which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Higher Education Act of 1965 to require the standards for accreditation of an institution of higher education to assess the institution's adoption of admissions practices that refrain from preferential treatment in admissions based on an applicant's relationship to alumni of, or donors to, the institution, to authorize a feasibility study on data collection, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Merit-based Educational Reforms and Institutional Transparency Act</short-title></quote> or the <quote><short-title>MERIT Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id6a0cee1575644be18b8f5822bf3c4ba6"><enum>2.</enum><header>Assessment of admissions practices</header><subsection commented="no" display-inline="no-display-inline" id="ided0bb7bcdc3845ab88b5dca93c299464"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><paragraph commented="no" display-inline="no-display-inline" id="idba257d66bc394e68ae4e0f5339f748e1"><enum>(1)</enum><header>Standards for accreditation</header><text display-inline="yes-display-inline">Section 496(a)(5) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1099b">20 U.S.C. 1099b(a)(5)</external-xref>) is amended—</text><subparagraph id="idd0f1d7cf3fa44c7c9cf964ee7199092d"><enum>(A)</enum><text>by redesignating subparagraphs (G), (H), (I), and (J), as subparagraphs (H), (I), (J), and (K), respectively;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id41a92b83e3274e93bcfc075afadc5068"><enum>(B)</enum><text>by inserting after subparagraph (F) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id60e749bb87c142f981ed3b96aaa62be2"><subparagraph id="idae885be83e1b49ffbb2c3ac25d494245"><enum>(G)</enum><text>adoption of admissions practices that refrain from any manner of preferential treatment in the admission process to applicants on the basis of the applicant's relationship to—</text><clause commented="no" display-inline="no-display-inline" id="id81b83e55eb4e4982b75abb35fcc8bb9f"><enum>(i)</enum><text>alumni of the institution; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id87aece097e3641c18f0d1432b3959e5c"><enum>(ii)</enum><text>donors to the institution;</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id7a09185b5f5c4cfe8f44fdc879f15f0d"><enum>(C)</enum><text>in subparagraph (H), as redesignated under subparagraph (A), by striking <quote>and admissions</quote>; and</text></subparagraph><subparagraph id="id2f6870ae174f40d1b141a5d267dda73d"><enum>(D)</enum><text>in the flush matter at the end, by striking <quote>subparagraphs (A), (H), and (J)</quote> and inserting <quote>subparagraphs (A), (I), and (K)</quote>.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idddf4cc32185e4014ab91c2a7618a2463"><enum>(2)</enum><header>Preferential treatment definition</header><text>Section 496 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1099b">20 U.S.C. 1099b</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idECA27F1C2D2E4B748D59EF4F2631CFFD"><subsection commented="no" display-inline="no-display-inline" id="id17a03dae28624abca06adc59daac17f8"><enum>(r)</enum><header>Preferential treatment</header><text display-inline="yes-display-inline">For the purpose of subsection (a)(5)(G), the term <term>preferential treatment</term> means making an admissions decision or awarding tangible education benefits where an applicant’s relationship with an alumni of, or donor to, the deciding institution serves as the determinative factor.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idb5e1c408878841c4a1f09c22703171a0"><enum>(b)</enum><header>Rule of construction</header><text>Section 496(p) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1099b">20 U.S.C. 1099b(p)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id9c826b3cde134b548088e47d2751aac0"><enum>(1)</enum><text>by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively, and moving the margins of such subparagraphs (as so redesignated) 2 ems to the right;</text></paragraph><paragraph id="ida907f58d06f14ae086d3b62ed3331655"><enum>(2)</enum><text>by striking <quote>Nothing in subsection (a)(5) shall be construed to restrict the ability of</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf576595dc4f04c5ab0f265bdb9c2eec6"><paragraph id="id6c9014823ad54bcd935f4178b25d67dc"><enum>(1)</enum><header>In general</header><text>Nothing in subsection (a)(5) shall be construed to restrict the ability of</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id06347e0944674cf4a2e218cda2840c98" commented="no"><enum>(3)</enum><text>by adding at the end of the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id725eb84ed5ed4911b506573c9f434a3d"><paragraph id="id01313aca3af84867a35436634d212704"><enum>(2)</enum><header>Demonstrated interest</header><text>Nothing in subparagraph (G) of subsection (a)(5) shall be construed to prevent institutions from considering the demonstrated interest of an applicant as a factor in admissions decisions if—</text><subparagraph commented="no" display-inline="no-display-inline" id="idaf56a2d2d93941b58227994a32b880e5"><enum>(A)</enum><text>the criteria for assessing demonstrated interest are clearly defined and made publicly available;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5eb3c24c96f14a85a3beb9904d1c88d7"><enum>(B)</enum><text>the applicant is provided the opportunity to explain why they have a demonstrated interest in the institution, which may be informed by lived experiences, values, attributes, and faith; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ideb575df24e2640fb9c215e84172015dd"><enum>(C)</enum><text>the opportunities to demonstrate interest are equally accessible to all applicants, regardless of their financial resources, alumni affiliation, or donor affiliation. </text></subparagraph></paragraph><paragraph id="id0adc83e4a88246309d37b6e02397d875"><enum>(3)</enum><header>Faith-based institutions</header><text>Nothing in subparagraph (G) of subsection (a)(5) shall be construed to inhibit the right of a religious institution to make admissions decisions consistent with the institution's faith-based values.