which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a working waterfronts grant program.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Working Waterfront Preservation Act</short-title></quote>.</text></section><section id="id77432e013a0b4229aef227b574815725"><enum>2.</enum><header>Working waterfront access protection grant program</header><subsection id="idd196798b9220496e8383e16747c091e3"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id9c6f4dc3989c47869be0f67df5cc7d7e"><enum>(1)</enum><header>Boat</header><text>The term <term>boat</term> means a watercraft that is not built in a shipyard, and is typically of the type suitable or intended for personal use or for use in a fishery.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb1c12cddd3b7484e877fda95420cfa2b"><enum>(2)</enum><header display-inline="yes-display-inline">Boatbuilding industry</header><text>The term <term>boatbuilding industry</term> means an industry primarily engaged in building boats. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0770260d6e6042b1b5206d53d52cf47c"><enum>(3)</enum><header display-inline="yes-display-inline">Coastal waters</header><text>The term <term>coastal waters</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="idfd9965d2a30842ed855f9780c5452213"><enum>(A)</enum><text display-inline="yes-display-inline">in the Great Lakes area, the waters within the territorial jurisdiction of the United States consisting of the Great Lakes, their connecting waters, harbors, roadsteads, and estuary-type areas such as bays, shallows, and marshes; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2998c992dec4446eabd6ee78e28a58db"><enum>(B)</enum><text display-inline="yes-display-inline">in other areas, those waters, adjacent to the shorelines, which contain a measurable quantity or percentage of sea water, including sounds, bays, lagoons, bayous, ponds, and estuaries. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idde4d03072d68443aa53536c52544d194"><enum>(4)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="ide919e300edcf4be59d9a91612ecb3287"><enum>(A)</enum><text>the government of a coastal State;</text></subparagraph><subparagraph id="id3626bfcc578e4161a81dcdcaafc123b5"><enum>(B)</enum><text>a unit of local government within a coastal State; </text></subparagraph><subparagraph id="idb7f21d84af9c4c1681a6b061566d1110"><enum>(C)</enum><text>a nonprofit organization that the Secretary determines is appropriate to receive a grant under subsection (b); or</text></subparagraph><subparagraph id="id013b72cbec544fadbd586164777e8bde"><enum>(D)</enum><text>a participant in the commercial fishing industry, the aquaculture industry, or the for-hire recreational fishing industry.</text></subparagraph></paragraph><paragraph id="idf366307d6e184c4892003cc5c16bffd8"><enum>(5)</enum><header>Eligible project</header><text>The term <term>eligible project</term> means a project—</text><subparagraph id="idb586c343f5414756a3d9bcfb10a80dce"><enum>(A)</enum><text>to—</text><clause commented="no" display-inline="no-display-inline" id="id092202cbe19945e184f6d111ebb62488"><enum>(i)</enum><text display-inline="yes-display-inline">make improvements to real property that is a working waterfront area located in a coastal State and owned by an eligible entity, including—</text><subclause commented="no" display-inline="no-display-inline" id="iddf61189bb76e4a298d64bed861b266fc"><enum>(I)</enum><text display-inline="yes-display-inline">the construction or repair of wharfs or related facilities;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id0b2a27b05460402cbbacb7d0a1ff4fa9"><enum>(II)</enum><text display-inline="yes-display-inline">the provision of access to coastal waters in working waterfront areas to persons engaged in the commercial fishing industry, the aquaculture industry, the for-hire recreational fishing industry, or the boatbuilding industry; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idd0eb93b1e19b48c68587f64fc2390080"><enum>(III)</enum><text display-inline="yes-display-inline">improvements made to such property in order to be resilient to climate change; or</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id56b3924a2e024c8aa34b5802b601d8c8"><enum>(ii)</enum><text display-inline="yes-display-inline">permanently designate or otherwise protect real property owned or operated by an eligible entity as a working waterfront area; </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id71c5c99ca9ae4d82b401d2811f40e0f2"><enum>(B)</enum><text>that has been approved or endorsed by the State government entity responsible for fishery management or the State’s coastal zone management agency; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3b4c74f526a9446e9dae145b9ca1609c"><enum>(C)</enum><text>that is consistent with State coastal shoreline access laws (including regulations).</text></subparagraph></paragraph><paragraph id="id2a4c2b93686545eaa99ec60ff747f4b5"><enum>(6)</enum><header>Nonprofit organization</header><text>The term <term>nonprofit organization</term> means an organization that is—</text><subparagraph id="id9e1b4d5e32fd4db49ec5dcb519af307b"><enum>(A)</enum><text>described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)</external-xref> of the Internal Revenue Code of 1986; and</text></subparagraph><subparagraph id="ida9f0fce6803446f08e0f5d0af2d4661f"><enum>(B)</enum><text>exempt from taxation under <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(a)</external-xref> of the Internal Revenue Code of 1986.