which was read twice and referred to the <committee-name committee-id="SLIA00">Committee on Indian Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To protect Native cultural sites located on Federal land, to improve consultation with Indian Tribes, to bring parity to Indian Tribes with regard to Federal public land management laws, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Advancing Tribal Parity on Public Land Act</short-title></quote>.</text></section><section id="id8b6decef7df945dea868607056f7d1cb"><enum>2.</enum><header>Preventing disposal of cultural sites</header><subsection id="iddde9f3a339304c2ba5a5561327465017"><enum>(a)</enum><header>In general</header><paragraph id="ided899438b5fc4dc3b542d22fb7d9d86c"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="ida6d35f815e5247c7bf140ba1c2cd8231"><enum>(A)</enum><header>Cultural site</header><text>The term <term>cultural site</term> means—</text><clause id="id7156912281514c1482ac7ecb37ff4f08"><enum>(i)</enum><text>a sacred site;</text></clause><clause id="id1c531a47416e4f04adab95fe7acbdfa3"><enum>(ii)</enum><text>a historic property (as defined in section 800.16 of title 36, Code of Federal Regulations (as in effect on the date of enactment of this Act)); or</text></clause><clause id="id922b9bf7effa47448f570a9e04d61187"><enum>(iii)</enum><text>a landform or landscape that—</text><subclause id="idc6f156f0ef81444298719b0b090a0665"><enum>(I)</enum><text>is the site of important customs, practices, objects, places, religions, or ceremonies of Indian Tribes;</text></subclause><subclause id="id0d4bbe107ae048708327a7df44c144f3"><enum>(II)</enum><text>is important to an Indian Tribe for the undertaking of religious, cultural, spiritual, or traditional practices;</text></subclause><subclause id="idf1f41d4836ec4519b73679702b5d06a0"><enum>(III)</enum><text>is connected through features or ceremonies to other sites or a larger sacred landscape, as determined by an Indian Tribe; or</text></subclause><subclause commented="no" id="id4f42abd5db0b4a8284cc153801d206ab"><enum>(IV)</enum><text>contains unique or important traditional Tribal food, medicinal, or material gathering areas.</text></subclause></clause></subparagraph><subparagraph id="id8b5e14c6e1264a02bcb9ab25b70e778f"><enum>(B)</enum><header>Former reservation</header><text>The term <term>former reservation</term> means land that is within the exterior boundaries of any previous reservation that was established by treaty, Executive order, or Secretarial order for an Indian Tribe.</text></subparagraph><subparagraph id="idb81942e83cf34e1bb57b946179cbcf4e"><enum>(C)</enum><header>Indian tribe</header><text>The term <term>Indian Tribe</term> means the governing body of any Indian or Alaska Native tribe, band, nation, pueblo, village, community, component band, or component reservation individually identified (including parenthetically) on the list published by the Secretary of the Interior under section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>).</text></subparagraph><subparagraph commented="no" id="id8a29bda73eed474e840236e8b31adc22"><enum>(D)</enum><header>Interested Indian Tribe</header><text>The term <term>interested Indian Tribe</term>, with respect to a tract of public land subject to proposed disposition by the Secretary concerned under, as applicable, section 203 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1713">43 U.S.C. 1713</external-xref>), section 503(a) of the Forest Service Facility Realignment and Enhancement Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/16/580d">16 U.S.C. 580d</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/109/54">Public Law 109–54</external-xref>), or section 2(a)(1) of <external-xref legal-doc="public-law" parsable-cite="pl/97/465">Public Law 97–465</external-xref> (commonly known as the <quote>Small Tract Act of 1983</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/16/521d">16 U.S.C. 521d(a)(1)</external-xref>), means an Indian Tribe with—</text><clause commented="no" id="id924172da27774ef1adf673f57f32a08c"><enum>(i)</enum><text>historic, precontact, cultural, or religious connection to a cultural site located on the tract of public land;</text></clause><clause commented="no" id="id038b3eaf45934b1c9806bb71dc7a9e8f"><enum>(ii)</enum><text>a former reservation located on the tract of public land; or</text></clause><clause commented="no" id="id53eb0d65ea2f40eca6113d32c22df8ad"><enum>(iii)</enum><text>treaty rights or other reserved rights associated with the tract of public land.