which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Immigration and Nationality Act to allow certain alien veterans to be paroled into the United States to receive health care furnished by the Secretary of Veterans Affairs.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HDA53F3D2B52E444FA5C79328552C3E48"><section section-type="section-one" id="H8FF4071CB3D44C79824C07B013FF84A7"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Healthcare Opportunities for Patriots in Exile Act</short-title></quote> or the <quote><short-title>HOPE Act</short-title></quote>.</text></section><section id="H2D4622F3DE944D9E984D3CA53A4E8848"><enum>2.</enum><header>Parole for certain veterans</header><text display-inline="no-display-inline">Section 212(d)(5) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(d)(5)</external-xref>) is amended—</text><paragraph id="H6D59E6AC4B0A46CE8AE14F603B3C16FA"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>subparagraph (B) or</quote> and inserting <quote>subparagraphs (B) and (C) and</quote>;</text></paragraph><paragraph id="HE58E0517E1C14657B44C763EA0D71BFE"><enum>(2)</enum><text>by striking <quote>Attorney General</quote> each place such term appears and inserting <quote>Secretary of Homeland Security</quote>; and</text></paragraph><paragraph id="HF26A9D9922EB4F1BAB34820771AB7E04"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="traditional" display-inline="no-display-inline" id="HF073BB9B6AA94148993598FAC72D01B4"><subparagraph id="H1C4ADE9BE07E4DFE822D6E22D1C7F7EC" indent="up2"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="HA4EC603166064BAA8EE18D961A9D49B4"><enum>(i)</enum><text>The Secretary of Homeland Security may parole any alien qualified under clause (ii) into the United States—</text><subclause id="idA4D89F2771E24D35B1727E41DCF02DB4" indent="up1"><enum>(I)</enum><text>at the discretion of the Secretary;</text></subclause><subclause id="idEC3EAC33C99D4B2E892500572DC9CB46" indent="up1"><enum>(II)</enum><text>on a case-by-case basis; and</text></subclause><subclause id="id756118581E784F25A4D657C3B15B84F7" indent="up1"><enum>(III)</enum><text>temporarily under such conditions as the Secretary may prescribe.</text></subclause></clause><clause id="idD0749C3AC4E74D37830AD396C7DF39A7" indent="up1"><enum>(ii)</enum><text>To qualify for parole under clause (i) an alien applying for admission to the United States shall—</text><subclause id="H30F5E3DCA9694533AE103769B22695B6"><enum>(I)</enum><text display-inline="yes-display-inline">be a veteran (as defined in section 101 of title 38, United States Code);</text></subclause><subclause id="H17373E801B8C4981A5E3830C829A292B"><enum>(II)</enum><text display-inline="yes-display-inline">seek parole to receive health care furnished by the Secretary of Veterans Affairs under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">chapter 17</external-xref> of title 38, United States Code; and</text></subclause><subclause id="HA5208EA7D7E34182B471C86AA36B85E2"><enum>(III)</enum><text>be outside of the United States pursuant to having been ordered removed or voluntarily departed from the United States under section 240B.</text></subclause></clause><clause id="H71DB50604DA44D28819592C118385E1A" indent="up1"><enum>(iii)</enum><text>Parole of an alien under clause (i) shall not be regarded as an admission of the alien.</text></clause><clause id="idA7673B7278B14B21BD346F8F98B2BB0A" indent="up1"><enum>(iv)</enum><text>If the Secretary of Homeland Security determines that the purposes of such parole have been served the alien shall forthwith return or be returned to the custody from which the alien was paroled.</text></clause><clause id="H8D7BF4A8BDC849A3AC480214663D9F79" indent="up1"><enum>(v)</enum><text>Parole shall not be available under clause (i) for an alien who is inadmissible due to a criminal conviction—</text><subclause id="idD335283DD65C4AB98851886C0892F6E1"><enum>(I)</enum><item commented="no" display-inline="yes-display-inline" id="id7D1A05C8FBBA4EA9AC5DC24442CE5A7D"><enum>(aa)</enum><text>for a crime of violence (as defined in section 16(a) of title 18, United States Code), excluding a purely political offense; or</text></item><item id="idC915572CE9954610A3022738FBB40270" indent="up1"><enum>(bb)</enum><text>for a crime that endangers the national security of the United States; and</text></item></subclause><subclause id="idD5E64AA9878349349EB8BB033978983A"><enum>(II)</enum><text>for which the alien has served a term of imprisonment of at least 5 years.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