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id09b9ca8d92c24574965f6affa896066f"><enum>(c)</enum><header>Report</header><paragraph commented="no" display-inline="no-display-inline" id="id257f966b1b664fe699229fcdd718957e"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of completion of the negotiated rulemaking process under section 492 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1098a">20 U.S.C. 1098a</external-xref>) with respect to the amendments made by this section, and biennially thereafter, the Secretary of Education shall submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Education and the Workforce of the House of Representatives a report that identifies the efforts taken to ensure compliance with the requirements of this section and the amendments made by this section, including— </text><subparagraph commented="no" display-inline="no-display-inline" id="id02c68cd1089845e4a83df9476cf9f9f0"><enum>(A)</enum><text display-inline="yes-display-inline">any technical assistance the Secretary has provided;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id47f82fc42ae548c39848d148e069b9f3"><enum>(B)</enum><text display-inline="yes-display-inline">any regulatory guidance the Secretary has issued; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id90746ff92c414fc0ace65a3f5a806cac"><enum>(C)</enum><text display-inline="yes-display-inline">any compliance monitoring the Secretary has conducted. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8fd189a1fe904a2f84c059c02119e101"><enum>(2)</enum><header>Public availability</header><text display-inline="yes-display-inline">Each report described under paragraph (1) shall be made available to the public.</text></paragraph></subsection></section><section id="id5e5eda19a8a44a63845bcf9150a61a4b"><enum>3.</enum><header>Feasibility study to improve data collection</header><subsection id="idd59447b16ac648bfa813f6aefb2f0072"><enum>(a)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary of Education shall explore the feasibility of working with the National Student Clearinghouse to establish a third-party method to collect and produce institution-level analysis of data on the impact of an admissions decision based on an applicant’s relationship with an alumni of, or donor to, the deciding institution, and how such data reported to the National Student Clearinghouse could be secured, while considering the following:</text><paragraph id="idc82c0f652c09409a9b1359c1348ea664"><enum>(1)</enum><text>Whether data reported to the National Student Clearinghouse can accurately capture the impact and prevalence of admitting students with alumni or donor affiliations at various institutions. </text></paragraph><paragraph id="id4b0c5efc61a3487dbc5c95587547110e"><enum>(2)</enum><text>Whether institutions have clear and defined policies regarding admitting students with alumni or donor affiliations that can be transparently reported to the National Student Clearinghouse. </text></paragraph><paragraph id="id5994fe37aeb94ba7b128bc047fa09d3c"><enum>(3)</enum><text>Whether this new data stream can be integrated with reporting to the Integrated Postsecondary Education Data System (IPEDS) while ensuring that the quality of data remains consistent or improves compared to the data provided through IPEDS.</text></paragraph><paragraph id="ideb3986a484cd4bc7b5f36596cffb53f6"><enum>(4)</enum><text>Whether reporting this new data might alter the current interaction between institutions and the National Student Clearinghouse. </text></paragraph><paragraph id="idc6cd88d8828c4373b966382dd6c80796"><enum>(5)</enum><text>Whether reporting such data can maintain confidentiality, especially regarding private donations and donor identities, while still producing accurate measures of institutional practices.</text></paragraph><paragraph id="id21062627105f4b4baab390618c557ef8"><enum>(6)</enum><text>Whether the National Student Clearinghouse can satisfy data reporting requirements without transferring any disaggregated data that would be personally identifiable to the Department of Education.</text></paragraph><paragraph id="id0e9c1975b328469fa61c4a01b18a04ed"><enum>(7)</enum><text>Whether the data can be reported in such a way that it separates students with familial ties to alumni from those admitted due to direct donor affiliations.</text></paragraph><paragraph id="id5b581134d5154e6f8b8452a4fe5d1589"><enum>(8)</enum><text>Whether there’s a distinction in admissions criteria for legacy and donor-affiliated applicants compared to traditional applicants.</text></paragraph></subsection><subsection id="idfe344bfa17c34ddab188add377e57134"><enum>(b)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to authorize the development of a nationwide database of personally identifiable information on individuals involved in studies or other collections of data under this Act or an amendment made by this Act.</text></subsection></section></legis-body></bill>