</text></clause></subparagraph><subparagraph id="id84c44a3ee3e847ef9581800c5b8784b8"><enum>(E)</enum><header>Public land</header><text>The term <term>public land</term> means—</text><clause id="id84aeb997c73147cc8440e86e050b1107"><enum>(i)</enum><text>public lands (as defined in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>)); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id1378feaa318246fb8637648ff18a6a4d"><enum>(ii)</enum><text>National Forest System land. </text></clause></subparagraph><subparagraph id="idd963bde70cbf45e189dad2d67fa2ee60"><enum>(F)</enum><header>Sacred site</header><text>The term <term>sacred site</term> means a specific, discrete, narrowly delineated site on public land that is identified by an Indian Tribe as sacred by virtue of the established religious significance of the site to, or ceremonial or medicinal use of the site by, an Indian Tribe.</text></subparagraph><subparagraph id="id01800cd7f1f141d29cfacb9350c2dfe8"><enum>(G)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text><clause id="id727965100a8346568ad38cf319afd345"><enum>(i)</enum><text>with respect to public land described in subparagraph (E)(i), the Secretary of the Interior; and</text></clause><clause id="id3d4bff45c4584d9cb9daf13ae34bcfe4"><enum>(ii)</enum><text>with respect to public land described in subparagraph (E)(ii), the Secretary of Agriculture.</text></clause></subparagraph></paragraph><paragraph id="ida6777fc3b20244a086af42117aeb0474"><enum>(2)</enum><header>Consideration of tribal interests</header><text>The Secretary concerned may not dispose of a tract of public land under, as applicable, section 203 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1713">43 U.S.C. 1713</external-xref>), section 503(a) of the Forest Service Facility Realignment and Enhancement Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/16/580d">16 U.S.C. 580d</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/109/54">Public Law 109–54</external-xref>), or section 2(a)(1) of <external-xref legal-doc="public-law" parsable-cite="pl/97/465">Public Law 97–465</external-xref> (commonly known as the <quote>Small Tract Act of 1983</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/16/521d">16 U.S.C. 521d(a)(1)</external-xref>) unless the Secretary concerned determines, through consultation with any interested Indian Tribes, as evidenced by a written correspondence signed by the Secretary concerned and all interested Indian Tribes, that disposal of the tract—</text><subparagraph id="idda1fce4e978a47e1bab5057466b9a8da"><enum>(A)</enum><text>would not impact the rights and interests of any interested Indian Tribe; and</text></subparagraph><subparagraph id="idca58d90e37804b4ea1458c7bee1fea9e"><enum>(B)</enum><text>would not impair access to a reservation.</text></subparagraph></paragraph><paragraph id="idf2dabd4c2c2c40d792cd128b245fb384"><enum>(3)</enum><header>Notification</header><text>If the Secretary concerned determines under paragraph (2) that disposal of a tract of public land under that paragraph would not impact the rights and interests of an interested Indian Tribe and would not impair access to a reservation, prior to conducting a sale of the tract of public land, the Secretary concerned shall notify all Indian Tribes of the availability of the tract for sale—</text><subparagraph id="idcb18358f97d34a2f98b079e9805a1e4a"><enum>(A)</enum><text>in accordance with—</text><clause id="idbda2e88a440443de829dfd290b77d287"><enum>(i)</enum><text>Executive Order 13175 (<external-xref legal-doc="usc" parsable-cite="usc/25/5301">25 U.S.C. 5301</external-xref> note; relating to consultation and coordination with Indian tribal governments); </text></clause><clause id="id0a8dc94e062245989e17951ad998e0d9"><enum>(ii)</enum><text>chapter 1780 of the Bureau of Land Management Manual (or successor regulations), with respect to public