<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 3320</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20231115">November 15, 2023</action-date><action-desc><sponsor name-id="S411">Mr. Marshall</sponsor> (for himself and <cosponsor name-id="S420">Mr. Schmitt</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide that an individual may not serve as an employee in the executive branch for longer than 12 years, except for Presidential appointees, law enforcement officers, members of the military, and employees of the Department of Defense.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tenure Evaluation and Rotation Mandate Act</short-title></quote> or the <quote><short-title>TERM Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idb01c5d098ac64128b80aa90f3c546350"><enum>2.</enum><header>Limitation on term of service in the executive branch</header><subsection id="idc791dcca051b4fc1b3d0f81a2408c7a9"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id9f8351b2befb434c9be92e86a49d568f"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term> means an agency, establishment, office, or other appointing authority in the executive branch of the Government of the United States.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5f0c4f0f347e4e7c9a5fd8cc6116d53b"><enum>(2)</enum><header>Position</header><text>The term <term>position</term>— </text><subparagraph commented="no" display-inline="no-display-inline" id="id6840b3603b46445182752f818d23c36d"><enum>(A)</enum><text display-inline="yes-display-inline">means a position as an employee of an agency; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id39c87682b11445ccba7d0fc93e5e86ba"><enum>(B)</enum><text display-inline="yes-display-inline">does not include—</text><clause commented="no" display-inline="no-display-inline" id="id8fbbb595a5d549e8ab34c736a5bc2016"><enum>(i)</enum><text display-inline="yes-display-inline">a position for which appointment is made by the President; </text></clause><clause commented="no" display-inline="no-display-inline" id="id0c993f265dc142e0a79e1562e3965044"><enum>(ii)</enum><text display-inline="yes-display-inline">a position as a law enforcement officer; </text></clause><clause commented="no" display-inline="no-display-inline" id="id86833e91866045bb934db05a072b8424"><enum>(iii)</enum><text>a position as a member of an Armed Force; or</text></clause><clause id="id786ac3680b4345d19997dbda763c1e9f"><enum>(iv)</enum><text>a position in the civil service in the Department of Defense. </text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idddc17ac693b0466b865153cf532bebbc"><enum>(b)</enum><header>Limitation</header><text>Notwithstanding any other provision of law or regulation, an individual may not serve for a total of more than 12 years in 1 or more positions.</text></subsection><subsection id="id50801a884cf04c7b8427ac9c59ff2812"><enum>(c)</enum><header>Application to current employees</header><paragraph commented="no" display-inline="no-display-inline" id="id18a0399f64484b539bd4ce812541ce74"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Subject to paragraph (2), an individual serving in a position on the date of enactment of this Act who has served for a total of not less than 9 years in 1 or more positions may not serve in a position on or after the date that is 3 years after the date of enactment of this Act. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaae60a431e144925a196e489d04b6be9"><enum>(2)</enum><header>Rule for separation from service</header><text>An individual serving in a position on the date of enactment of this Act who has served for a total of not less than 9 years in 1 or more positions and who separates from service before the date that is 3 years after the date of enactment of this Act may not serve in a position on or after the date on which the individual has served in a position for a total of not less than 12 years.</text></paragraph></subsection></section></legis-body></bill>