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id960ec7beae924864979cfef05e8d9953"><enum>(7)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce. </text></paragraph><paragraph id="id74e0b834e00147caa7e787b23c86b7b1"><enum>(8)</enum><header>Working waterfront area</header><text>The term <term>working waterfront area</term> means land that is used for, or that supports, the commercial fishing industry, the aquaculture industry, the for-hire recreational fishing industry, or the boatbuilding industry.</text></paragraph></subsection><subsection id="id1448f6ca9a8642db91c650243c7c7d64"><enum>(b)</enum><header>Grant program authorized</header><paragraph id="ide38e180a1b4f4bfbbefc956a15409653"><enum>(1)</enum><header>In general</header><text>The Secretary, acting through the Economic Development Administration of the Department of Commerce, shall award grants, on a competitive basis, to eligible entities to carry out eligible projects that support the commercial fishing industry, the aquaculture industry, the for-hire recreational fishing industry, or the boatbuilding industry in coastal States.</text></paragraph><paragraph id="ide527c314378244df8093110ec407d8fe"><enum>(2)</enum><header>Application</header><text>An eligible entity desiring a grant under this section shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may reasonably require. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ided78401ffef74b7fbeb41a024db656ba"><enum>(3)</enum><header>Grant selection considerations</header><text display-inline="yes-display-inline">In selecting eligible entities to receive grants under this section, the Secretary shall give substantial weight to—</text><subparagraph id="id2448034ac7a04c0b8e0eae9132b37027"><enum>(A)</enum><text>the economic significance of the eligible project to the commercial fishing industry, the aquaculture industry, the for-hire recreational fishing industry, or the boatbuilding industry in the immediate vicinity and in the coastal State in which the eligible project is located;</text></subparagraph><subparagraph id="id79578ef8ec7c49efad52c5e5cd99dce8"><enum>(B)</enum><text>whether other adequate waterfront access alternatives exist for the commercial fishing industry within the community in which the eligible entity seeks to use grant funding; </text></subparagraph><subparagraph id="id6979c9394bf946759ec98dd2fbc71d5d"><enum>(C)</enum><text>the utility of the eligible project for use in the commercial fishing industry, the aquaculture industry, the for-hire recreational fishing industry, or the boatbuilding industry, with respect to the natural characteristics and developed infrastructure of the relevant property;</text></subparagraph><subparagraph id="idb27df57b0130415dad476454f65428a9"><enum>(D)</enum><text>whether the applicant has a business plan for the area in which the project will be located;</text></subparagraph><subparagraph id="id59cf83cf1fcb4640a9b501c52d193595"><enum>(E)</enum><text>the likelihood that the working waterfront area will remain compatible with commercial fishing, aquaculture, for-hire recreational fishing, or boatbuilding, and the applicant’s ability to demonstrate a need for, or support for, the project within the community; and</text></subparagraph><subparagraph id="id8c3f51da10ef48d1a30c53b8cbb4c750"><enum>(F)</enum><text>whether the applicant intends to permanently protect the relevant property.</text></subparagraph></paragraph></subsection><subsection id="id379c99d10fdf4198aa80e3125e4984b7"><enum>(c)</enum><header>Cost sharing</header><text>The amount of a grant awarded under this section to carry out an eligible project may not exceed 50 percent of the total cost of the eligible project.</text></subsection><subsection id="id97249fff698447f29eb3acf60a2f0322"><enum>(d)</enum><header>Use of grant funds for eligible projects</header><paragraph id="id9c69af536f9e404f8b7545e23e279705"><enum>(1)</enum><header>Improved or protected property</header><subparagraph id="id9ef778392dba4fbc8ad0866321f29e99"><enum>(A)</enum><header>In general</header><text>Grants awarded under this section may be used to improve or protect privately owned real property or interests in privately owned real property, including easements, only from willing owners.</text></subparagraph><subparagraph id="id8726f893030240b5b7ad4b963aea7b5f"><enum>(B)</enum><header>No exercise of eminent domain</header><text>No Federal, State, or local agency may exercise the power of eminent domain to secure title to any real property or facilities in connection with a project carried out under this Act.</text></subparagraph></paragraph></subsection><subsection id="ida129ce433a044f9fbf71f9023556e793"><enum>(e)</enum><header>Annual report</header><text>The Secretary shall submit to Congress an annual report that describes the eligible projects funded with grants awarded under this section.</text></subsection><subsection id="id359c00f7df6840f8b919e04fb563227f"><enum>(f)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out this Act $20,000,000 for each of the fiscal years 2024 through 2028. </text></subsection></section></legis-body></bill>
