which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To modify Department of Agriculture programs to improve flood protection and infrastructure resiliency, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Flood Protection and Infrastructure Resilience Act of 2023</short-title></quote>.</text></section><section id="H9E647BD48C6C4704928D932AE6D70D14"><enum>2.</enum><header>Emergency watershed program</header><text display-inline="no-display-inline">Section 403 of the Agricultural Credit Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2203">16 U.S.C. 2203</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HADC0232E3E1E46D9B6814C8347966BC9" display-inline="no-display-inline"><subsection id="H5E038B8D703E4DE1BA8965E5FAF1FF66"><enum>(c)</enum><header>Level of restoration</header><text display-inline="yes-display-inline">In carrying out this section, the Secretary may undertake measures that increase the level of protection above that which would be necessary to address the immediate impairment of the watershed if the Secretary determines that such restoration is in the best interest of—</text><paragraph commented="no" display-inline="no-display-inline" id="id5799bd975cb742af9e460a197316c84f"><enum>(1)</enum><text display-inline="yes-display-inline">the long-term health of the watershed; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id02abef01882b45f7b976c7d402bc7179"><enum>(2)</enum><text display-inline="yes-display-inline">the protection of the watershed from repetitive impairments.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H9B0ADA00A8464B558A9BCF45D3C4636B" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header>Rehabilitation of structural measures near, at, or past their evaluated life expectancy</header><text display-inline="no-display-inline">Section 14(b) of the Watershed Protection and Flood Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1012">16 U.S.C. 1012(b)</external-xref>) is amended by striking paragraph (2) and inserting the following:</text><quoted-block style="OLC" id="HB435586E502D4AEBAF715D6F87CD360C" display-inline="no-display-inline"><paragraph id="H765B28745F394E379D695DC8ED7F7775"><enum>(2)</enum><header>Amount of assistance; limitations</header><subparagraph id="HAB8FA630A4084E87BB1B704EB91BCC39"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The amount of Federal funds that may be made available under this subsection to a local organization for construction of a particular rehabilitation project shall be equal to 65 percent of the total rehabilitation costs, but not to exceed 100 percent of actual construction costs incurred in the rehabilitation.</text></subparagraph><subparagraph id="H7BAEFA96205B4D4B9A4D1805BDFD9F15"><enum>(B)</enum><header>Limited resource areas</header><text>Notwithstanding subparagraph (A), the Secretary may contribute up to 90 percent of the total rehabilitation costs to a local organization for construction of a particular rehabilitation project that serves a limited resource area, as determined by the Secretary, but not to exceed 100 percent of actual construction costs incurred in the rehabilitation.</text></subparagraph><subparagraph id="H51C2FBE160EB4E3580C5C30BBBBC73A0"><enum>(C)</enum><header>Costs of resource rights and permits</header><text>The local organization shall be responsible for the costs of water, mineral, and other resource rights and all Federal, State, and local permits.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H7E4DB14159E94590B3DB7A51D14B240F"><enum>4.</enum><header>Regional Conservation Partnership Program purposes</header><text display-inline="no-display-inline">Section 1271(b) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3871">16 U.S.C. 3871(b)</external-xref>) is amended by striking paragraph (2) and inserting the following:</text><quoted-block id="HA958D6C6DD8444D4A036327707E636D3" display-inline="no-display-inline" style="OLC"><paragraph id="HA7BA09ADFE90455EB1694F878C8B5196"><enum>(2)</enum><text display-inline="yes-display-inline">To address natural resource concerns on eligible land on a regional or watershed scale, including—</text><subparagraph id="HCF726DE5C5B0461C83CEA3FA1946A26B"><enum>(A)</enum><text>the conservation, protection, restoration, and sustainable use of soil;</text></subparagraph><subparagraph id="H83FF870861954077A333C908B6976896"><enum>(B)</enum><text>the conservation and protection of water, including sources of drinking water and groundwater;</text></subparagraph><subparagraph id="H18B2040BB8F6482ABFF9B17F512FA9D9"><enum>(C)</enum><text display-inline="yes-display-inline">the prevention and mitigation of the effects of flooding and drought, and the improvement or expansion of flood resiliency; and</text></subparagraph><subparagraph id="HB66081463129436093427EB35A602B97" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text>the conservation of wildlife, agricultural land, and related natural resources.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