land described in paragraph (1)(E)(i); and</text></clause><clause id="id25bbb4d01cf949b787f652f1ccf1b850"><enum>(iii)</enum><text>chapter 1563 of the Forest Service Manual (or successor regulations), with respect to public land described in paragraph (1)(E)(ii); and</text></clause></subparagraph><subparagraph id="id03f3b0555b624fcc9eff2b9986dde549"><enum>(B)</enum><text>in a manner that—</text><clause id="id256c9a4853964af19035b7e53213c3b0"><enum>(i)</enum><text>the Secretary concerned determines provides adequate notice to each Indian Tribe of the availability of the tract for sale; and</text></clause><clause id="idd1b3c56693084a9cb847c706fc4f55ba"><enum>(ii)</enum><text>uses any methods or modes of communication by which an Indian Tribe has requested to be notified of the availability of the tract for sale.</text></clause></subparagraph></paragraph><paragraph id="id42AE599733EE43ABAC417D55B5F9DB91"><enum>(4)</enum><header>Tribal right of first refusal</header><subparagraph id="id1d7512e8b9eb4b18bad046660f7c64d5"><enum>(A)</enum><header>Sale to Indian tribe</header><text>If an interested Indian Tribe notified of the proposed sale of a tract of public land under paragraph (3) submits to the Secretary concerned a bid to buy the tract for fair market value by not later than 60 days after receiving the notification, the Secretary concerned shall sell the tract to the interested Indian Tribe.</text></subparagraph><subparagraph id="id7a1928472a9c46549842fa04f2bfddbb"><enum>(B)</enum><header>Multiple bids</header><clause id="id441320f336dd4e49be660413d3e7ec24"><enum>(i)</enum><header>In general</header><text>If more than 1 interested Indian Tribe submits a bid to purchase a tract of public land under subparagraph (A), the Secretary concerned shall defer the sale of the tract for a period of not more than 180 days, unless an extension is agreed to by the interested Indian Tribes that submitted bids and the Secretary concerned, to allow the Secretary concerned and interested Indian Tribes to develop a mutually agreeable sale of the tract to 1 or more interested Indian Tribes.</text></clause><clause id="idc2a4bade9e844f17bd48b8ed1d08d1b1"><enum>(ii)</enum><header>Agreement</header><text>If the Secretary concerned and the interested Indian Tribes reach an agreement under clause (i), the Secretary shall execute the terms of that agreement in accordance with applicable law (including regulations).</text></clause><clause id="idf70cfcde5a784d4ca6c1581b051706eb"><enum>(iii)</enum><header>Failure to reach agreement</header><text>If, at the end of, as applicable, the 180-day period described in clause (i) or any extended period agreed to under that clause, the Secretary concerned and the interested Indian Tribes fail to reach an agreement regarding the sale of the applicable tract of public land, the Secretary concerned shall not, for a period of 5 years following the end of that 180-day period, offer the tract for sale.</text></clause></subparagraph><subparagraph id="id6ceae3e502c146f881fc2c8e8eded3a0"><enum>(C)</enum><header>Mandatory trust acquisition</header><text>A tract of public land acquired by an interested Indian Tribe under this paragraph shall be taken into and held in trust by the Secretary of the Interior for the benefit of the interested Indian Tribe.</text></subparagraph></paragraph><paragraph id="id8de5b749422141818915358e8c04f1a6"><enum>(5)</enum><header>Appraisal standards</header><text>The fair market value of a tract of public land to be sold under this subsection shall be determined pursuant to an appraisal conducted in accordance with—</text><subparagraph id="id4bc72f379a3e4382ade2293901aece96"><enum>(A)</enum><text>the Uniform Appraisal Standards for Federal Land Acquisitions; and</text></subparagraph><subparagraph id="id417eda0fc0684fe892f0fb255086615f"><enum>(B)</enum><text>the Uniform Standards of Professional Appraisal Practice.