which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit actions recognizing the Islamic Emirate of Afghanistan, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing the Recognition of Terrorist States Act of 2023</short-title></quote>.</text></section><section commented="no" id="id7736cba2c1e34bdcb3cfcc2324045035"><enum>2.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It is the policy of the United States—</text><paragraph commented="no" id="id0D1F33A84F4C4E639DEA2E03671433F5"><enum>(1)</enum><text>to not recognize the Islamic Emirate of Afghanistan, which is controlled by the Taliban, as the official Government of Afghanistan under any circumstances;</text></paragraph><paragraph commented="no" id="id4357843e6bb74f3d8041e0612bd9912b"><enum>(2)</enum><text>to view the Taliban’s takeover of Afghanistan as a coup d’état and therefore illegitimate; and</text></paragraph><paragraph commented="no" id="id9e98a459717e4e5898c5a9209bf43dd9"><enum>(3)</enum><text>to recognize that individuals designated as terrorists by the United States, such as Sirajuddin Haqqani, will play a key role in the Taliban regime.</text></paragraph></section><section commented="no" id="id03f9c64ae7fe4a978aa4385edf5ef60a"><enum>3.</enum><header>Prohibition on actions recognizing the Islamic Emirate of Afghanistan</header><subsection commented="no" id="idb1d2b552c372468e874890b8770b762e"><enum>(a)</enum><header>In general</header><text>In furtherance of the policy set forth in section 2, no Federal department or agency may take any action or extend any assistance that states or implies recognition of the Taliban’s claim of sovereignty over Afghanistan.</text></subsection><subsection commented="no" id="id84c522d37fcf484abfa7a5d279baeb0f"><enum>(b)</enum><header>Funding limitation</header><text>Notwithstanding any other provision of law, no Federal funds appropriated or otherwise made available for the Department of State, the United States Agency for International Development, or the Department of Defense on or after the date of the enactment of this Act may be obligated or expended to prepare or promulgate any policy, guidance, regulation, notice, or Executive order, or to otherwise implement, administer, or enforce any policy, that extends diplomatic recognition to the Islamic Emirate of Afghanistan.</text></subsection></section><section id="idd1de5adc6d924b29a564d84dbf77a34d"><enum>4.</enum><header>Designation of Islamic Emirate of Afghanistan as a state sponsor of terrorism</header><subsection id="id2100730A6FB94706A08E19531DB6B021"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of State shall designate the Islamic Emirate of Afghanistan as a State sponsor of terrorism.</text></subsection><subsection id="id3056C9F3C2954531B516A64E4283664A"><enum>(b)</enum><header>State sponsor of terrorism defined</header><text>In this section, the term <term>state sponsor of terrorism</term> means a country the government of which the Secretary of State has determined has repeatedly provided support for acts of international terrorism, for purposes of—</text><paragraph id="id5f50ebbabf00458d9a2a1fcade39725f"><enum>(1)</enum><text>section 1754(c)(1)(A)(i) of the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4813">50 U.S.C. 4813(c)(1)(A)(i)</external-xref>);</text></paragraph><paragraph id="idacc8dc561bea472a9c0ccebe6cb590d8"><enum>(2)</enum><text>section 620A of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2371">22 U.S.C. 2371</external-xref>);</text></paragraph><paragraph id="ide8ebb37aacec4d78b49282d5171e37ce"><enum>(3)</enum><text>section 40(d) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2780">22 U.S.C. 2780(d)</external-xref>); or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5010181d6c604491a3e8de8f8a3712ba"><enum>(4)</enum><text>any other provision of law. </text></paragraph></subsection></section><section id="id12767B891D2744AC97C67CD53CFA87EB"><enum>5.</enum><header>Designation of the Taliban as a foreign terrorist organization</header><text display-inline="no-display-inline">The Secretary of State shall designate the Taliban as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>).</text></section></legis-body></bill>
