which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require institutions of higher education to include reporting regarding campus anti-Semitism in the annual security report required under the Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act, to ensure that institutions of higher education do not support terrorist activity of foreign terrorist organizations, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ending Subsidies for Pro-Terrorist Activity on Campus Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="ida21b7121f8d6454a831164edf9439569"><enum>2.</enum><header>Reporting anti-Semitism on campuses</header><text display-inline="no-display-inline">Section 485(f)(1) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092(f)(1)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8ab73a2566be4b4cb5e1a21dcc4fa276"><subparagraph id="id3416bbcfe52e4c9aa8776b4e7debdf51" indent="up1"><enum>(K)</enum><clause commented="no" display-inline="yes-display-inline" id="id23e5968e82764546b5f1c5e09e844fc1"><enum>(i)</enum><text>A statement of current campus policies regarding anti-Semitism, which shall include—</text><subclause id="idd2dc716faad9470582b095ef059f8840" indent="up1"><enum>(I)</enum><text>a detailed plan of action for combating anti-Semitism on campus;</text></subclause><subclause id="id98624eb2ec6344d0b44cd6bc61415500" indent="up1"><enum>(II)</enum><text>information and procedures on how to report actual or perceived incidents of anti-Semitism, as well as the subsequent investigatory process for determining the outcome of such report; and</text></subclause><subclause id="id7901fe8b3ccf4c129f6eea81319c2564" indent="up1"><enum>(III)</enum><item commented="no" display-inline="yes-display-inline" id="id2bd3e611316a4b7e9562b82443b86306"><enum>(aa)</enum><text>a detailed list of actual or perceived incidents of anti-Semitism that have occurred on campus; and</text></item><item id="id8cbe22e163044fe99824ac7cfc0348f8" indent="up1"><enum>(bb)</enum><text>the institution’s subsequent actions taken in response to each such incident.</text></item></subclause></clause><clause indent="up1" commented="no" display-inline="no-display-inline" id="idfe6e8d66936f457d884c4bab2d7c7b2a"><enum>(ii)</enum><text display-inline="yes-display-inline">In this subparagraph, the term <term>anti-Semitism</term> has the meaning given the working definition of anti-Semitism adopted by the International Holocaust Remembrance Alliance on May 26, 2016, including the contemporary examples of anti-Semitism cited by the Alliance.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id06388e426e004edf9b2e8fc33e3e8a9a"><enum>3.</enum><header>Preventing terrorism support on higher education campuses</header><subsection id="idfae931ba7a0a4fe7b6e8ab52a0e134e5"><enum>(a)</enum><header>Requirements for institutions</header><paragraph commented="no" display-inline="no-display-inline" id="id19ebdc9d453641ddb85dc6d5690ff9ec"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Part B of title I of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1011">20 U.S.C. 1011 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id49DCE6181AFF427487C1F151E617FF1E"><section commented="no" display-inline="no-display-inline" id="id3ca8479f090b49ada37654aaff6ea909"><enum>124.</enum><header>Preventing terrorist activity support on campus</header><subsection commented="no" display-inline="no-display-inline" id="idd4a972a7c99b4712848b76c5bc4953f7"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="idb3ca82531e36403bb7d067c842b2b0b9"><enum>(1)</enum><header>Engage in terrorist activity</header><text>The term <term>engage in terrorist activity</term> has the meaning given the term in section 212(a)(3)(B)(iv) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(3)(B)(iv)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5258f339669448128d430382b628e084"><enum>(2)</enum><header>Foreign terrorist organization</header><text>The term <term>foreign terrorist organization</term> means a foreign organization that is designated by the Secretary of State in accordance with section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id937f0293cb5546ba9d3ef588bef62ab4"><enum>(3)</enum><header>Institution</header><text>The term <term>institution</term> means an institution of higher education, as defined in section 102. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id83fc4507867441b284b1e4b47080a37e"><enum>(4)</enum><header>Institution activity</header><text>The term <term>institution activity</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="id71ce0e09e39b423e856885bf309c929b"><enum>(A)</enum><text display-inline="yes-display-inline">means an activity of an institution or occurring on the campus of the institution; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id237f37388fb74573a6616b0514888b69"><enum>(B)</enum><text>includes research, classes, and events organized by student organizations.