</text></subparagraph></paragraph></subsection><subsection id="id152234a0ca044caabe44f8c961d82864"><enum>(b)</enum><header>Federal land policy and management act of 1976 amendments</header><paragraph id="idf0ae0307f9224b58ab0112175e358f43"><enum>(1)</enum><header>Exchanges</header><text>Section 206(a) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1716">43 U.S.C. 1716(a)</external-xref>) is amended—</text><subparagraph id="idE23A0DC3DA0D4ED2A2F8F44A9B63636A"><enum>(A)</enum><text>by inserting <quote>, the interests of Indian Tribes,</quote> after <quote>better Federal land management</quote>; and</text></subparagraph><subparagraph id="idF40D81D40FD349AC8C273811F31622B1"><enum>(B)</enum><text>by striking <quote>(a) A tract</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCDE29B0A84B74704B103AA8E7C418459"><subsection id="id2CA0FF7C7E234AB2B7AA100B07143288"><enum>(a)</enum><header>Authorization</header><paragraph id="id096AC6091103413CAC2A44BC1BA60E06"><enum>(1)</enum><header>Definition of Indian Tribe</header><text>In this subsection, the term <term>Indian Tribe</term> means the governing body of any Indian or Alaska Native tribe, band, nation, pueblo, village, community, component band, or component reservation individually identified (including parenthetically) on the list published by the Secretary under section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>).</text></paragraph><paragraph id="id0EAC52A081E1451A82CC0DFF0F04C19B"><enum>(2)</enum><header>Authorization</header><text>A tract</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idace63d1d1b874c11af1c591894f9a731"><enum>(2)</enum><header>Coordination with state, local, and Tribal governments</header><subparagraph id="id77d8d68491b44762943ddbc5371223dd"><enum>(A)</enum><header>In general</header><text>Section 210 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1720">43 U.S.C. 1720</external-xref>) is amended—</text><clause id="ida14b2e999f1a4ac681544891eca639e8"><enum>(i)</enum><text>in the first sentence—</text><subclause id="idD220CEA05FDF4BE0BDFACDB59BFFA160"><enum>(I)</enum><text>by striking <quote>are located and the head</quote> and inserting <quote>are located, the head</quote>; and</text></subclause><subclause id="id1A32BDD4D91C4BABB3D6B920B49C9476"><enum>(II)</enum><text>by inserting <quote>and interested Indian Tribes</quote> after <quote>area within which such lands are located,</quote>; or</text></subparagraph><subparagraph id="idB4BC0BE31D154AC79C4122654F4FE580"><enum>(C)</enum><text>a landform or landscape that—</text><clause id="id97B633017C604FD9B8E06F9A061D86E7"><enum>(i)</enum><text>is the site of important customs, practices, objects, places, religions, or ceremonies of Indian Tribes;</text></clause><clause id="id72E2F4E13E704E088569EFEAE06A2626"><enum>(ii)</enum><text>is important to an Indian Tribe for the undertaking of religious, cultural, spiritual, or traditional practices;</text></clause><clause id="idC61EE0C70ABE4E67B1FDF85CD013B0FF"><enum>(iii)</enum><text>is connected through features or ceremonies to other sites or a larger sacred landscape, as determined by an Indian Tribe; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id3AC73518FFE643A9BC37996885F2F40E"><enum>(iv)</enum><text>contains unique or important traditional Tribal food, medicinal, or material gathering areas. </text></clause></subparagraph></paragraph><paragraph id="id3012919439E24DFFBDD0CC5F0604C74B"><enum>(2)</enum><header>Former reservation</header><text>The term <term>former reservation</term> means land that is within the exterior boundaries of any previous reservation that was established by treaty, Executive order, or Secretarial order for an Indian Tribe. </text></paragraph><paragraph id="id6AA0CE04C0B94A4E8EB8ECCA36ADB40C"><enum>(3)</enum><header>Indian tribe</header><text>The term <term>Indian Tribe</term> means the governing body of any Indian or Alaska Native tribe, band, nation, pueblo, village, community, component band, or component reservation individually identified (including parenthetically) on the list published by the Secretary under section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>).