<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 3240</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20231107">November 7, 2023</action-date><action-desc><sponsor name-id="S407">Mr. Hagerty</sponsor> (for himself, <cosponsor name-id="S365">Mr. Scott of South Carolina</cosponsor>, <cosponsor name-id="S355">Mr. Cruz</cosponsor>, <cosponsor name-id="S350">Mr. Rubio</cosponsor>, and <cosponsor name-id="S317">Mr. Barrasso</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require senior Department of State officials to maintain security clearances and to require the Secretary of State to notify Congress when the security clearances of such officials are suspended or revoked.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HC0647371D4874B66A1D6FB89CC4A6457"><section id="H8A43D6363D8246DFA162FE5E17241DD7" section-type="section-one"><enum>1.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="idf293834866f64870b9b19c0d9b983510"><enum>(1)</enum><header display-inline="yes-display-inline">Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name> and the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>.</text></paragraph><paragraph id="H70FEB574CF8A44D0AEF5466DB82B1639"><enum>(2)</enum><header>Covered official</header><text>The term <term>covered official</term> means any individual—</text><subparagraph id="HDB15ADE9E4EB4A8689B7BFF7365E40A5"><enum>(A)</enum><text>holding a position at the level of Assistant Secretary or higher at the Department of State;</text></subparagraph><subparagraph id="HB720B9B9ADD14441BDFA146C68011397"><enum>(B)</enum><text>holding the position of chief of mission or principal officer at any diplomatic or consular post;</text></subparagraph><subparagraph id="HA6FA9DB6612649C58A025932DBC34694" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>holding the rank and status of ambassador; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb8608f5576cf4675bdc87a3544847c29"><enum>(D)</enum><text display-inline="yes-display-inline">holding any other position that reports directly to the Secretary of State, such as special envoy.</text></subparagraph></paragraph></section><section id="idecf8156490c34213b8e9128b2bb09976"><enum>2.</enum><header>Security clearances required for senior employees of the Department of State</header><text display-inline="no-display-inline">All covered officials shall obtain and maintain a security clearance that allows the covered official to access sensitive compartmented information. </text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="ide5534e9d2d764e77b3b3bdde88bd9c3b"><enum>3.</enum><header display-inline="yes-display-inline">Notification of suspension or revocation of clearances</header><text display-inline="no-display-inline">If the security clearance of any covered official is suspended or revoked, the Secretary of State shall—</text><paragraph id="H59410AD12AC44894ACC8F23341AEEB24"><enum>(1)</enum><text>not later than 15 days after such suspension or revocation, notify the appropriate congressional committees of the name and position of the individual whose security clearance was suspended or revoked; and</text></paragraph><paragraph id="H9377248DCDC5488DB8803F4610616478"><enum>(2)</enum><text display-inline="yes-display-inline">not later than 30 days after such suspension or revocation, provide a briefing for the appropriate congressional committees regarding—</text><subparagraph id="H3C22BB2475E44E8BAEA8A8E8C09BE06E"><enum>(A)</enum><text>the documentation notifying such individual of such suspension or revocation; and</text></subparagraph><subparagraph id="H2AFE76FAA3684D87A07F608C2DC28C55"><enum>(B)</enum><text>the current employment status and conditions of such individual.</text></subparagraph></paragraph></section></legis-body></bill>