</text></subparagraph></paragraph><paragraph id="id7b602b661d0f4829b73c139856dc2a79"><enum>(5)</enum><header>Material support or resources</header><text>The term <term>material support or resources</term> has the meaning given the term in section 2339A of title 18, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6553641c13c149f49061ecc4410ffec9"><enum>(6)</enum><header>Terrorist activity</header><text>The term <term>terrorist activity</term> has the meaning given the term in section 212(a)(3)(B)(iii) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(3)(B)(iii)</external-xref>).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id62733b2b176e45708271bebd659554fa"><enum>(b)</enum><header>Procedures</header><text display-inline="yes-display-inline">An institution that receives Federal funds shall develop and carry out policy and procedures to identify applicants for faculty and staff positions, and student applicants, who have, as determined under regulations promulgated by the Secretary—</text><paragraph id="idfafcf2271f1248b7a78f25bda228c536"><enum>(1)</enum><text>engaged in terrorist activity with the intent to accomplish a goal of a foreign terrorist organization;</text></paragraph><paragraph id="idc70032b386874754b610a83616b8955e"><enum>(2)</enum><text>incited terrorist activity with the intent to accomplish a goal of a foreign terrorist organization; or</text></paragraph><paragraph id="id79bc9a26980e4c82925210752cda1a37"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id316c01ee39e540c69b62dc58085b3b8e"><enum>(A)</enum><text>provided material support or resources to a foreign terrorist organization; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id99964f9bd56c47ef81bc674283613ee5" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">with the intent to accomplish a goal of a foreign terrorist organization, provided material support or resources to an individual engaging in terrorist activity. </text></subparagraph></paragraph></subsection><subsection id="idf7bae1fbf2aa4340a0a3c0072c05b311"><enum>(c)</enum><header>Limitation on funds</header><text>Each institution receiving Federal funds shall ensure that such Federal funds are not used for any institution activity that urges support for, endorses, espouses, encourages, organizes for, or promotes a foreign terrorist organization or its terrorist activities.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id3138d7c7d4434d2aa100280667f057dc"><enum>(d)</enum><header>Special rule</header><text display-inline="yes-display-inline">The regulations promulgated by the Secretary under subsection (b) shall not be limited to violations of paragraph (1), (2), or (3) of such subsection evidenced by a criminal conviction.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id683f84dc4a154eb2bdc13b132566e3c2"><enum>(2)</enum><header>Program participation agreement</header><text>Section 487(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1094">20 U.S.C. 1094(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7633E6AB0A8C421F91401C524363CA84"><paragraph id="idcc94b2d71e9f402e81b10d81f2da1ea7"><enum>(30)</enum><text>The institution certifies that the institution complies with the requirements of section 124.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id1850ed3cbbb44845af6196897dad3293"><enum>(b)</enum><header>Annual campus security report</header><text>Section 485(f)(1) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092(f)(1)</external-xref>), as amended by section 2, is further amended by adding at the end the following:</text><quoted-block id="id94A46E3F621E44D4BE6073218A091C0A" display-inline="no-display-inline" style="OLC"><subparagraph commented="no" display-inline="no-display-inline" id="id64c6db0bf6bd4beca5337a7ef2b26a32" indent="up1"><enum>(L)</enum><clause commented="no" display-inline="yes-display-inline" id="id7b50c9da35804b46a19166dd7225ff45"><enum>(i)</enum><text>A statement of current campus policies regarding procedures to prevent (including by educating students and employees) and respond to—</text><subclause indent="up1" commented="no" display-inline="no-display-inline" id="idb1e3620e490a433097f0bb28fe4d729f"><enum>(I)</enum><text>speech by students, employees, or other individuals on campus, or through an online campus platform, related to the existence, terrorist activities, or goals of a foreign terrorist organization that—</text><item commented="no" display-inline="no-display-inline" id="ide1e0c5ce527044db976284f2dce7651d"><enum>(aa)</enum><text display-inline="yes-display-inline">imminently incites or produces lawless action; or </text></item><item commented="no" display-inline="no-display-inline" id="ide3f067828f7a4996a5ef1cd2f4047cc9"><enum>(bb)</enum><text display-inline="yes-display-inline">is