which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Camp Lejeune Justice Act of 2022 to ensure claimants are adequately informed regarding filing a Federal cause of action.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Patriot Bill of Rights</short-title></quote>.</text></section><section id="idf00e279822f2434399772f055f8867c3"><enum>2.</enum><header>Information regarding Federal cause of actions relating to water at Camp Lejeune, North Carolina</header><subsection commented="no" display-inline="no-display-inline" id="id787644b0e6974b9e913bc3099a74ec82"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Camp Lejeune Justice Act of 2022 (<external-xref legal-doc="usc" parsable-cite="usc/28/2671">28 U.S.C. 2671</external-xref> note prec.) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7ef13fee0f5d4b36b07d269ae7ba2042"><subsection id="id5b3f0b39d46a4a3ab82fb23fcf0006b4"><enum>(k)</enum><header>Acknowledgments</header><paragraph id="ide598a4ae642142d39dc9df48ef6a0b98"><enum>(1)</enum><header>Guidance and advice services</header><text>An individual, or the legal representative of an individual, bringing a cause of action under subsection (b) shall sign a written acknowledgment, provided by the attorney, indicating that the individual or legal representative bringing the action understands that the individual or legal representative may seek guidance and advice free of charge from—</text><subparagraph id="id43220499f16043e5b6c14709d6d3ecf6"><enum>(A)</enum><text>organizations recognized under section 5902 of title 38, United States Code;</text></subparagraph><subparagraph id="idefafa03284a7442f82efb0b724321a19"><enum>(B)</enum><text>the Secretary of Veterans Affairs;</text></subparagraph><subparagraph id="idc12eb21a1dbb411099806d1a4382f5b3"><enum>(C)</enum><text>the congressional representatives of the individual or legal representative; and</text></subparagraph><subparagraph id="id69538c5d7efe441abdc985db362c5ec6"><enum>(D)</enum><text>the Tort Claims Unit of the Department of the Navy.</text></subparagraph></paragraph><paragraph id="id3e2b41bdc8b6416dbbbdf9e7ab568af0"><enum>(2)</enum><header>Other required acknowledgments</header><text>An attorney representing an individual or the legal representative of an individual in a cause of action brought under subsection (b) shall file with the Secretary of the Navy a written acknowledgment signed by the individual or legal representative indicating that the individual or legal representative understands—</text><subparagraph id="idb7ac766c834348a288c64576adf3c954"><enum>(A)</enum><text>legal representation by an attorney is not required to file an action; and</text></subparagraph><subparagraph id="id96d11a4945bf42aebfec2441d0ad7eff"><enum>(B)</enum><text>the attorney’s fee arrangement regarding representation in the action, which shall include an acknowledgment of whether the fee arrangement is one under which the total amount of the fee payable to the attorney is—</text><clause id="id9fa517de1f1b4556b9638a93444662a5"><enum>(i)</enum><text>to be paid to the attorney by the claimant, subsequent to the allocation of the award; or</text></clause><clause id="id86790a0a03b246a0b9e71810a6c90ad6"><enum>(ii)</enum><text>contingent on whether the matter is resolved in a manner favorable to the claimant.</text></clause></subparagraph></paragraph><paragraph id="idedff070e6d3240f3a2f9c9744212cbfd"><enum>(3)</enum><header>Application to pending matters</header><text>For any cause of action brought under subsection (b) that is pending on the date of enactment of this subsection, not later than 90 days after such date of enactment, the individual bringing the action, the legal representative of the individual, or the attorney for the individual or legal representative, as applicable, shall file the acknowledgments described in paragraphs (1) and (2).</text></paragraph><paragraph id="id473f45ee08104c978dde414d6639ddd8"><enum>(4)</enum><header>Advertising</header><text>A law firm that receives veteran data from an advertising agency shall reduce the attorney’s legal fee in an amount equal to the cost incurred by the law firm to receive the data.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="idf228d8774664436591921bf8ae61d1c8"><enum>(b)</enum><header>Severability</header><text>If any provision of the amendment made by subsection (a), or the application of such a provision to any person or circumstance, is held to be unconstitutional, the remaining provisions of the amendment made by subsection (a), the other provisions of the Camp Lejeune Justice Act of 2022 (<external-xref legal-doc="usc" parsable-cite="usc/28/2671">28 U.S.C. 2671</external-xref> note prec.), and the application of the provision of the amendment made by subsection (a) held to be unconstitutional to any other person or circumstance shall not be affected thereby. </text></subsection></section></legis-body></bill>