</text></paragraph><paragraph commented="no" id="id4B21C20F3A8F4279A96F43209F897A01"><enum>(4)</enum><header>Interested Indian Tribe</header><text>The term <term>interested Indian Tribe</term>, with respect to a tract of public lands the offer for sale or conveyance of which is subject to notification under subsection (b), means an Indian Tribe with—</text><subparagraph commented="no" id="idC0D0FC12EC0942B6AB0D70E5CFE4421F"><enum>(A)</enum><text>historic, precontact, cultural, or religious connection to a cultural site located on the tract of public lands;</text></subparagraph><subparagraph commented="no" id="idF598A2D4BB6046ED966AD9F0AD46DEBF"><enum>(B)</enum><text>a former reservation located on the tract of public lands; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id194C2D4D72D54DD7A691B45A00D48C94"><enum>(C)</enum><text>treaty rights or other reserved rights that can be exercised on the tract of public lands. </text></subparagraph></paragraph><paragraph id="id0BC9715F1550419CB58D239C55D0A4F3"><enum>(5)</enum><header>Sacred site</header><text>The term <term>sacred site</term> means a specific, discrete, narrowly delineated site on public lands that is identified by an Indian Tribe as sacred by virtue of the established religious significance of the site to, or ceremonial or medicinal use of the site by, an Indian Tribe. </text></paragraph></subsection><subsection id="idA163FAFF39C542098C0C78AD19AC46FD"><enum>(b)</enum><header>Notification</header><text>At least 60</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="idf88ddd1ca06041cd8e8af3a9c0b9b5a9"><enum>(B)</enum><header>Conforming amendment</header><text>The table of contents for the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="public-law" parsable-cite="pl/94/579">Public Law 94–579</external-xref>; 90 Stat. 2743) is amended by striking the item relating to section 210 and inserting the following:</text><quoted-block style="OLC" id="id93709f03-bb54-46d2-8c48-8e22718167ef"><toc><toc-entry level="section" idref="id46C68CE4D05344899FCA572ACCFD5ABA">Sec. 210. Coordination with State, local, and Tribal governments.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id73c92e8b0de54bfd9c9c244a7ae75a01"><enum>(c)</enum><header>Federal land transaction facilitation act amendments</header><paragraph id="id82aee82d588941978b559de33e2ce204"><enum>(1)</enum><header>Definitions</header><text>Section 203 of the Federal Land Transaction Facilitation Act (<external-xref legal-doc="usc" parsable-cite="usc/43/2302">43 U.S.C. 2302</external-xref>) is amended—</text><subparagraph id="idf4c4df183cdd45a1b06e157935ca2d68"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="id5bb9d4b470ac4985bec205c8e250c7e6"><enum>(i)</enum><text>by inserting <quote>, including sacred sites and land that affect the exercise of treaty or other reserved rights,</quote> after <quote>value</quote>; or</text></clause><clause id="idbc023dbeceba4a37b6ade0c26f9e69ed"><enum>(iii)</enum><text>a landform or landscape that—</text><subclause id="id35034345f9214cce8c9462e1533f10e2"><enum>(I)</enum><text>is the site of important customs, practices, objects, places, religions, or ceremonies of Indian Tribes;</text></subclause><subclause id="id81b7792246f840ea8c3a1d87ea83a33d"><enum>(II)</enum><text>is important to an Indian Tribe for the undertaking of religious, cultural, spiritual, or traditional practices;</text></subclause><subclause id="id41940c2caf4f4516bf976820d3e47f8d"><enum>(III)</enum><text>is connected through features or ceremonies to other sites or a larger sacred landscape, as determined by an Indian Tribe; or</text></subclause><subclause commented="no" id="idb07d44976fdc44919d622360baed118b"><enum>(IV)</enum><text>contains unique or important traditional Tribal food, medicinal, or material gathering areas.</text></subclause></clause></subparagraph><subparagraph id="idc170f1e8bf5f4c8bb6af1c25ffcc5379"><enum>(B)</enum><header>Former reservation</header><text>The term <term>former reservation</term> means land that is within the exterior boundaries of any previous reservation that was established by treaty, Executive order, or Secretarial order for an Indian Tribe.</text></subparagraph><subparagraph id="id37f65b22d6ae4e2b8509b2d824617060"><enum>(C)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> means the governing body of any Indian or Alaska Native tribe, band, nation, pueblo, village, community, component band, or component reservation individually identified (including parenthetically) on the list published by the Secretary of the Interior under section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>).