Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a grant program for institutions of higher education to implement patient-centered academic counseling services for student survivors of sexual assault and other violence.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Support for Universities and Colleges to Champion the Educational Success of Survivors Act of 2023</short-title></quote> or the <quote><short-title>SUCCESS Act of 2023</short-title></quote>.</text></section><section id="idef68903237ae4a6eb5294027fe5330b4"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="idda3509af951e45d49ff92b978b26bfc9"><enum>(1)</enum><text>Campus sexual assault remains a pervasive issue on the campuses of institutions of higher education across the United States and negatively impacts student survivors’ academic outcomes.</text></paragraph><paragraph id="idae2dbc53c8af4ae4aea9721f7f085d54"><enum>(2)</enum><text>Sexual assault is one of the biggest risk factors for developing post-traumatic stress disorder, which is associated with decreased neurocognitive functioning that makes learning and retaining information difficult.</text></paragraph><paragraph id="id01a4a730bcb6448cbffdebf263c7a331"><enum>(3)</enum><text>Individuals impacted by trauma can often experience residual effects such as substance use disorders, suicidal ideation, personality disorders, depression, and anxiety, as well as other possible mental health challenges that can significantly impact academic performance or success and overall well-being. </text></paragraph><paragraph id="id9115f6618726496da92aa4b26518fe44"><enum>(4)</enum><text>Studies have shown that student survivors are more likely to have lower grade point averages, have difficulty with self-regulated learning, and are ultimately more likely to drop out of their institution of higher education.</text></paragraph><paragraph id="id74338e60d92f40e990a02657f5a156e2"><enum>(5)</enum><text>Considering the relationship between sexual assault and negative academic outcomes, institutions of higher education should provide these students not only with mental health services, but also with targeted academic support to counter their increased risk for negative academic outcomes.</text></paragraph><paragraph id="id9a912bef1b21455fb905d4b236a8b07b"><enum>(6)</enum><text>Patient-centered academic counseling and tutoring programs can be powerful tools to better support student survivors, improve their higher education retention rates, and ultimately support their educational success.</text></paragraph></section><section id="id2cabdc5652714b16968ac132d6006caa"><enum>3.</enum><header>Grant program for patient-centered academic counseling services for student survivors of sexual assault and other violence</header><text display-inline="no-display-inline">Part B of title I of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1011">20 U.S.C. 1011 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb20249c7e8fc4a95a57d3defc40eb568"><section id="id84256157a0d346c1b1126a4a3ce179f5"><enum>124.</enum><header>Grant program for patient-centered academic counseling services for student survivors of sexual assault and other violence</header><subsection id="id818243df97eb4d1ca77c8b0785f0279e"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id5625c1d916394a7484560be1efceec0e"><enum>(1)</enum><header>Eligible institution</header><text>The term <term>eligible institution</term> means an institution of higher education as defined in section 101(a). </text></paragraph><paragraph id="id8df53d03e2d6456fb7edbc2cd2c9f139"><enum>(2)</enum><header>Patient-centered</header><text>The term <term>patient-centered</term>, when used with respect to services provided to student survivors of sexual assault or other violence, means—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbb199c2b2e47499dbe74b13713c3ad14"><enum>(A)</enum><text display-inline="yes-display-inline">recognizing the widespread emotional, behavioral, developmental, and legal impact of trauma and understanding potential paths for recovery;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9788156dbac34d4ba6f407c1f1c41842"><enum>(B)</enum><text display-inline="yes-display-inline">recognizing the signs and symptoms of trauma in individuals, families, and staff;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id703526dc0f6c49309e696230b4f80590"><enum>(C)</enum><text display-inline="yes-display-inline">integrating the knowledge about trauma into policies, procedures, and practices; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idee97b077e1244cf9a1a8b92caa733f82"><enum>(D)</enum><text display-inline="yes-display-inline">actively resisting re-traumatizing by avoiding creating environments that inadvertently remind survivors of their traumatic experiences and cause them to experience psychological and biological stress. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1a223694c5404e5394b76428fc90b009"><enum>(3)</enum><header>Sexual assault</header><text>The term <term>sexual assault</term> has the meaning given the term in section 485(f)(6)(A).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id11fe794b2e0442839150e0b5702a32c3"><enum>(b)</enum><header>Grants authorized</header><paragraph id="id5ce63612cf3342f286db585b1cb9e3de"><enum>(1)</enum><header>In general</header><text>From amounts made available to carry out this section, the Secretary shall award grants, on a competitive basis, to eligible institutions to enable the eligible institutions to implement patient-centered academic counseling services and other services for student survivors of sexual assault and other violence.</text></paragraph><paragraph id="id79ae53f9ec024b898c06b112337ad084" commented="no"><enum>(2)</enum><header>Duration</header><text>A grant awarded under this section shall be for a term of 5 years.</text></paragraph></subsection><subsection id="id3edd3614dfa2434e96fc60a7055c45b7" commented="no"><enum>(c)</enum><header>Application</header><paragraph commented="no" display-inline="no-display-inline" id="id667fd3e03f21480393bbb67a2d784e8d"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible institution desiring a grant under this section shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd11b75dc67fd4c069cae6fbe4613b805"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">Each application submitted under paragraph (1) shall include—</text><subparagraph id="id3621e84492214171bf94e21c926e9642" commented="no"><enum>(A)</enum><text>a description of how the eligible institution will inform students enrolled in the institution of the patient-centered academic counseling services for student survivors of sexual assault and other violence;</text></subparagraph><subparagraph id="id02f3069a55d04fbb8cbd75e42af71d87" commented="no"><enum>(B)</enum><text>a description of how the eligible institution will provide training for faculty and staff to support and connect student survivors of sexual assault and other violence with patient-centered care; and</text></subparagraph><subparagraph id="id53a35689d2cc40d7993e74e54f91a682" commented="no"><enum>(C)</enum><text>a description of the protocols the eligible institution will follow for coordinating patient-centered academic counseling and tutoring programs for survivors.