which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To allow holders of certain grazing permits to make minor range improvements and to require that the Secretary of Agriculture and the Secretary of the Interior respond to requests for range improvements within 30 days, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H237A6525C15C4FCC8E20FCED453384F7"><section section-type="section-one" id="H9AC0F8C5DF9643ABB4B6061652CD8E23"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ranching Without Red Tape Act of 2023</short-title></quote>. </text></section><section id="H92182E9F0F94426A867E12603C9E28DB"><enum>2.</enum><header>Minor range improvements under USFS grazing permits</header><subsection id="H3BF8972381664E6EB5DF563765367772"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HBB58E1A3B5834504882CF3F26A4950F0"><enum>(1)</enum><header>CFR terms</header><text>The terms <term>grazing permit</term>, <term>permittee</term>, and <term>range improvement</term> have the meanings given those terms, respectively, in section 222.1(b) of title 36, Code of Federal Regulations (or successor regulations).</text></paragraph><paragraph id="H711CC1F223EB4B93916D5525847D8A19"><enum>(2)</enum><header>Covered request</header><text>The term <term>covered request</term> means a request submitted by a permittee to the Secretary requesting that the Secretary carry out a range improvement.</text></paragraph><paragraph id="HD4CEA0118D504C6AA192B2AD27A370CA"><enum>(3)</enum><header>Minor range improvement</header><text>The term <term>minor range improvement</term> includes improvements to existing fences and fence lines, wells, water pipelines, and stock tanks. </text></paragraph><paragraph id="H4B5ED84FD6FE45149E95779ADC12D928" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph></subsection><subsection id="HD752C8174C7B43BEA41B1C8EA3B5F608"><enum>(b)</enum><header>Minor range improvements by permittees</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall issue regulations allowing a permittee to carry out a minor range improvement on the land with respect to which the permittee holds a grazing permit if—</text><paragraph id="H4F8E21D6ED98427683DCBB8263742305"><enum>(1)</enum><text>the permittee notifies the applicable Forest Service district ranger at least 30 days prior to carrying out such minor range improvement; and</text></paragraph><paragraph id="H02F669F2642B4693AEEE4434F0F31872"><enum>(2)</enum><text>such applicable district ranger—</text><subparagraph id="HE72C974A67734322A8672CA995A69107"><enum>(A)</enum><text>approves the minor range improvement; or</text></subparagraph><subparagraph id="HCE6EAEDA55CC44848881112307F020ED"><enum>(B)</enum><text>does not respond to the notification.</text></subparagraph></paragraph></subsection><subsection id="H0A299958F7D9418F9DBB4CBD807C9BD6"><enum>(c)</enum><header>Range improvements by the Secretary</header><text display-inline="yes-display-inline">The Secretary, acting through the applicable forest supervisor, shall—</text><paragraph id="H12ED2313EE73400FAA9998D7CACAE473"><enum>(1)</enum><text>respond to a covered request not later than 30 days after the date on which such covered request is submitted; and</text></paragraph><paragraph id="H28A7D832C82B4551B25DE05F4586211D"><enum>(2)</enum><text>if such response confirms that the Secretary, acting through the applicable forest supervisor, will carry out the range improvement requested—</text><subparagraph id="H53A216567F7F4B31B029097708AB8D5F"><enum>(A)</enum><text>notify the district office that serves the area in which such range improvement will occur; and</text></subparagraph><subparagraph id="H339F319873774DB4A560E77A763EE239"><enum>(B)</enum><text>expedite the carrying out of such range improvement using any available administrative tools or authorities, including categorical exclusions. </text></subparagraph></paragraph></subsection></section><section id="H6ECC8287360D4E1CAA2B6898DE0C74B2"><enum>3.</enum><header>Minor range improvements under BLM grazing permits</header><subsection id="H985584D2F5EE417A99475BF1AC796373"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HF8C310461ADE496B9396E0E56C38DCBB"><enum>(1)</enum><header>Covered request</header><text>The term <term>covered request</term> means a request submitted by a grazing permit or lease holder to the Secretary requesting that the Secretary carry out a range improvement.</text></paragraph><paragraph id="HE7411603ED184B2DBB4C712712B1A909"><enum>(2)</enum><header>Grazing permit or lease</header><text>The term <term>grazing permit or lease</term> means a grazing permit or lease described in section 4130.2 of title 43, Code of Federal Regulations (or successor regulations).</text></paragraph><paragraph id="HFE14C22874D9465187C69A9B6BDCF164"><enum>(3)</enum><header>Minor range improvement</header><text>The term <term>minor range improvement</term> includes improvements to existing fences and fence lines, wells, water pipelines, and stock tanks. </text></paragraph><paragraph id="HE30866B3B3D8430AA1875213DC4A02D9"><enum>(4)</enum><header>Range improvement</header><text>The term <term>range improvement</term> means a range improvement carried out pursuant to subpart 4120 of title 43, Code of Federal Regulations (or successor regulations).</text></paragraph><paragraph id="H97A7F8D19C99414BA697107F0C7D5F33" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior. </text></paragraph></subsection><subsection id="HC189DDCF15D24E36BDEF23C434219E54"><enum>(b)</enum><header>Minor range improvements by grazing permit holders</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall issue regulations allowing a grazing permit or lease holder to carry out a minor range improvement on the land with respect to which the grazing permit or lease applies if—</text><paragraph id="H74E92A66997C4673AC79141C0F296982"><enum>(1)</enum><text>the grazing permit or lease holder notifies the applicable Bureau of Land Management district or field manager at least 30 days prior to carrying out such minor range improvement; and</text></paragraph><paragraph id="HFDF1B05EB6C340B7B102C8E3F4209EF8"><enum>(2)</enum><text>such applicable district or field manager—</text><subparagraph id="H1CE1A45E66BF42B38DE7FFC8FF382AD3"><enum>(A)</enum><text>approves the minor range improvement; or</text></subparagraph><subparagraph id="H70238D29160A44B28057B71F176C3F6E"><enum>(B)</enum><text>does not respond to the notification.</text></subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="H8A39338E358A4AF3BDADE3AF470B942B"><enum>(c)</enum><header>Range improvements by the Secretary</header><text display-inline="yes-display-inline">The Secretary, acting through the applicable State Director of the Bureau of Land Management, shall—</text><paragraph id="HF701D079E7E84CF9ACF0CB9FE3384588"><enum>(1)</enum><text>respond to a covered request not later than 30 days after the date on which such covered request is submitted; and</text></paragraph><paragraph id="HA823A3D867534ECCBEF73779344CB1BF"><enum>(2)</enum><text>if such response confirms that the Secretary, acting through the applicable State Director of the Bureau of Land Management, will carry out the range improvement requested—</text><subparagraph id="H0BA3D0BB9D574D75A6795854B79935CB"><enum>(A)</enum><text>notify the State office that serves the area in which such range improvement will occur; and</text></subparagraph><subparagraph id="H085B75DFD5E542B189FF93248CCC82CE"><enum>(B)</enum><text>expedite the carrying out of such range improvement using any available administrative tools or authorities, including categorical exclusions. </text></subparagraph></paragraph></subsection></section></legis-body></bill>
