2)</enum><text>has received any written communication by the Secretary regarding potential noncompliance with such hospital price transparency rule. </text></paragraph></subsection><subsection id="idE4790052DBCB4AB28A1D8E0CDFCC82E2"><enum>(b)</enum><header>FOIA requests</header><text display-inline="yes-display-inline">Any penalty, notice, request, or other communication described in subsection (a) shall be subject to public disclosure, in full and without redaction, under section 552 of title 5, United States Code, notwithstanding any exemptions or exclusions otherwise available under such section 552. </text></subsection><subsection id="id4a2b5a2ecc944fca945e9604c609d708"><enum>(c)</enum><header>Report to congress</header><text>Not later than 1 year after the date of enactment of this Act and each year thereafter, the Secretary shall submit to Congress, and make publicly available, a report that contains information regarding complaints of alleged violations of law and enforcement activities by the Secretary under the hospital price transparency rule implementing section 2718(e) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-18">42 U.S.C. 300gg–18(e)</external-xref>). Such report shall be made available to the public on the website of the Centers for Medicare &amp; Medicaid Services.</text></subsection><subsection id="id2cf447c45cfc46cdb97a821b1406a8e4"><enum>(d)</enum><header>GAO report</header><text>Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Ways and Means and the Committee on Energy and Commerce of the House of Representatives a report on the compliance and enforcement with the hospital price transparency rule implementing section 2718(e) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-18">42 U.S.C. 300gg–18(e)</external-xref>). The report shall include recommendations related to—</text><paragraph id="id9C0D2919932748E9AA43ACC3DE4F30D8"><enum>(1)</enum><text>improving price transparency to patients, employers, and the public; </text></paragraph><paragraph id="idF889E8022F8A4E0C84070BD3E1B605E0"><enum>(2)</enum><text>the revocation or suspension of tax-exempt status under <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 for noncompliant hospitals; and </text></paragraph><paragraph id="idF60791AA51BA4A0FBD46FF54BD036A33"><enum>(3)</enum><text>increased civil monetary penalty amounts to ensure compliance. </text></paragraph></subsection><subsection id="ida6aa214a090442d48274328563d77d23"><enum>(e)</enum><header>Rulemaking</header><text>Not later than 180 days after the report described in subsection (d) is published, the Secretary, in consultation with the Secretary of the Treasury, shall issue a proposed rule based on the recommendations of the Comptroller General of the United States under subsection (d), including the recommendations described in paragraphs (2) and (3) of such subsection. </text></subsection></section></legis-body></bill>