</text></subparagraph></paragraph></subsection><subsection id="idc0b376ceaff44493b7ab6cece5acc39a"><enum>(d)</enum><header>Award basis</header><text>In awarding grants under this section, the Secretary shall give priority to—</text><paragraph id="idc75e7b9762f24945be512e13187e6aa6"><enum>(1)</enum><text>institutions of higher education with a history of violations of title IX of the Education Amendments of 1972;</text></paragraph><paragraph id="idd91fc40c0b824a5480fba0ad93aa62ed"><enum>(2)</enum><text>community colleges (defined as <term>junior or community colleges</term> under section 502(a)(6));</text></paragraph><paragraph id="id5a8cda9f64204fc19bdcbd15ee65220e"><enum>(3)</enum><text>historically Black colleges and universities (defined as <term>part B institutions</term> under section 322);</text></paragraph><paragraph id="idf6debe11bf5f4d0b91d32c8f4868baad"><enum>(4)</enum><text>Tribal Colleges or Universities (as defined under section 316(b)); and</text></paragraph><paragraph id="id7c5f2650d3c14a4193de75adc5ecc799"><enum>(5)</enum><text>other minority-serving institutions (defined as institutions eligible under section 371(a)).</text></paragraph></subsection><subsection id="id89e03be4e5eb492a8b910a5e61ca1d4f"><enum>(e)</enum><header>Use of funds</header><text>An eligible institution receiving a grant under this section shall use grant funds to carry out 1 or more of the following: </text><paragraph id="ida69fe4dd1b5b4b3f99f5a2a21897d5cd"><enum>(1)</enum><text>Providing higher education re-entry assistance for student survivors of sexual assault and other violence who had to take leaves of absence or withdraw from the eligible institution.</text></paragraph><paragraph id="idef0af6128ef84f04965f2a16ad047f8c"><enum>(2)</enum><text>Increasing training for faculty and administrators on patient-centered care, on recognizing signs of trauma, and on connecting survivors of sexual assault and other violence to appropriate support services.</text></paragraph><paragraph id="idf40cf30a5dc84063b7974b35b26705e3"><enum>(3)</enum><text>Providing professional development focused on patient-centered practices for academic advisors and academic counselors.</text></paragraph><paragraph id="idf510bd355b2647739f2aa9feeff453b0"><enum>(4)</enum><text>Providing academic accommodation for students experiencing trauma, such as patient-centered training for tutors or the establishment of a confidential tutoring program specifically designed to assist student survivors of sexual assault and other violence.</text></paragraph><paragraph id="id121d09a10ca64174922f9518fde75e2e"><enum>(5)</enum><text>Increasing mental health services for student survivors of sexual assault and other violence.</text></paragraph><paragraph id="idb1597eb8b36c4121bc60e20e13e4399f"><enum>(6)</enum><text>Creating or enhancing a fund for survivors of sexual assault and other violence to be used for wrap-around services.</text></paragraph></subsection><subsection id="idd97485dd56ce4e2ca5a243126857f2ac"><enum>(f)</enum><header>Reports</header><paragraph id="id172ca6f052a04b62b41d176cd2538633"><enum>(1)</enum><header>Eligible institution reports</header><subparagraph commented="no" display-inline="no-display-inline" id="id21cf321cdf0d4f47b6fb1f42710d3390"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">At the end of the grant period, each eligible institution receiving a grant under this section shall prepare and submit to the Secretary a report on the program carried out under the grant.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id974fa591cf4b47949b76f7eb90e894f5"><enum>(B)</enum><header>Contents</header><text display-inline="yes-display-inline">The report submitted under subparagraph (A) shall include—</text><clause id="id3bae1fe991fb4921a001ba2f9554ce19"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="id770dd9f144de466e866211cd0a065254"><enum>(I)</enum><text>the kinds of accommodations the student survivors who reported sexual assault or instances of other violence during the period described in subparagraph (A) requested; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc6384f55e5b84a3aa6a199a99b4d349a" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">the accommodations that such students were given; </text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idbaa08a7ac4b54c239cd7d3f0d2cdd6f4"><enum>(ii)</enum><text>the graduation and re-enrollment rates of student survivors of sexual assault and other violence who were enrolled in the eligible institution during the grant period; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idf3b8e035727b4e86b82f9f6083963c06"><enum>(iii)</enum><text>such other information as the Secretary may require.</text></clause></subparagraph></paragraph><paragraph id="ida2e7dff2e77a452bacd05ed519ac0edf"><enum>(2)</enum><header>Secretary reports</header><subparagraph commented="no" display-inline="no-display-inline" id="idb63b01975675403a874bbe0a2e3c0dc2"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than one year after the grant program has concluded, the Secretary shall submit a report to the authorizing committees regarding the grant program carried out under this section.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf4c65db4d4014caea59a146b30d3d10d"><enum>(B)</enum><header>Contents</header><text display-inline="yes-display-inline">The report submitted under subparagraph (A) shall include the graduation and re-enrollment rates of student survivors of sexual assault and other violence who were enrolled in the eligible institutions during the grant period, in order to determine the effectiveness of the grant program. </text></subparagraph></paragraph></subsection><subsection id="idab359d71679c4126807eab19976d673e"><enum>(g)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section such sums as may be necessary for 2024 and each of the 4 succeeding fiscal years.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