directed to inciting or producing imminent lawless action and is likely to imminently incite or produce such action; </text></item></subclause><subclause indent="up1" commented="no" display-inline="no-display-inline" id="idda908f6cb7bc4e739121fbbe9c1561ea"><enum>(II)</enum><text>fighting words by students, employees, or other individuals on campus, or through an online campus platform, related to the existence, terrorist activities, or goals of a foreign terrorist organization;</text></subclause><subclause indent="up1" commented="no" display-inline="no-display-inline" id="idcb0485a3360244a2b9fffaf8d8fdfeec"><enum>(III)</enum><text>true threats by students, employees, or other individuals, on campus or through an online campus platform, related to the existence, terrorist activities, or goals of a foreign terrorist organization; and</text></subclause><subclause indent="up1" commented="no" display-inline="no-display-inline" id="idf029733d9ea24236a2ed285c12f51846"><enum>(IV)</enum><text>speech by students, employees, or other individuals on campus, or through an online campus platform—</text><item commented="no" display-inline="no-display-inline" id="id75c1fa0aa6f048768125a01d964293dd"><enum>(aa)</enum><text display-inline="yes-display-inline">related to the existence, terrorist activities, or goals of a foreign terrorist organization; and</text></item><item commented="no" display-inline="no-display-inline" id="id365ae14248594f6fb3d435833cd0372f"><enum>(bb)</enum><text display-inline="yes-display-inline">used as an integral part of conduct in violation of a valid criminal statute.</text></item></subclause></clause><clause indent="up1" commented="no" display-inline="no-display-inline" id="idfa0a08c3f6a944e8afaf9dadf161a7f0"><enum>(ii)</enum><text>In this subparagraph—</text><subclause commented="no" display-inline="no-display-inline" id="id429b91c74b834243b07617671d9cc6a7"><enum>(I)</enum><text display-inline="yes-display-inline">the term <term>foreign terrorist organization</term> has the meaning given the term in section 124(a); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id5ff0ffdc3a104dad91ccbb04de03798a"><enum>(II)</enum><text display-inline="yes-display-inline">the term <term>online campus platform</term> means an online platform that is operated or maintained by the institution.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id087fcd6acb154a418def9646f228f467"><enum>(c)</enum><header>Student eligibility</header><text>Section 484 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1091">20 U.S.C. 1091</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id817DA4A10C964693BA9207CD98946E00"><subsection commented="no" display-inline="no-display-inline" id="idcc2e14c1630b417f817fecc5eb125b4e"><enum>(u)</enum><header>Terrorist activity disqualification</header><paragraph commented="no" display-inline="no-display-inline" id="iddbc7304ad7014303922a1ea242bb7322"><enum>(1)</enum><header>Disqualification</header><text display-inline="yes-display-inline">A student shall not be eligible to receive any grant, loan, or work assistance under this title if the Secretary determines, consistent with the regulations promulgated under section 124, that the student has been convicted, including pursuant to a plea of nolo contendre or guilty, of a criminal offense involving—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb59a9da709a24dd99439f131730bb882"><enum>(A)</enum><text display-inline="yes-display-inline">engaging in terrorist activity with the intent to accomplish a goal of a foreign terrorist organization;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id75a1115fdead4690b8bcd23e4b6db8c8"><enum>(B)</enum><text display-inline="yes-display-inline">inciting terrorist activity with the intent to accomplish a goal of a foreign terrorist organization; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id359fc07f8da144c29a79863246d3aa99"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="id8d94914e67354612b76d0a41c337a122"><enum>(i)</enum><text display-inline="yes-display-inline">providing material support or resources to a foreign terrorist organization; or </text></clause><clause commented="no" display-inline="no-display-inline" id="id835a9914e4f94a209c6664e5a2860dbf" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">with the intent to accomplish a goal of a foreign terrorist organization, providing material support or resources to an individual engaging in terrorist activity; or </text></clause></subparagraph><subparagraph id="id1a12e77ff9604378816acb6a01ea9bad" commented="no"><enum>(D)</enum><text>conspiring to, or soliciting another person to, engage in terrorist activity, with the intent to accomplish a goal of a foreign terrorist organization.