</text></subparagraph><subparagraph id="id6c872f50a3954b56a0a5b74f7b1ae15e"><enum>(D)</enum><header>Interested Indian Tribe</header><text>The term <term>interested Indian Tribe</term>, with respect to National Forest System land, means an Indian Tribe with—</text><clause id="idd2b9a54e0e8f4668a6689fb772fa571c"><enum>(i)</enum><text>historic, precontact, cultural, or religious connection to a cultural site located on the National Forest System land;</text></clause><clause id="id7875d491aa964bc9aedffb4f561b2334"><enum>(ii)</enum><text>a former reservation located on the National Forest System land; or</text></clause><clause id="ide21d4f9741d343d9b52aecac5a182481"><enum>(iii)</enum><text>treaty rights or other reserved rights that can be exercised on the National Forest System land.</text></clause></subparagraph><subparagraph id="id661ef40cd5b34e0d968c5b571acae83b"><enum>(E)</enum><header>Sacred site</header><text>The term <term>sacred site</term> means a specific, discrete, narrowly delineated site on National Forest System land that is identified by an Indian Tribe as sacred by virtue of the established religious significance of the site to, or ceremonial or medicinal use of the site by, an Indian Tribe.</text></subparagraph></paragraph><paragraph id="id6764269cd7084c30a3bdd0c98f5253de"><enum>(2)</enum><header>Establishment</header><text>In providing</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idb68ebd30fdc945e2b7bc6df8d882062d"><enum>(2)</enum><text>in paragraph (2) (as so designated), in the second sentence, by striking <quote>The membership of such boards</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id11df82d884cd4b3f882e1470756d362a"><paragraph id="id448bbc1f0a1b48fc8dbba2184160fb16"><enum>(3)</enum><header>Membership</header><subparagraph id="idb6fce30cee074cb895cd1a9fd19bb249"><enum>(A)</enum><header>In general</header><text>The membership of each advisory board established under paragraph (2)</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id7fb30f710bdf4fa39c5eaf5baedd7344"><enum>(3)</enum><text>in paragraph (3) (as so designated), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id84c54e2398344db29adad07a1a45eeec"><subparagraph id="id7b7ec3517fc642eca72047fdf5fc1455"><enum>(B)</enum><header>Interested Indian Tribes</header><text>At least 1 member of each advisory board established under paragraph (2) shall be a representative of an interested Indian Tribe.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="idd0d5dd7387894948b0b51c5908754672"><enum>4.</enum><header>Confidential information</header><subsection id="idfe2a4ace791e42b397267959962a8230"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law, at the request of the applicable Indian Tribe or Tribal government, any Tribal consultation meeting held for the purpose of carrying out this Act or an amendment made by this Act shall be closed to the public.</text></subsection><subsection id="ida936f2d987d44655bd399e13166700e2"><enum>(b)</enum><header>Sensitive information</header><paragraph id="id8586C925617945E2B7436BD1D33044DF"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, if, during a Tribal consultation process conducted for the purpose of carrying out this Act or an amendment made by this Act, the applicable Indian Tribe or Tribal government designates any information, such as the location of a sacred site or other detail of a cultural or religious practice, as sensitive, that information shall be protected by law as confidential and withheld from any public disclosure or publication made as part of the Tribal consultation process or in the process of carrying out this Act or an amendment made by this Act.</text></paragraph><paragraph id="id67c491dcaaf74e0b9026e77564f491bd"><enum>(2)</enum><header>Access</header><text>If information has been designated as sensitive under paragraph (1), the applicable agency shall determine, in consultation with the applicable Indian Tribe or Tribal government, who may have access to the information for the purposes of carrying out this Act or an amendment made by this Act.</text></paragraph></subsection></section></legis-body></bill>