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6e6da12703f449f7925a14d89d26a357"><enum>(2)</enum><header>Definitions</header><text display-inline="yes-display-inline">The terms <term>engage in terrorist activity</term>, <term>foreign terrorist organization</term>, <term>material support or resources</term>, and <term>terrorist activity</term> have the meanings given the terms in section 124(a).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="ide6c62574bc3e4a4fa5df20afad0fbd12"><enum>(d)</enum><header>Student and Exchange Visitor Information System</header><text>Section 641(c) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1372">8 U.S.C. 1372(c)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id553b47f5c2c3457388746345e1742052"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0ba093d925ae4b0faaad14ee0d4b9ec1"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraphs (C) and (D), by striking <quote>institution,,</quote> each place such term appears and inserting <quote>institution,</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3113f41720284f109476a9f89734fff3"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (D), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idee526a4b5cd04de3a0051dd9d4bcfc83"><enum>(C)</enum><text display-inline="yes-display-inline">in subparagraph (G), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1a11abf6d1ba4e8584a025c46723e7ff"><enum>(D)</enum><text display-inline="yes-display-inline">in subparagraph (H), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6842adcd29a141ba84a36123278b302d"><enum>(E)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4D7C1F5B979046A4B6712DEE58307E04"><subparagraph commented="no" display-inline="no-display-inline" id="iddedee65a92be422e84cf3f26bd8035e2"><enum>(I)</enum><text display-inline="yes-display-inline">details regarding any instance in which an alien student at an approved institution of higher education violates a policy of such institution referred to in subparagraph (K)(i) or (L)(i) of section 485(f)(1) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092(f)(1)</external-xref>), including any disciplinary action taken against such alien student.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1da9087b8176451296bd59267945e4c7"><enum>(2)</enum><text>in paragraph (5)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2cc71da26698487bb14a28d02062bb2b"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>The Attorney General</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id86C416BD374E440F85704A6534971CDE"><subparagraph commented="no" display-inline="no-display-inline" id="id8ffd2922ab0441c4a59090c109a3de4b"><enum>(A)</enum><header>In general</header><text>The Director of U.S. Immigration and Customs Enforcement</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="ide9180d278a4941f19d7925d4c1db7184"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7847DFA62A804819B51CB859CB69C6B4"><subparagraph commented="no" display-inline="no-display-inline" id="idba2d242c87b249f3afb03a35227f6a38"><enum>(B)</enum><header>Anti-semitic and terrorism-related incidents</header><text>Not later than 21 days after an alien student described in paragraph (1)(I) commits a violation described in such paragraph, the relevant institution of higher education shall report such violation, and any disciplinary action taken against such alien student, to the Department of Homeland Security and the Department of State through the Student and Exchange Visitor Information System.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section><section id="id818113acaee34deeb92f2d5d9ea188ba"><enum>4.</enum><header>Reports regarding discrimination</header><subsection commented="no" display-inline="no-display-inline" id="id81a92560d92d48e4a76bbd4e7a575902"><enum>(a)</enum><header display-inline="yes-display-inline">IHE reports to the Secretary</header><text display-inline="yes-display-inline">Each institution of higher education (as defined in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>)) that receives Federal financial assistance shall report to the Secretary of Education information about the institution's efforts to prevent and respond to discrimination, including harassment, on the basis of race, color, or national origin that is based on an individual's actual or perceived Jewish lineage or Jewish ethnic characteristics and that occurs on the institution's campus, including on online platforms that are operated or maintained by the institution.</text></subsection><subsection id="id0a9507ad742a4bfab588172113eb134e" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Report to Congress</header><text>Not later than 6 months after the date of enactment of this Act, and annually thereafter, the Secretary of Education shall submit a report to Congress containing the information described in subsection (a). </text></subsection></section></legis-body></bill>
